संख्या. ए-12(11)3/2006-स्था.1--कर्मचारी राज्य बीमा अधिनियम, 1948 (1948 का 34) की धारा 97 की उप-धारा (2) के खण्ड (xxi) और उप-धारा (2क) के साथ पठित उक्त धारा की उप-धारा (1) और धारा 17 की उप-धारा (2) के खंड (क) के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा कर्मचारी राज्य बीमा निगम (बीमा आयुक्त) भर्ती विनियम, 1996 के अधिक्रमण में, ऐसे अधिक्रमण से पहले की गई अथवा किए जाने से छूट गई बातों के अलावा कर्मचारी राज्य बीमा निगम, केन्द्रीय सरकार के अनुमोदन से, एतद्‌द्वारा कर्मचारी राज्य बीमा निगम में बीमा आयुक्त के पद पर भर्ती की पद्धति को विनियमित करने हेतु निम्नलिखित विनियम बनाता है, अर्थात्‌ :-

1. संक्षिप्त नाम और प्रारम्भ--(1) ये विनियम कर्मचारी राज्य बीमा निगम (बीमा आयुक्त) भर्ती विनियम, 2013 कहे जायेंगे ।

(2) ये शासकीय राजपत्र में इनके प्रकाशन की तारीख से लागू होंगे ।

2. पदों की संख्या, वर्गीकरण, वेतन बैंड, ग्रेड वेतन एवं वेतनमान--पदों की संख्या, उनका वर्गीकरण, उनसे सम्बद्ध वेतन बैंड, ग्रेड वेतन एवं वेतनमान इन विनियमों के साथ संलग्न अनुसूची के कॉलम (2) से (4) में यथा विनिर्दिष्ट होंगे ।

3. भर्ती की पद्धति, आयु सीमा, अर्हताएं, आदि--भर्ती की पद्धति, आयु सीमा, अर्हताएं और उनसे संबंधित अन्य मामले उक्त अनुसूची के कॉलम (5) से (13) में यथा विनिर्दिष्ट होंगे ।

4. निरर्हता--ऐसा कोई व्यक्ति--

(क) जिसने ऐसे व्यक्ति से विवाह किया है या विवाह करने का करार किया है जिसका विवाहिती जीवित है; अथवा

(ख) जिसने अपने विवाहिती के जीवित रहते हुए किसी व्यक्ति से विवाह किया है अथवा विवाह करने का करार किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा ।

परन्तु यदि कर्मचारी राज्य बीमा निगम के महानिदेशक इस बात से संतुष्ट हैं कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वे किसी व्यक्ति को इन विनियमों के प्रवर्तन से छूट दे सकेंगे।

5. ढील देने की शक्ति--जहाँ कर्मचारी राज्य बीमा निगम के महानिदेशक की राय में ऐसा करना आवश्यक अथवा समीचीन है तो वे तत्संबंधी कारणों को लेखबद्ध करके केन्द्र सरकार का पूर्व अनुमोदन लेकर तथा संघ लोक सेवा आयोग के परामर्श से किसी श्रेणी अथवा वर्ग के व्यक्तियों के संबंध में इन विनियमों के किसी भी उपबंध में आदेश द्वारा ढील दे सकते हैं ।

6. अवशिष्ट मामले--इन विनियमों के उपबंधों के अधीन कर्मचारी राज्य बीमा निगम में पदों की तदनुरूपी श्रेणी पर लागू कर्मचारी राज्य बीमा निगम (भर्ती) विनियम, 1965 में उल्लिखित अन्य सभी विनियम और अनुदेश इन विनियमों के साथ संलग्न अनुसूची में उल्लिखित पद पर लागू होंगे।

7. व्यावृत्ति-- इन विनियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय-समय पर जारी किए गए आदेशों के अनुरूप अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, तथा अन्य वर्गो के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

क्या सीधी भर्ती वालों के लिए विहित आयु और परिवीक्षा की अवधि, यदि कोई है भर्ती की पद्धति--क्या सीधी भर्ती द्वारा अथवा पदोन्नाति द्वारा अथवा प्रतिनियुक्ति अथवा आमेलन द्वारा और विभिन्ना पद्धतियों द्वारा भरी शैक्षिक अर्हताएं पदोन्नातों के मामले में भी लागू जाने वाली रिक्तियों की प्रतिशतता होंगी

पदोन्नति/प्रतिनियुक्ति/आमेलन द्वारा भर्ती के मामले में वे ग्रेड जिनसे पदोन्नति या प्रतिनियुक्ति या आमेलन किया जाना है।

पदोन्नति :

वेतन बैंड-4 में 37,400-67,000 रुपये ग्रेड वेतन 8,900/- रुपये के वेतनमान के ग्रेड में दो वर्ष की नियमित सेवा वाले अपर आयुक्त।

पदोन्नति निगम द्वारा समूह 'क' अधिकारियों के लिए तैयार 'ङ' स्तर के प्रशिक्षण के समापन की शर्त के अधीन होगी।

परंतु शर्त यह है कि विभागीय पदोन्नति समिति की बैठक की तिथि से पहले पदोन्नाति के लिए जिन व्यक्तियों ने प्रशिक्षण पूरा नहीं किया है, उन पर भी इस शर्ताध्ीन विचार किया जाएगा कि विभागीय पदोन्नाति समिति की बैठक की तिथि के एक वर्ष के भीतर अपेक्षित प्रशिक्षण पूरा कर लिया जाएगा।

टिप्पणी (1) : दो वर्ष के भीतर सेवानिवृत्त होने वाले व्यक्तियों को पदोन्नति हेतु इस प्रशिक्षण को पूरा करने से छूट होगी।

टिप्पणी (2) : जहाँ पदोन्नति के लिए अपनी अर्हक या पात्रता सेवा पूरी कर चुके कनिष्ठों पर विचार किया जा रहा है, वहाँ उनके वरिष्ठों की पदोन्नति पर भी विचार किया जाएगा बशर्ते कि अपनी अपेक्षित अर्हक या पात्रता सेवा ऐसी अर्हक या पात्रता सेवा के आधे से अधिक अथवा दो वर्ष, जो भी कम हो, से कम भाग III—खण्ड 4] भारत का राजपत्र, नवम्बर 2, 2013 (कार्तिक 11, 1935)

न हो तथा उन्होंने ऐसी अर्हक अथवा पात्रता सेवा पहले ही पूरी कर चुके अपने कनिष्ठों के साथ अगले उच्च ग्रेड में पदोन्नति के लिए ऐसी अर्हक या पात्रता सेवा पूरी कर ली हो।

टिप्पणी (3) : पदोन्नाति हेतु न्यूनतम अर्हक सेवा के परिकलन के प्रयोजनार्थ 01.01.2006 अथवा जिस तिथि से छठे वेतन आयोग की सिफारिशों के आधार पर परिशोधित वेतन ढाँचा विस्तारित किया गया है, से पूर्व अधिकारी द्वारा नियमित आधार पर की गई सेवा छठे केन्द्रीय वेतन आयोग की सिफारिशों के आधर पर तदनुरूपी ग्रेड वेतन या विस्तारित वेतनमान में की गई सेवा मानी जाएगी। आगे, 01 जून, 2011 से पहले 8,700/- रुपये ग्रेड वेतन में नियमित आधार पर की गई सेवा को भी पदोन्नाति के लिए न्यूनतम अर्हक सेवा के रूप में परिकलित किया जाएगा।

प्रतिनियुक्ति (अल्पावधि ठेके सहित) :

केंद्रीय सरकार या राज्य सरकार या संघ राज्य क्षेत्रों या स्वायत्त निकायों या सांविधिक निकायों या सार्वजनिक क्षेत्र के उपक्रमों के अंतर्गत अधिकारी-- क. (I) मूल संवर्ग या विभाग में नियमित आधार पर सदृश पदधारी; अथवा

(II) वेतन बैंड-4 : 37,400--67,000/- रुपये ग्रेड वेतन 8,700/- रुपये अथवा समकक्ष में नियमित आधार पर छह वर्ष की सेवा;

ख. वित्तीय या प्रशासनिक मामलों अथवा सामाजिक सुरक्षा योजना या श्रम कानून से संबंधित कार्य का पंद्रह वर्ष का अनुभव।

टिप्पणी 1 : फीडर श्रेणी के विभागीय अधिकारी जो पदोन्नति की सीधी रेखा में है, प्रतिनियुक्ति (अल्पावधि ठेके सहित) पर नियुक्ति के विचारार्थ पात्र नहीं होंगे। इसी प्रकार प्रतिनियुक्त पदोन्नति द्वारा नियुक्ति के विचारार्थ पात्र नहीं होगा। इस नियुक्ति से तत्काल पूर्व इसी या केंद्र सरकार के अन्य किसी संगठन या विभाग में अन्य संवर्ग बाह्‌य पद पर प्रतिनियुक्ति की अवधि (अल्पावधि ठेके सहित) सहित प््रतिनियुक्ति की अवधि (अल्पावधि ठेके सहित) सामान्यतः पाँच वर्ष से अधिक नहीं होगी। प््रतिनियुक्ति (अल्पावधि ठेके सहित) पर नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्ति की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी।

टिप्पणी 2 : प्रतिनियुक्ति आधार पर नियुक्ति के प्रयोजनार्थ 1 जनवरी, 2006, जिस तारीख से छठे केन्द्रीय वेतन आयोग की सिफारिशों के आधार पर परिशोध्ति वेतन ढांचा विस्तारित किया गया है से पूर्व अधिकारी द्वारा नियमित आधार पर की गई सेवा वेतन आयोग की सिफारिशों पर आधारित तदनुरूपी वेतन बैंड तथा ग्रेड वेतन या विस्तारित वेतनमान में की गई सेवा मानी जाएगी, सिवाय उनके जहाँ एक से अधिक परिशोधन पूर्व वेतनमानों को सामान्य ग्रेड वेतन या वेतनमान वाले ग्रेड में मिलाया गया है तथा जहाँ यह लाभ केवल उन पदों के लिए विस्तारित होगा जिनके लिए वह ग्रेड वेतन या वेतनमान किसी उन्नायन के बिना सामान्य प्रतिस्थापन ग्रेड है।

यदि विभागीय पदोन्नति समिति है तो उसका गठन कैसे होता है वे परिस्थितियां जिनमें भर्ती करते समय संघ लोक सेवा आयोग से परामर्श किया जाना है

समूह 'क' विभागीय पदोन्नति समिति प्रत्येक अवसर पर संघ लोक सेवा आयोग से परामर्श आवश्यक।

(2) सचिव, श्रम और रोजगार मंत्रालय -सदस्य

वेतन बैंड-4 में 37,400--67,000/- रुपये ग्रेड वेतन 8,700/- रुपये के वेतनमान के ग्रेड में चार वर्ष की नियमित सेवा वाले क्षेत्रीय निदेशक ग्रेड 'ए' अथवा निदेशक।

पदोन्नति निगम द्वारा समूह 'क' अधिकारियों के लिए तैयार 'घ' स्तर के प्रशिक्षण के समापन की शर्त के अधीन होगी।

परंतु शर्त यह है कि विभागीय पदोन्नति समिति की बैठक की तिथि से पहले पदोन्नति के लिए जिन व्यक्तियों ने प्रशिक्षण पूरा नहीं किया, उन पर भी इस शर्ताध् ाीन विचार किया जाएगा कि विभागीय पदोन्नाति समिति की बैठक की तिथि के एक वर्ष के भीतर अपेक्षित प्रशिक्षण पूरा कर लिया जाएगा।

टिप्पणी (1) : दो वर्ष के भीतर सेवानिवृत्त होने वाले व्यक्तियों को पदोन्नति हेतु इस प्रशिक्षण को पूरा करने से छूट होगी।

टिप्पणी (2) : जहाँ पदोन्नाति के लिए अपनी अर्हक या पात्रता सेवा पूरी कर चुके कनिष्ठों पर विचार किया जा रहा है, वहाँ उनके वरिष्ठों की पदोन्नाति पर भी विचार किया जाएगा बशर्ते कि अपनी अपेक्षित अर्हक या पात्रता सेवा ऐसी अर्हक या पात्रता सेवा के आधे से अधिक अथवा दो वर्ष, जो भी कम हों, से कम न हो तथा उन्होंने ऐसी अर्हक अथवा पात्रता सेवा पहले ही पूरी कर चुके अपने कनिष्ठों के साथ अगले उच्च ग्रेड में पदोन्नाति के लिए ऐसी अर्हक या पात्रता सेवा पूरी कर ली हो।

टिप्पणी (3) : पदोन्नाति हेतु न्यूनतम अर्हक सेवा के परिकलन के प्रयोजनार्थ 01.01.2006 अथवा जिस तिथि से छठे वेतन आयोग की सिफारिशों के आधार पर परिशोधित वेतन ढाँचा विस्तारित किया गया है, से पूर्व अधिकारी द्वारा नियमित आधार पर की गई सेवा छठे केन्द्रीय वेतन आयोग की सिफारिशों के आधर पर तदनुरूपी ग्रेड वेतन या विस्तारित वेतनमान में की गई सेवा मानी जाएगी। आगे, 01 जून, 2011 से पहले 7,600/- रुपये ग्रेड वेतन में नियमित आधार पर की गई सेवा को भी पदोन्नाति के लिए न्यूनतम अर्हक सेवा के रूप में परिकलित किया जाएगा।

प्रतिनियुक्ति (अल्पावधि ठेके सहित) :

केंद्रीय सरकार या राज्य सरकार या संघ राज्य क्षेत्रों या स्वायत्त निकायों या सांविधिक निकायों या सार्वजनिक क्षेत्र के उपक्रमों के अंतर्गत अधिकारी :-

क. (I) मूल संवर्ग अथवा विभाग में नियमित आधार पर सदृश पदधारी; अथवा

(II) वेतन बैंड-4 : 37,400--67,000/- रुपये ग्रेड वेतन 8,700/- रुपये अथवा समकक्ष में नियमित आधार पर चार वर्ष की सेवा;

ख. वित्तीय अथवा प्रशासनिक मामलों अथवा सामाजिक सुरक्षा योजना अथवा श्रम कानून से संबंधित कार्य का बारह वर्ष का अनुभव।

टिप्पणी 1 : फीडर श्रेणी के विभागीय अधिकारी जो पदोन्नाति की सीधी रेखा में है, प्रतिनियुक्ति पर नियुक्ति के विचारार्थ पात्र नहीं होंगे। इसी प्रकार प्रतिनियुक्त पदोन्नाति द्वारा नियुक्ति के विचारार्थ पात्र नहीं होंगे। इस नियुक्ति से तत्काल पूर्व इसी या केंद्र सरकार के अन्य किसी संगठन या विभाग में अन्य संवर्ग बाह्‌य पद पर प्रतिनियुक्ति की अवधि (अल्पावधि ठेके सहित) सहित प्रतिनियुक्ति की अवधि (अल्पावधि ठेके सहित) सामान्यतः पाँच वर्ष से अधिक नहीं होगी। प्रतिनियुक्ति (अल्पावधि ठेके सहित) पर नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्ति की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी।

टिप्पणी 2 : प्रतिनियुक्ति आधार पर नियुक्ति के प्रयोजनार्थ 1 जनवरी, 2006 अथवा जिस तारीख से छठे केन्द्रीय वेतन आयोग की सिफारिशों के आधार पर परिशोधित वेतन ढांचा विस्तारित किया गया है, से पूर्व अधिकारी द्वारा नियमित आधार पर की गई सेवा वेतन आयोग की सिफारिशों पर आधारित तदनुरूपी वेतन बैंड तथा ग्रेड वेतन या विस्तारित वेतनमान में की गई सेवा मानी जाएगी, सिवाय उनके जहाँ एक से अधिक परिशोधन पूर्व वेतनमानों को सामान्य ग्रेड वेतन या वेतनमान वाले ग्रेड में मिलाया गया है तथा जहाँ यह लाभ केवल उन पदों के लिए विस्तारित होगा जिनके लिए वह ग्रेड वेतन या वेतनमान किसी उन्नायन के बिना सामान्य प्रतिस्थापन ग्रेड है।

जाने से छूट गई बातों के अलावा कर्मचारी राज्य बीमा निगम, केन्द्रीय सरकार के अनुमोदन से, एतद्‌द्वारा कर्मचारी राज्य बीमा निगम में क्षेत्रीय निदेशक ग्रेड 'ए'/निदेशक के पद पर भर्ती की पद्धति को विनियमित करने हेतु निम्नलिखित विनियम बनाता है, अर्थात्‌ :-

1. संक्षिप्त नाम और प्रारम्भ--(1) ये विनियम कर्मचारी राज्य बीमा निगम, क्षेत्रीय निदेशक ग्रेड 'ए'/निदेशक भर्ती विनियम, 2013 कहे जायेंगे ।

(2) ये शासकीय राजपत्र में इनके प्रकाशन की तारीख से लागू होंगे ।

2. पदों की संख्या, वर्गीकरण, वेतन बैंड, ग्रेड वेतन एवं वेतनमान--पदों की संख्या, उनका वर्गीकरण, उनसे सम्बद्ध वेतन बैंड, ग्रेड वेतन एवं वेतनमान इन विनियमों के साथ संलग्न अनुसूची के कॉलम (2) से (4) में यथा विनिर्दिष्ट होंगे ।

3. भर्ती की पद्धति, आयु सीमा, अर्हताएं, आदि--भर्ती की पद्धति, आयु सीमा, अर्हताएं और उनसे संबंधित अन्य मामले उक्त अनुसूची के कॉलम (5) से (13) में यथा विनिर्दिष्ट होंगे ।

4. निरर्हता--ऐसा कोई व्यक्ति--

(क) जिसने ऐसे व्यक्ति से विवाह किया है या विवाह करने का करार किया है जिसका विवाहिती जीवित है; अथवा

(ख) जिसने अपने विवाहिती के जीवित रहते हुए किसी व्यक्ति से विवाह किया है अथवा विवाह करने का करार किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा ।

परन्तु यदि कर्मचारी राज्य बीमा निगम के महानिदेशक इस बात से संतुष्ट हैं कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वे किसी व्यक्ति को इन विनियमों के प्रवर्तन से छूट दे सकेंगे।

5. ढील देने की शक्ति--जहाँ कर्मचारी राज्य बीमा निगम के महानिदेशक की राय में ऐसा करना आवश्यक अथवा समीचीन है तो वे तत्संबंधी कारणों को लेखबद्ध करके केन्द्र सरकार का पूर्व अनुमोदन लेकर तथा संघ लोक सेवा आयोग के परामर्श से किसी श्रेणी अथवा वर्ग के व्यक्तियों के संबंध में इन विनियमों के किसी भी उपबंध में आदेश द्वारा ढील दे सकते हैं ।

6. अवशिष्ट मामले--इन विनियमों के उपबंधों के अधीन कर्मचारी राज्य बीमा निगम में पदों की तदनुरूपी श्रेणी पर लागू कर्मचारी राज्य बीमा निगम (भर्ती) विनियम, 1965 में उल्लिखित अन्य सभी विनियम और अनुदेश इन विनियमों के साथ संलग्न अनुसूची में उल्लिखित पद पर लागू होंगे।

7. व्यावृत्ति--इन विनियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुरूप अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों तथा अन्य वर्गों के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

पदोन्नति :

वेतन बैंड-3 में 15,600-39,100 रुपये ग्रेड वेतन 7,600/- रुपये के वेतनमान में पांच वर्ष की नियमित सेवा वाले क्षेत्रीय निदेशक ग्रेड 'बी' अथवा संयुक्त निदेशक जिसके न होने पर क्षेत्रीय निदेशक ग्रेड 'बी' अथवा संयुक्त निदेशक और उप निदेशक के ग्रेड में सोलह वर्ष की संयुक्त नियमित सेवा वाले क्षेत्रीय निदेशक ग्रेड 'बी' या संयुक्त निदेशक जिसमें से तीन वर्ष की नियमित सेवा क्षेत्रीय निदेशक ग्रेड 'बी' अथवा संयुक्त निदेशक के ग्रेड में होनी चाहिए।

पदोन्नति निगम द्वारा समूह 'क' अधिकारियों के लिए तैयार 'ग' स्तर के प्रशिक्षण के समापन की शर्त के अधीन होगी।

परंतु शर्त यह है कि विभागीय पदोन्नति समिति की बैठक की तिथि से पहले पदोन्नति के लिए जिन व्यक्तियों ने प्रशिक्षण पूरा नहीं किया, उन पर भी इस शर्ताध्ीन विचार किया जाएगा कि विभागीय पदोन्नति समिति की बैठक की तिथि के एक वर्ष के भीतर अपेक्षित प्रशिक्षण पूरा कर लिया जाएगा।

टिप्पणी (1) : दो वर्ष के भीतर सेवानिवृत्त होने वाले व्यक्तियों को पदोन्नति हेतु इस प्रशिक्षण को पूरा करने से छूट होगी।

टिप्पणी (2) : जहाँ पदोन्नति के लिए अपनी अर्हक या पात्रता सेवा पूरी कर चुके कनिष्ठों पर विचार किया जा रहा है, वहाँ उनके वरिष्ठों की पदोन्नति पर भी विचार किया जाएगा बशर्ते कि अपनी अपेक्षित अर्हक या पात्रता सेवा ऐसी अर्हक या पात्रता सेवा के आधे से अधिक अथवा दो वर्ष, जो भी कम हो, से कम न हो तथा उन्होंने ऐसी अर्हक अथवा पात्रता सेवा पहले ही पूरी कर चुके अपने कनिष्ठों के साथ अगले उच्च ग्रेड में पदोन्नति के लिए अपनी परिवीक्षा अवध्ि सफलतापूर्वक पूरी कर ली हो।

I—In exercise of the powers conferred by sub-section (1) of section 97 read with clause (xxi) of sub-section (2) and sub-section (2A) of that section and proviso to clause (a) of sub-section (2) of section 17 of the Employees' State Insurance Act, 1948 (34 of 1948) and in supersession of the Employees' State Insurance Corporation (Insurance Commissioner) Recruitment Regulations, 1996 except as respects things done or omitted to be done before such supersession, the Employees' State Insurance Corporation hereby makes, with the approval of the Central Government, the following regulations regulating the method of recruitment to the posts of Insurance Commissioner in the Employees' State Insurance Corporation, namely:—

1. Short title and commencement.— (1) These regulations may be called the Employees' State Insurance Corporation (Insurance Commissioner) Recruitment Regulations, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification, Pay Band, Grade Pay and Pay Scale.— The number of posts, their classification, Pay Band, Grade Pay and Pay Scale attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these regulations.

3. The method of recruitment, age limit, qualifications, etc.— The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification. — No person, —

(a) who has entered into or contracted a marriage with a person having spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post :

Provided that the Director General of the Employees' State Insurance Corporation may, if satisfied that such marriage is permissible under the personal law applicable to such person and to the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of these regulations.

5. Power to relax.— Where the Director General of the Employees' State Insurance Corporation is of the opinion that it is necessary or expedient to do so, he may, after taking prior approval of the Central Government and in consultation with the Union Public Service Commission, by order, for reasons to be recorded in writing, relax any of the provisions of these regulations, with respect to any class or category of persons.

6. Residuary matters.— Subject to the provisions of these regulations, all other regulations and instructions, laid down in the Employees' State Insurance Corporation (Recruitment) Regulations, 1965 applicable to the corresponding category of posts in the Employees' State Insurance Corporation, shall apply to the post specified in the Schedule above referred to.

7. Savings.— Nothing in these regulations shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, Ex-Servicemen and other categories of persons in accordance with the orders issued by the Central Government from time to time, in this regard.

Promotion:

Additional Commissioner in PB-4 in the scale of Rs. 37,400—67,000/- with Grade Pay of Rs. 8,900/- with two years' of regular service in the grade.

Promotion shall be subject to completion of Level 'E' training for Group 'A' Officers devised by the Employees' State Insurance Corporation :

Provided that those persons who have not completed training for promotion before the date of meeting of Departmental Promotion Committee will also be considered subject to the condition that the required training will be completed within one year of the date of meeting of Departmental Promotion Committee.

Note (1) Those persons who are due to retire within two years will be exempted from completion of such training for promotion.

Note (2) Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their seniors shall also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less, for promotion to the next higher grade along with their juniors who have already completed such qualifying or eligibility service.

Note (3) For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to 01.01.2006, or the date from which the revised pay structure based on the 6th Central Pay Commission recommendations has been extended, shall be deemed to be service rendered in the corresponding Grade Pay or Pay Scale extended, based on the recommendations of the 6th Pay Commission. Further, service rendered on a regular basis prior to 1st June, 2011 in the Grade Pay of Rs. 8,700/- shall be also computed as minimum qualifying service for promotion.

Deputation (including short-term contract) :

Officers under the Central Government or State Government or Union Territories or Autonomous Bodies or Statutory Bodies or Public Sector Undertakings —

A.

(i) holding analogous post on regular basis in the parent cadre or department ;

or

(ii) with six years' regular service in posts in PB-4 in the scale of pay of Rs. 37,400—67,000/- with Grade Pay of Rs.8,700/- or equivalent.

B. Possessing fifteen years' experience in financial or administrative matters or dealing with social security scheme or labour law.

Note (1) The departmental officers in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation (including short-term contract). Similarly deputationist shall not be eligible for consideration for appointment by promotion. Period of deputation (including short-term contract) including period of deputation ( including short-term contract ) in another ex-cadre post held immediately preceding this appointment in the same or some other organisation or department of the Central Government shall ordinarily not exceed five years. The maximum age limit for appointment by deputation (including short-term contract) shall be not exceeding 56 years as on the closing date of the receipt of applications.

Provided that those persons who have not completed training for promotion before the date of meeting of Departmental Promotion Committee will also be considered subject to the condition that the required training will be completed within one year of the date of meeting of Departmental Promotion Committee.

Note (1) Those persons who are due to retire within two years will be exempted from completion of such training for promotion.

.Note (2) Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their seniors shall also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less, and have successfully completed their probation period for promotion to the next higher grade alongwith their juniors who have already completed such qualifying or eligibility service.

Note (3) For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to 01.01.2006, or the date from which the revised pay structure based on the 6th Central Pay Commission recommendations has been extended, shall be deemed to be service rendered in the corresponding Grade Pay or Pay Scale extended, based on the recommendations of the Pay Commission.
