सा.का.नि. 18.—केन्द्रीय सरकार भारतीय तार अध्निियम, 1885 ;1885 का 13द्ध की धरा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए भारतीय तार नियम, 1951 का और संशोध्न करने के लिए निम्नलिखित नियम बनाती है, अर्थात्‌ :—

1. ;1द्ध इन नियमों का संक्षिप्त नाम भारतीय तार ;2014 का

प्रथम संशोध्नद्ध नियम, 2014 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. भारतीय तार नियम, 1951 के नियम 419क, के बदले,

निम्नलिखित नियम प्रतिस्थापित होंगे ।

फ्419क ;1द्ध भारतीय तार अध्निियम, 1885 ;जिसे इसमें इसके पश्चात्‌ उक्त अध्निियम कहा गया हैद्ध की धरा 5 की उप-धारा ;2द्ध के अध्ीन किसी संदेश या संदेशों के वर्ग के अपरोध्न के निदेश तब तक जारी नहीं किए जाएंगे जब तक भारत सरकार की दशा में भारत सरकार के गृह मंत्राालय के सचिव द्वारा और राज्य सरकार की दशा में राज्य सरकार के गृह विभाग के भार-साध्क सचिव द्वारा आदेश जारी नहीं कर दिया जाता तथा अपरिहार्य परिस्थितियों में ऐसा आदेश भारत सरकार के संयुक्त सचिव के स्तर से अन्यून किसी अध्किारी द्वारा किया जा सकेगा जो यथास्थिति संघ के गृह सचिव या राज्य के गृह सचिव द्वारा सम्यक रूप से प्राध्कृित किया गया हो ।

परन्तु आपात मामलों में—

(i) दूरस्थ क्षेत्राों में जहां संदेश या संदेशों के वर्ग के अपरोध्न के लिए पूर्व निदेश अभिप्राप्त करना साध्य नहीं हैऋ या

वह किसी संदेश या संदेशों के वर्ग के अपेक्षित अपरोध्न को प्राध्कृित सुरक्षा के प्रधन या द्वितीय ज्येष्ठतम अध्किारी के पूर्व अनुमोदन से किया जाएगा अर्थात्‌ केन्द्रीय स्तर पर विध् ि प्रवर्तन अभिकरण और इस निमित्त प्राध्कृित अध्किारी, पुलिस महानिदेशक के स्तर से अन्यून स्तर का अध्किारी, किन्तु अनुमोदन प्राध्किारी द्वारा संब( सक्षम प्राध्किारी को तीन कार्य दिवस के भीतर राज्य स्तर पर ऐसे अपरोधनों के संबंध् में सूचित किया जाएगा और ऐसे अपरोध्नों की सात कार्य दिवस की अवध् िके भीतर संब( प्राध्किारी से पुष्टि कराई जाएगी । यदि सक्षम प्राध्किारी से नियत सात दिन के भीतर पुष्टिकरण प्राप्त नहीं होता है तो ऐसे अपरोध्न समाप्त हो जाएंगे और वे संदेश या संदेशों के वर्ग को यथास्थिति संघ के गृह सचिव या राज्य के गृह सचिव के पूर्व अनुमोदन के बिना अपरोध्ति नहीं किया जाएगा।

;2द्ध उप-नियम ;1द्ध के अध्ीन सक्षम प्राध्किारी द्वारा जारी किसी आदेश में ऐसे निदेश के लिए कारण अंतवष्ट होंगे और ऐसे आदेश की प्रति सात कार्य दिवस की अवध् िके भीतर संब( पुनवलोकन समिति को अग्रेषित की जाएगी ।

;3द्ध उप-नियम ;1द्ध के अध्ीन निदेश जारी करते समय अध्किारी अन्य साध्नों द्वारा आवश्यक जानकारी प्राप्त करने की संभावना पर विचार करेगा और उप-नियम ;1द्ध के अध्ीन निदेश तभी जारी किए जाएंगे जब किसी अन्य युक्तियुक्त साध्नों द्वारा जानकारी प्राप्त करना संभव न हो ।

;4द्ध निदेशित अपरोध्न किसी संदेश या संदेशों के वर्ग का वह अपरोध्न होगा जो किसी विशिष्ट विषय से संबंध्ति किसी व्यक्ति या व्यक्तियों के वर्ग को भेजे जाते हैं चाहे वे ऐसे संदेश या संदेशों के वर्ग आदेश में विनिदष्ट किसी एक या अध्कि पतों पर प्राप्त होता है, जो ऐसा पता या पते हैं, जिनका आदेश विनिदष्ट या वणत विशिष्ट व्यक्ति से या को या आदेश में विनिदष्ट या वणत परिसरों के एक विशिष्ठ सैट पर पारेषण या संचार करने के लिए उपयोग किए जाने की संभावना है ।

;5द्ध निदेश, उन अध्किारी या प्राध्किारी के नाम और पदनाम को विनिदष्ट करेंगे जिनको अपरोध्ति संदेश या संदेशों के वर्ग को प्रकट किया जाना है और यह भी विनिदष्ट करेंगे कि उपरोध्ति संदेश या संदेशों के वर्ग का उपयोग उक्त अध्निियम की धरा 5 की उप-धारा ;2द्ध के उपबंधें के अध्ीन होगा ।

;6द्ध अपरोध्न के लिए निदेश तब तक प्रवृत्त रहेंगे जब तक जारी होने की तारीख से साठ दिन से अनध्कि की अवध् िके पूर्व प्रतिसंहत नहीं हो जाते, किन्तु वे 180 दिन की कुल अवध् िसे परे प्रवृत्त नहीं रहेंगे ।

;7द्ध उप-नियम ;1द्ध के अंतर्गत जारी अपरोध्न संबंध्ी निदेशों को कम-से-कम पुलिस अध्ीक्षक स्तर के अध्किारी अथवा समकक्ष अध्किारी द्वारा लिखित अथवा सुरक्षित इलैक्ट्रॉनिक संचार के द्वारा उक्त अध्निियम की धरा 4 के अंतर्गत अनुज्ञप्तिधरी सेवा प्रदाता/सेवा प्रदाताओं के मनोनीत अध्किारियों अथवा तार प्राध्किरण के मनोनीत अध्किारियों को समप्रेषित किया जाएगा और इलैक्ट्रॉनिक संचार तथा इसका कार्यान्वयन तार प्राध्किरण द्वारा निर्धरित होगा ।

;8द्ध किसी संदेश या संदेशों के वर्ग का अपरोध्न करने के लिए प्राध्कृित अध्किारी उसमें उल्लिखित, अपरोध्ति संदेश या संदेशों के वर्ग, व्यक्तियों की विशिष्टियां जिनके संदेश को अपरोध्ति किया गया है, अध्किारी या प्राध्किारी का नाम या अन्य विशिष्टियां जिनको अपरोध्ति संदेश या संदेशों के वर्ग को प्रकट किया गया है, अपरोध्ति किए गए संदेश या संदेशों की प्रतियों की संख्या और रीति या प(ति जिसमें ऐसी प्रतियां तैयार की जाती हैं, प्रतियों के नष्ट होने की तारीख और वह अवध् िजिसके भीतर निदेश प्रवृत्त बना रहेगा, उचित अभिलेख का अनुरक्षण करेंगे ।

;9द्ध सभी मांग करने वाले सुरक्षा और विध् िप्रवर्तन अभिकरण, तार प्राध्किरण के मनोनीत अध्किारियों और संबंध्ति सेवा प्रदाताओं, जैसा भी मामला हो के अपरोध्न हेतु अपनी मांगे भेजने और उनका प्रमाणिकरण करने के प्रयोजनार्थ कम-से-कम पुलिस अध्ीक्षक स्तर अथवा इसके समकक्ष स्तर के अध्किारियों में से एक या एक से अधिक अध्किारियों को मनोनीत करेंगे और अपरोध्न से संबंध्ति लिखित मांग को सौंपने संबंध्ी कार्य कम-से-कम उप पुलिस निरीक्षक स्तर के अध्किारी द्वारा निष्पादित किया जाएगा ।

;10द्ध तार प्राध्किरण, अपरोध्न संबंध्ी ऐसी मांगों को प्राप्त करने और उनका निपटान करने के लिए नोडल अध्किारियों के रूप में प्रत्येक अनुज्ञप्ति सेवा क्षेत्रा/राज्य/संघ राज्य क्षेत्रा में ऐसे अध्किारी को मनोनीत करेगा और सेवा प्रदाता अपरोध्न संबंध्ी ऐसी मांगों को प्राप्त करने और उनका निपटान करने के लिए नोडल अध्किारियों के रूप में प्रत्येक अनुज्ञप्ति सेवा क्षेत्रा/राज्य/संघ राज्य क्षेत्रा में कंपनी के दो वरिष्ठ अध्किारियों को मनोनीत करेंगे ।

;11द्ध तार प्राध्किरण अथवा सेवा प्रदाताओं के अभिहित नोडल अध्किारी, अपरोध्न संबंध्ी सूचना प्राप्त होने पर दो घंटे के अंदर इस प्रकार की सुरक्षा की मांग करने वाले एवं कानून प्रवर्तन अध्किरण को पावती जारी करेंगे ।

;12द्ध अपरोध्न के लिए अध्यपेक्षा की संसूचना देने और प्राप्त करने के लिए अभिहित नोडल अध्किारी की प्रणाली का आपात मामलों/अपरिहार्य मामलों में भी अनुसरण किया जाएगा, जहां सक्षम प्राध्किारी का पूर्वानुमोदन प्राप्त नहीं किया गया है ।

;13द्ध सेवा प्रदाताओं के अभिहित नोडल अध्किारी या अनुज्ञप्तिदाता, जैसा भी मामला हो, ऐसे अध्प्रिमाणन की अधिप्रमाणिकता की पुष्टि के लिए सुरक्षा और विध् िप्रवर्तन अभिकरण के नोडल अध्किारियों को पूर्ववर्ती पखवाड़े के दौरान उनके द्वारा99 [भाग IIखण्ड 3(i)] भारत का राजपत्रा : पफरवरी 8, 2014/माघ 19, 1935 प्राप्त अपरोध्न अध्प्रिमाणन की सूची प्रत्येक पंद्रह दिन में अग्रेषित करेंगे और सूची में संघ के गृह सचिव या राज्य के गृह सचिव के आदेशों का सन्दर्भ एवं तारीख या उप-नियम ;1द्ध के निबंध्नों में, सक्षम प्राध्किारी के अलावा अन्य अध्किारी द्वारा जारी आदेशों के उद्‌गामी मामलों में जिसे तदुपंरात सक्षम प्राध्किारी द्वारा सुनिश्चित किया गया था, ऐसे आदेशों की प्राप्ति का समय तथा ऐसे आदेशों के क्रियान्वयन की तारीख और समय के ब्यौरे संदर्भ के रूप में सम्मिलित होंगे ।

;14द्ध सेवा प्रदाता इस बात की पर्याप्त और प्रभावी आंतरिक नियंत्राण सुनिश्चित करेगा जिससे संदेशों का अप्राध्कृित अपरोध्न न हो और उनकी अत्यध्कि गोपनीयता बरकरार रहे तथा संदेश के अपरोध्न की मामले में अत्यध्कि सावधनी और पूर्वावधनी बरती जाए क्योंकि इससे नागरिकों की निजता प्रभावित होती है और साथ ही यह भी सुनिश्चित करेगा कि कंपनी के केवल अभिहित नोडल अधिकारी इस कार्य को करे ।

;15द्ध सेवा प्रदाता अपने कर्मचारियों के कार्यों के लिए भी जिम्मेदार होंगे और सूचना की गोपनीयता एवं विश्वस्तता कायम रखने और संचार के अप्राध्कृित अपरोध्न के संबंध् में अनुज्ञप्ति के शर्तों का अल्लंघन सि( होने पर सेवाप्रदाताओं के विरु( उक्त अध्निियम के उपबंधें के अनुसार कार्रवाई की जाएगी और इसमें केवल जुर्माना ही नहीं बल्कि उनके अनुज्ञप्तियों का प्रतिसंहरण अथवा निलंबन भी शामिल होगा ।

;16द्ध यथास्थिति केन्द्रीय सरकार और राज्य सरकार एक

पुनवलोकन समिति का गठन करेगी ।

;iद्ध पुनवलोकन समिति केन्द्रीय सरकार द्वारा गठित की जाएगी जो निम्नलिखित से मिलकर बनेगी, अर्थात्‌—

;कद्ध मंत्रिामंडल सचिव — अध्यक्ष

;खद्ध सचिव, भारत सरकार, — सदस्य

विध् िकार्य के भार साध्क

;गद्ध सचिव, भारत सरकार, — सदस्य

दूरसंचार विभाग

;iiद्ध राज्य सरकार द्वारा गठित पुनवलोकन समिति

निम्नलिखित से मिलकर बनेगी, अर्थात्‌—

;कद्ध मुख्य सचिव — अध्यक्ष

;खद्ध सचिव, विध्/िविध् िपरामर्शी — सदस्य

विध् िकार्य के भार साध्क

;गद्ध सचिव, राज्य सरकार, — सदस्य

;गृह सचिव से भिन्नद्ध

;17द्ध पुनवलोकन समिति की बैठक दो मास में कम से कम एक बार होगी और उसके परिणामों को अभिलिखित करेगी कि उप-धरा ;1द्ध के अध्ीन जारी निदेश उक्त अध्निियम की धरा 5 की उप-धरा ;2द्ध के उपबंधें के अनुसार है या नहीं और यदि पुनवलोकन समिति का विचार है कि निदेश ऊपर निदष्ट उपबंधें के अनुसार नहीं है तो, यह समिति निदेशों को अपास्त कर सकेगी और अपरोध्ति संदेश या संदेशों के वर्ग की प्रतियों को नष्ट करने के लिए आदेश दे सकेगी ।

;18द्ध अपरोध्न के लिए ऐसे निदेशों से संबंध्ति अभिलेखों और अपरोध्ति संदेशों को सुसंगत सक्षम प्राध्किारी और प्राध्कृित सुरक्षा तथा विध् िप्रवर्तन अभिकरण द्वारा प्रत्येक छह मास पर नष्ट किया जाएगा, जब तक कि ये कृत्यिक अपेक्षाओं के लिए अपेक्षित या इनका होना अपेक्षित संभावित न हो ।

;19द्ध सेवा प्रदाता और तार प्राध्किारी ऐसे संदेशों के अपरोधन की निरंतरता की समाप्ति के दो मास के भीतर संदेशों के अपरोध्न के लिए निदेशों से संबंध्ति अभिलेखों को नष्ट करेंगे और ऐसा करते समय यह अत्यध्कि गोपनीयता बनाए रखेंगे ।य्

G.S.R. 18.—In exercise of the powers conferred by section 7 of the Indian Telegraph Act, 1885 (13 of 1885), the Central Government hereby makes the following rules further to amend the Indian Telegraph Rules, 1951, namely:—

1. (1) These rules may be called the Indian

Telegraph (1st Amendment of 2014) Rules, 2014.

(2) They shall come into force on the date of

their publication in the Official Gazette.

2. In the Indian Telegraph Rules, 1951, for rule 419A,

the following rule shall be substituted, namely :—

"419A. (1) Directions for interception of any message or class of messages under sub-section (2) of section 5 of the Indian Telegraph Act, 1885 (hereinafter referred to as the said Act) shall not be issued except by an order made by the Secretary to the Government of India in the Ministry of Home Affairs in the case of Government of India and by the Secretary to the State Government in-charge of the Home Department in the case of a State Government and in unavoidable circumstances, such order may be made by an officer, not below the rank of a Joint Secretary to the Government of India, who has been duly authorised by the Union Home Secretary or the State Home Secretary, as the case may be:

Provided that in emergent cases—

(i) in remote areas, where obtaining of prior directions for interception of messages or class of messages is not feasible; or

(ii) for operational reasons, where obtaining of prior directions for interception of messages or class of messages is not feasible,

the required interception of any message or class of messages shall be carried out with the prior approval of the Head or the second senior most officer of the authorised Security and Law Enforcement Agency at the Central Level and the officers authorised in this behalf, not below the rank of Inspector General of Police, at the[भाग IIखण्ड 3(i)] भारत का राजपत्रा : पफरवरी 8, 2014/माघ 19, 1935 101 State level but the concerned competent authority shall be informed of such interceptions by the approving authority within three working days and that such interceptions shall be got confirmed by the concerned competent authority within a period of seven working days and if the confirmation from the competent authority is not received within the stipulated seven days, such interception shall cease and the same message or class of messages shall not be intercepted thereafter without the prior approval of the Union Home Secretary or the State Home Secretary, as the case may be.

(2) Any order issued by the competent authority under sub-rule (1) shall contain reasons for such direction and a copy of such order shall be forwarded to the concerned Review Committee within a period of seven working days.

(3) While issuing directions under sub-rule (1), the officer shall consider possibility of acquiring the necessary information by other means and the directions under sub- rule (1) shall be issued only when it is not possible to acquire the information by any other reasonable means.

(4) The interception directed shall be the interception of any message or class of messages as are sent to or from any person or class of persons or relating to any particular subject whether such message or class of messages are received with one or more addresses, specified in the order, being an address or addresses likely to be used for the transmission of communications from or to one particular person specified or described in the order or one particular set of premises specified or described in the order.

(5) The directions shall specify the name and designation of the officer or the authority to whom the intercepted message or class of messages is to be disclosed and also specify that the use of intercepted message or class of messages shall be subject to the provisions of sub-section (2) of section 5 of the said Act.

(6) The directions for interception shall remain in force, unless revoked earlier, for a period not exceeding sixty days from the date of issue and may be renewed but the same shall not remain in force beyond a total period of one hundred and eighty days.

(7) The directions for interception issued under sub- rule (1) shall be conveyed to designated officers of the telegraph authority or to the designated officers of the service provider(s) who have been granted licences under section 4 of the said Act, in writing or by secure electronic communication by an officer not below the rank of Superintendent of Police or the officer of the equivalent rank and mode of secure electronic communication and its implementation shall be as determined by the telegraph authority.

(8) The officer authorised to intercept any message or class of messages shall maintain proper records mentioning therein, the intercepted message or class of messages, the particulars of persons whose message has been intercepted, the name and other particulars of the officer or the authority to whom the intercepted message or class of messages has been disclosed, the number of copies of the intercepted message or class of messages made and the mode or the method by which such copies are made, the date of destruction of the copies and the duration within which the directions remain in force.

(9) All the requisitioning Security and Law Enforcement Agencies shall designate one or more nodal officers not below the rank of Superintendent of Police or the officer of the equivalent rank to authenticate and send the requisitions for interception to the designated officers of the telegraph authority or the concerned service providers, as the case may be and the delivery of written requisition for interception shall be done by an officer not below the rank of Sub-Inspector of Police.

(10) The telegraph authority shall designate officer(s) in every licensed service area / State / Union territory as the nodal officers to receive and handle such requisitions for interception and the service providers shall designate two senior officer(s) of the company in every licensed service area / State / Union territory as the nodal officers to receive and handle such requisitions for interception.

(11) The designated nodal officer(s) of the telegraph authority or the service providers shall issue acknowledgment to the requisitioning Security and Law Enforcement Agency within two hours on receipt of intimations for interception.

(12) The system of designated nodal officers for communicating and receiving the requisitions for interceptions shall also be followed in emergent cases / unavoidable cases where prior approval of the competent authority has not been obtained.

(13) The designated nodal officer(s) of the telegraph authority or the service providers shall forward every fifteen days a list of interception authorisations received by them during the preceding fortnight to the nodal officers of the Security and Law Enforcement Agencies for confirmation of the authenticity of such authorisations and the list shall include details such as the reference and date of orders of the Union Home Secretary or State Home Secretary or orders issued by officer other than competent authority, in terms of sub-rule (1) in emergent cases which were not subsequently confirmed by the competent authority, date and time of receipt of such orders and the date and time of implementation of such orders.

(14) The service providers shall put in place adequate and effective internal checks to ensure that unauthorised interception of messages does not take place and extreme secrecy is maintained and utmost care and precaution is taken in the matter of interception of messages as it affects privacy of citizens and also that this matter is handled only by the designated nodal officers of the company.

(15) The service providers shall be responsible for actions of their employees also and in case of established violation of licence conditions pertaining to maintenance of secrecy and confidentiality of information and unauthorised interception of communication, action shall be taken against the service providers as per provisions of the said Act, and this shall include not only fine but also suspension or revocation of their licences.

(16) The Central Government and the State Government, as the case may be, shall constitute a Review Committee.

(i) The Review Committee to be constituted by the Central Government shall consist of the following, namely:-

(a) Cabinet Secretary —Chairman;

(b) Secretary to the Government of India Incharge, Legal Affairs —Member;

(c) Secretary to the Government,

Department of Telecommunications —Member.

(ii) The Review Committee to be constituted by a State Government shall consist of the following, namely:-

(a) Chief Secretary —Chairman;

(b) Secretary Law/Legal

Remembrancer Incharge, Legal Affairs —Member;

(c) Secretary to the State

Government (other than the Home Secretary) —Member.

(17) The Review Committee shall meet at least once in two months and record its findings whether the directions issued under sub-rule (1) are in accordance with the provisions of sub-section (2) of section 5 of the said Act and when the Review Committee is of the opinion that the directions are not in accordance with the provisions referred to above, it may set aside the directions and orders for destruction of the copies of the intercepted message or class of messages.

(18) Records pertaining to such directions for interception and of intercepted messages shall be destroyed by the relevant competent authority and the authorised Security and Law Enforcement Agencies every six months unless these are, or likely to be, required for functional requirements.

(19) The service providers and telegraph authority shall destroy records pertaining to directions for interception of messages within two months of discontinuance of the interception of such messages and in doing so they shall maintain extreme secrecy".

सा.का.नि. 19.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और ग्रामीण विकास विभाग, पुस्तकालय लिपिक भर्ती नियम, 1985 को, उन बातों के सिवाय अधिक्रान्त करते हुए, जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने का लोप किया गया है, ग्रामीण विकास विभाग में पुस्तकालय लिपिक पद पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम ग्रामीण विकास विभाग, पुस्तकालय लिपिक, समूह 'ग' पद भर्ती नियम, 2013 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. ये लागू होता.—ये नियम इन नियमों से उपाब( अनुसूची के स्तंभ ;1द्ध में विनिदष्ट पद पर लागू होंगे ।

3. पदों की संख्या, वर्गीकरण और वेतन बैंड तथा ग्रेड वेतन या वेतनमान.—उक्त पदों की संख्या, उनका वर्गीकरण और वेतन बैंड तथा ग्रेड वेतन या वेतनमान वह होगा, जो इन नियमों से उपाब( अनुसूची केे स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

4. भर्ती की प(ति, आयु-सीमा, अर्हताएं आदि .—उक्त पद पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;13द्ध में विनिदष्ट हैं ।

5. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

7. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

G.S.R. 19.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Department of Rural Development Library Clerks Recruitment Rules, 1985, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Library Clerk in the Department of Rural Development, namely:-

1 . Short title and commencement.—(1) These rules may be called the Department of Rural Development, Library Clerk, Group 'C' Posts Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application.—These rules shall apply to the posts specified in the column (1) of the Schedule annexed to these rules.

3. Number of post, classification, pay band and grade pay or pay scale.—The number of said post, its classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the said Schedule.

4. Method of recruitment, age limit, qualifications, etc. .—The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the aforesaid Schedule.

5. Disqualification.—No person, -

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living, has entered nto or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

6. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

7. Saving.—Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

G.S.R. 20.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Commission for Agricultural Costs and Prices Group 'C' and 'D' posts Recruitment Rules, 2000, except as respects things done or omitted to be done before such suppression, the President hereby makes the following rules, regulating the method of recruitment to the post of Multi Tasking Staff in the Ministry of Agriculture, Department of Agriculture and Cooperation, Commission for Agricultural Costs and Prices, namely:-

1. Short title and commencement.—(l) These rules may be called the Ministry of Agriculture, Department of Agriculture and Cooperation, Commission for Agricultural Costs and Prices, Multi Tasking Staff Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification, pay band and grade payor pay scale.—The number of the said post, its classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit, qualifications, etc.- The method of recruitment, age limit, qualifications and other matters relating thereto, shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification. - No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall not be eligible for appointment to the said post.

Provided that the Central Government, may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward. Classes, ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

G.S.R. 22.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Directorate of Plant Protection, Quarantine and Storage Group 'C' post of Technicial Assistant (X-Ray) Recruitment Rules, 1990, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Assistant Plant Protection Officer (X-Ray) in the Directorate of Plant Protection, Quarantine and Storage, Faridabad under the Department of Agriculture and Cooperation of the Ministry of Agriculture, namely :—

1. Short title and commencement.—(1) These rules may be called the Ministry of Agriculture, Department of Agriculture and Cooperation, Directorate of Plant Protection, Quarantine and Storage, Faridabad, Assistant Plant Protection Officer (X-Ray) Recruitment Rules, 2014.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification, pay band and grade pay or pay scale.—The number of the said post, its classification pay band and grade pay and pay scale attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed in these rules.

3. Method of recruitment, age-limit, other qualifications, etc.—The method of recruitment to the said post, age- limit, qualifications and other matters relating to the said post shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification.—No person,—

(1) who has entered into or contracted a marriage with a person having a spouse living, or

(2) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. G.S.R. 23.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Ministry of Minority Affairs, Staff Car Driver, Group 'C' Recruitment Rules, 2009, except as respects things done126 THE GAZETTE OF INDIA : FEBRUARY 8, 2014/MAGHA 19, 1935 [PART II—SEC.3(i)] or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Driver in the Ministry of Minority Affairs, namely :—

1. Short title and commencement.—(1) These rules may be called the Ministry of Minority Affairs (Driver) Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of the posts, classification and the pay band, grade pay or pay scale.—The number of the said post, its classification, and the pay band, grade pay or pay scale attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age-limit, qualification, etc.—The method of recruitment, age-limit, educational qualifications and other matters relating to the said post shall be as specified in columns (5) to (13) of the aforesaid Schedule .

4. Disqualification.—No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservations, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Ex-Servicemen, the Other Backward Classes, and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
