सा.का.नि. 261.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, और विध् िऔर न्याय मंत्राालय, विधयी विभाग, राजभाषा खंड ;समूह ''क'' और समूह ''ख'' पदद्ध भर्ती नियम, 2003 को उन बातों के सिवाय अध्क्रिान्त करते हुए, जिन्हें ऐसे अधिक्रमण से पहले की गई हैं या करने का लोप किया गया है, राजभाषा खंड, विधयी विभाग, विध् िऔर न्याय मंत्राालय, में समूह ''क'' पदों पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम विध् िऔर न्याय मंत्राालय, विधयी विभाग, राजभाषा खंड ;समूह ''क'' पद प्रादेशिक भाषाद्ध भर्ती नियम, 2013 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान.—उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतन बैंड और ग्रेड वेतन या वेतनमान वे होंगे, जो इन नियमों से उपाब( अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

4. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके, तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर निकाले किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

तक शिथिल की जा सकती है ।

टिप्पण : आयु-सीमा अवधरित करने के लिए निर्णायक तारीख भारत में अभ्यथयों से आवेदन प्राप्त करने कि लिए नियत की गई अंतिम तारीख होगी ;न कि वह अंतिम तारीख जो असम, मेघालय, अरूणाचल प्रदेश, मिजोरम, मणिपुर, नागालैंड, त्रिापुरा, सिक्किम, जम्मू- कश्मीर राज्य के लद्‌दाख खंड हिमाचल प्रदेश के लाहौल और स्पीति जिले एवं चम्बा जिले के पांगी उपखंड, अंदमान और निकोबार द्वीप और लक्षद्वीप के अभ्यथयों के लिए विहित की गई हैद्ध।

सीध्े भर्ती किए जाने वाले व्यक्तियों के लिए अपेक्षित सीध्े भर्ती किए जाने वाले व्यक्तियों परिवीक्षा की अवध्,ि यदि कोई हो शैक्षिक और अन्य अर्हताएं के लिए विहित आयु और शैक्षिक अर्हताएं प्रोन्नत व्यक्तियों की दशा में लागू होंगी या नहीं

;iii) किसी मान्यताप्राप्त बोर्ड या विश्वविद्यालय या कोई संस्थान या केन्द्रीय सरकार द्वारा अनुमोदित विदेशी विश्वविद्यालय से माध्यमिक विद्यालय परीक्षा अथवा कोई उच्चतर परीक्षा में संब( भाषा ;संविधन की आठवीं अनुसूची में वणत हदी से भिन्न कोई एक भाषाद्ध अथवा किसी मान्यताप्राप्त बोर्ड या विश्वविद्यालय या संस्थान से माध्यमिक विद्यालय परीक्षा या समतुल्य या किसी उच्चतर परीक्षा में संब( भाषा एक विषय रहा हो ।

टिप्पण 1ः अर्हताएं, अन्यथा सुअहत अभ्यथयों की दशा में कारणों को लेखब( करते हुए, संघ लोक सेवा आयोग के विवेकानुसार शिथिल की जा सकती है ।

वांछनीय

1. केन्द्रीय सरकार या राज्य सरकार में संब( भाषा ;संविधन की आठवीं अनुसूची में वणत हदी से भिन्न कोई एक भाषाद्ध में विधयी प्रारुपण का पांच वर्ष का अनुभव ।

2. केन्द्रीय अध्निियमऋ प्रांतीय अध्निियम या राज्य अध्निियम के अध्ीन स्थापित या निगमित कोई विश्वविद्यालय या उच्च शिक्षा के लिए कोई संस्थान जिसे केन्द्रीय सरकार द्‌्‌वारा किसी विश्वविद्यालय के समतुल्य समझा गया है या कोई अन्य संस्थान या केन्द्रीय सरकार द्‌्‌वारा अनुमोदित विदेशी विश्वविद्यालय से किसी संब( भाषा में ;संविधन की आठवीं अनुसूची में वणत हदी से भिन्न कोई एक भाषाद्ध विषय के साथ या स्नातक स्तर पर किसी विषय के रूप में या माध्यम के साथ स्नातक की उपाध् ि।

टिप्पण :— संब( भाषा की सही अपेक्षा भर्ती के समय उपदशत होगी ।

भर्ती की प(ति : भर्ती सीध्े होगी या प्रोति द्वारा प्रोति/प्रतिनियुक्ति/आमेलन द्वारा भर्ती की दशा में वे श्रेणियां जिनसे प्रोति/प्रतिनियुक्ति/ या प्रतिनियुक्ति/आमेलन द्वारा तथा विभिन्न प(तियों आमेलन किया जाएगा द्वारा भरे जाने वाले पदों की प्रतिशतता

प्रोति द्वारा जिसके न हो सकने पर प्रतिनियुक्ति द्‌्‌वारा, प्रोन्नति : दोनों के न हो सकने पर सीध्ी भर्ती द्‌्‌वारा । राजभाषा खंड, विधयी विभाग में 15600-39100 रफ. के वेतन बैंड-3, ध्न ग्रेड वेतन 6600 रफ. के ग्रेड वेतन का सहायक विधयी परामर्शी ;प्रादेशिक भाषा शाखाद्ध जो उस श्रेणी में पांच वर्ष नियमित सेवा कर चुका हो ।

टिप्पण 1 : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में, जिन्होंने अपनी अर्हक या पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो, वहां उनसे ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परन्तु यह तब जबकि उनके द्वारा की गई ऐसी अर्हक या पात्राता सेवा, अपेक्षित अर्हक या पात्राता सेवा के आधे से अध्कि से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, उनकी उच्चतर श्रेणी में प्रोन्नति के लिए1532 THE GAZETTE OF INDIA : NOVEMBER 16, 2013/KARTIKA 25, 1935 [PART II—SEC. 3(i)] ;11द्ध

अपनी परिवीक्षा की अवध् िसपफलतापूर्वक पूरी कर ली है, जिन्होंने ऐसी अर्हक या पात्राता सेवा पहले ही पूरी कर ली है।

टिप्पण 2 : प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना करने के प्रयोजन के लिए, किसी अध्किारी द्वारा 1 जनवरी, 2006 से पहले या उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को, सिवाय उस दशा के जहां एक से अध्कि पूर्व-पुनरीक्षित वेतनमानों को साधरण ग्रेड वेतन या वेतनमान सहित एक श्रेणी में विलय हो गया है और वहां यह लाभ केवल उस पद ;उन पदोंद्ध पर, विस्तारित होगा, जिसके ;जिनकेद्ध लिए ग्रेड वेतन या वेतनमान बिना किसी उन्नयन के साधरण प्रतिस्थापन ग्रेड है आयोग की सिपफारिशों पर आधरित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी ।

प्रतिनियुक्तिः

केंद्रीय सरकार या राज्य सरकार के ऐसे अध्किारी जो :—

;कद्ध;iद्ध जो मूल काडर या विभाग में नियमित आधर पर सदृश पद धरण किए हुए हैंऋ या

;iiद्ध जो मूल काडर या विभाग में 15600-39100 रफ. के वेतन बैंड-3, ध्न ग्रेड वेतन 6600 रफ. में नियमित आधर पर नियुक्ति के पश्चात उस श्रेणी में पांच वर्ष सेवा कर चुका होऋ और

;खद्ध स्तंभ ;7द्ध के अध्ीन सीध्े भर्ती किए जाने वाले व्यक्तियों के लिए विहित शैक्षिक अर्हताएं और अनुभव रखता हो ।

टिप्पण ;1द्ध : पोषक प्रवर्ग के ऐसे विभागीय अध्किारी, जो प्रोन्नति की सीध्ी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे । इसी प्रकार, प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे ।

;प्रतिनियुक्ति की अवध्,ि जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धरित किसी अन्य काडर बाह्‌य पद पर प्रतिनियुक्ति की अवध् िहै, साधरणतया 4 वर्ष से अध्कि नहीं होगी । प्रतिनियुक्ति पर नियुक्ति के लिए अध्कितम आयु-सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी ।

टिप्पण ;2द्ध : प्रतिनियुक्ति के आधर पर नियुक्ति के प्रयोजन के लिए, किसी अधिकारी द्वारा 1 जनवरी, 2006 से या उस तारीख से जिसको छठे वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, पूर्व नियमित आधर पर की गई सेवा को उक्त आयोग की सिपफारिशों के आधर पर विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान में की गई सेवा समझा जाएगा, सिवाय उस दशा के जहां एक से अध्कि पूर्व पुनरीक्षित वेतनमानों का सामान्य ग्रेड वेतन या वेतनमानों के साथ एक श्रेणी में विलय हो गया है और जहां यह लाभ केवल उस पद ;उन पदोंद्ध के लिए विस्तारित होगा, जिसके ;जिनके द्ध लिए ग्रेड वेतन या वेतनमान बिना किसी उन्नयन के साधरण प्रतिस्थापन ग्रेड है।

G.S.R. 261. — In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Ministry of Law and Justice, Legislative Department, Official Languages Wing (Group 'A' and Group 'B' posts) Recruitment Rules, 2003, except as respects things done or omitted to be done before such supersession, the President1538 THE GAZETTE OF INDIA : NOVEMBER 16, 2013/KARTIKA 25, 1935 [PART II—SEC. 3(i)] hereby makes the following rules regulating the method of recruitment to Group 'A' posts in the Official Languages Wing, Legislative Department, Ministry of Law and Justice, namely:-

1. (1) These rules may be called the Ministry of Law and Justice, Legislative Department, Official Languages Wing, (Group 'A' posts Regional Languages) Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification and Pay Band and Grade Pay or Pay scale.—The number of posts, their classification and the Pay Band and Grade Pay or Pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit, qualifications etc. —The method of recruitment to the said posts, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification. —No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.-—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time, in this regard.

(iii) Passed Secondary School Examination or any higher examination from a recognised Board or University or Institution through medium of language (one of the languages other than Hindi mentioned in the Eighth Schedule to the Constitution) concerned or had offered the language concerned as a subject in Secondary School Examination or any higher examination from a recognised Board or University or any institution or foreign university approved by the Central Government.

Note 1.—Qualifications are relaxable at the discretion of the Union Public Service Commission, for reasons to be recorded in writing, in case of candidates otherwise well qualified.

(ii) with five years' service in the grade rendered after appointment thereto on a regular basis in PB-3 of Rs.15600—39100 plus Grade Pay of Rs. 6600 or equivalent in the Parent Cadre or Department; and

(b) possessing the educational qualifications and experience as prescribed for direct recruits under column 7:

Note (1) : The departmental officers in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation. Similarly, deputationists shall not be eligible for consideration for appointment by promotion.

(Period of deputation including period of deputation in another ex- cadre post held immediately preceding this appointment in the same or some other organisation/department of the Central Government shall ordinarily not exceed four years. The maximum age limit for appointment by deputation shall be not exceeding 56 years as on the closing date of receipt of applications.)

सा.का.नि. 262.-राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए विध् िऔर न्याय मंत्राालय, विधयी विभाग, राजभाषा ख्ांड ;समूह ''क'' और समूह ''ख'' पदद्ध भर्ती नियम, 2003 को उन बातों के सिवाय अध्क्रिांत करते हुए, जिसे ऐसे अध्क्रिमण से पूर्व किया गया है या करने से लोप किया गया है, राजभाषा ख्ांड, विधयी विभाग, विध् िऔर न्याय मंत्राालय में समूह ''क'' पदों पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌्‌ :-

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम विध् िऔर न्याय मंत्राालय, विधयी विभाग, राजभाषा खंड ;समूह ''क'' पद हिन्दी शाखाद्ध भर्ती नियम, 2013 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद-संख्या, वर्गीकरण और वेतन बैंड और ग्रेड वेतन या वेतनमान.—उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतन बैंड और ग्रेड वेतन या वेतनमान वे होेेंगे, जो इन नियमों से उपाब( अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिर्दिष्ट हैं।

3. भर्ती की प(ति, आयु-सीमा अन्य अर्हताएं आदि.—उक्त पदों पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;14द्ध में विनिर्दिष्ट हैं ।

4. निरर्हता.—वह व्यक्ति -

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है, उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. f'kfFky djus dh 'kfDr.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहाँ वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करकेे, और संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्‌वारा श्ाििथल कर सकेगी ।

6. O;ko`fRr.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहींं डालेगी, जिनका केन्द्रीय सरकार द्‌वारा इस संबंध में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है।

टिप्पण ;1द्ध : पोषक प्रवर्ग के ऐसे विभागीय अध्किारी, जो प्रोन्नति की सीध्ी पंक्ति में है, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्‌वारा नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे ।

तब जब कि उनके द्‌्‌वारा की गई ऐसी अर्हक या पात्राता सेवा, अपेक्षित

अर्हक या पात्राता सेवा के आध्े से अध्कि से या दो वर्ष से, इनमें से जो भी

कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित उनकी

उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध् िसपफलतापूर्वक

टिप्पण ;1द्धः पोषक प्रवर्ग के ऐसे विभागीय अध्किारी, जो प्रोन्नति की सीध्ी

पंक्ति में है, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्रा

नहीं होंगे । इसी प्रकार प्रतिनियुक्ति व्यक्ति प्रोन्नति द्‌्‌वारा नियुक्ति के लिए

G.S.R. 262.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Ministry of Law and Justice, Legislative Department, Official Lanuages Wing (Group 'A' and Group 'B' posts) Recruitment Rules, 2003, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to Group 'A' posts in the Official Languages Wing, Legislative Department, Ministry of Law and Justice, namely:—

1. (1) These rules may be called the Ministry of Law and Justice, Legislative Department, Official Languages Wing, (Group 'A' posts Hindi Branch) Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

4. Disqualification.—No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said posts:

(ii) Should have been a member of State Judicial Service for a period of fifteen years;

Should have been held a post in the legal department of a State Government for fifteen years;

Should have been a Central Government servant who has had experience in legal affairs for fifteen years;

Should have been a qualified legal practitioner who has practiced as such for fifteen years;

Should have been a teacher of law for fifteen years in a recognised institution;

Should have fifteen years' experience of translation into Hindi of statutes, statutory rules and orders in Central Government or State Government;

Should have fifteen years' experience of drafting of statutes in the Central Government or State Government; and

(iii) passed Secondary School Examination or any higher examination from a recognised Board or University or institution through Hindi medium or had offered Hindi as a subject in Secondary School Examination or any higher examination from a recognised board/university or any institution or foreign university approved by the Central Government.

Note 1—Qualifications are relaxable at the discretion of the Union Public Service Commission for reasons to be recorded in writing in case of candidates otherwise well qualified.

Deputation: Officers under the Central Government or State Government –

(a) (i) holding analogous posts on regular basis in the Parent Cadre

or Department; or

(ii) with two years' service in the grade rendered after appointment thereto on a regular basis in the PB-4 Rs.37400-67000 plus Grade Pay of Rs.8900 or equivalent in the Parent Cadre or Department; or

(iii) with three years' service in the grade rendered after appointment thereto on a regular basis in the PB-4 of Rs.37400-67000 plus Grade Pay of Rs.8700/- or equivalent in the Parent Cadre or Department; and

(b) possessing the educational qualifications and experience prescribed
