आ.अ. 51.—यतः भारत निर्वाचन आयोग का यह समाधन हो गया है कि मेघालय राज्य से विधान सभा के साधारण निर्वाचन, 2013 में, नीचे की सारणी में स्तम्भ ;3द्ध में विनिदष्ट निर्वाचन क्षेत्रा से और स्तम्भ ;4द्ध में उसके सामने उल्लिखित निर्वाचन लड़ने वाला प्रत्येक अभ्यर्थी, लोक प्रतिनिध्त्वि अध्निियम, 1951 तथा त(ीन बनाए गए नियमों के अंंतर्गत यथा अपेक्षित उक्त सारणी के स्तंभ ;5द्ध में यथा दशत अपने निर्वाचन व्ययों का लेखा दाखिल करने में असपफल रहा हैऋ
और यतः, उक्त अभ्यथयों ने भारत निर्वाचन आयोग द्वारा सम्यक्् नोटिस दिए जाने के बावजूद उक्त असपफलता के लिए कोई कारण या स्पष्टीकरण नहीं दिया है, या उनके द्वारा दिए गए अभ्यावेदन, यदि कोई हों, पर विचार करने के उपरान्त निर्वाचन आयोग का यह समाधन हो गया है कि उक्त असपफलता के लिए उनके पास कोई उपयुक्त या न्यायोचित कारण नहीं हैऋ
अतः अब, उक्त अध्निियम की धरा 10क के अनुसरण में, निर्वाचन आयोग नीचे की सारणी के स्तंभ ;4द्ध में विनिदष्ट व्यक्तियों को संसद के किसी भी सदन या राज्य या संघ राज्य क्षेत्रा की विधन सभा अथवा विधन परिषद् के लिए सदस्य चुने जाने या होने के लिए इस आदेश की तारीख से तीन वर्ष की अवध् िके लिए निरहत घोषित करता है :—

O.N. 51.—Whereas, the Election Commission of India is satisfied that each of the contesting candidates specified in column (4) of the Table below at the General Election to the Legislative Assembly, 2013, in the Meghalaya State held from the constituency specified in column (3) against his/her name has failed to lodge the account of his/her election expenses as shown in column (5) of the said Table as required by the Representation of the People Act, 1951 and the Rules made thereunder;
And whereas, the said candidates has either not furnished any reason or explanation for the said failure even after due notice by the Election Commission, the Election Commission is satisfied that they have no good reason or justification for the said failure;
Now, therefore, in pursuance of Section 10A of the said Act, the Election Commission hereby declares the person specified in column (4) of the Table below to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order: —

2. This is an election petition under Section 80/81 of Representation of Peoples Act, 1951. The respondent, Smt. Seema Upadhyay returned elected from 19-Fatehpur Sikri Parliamentary Constituency in Parliamentary elections held in 2009 pursuant to Election Commission of India's notification dated 11.04.2009 for constituting 15th Lok Sabha, 2009.
3. Despite opportunity the election-petitioner did not adduce any evidence, documentary or oral, as the case may be, and, therefore, the Court directed this matter to be listed for final hearing. It was listed yesterday but despite repeated call none appeared on behalf of election-petitioner. With a view to give further opportunity, this matter was posted for today but again none appeared on behalf of election-petitioner. Since neither the ground of challenge of election of respondent has been sought to be supported by any evidence nor anybody is present to press this petition, I have no option but to dismiss the same.
4. The election petition is accordingly dismissed.
5. As provided in the Rules the information of dismissal of this election petition shall be conveyed to all concerned by Registry without any further delay.
