आदेश

सं. 7(2)/2012/सतर्कता/684--जबकि यह आरोप लगाया गया था कि श्री सुखराम मीणा, तकनीशियन/डी, ईडीएंडसीडी, भापअ केन्द्र दिनांक 03.11.2011 से अनधिकृत रूप से ड्‌यूटी से अनुपस्थित रह रहे ह और सक्षम प्राध्किारी की अनुमति के बिना उन्होंने मुख्यालय छोड़ दिया है। अपने उपर्युक्त आचरण के द्वारा, उक्त श्री मीणा ने कार्य के प्रति निष्ठा की कमी को दर्शातेभाग III—खण्ड 1] भारत का राजपत्र, मार्च 15, 2014 (फाल्गुन 24, 1935) 251 हुए केन्द्रीय सिविल सेवा (आचरण) नियमावली, 1964 के नियम 3 के उप नियम (1) के खंड (ii) के प्रावधानों का उल्लंघन किया ह;

2. और जबकि उक्त श्री मीणा को दिनांक 22.06.2012 के ज्ञापन सं. 7(2)/2012/सतर्कता/5469 द्वारा आरोपों को सूचित करते हुए केन्द्रीय सिविल सेवाएं (वर्गीकरण, नियंत्रण एवं अपील) नियमावली, 1965 के नियम 14 के अधीन उनके विरूद्ध की जाने वाली प्रस्तावित कार्रवाई की सूचना दी गई थी;

3. और जबकि उक्त श्री मीणा ने दिनांक 22.06.2012 के आरोप ज्ञापन हेतु दिनांक 09.07.2012 को बचाव के लिए अपना लिखित बयान प्रस्तुत किया;

4. और जबकि उक्त श्री मीणा ने दिनांक 09.07.2012 के अपने

अभ्यावेदन में आरोपों से इन्कार किया;

5. और जबकि उक्त श्री मीणा के विरूद्ध लगाए गए आरोपों के जांच के आदेश दिए गए और तद्‌नुसार अधोहस्ताक्षरी की ओर से श्री सी.के. राधाकृष्णन, प्रशासन अधिकारी-II, सीडीएम, भापअ केन्द्र को उक्त आरोपों की जांच हेतु दिनांक 02.08.2012 के आदेश सं. 7(2)/2012/सतर्कता/6634 द्वारा जांच प्राधिकारी के रूप में नियुक्त किया गया और श्री वाई रामान्जनेयुलू, सहायक कामक अधिकारी, भापअ केन्द्र को मामला प्रस्तुत करने के लिए प्रस्तुतीकरण अधिकारी के रूप में नियुक्त किया गया;

6. और जबकि जांच प्राधिकारी ने अपनी दिनांक 14.09.2012 की जांच रिपोर्ट प्रस्तुत की जिसमें बताया गया कि दिनांक 12.09.2012 को हुई प्रारंभिक सुनवाई के दौरान उक्त श्री मीणा ने उनपर लगाए गए आरोप को बिना किसी शर्त के स्वीकार किया था और इस तरह उक्त श्री मीणा के विरूद्ध लगाया गया आरोप सही सिद्ध हुआ;

7. और जबकि दिनांक 25.09.2012 को उक्त श्री मीणा को जांच रिपोर्ट की प्रतिलिपि यह सलाह देते हुए अग्रेषित की गई ताकि वे यदि कोई अपना अभ्यावेदन/निवेदन देना चाहे तो दे;

8. और जबकि उक्त श्री मीणा ने दिनांक 11.10.2012 का अपना

अभ्यावेदन प्रस्तुत किया जिसमें निम्नलिखित बातें कही गईं थीः--

1. जांच प्राधिकारी ने उन पर लगे आरोग स्वीकार करने के लिए उन्हें बाध्य किया और उन्हें बहकाया कि ऐसा करने पर उन्हें माफी मिल सकेगी।

2. उन पर लगाए गए आरोप को स्वीकार करने वाला लिखित बयान स्वयं उनके द्वारा अथवा उनके सहायकों द्वारा तैयार किया गया था।

3. यदि उन्हें अपराध महसूस होता तो वह बहुत पहले ही जांच

आदेश आने से पहले ही वे इसे स्वीकार कर लेते।

4. श्री मीणा ने व्यक्तिगत सुनवाई हेतु भी अनुरोध किया था।

9. और जबकि जांच प्राधिकारी ने आगे कहा किः

1) आरंभिक सुनवाई के दौरान उनके विरूद्ध लगाए गए आरोपों को स्वीकार अथवा अस्वीकार करने के लिए किसी प्रकार का कोई दबाव श्री मीणा पर नहीं डाला गया था।

2) हांलाकि श्री मीणा को अपने बचाव से संबंधित लिखित बयान टाइप कराने के लिए आवश्यक सहायता उपलब्ध कराई गई थी। उन्होंने अपने हस्ताक्षर के अंतर्गत स्वैच्छिक अपना लिखित बयान प्रस्तुत किया।

3) अनुशासनिक कार्यवाहियों के दौरान श्री मीणा किसी भी समय उनके विरूद्ध लगाए गए आरोपों को स्वीकार अथवा अस्वीकार करने के लिए स्वतंत्र थे। श्री मीणा ने विचार-पूर्वक दिनांक 12.09.2012 को हुई आरंभिक सुनवाई के दौरान बिना किसी शर्त के आरोपों को स्वीकार किया था।

10. और जबकि उक्त श्री मीणा को दिनांक 18.11.2013 को वैयक्तिक सुनवाई का मौका दिया गया जिसके दौरान उन्होंने दिनांक 18.11.2013 को पत्र दिया और स्पष्ट किया कि खराब स्वास्थ्य के कारण वे अब तक ड्‌यूटी पर नहीं आ पाए थे। उन्होंने अपने खराब स्वास्थ्य के लिए किसी भी डॉक्टर का दिया हुआ कोई भी चिकित्सा प्रमाणपत्र प्रस्तुत नहीं किया। आगे उन्होंने आश्वासन दिया कि वे 10 दिनों के अंदर ड्‌यूटी पर लौट आएंगे और फिर नियमित रूप से कार्य हेतु उपस्थित रहेंगे। फिर भी वे ड्‌यूटी पर नहीं आए;

11. और जबकि अधोहस्ताक्षरी ने जांच रिपोर्ट को ध्यानपूर्वक देखा। उक्त श्री मीणा ने जांच के दौरान आरोपों को बिना किसी शर्त के स्वीकार किया था और इसलिए ही जांच अधिकारी के परिणामों को स्वीकार किया गया। आगे वैयक्तिक सुनवाई के दौरान उनकी स्वीकृति और दिनांक 18.11.2013 के उनके पत्र को ध्यान में रखते हुए अधोहस्ताक्षरी ने पाया कि उक्त श्री मीणा दिनांक 03.11.2011 से ड्‌यूटी से अनधिकृत रूप से अनुपस्थित रहे ह और उनके विरूद्ध लगाए गए आरोप सहीं है;

12. और जबकि अधोहस्ताक्षरी ने मामले के सभी तथ्यों और परिस्थितियों का विचार किया और वे इस निष्कर्ष पर पहुंचे कि दो वर्षाें से भी अध्कि अनधिकृत अनुपस्थिति के बावजूद श्री मीणा अभी तक ड्‌यूटी पर नहीं आए ह। इससे यह साफ स्पष्ट है कि उन्हें सरकारी सेवा में बने रहने में कोई रूचि नहीं है। इन सब तथ्यों को ध्यान में रखते हुए और उक्त श्री मीणा का लापरवाही पूर्ण रवैया देखते हुए अधोहस्ताक्षरी को लगाता है कि इस मामले में उक्त श्री मीणा को तत्काल प्रभाव से 'सेवा से हटाने' का दंड देना न्यायसंगत होगा;

13. अब इसलिए, अधोहस्ताक्षरी केन्द्रीय सिविल सेवाएं (वर्गीकरण, नियंत्रण एवं अपील) नियमावली, 1965 के नियम 12 के उप नियम (2) के खंड (ख) के साथ पठित परमाणु ऊर्जा विभाग के दिनांक 16 मई, 2013 के आदेश सं. 1/6/(1)/2009-सतर्कता/खंड-II के अंतर्गत निहित शक्तियों का प्रयोग करते हुए एतद्‌द्वारा उक्त श्री मीणा पर तत्काल प्रभाव से सेवा से हटाने का दंड लगाते ह।

14. आगे यह भी आदेश दिया जाता है कि दिनांक 03.11.2011 से 11.09.2012 और 13.09.2012 से इस आदेश के जारी होने की तारीख तक उनकी अनधिकृत अनुपस्थिति की अवधि को 'अकार्य-दिवस' माना जाएगा।

15. श्री मीणा को सूचित किया जाता है कि उपर्युक्त आदेश के विरूद्ध अपीलीय प्राधिकारी अध्यक्ष, पी एंड सीडी, भापअ केन्द्र के पास अपील की जा सकती है। यदि कोई अपील करनी हो तो वह अपीलीय प्राधिकारी के पास इस आदेश की प्राप्ति की तारीख से पतालीस दिनों के भीतर प्रस्तुत करनी होगी।

No. 7(2)/2012/Vig./684—WHEREAS it was alleged that Shri Sukhram Meena, Technician/D, ED&CD, BARC has been remaining absent from duties unauthorisedly w.e.f. 03.11.2011 and left the Headquarter without permission of the Competent Authority. By his aforesaid conduct, the said Shri Meena has shown lack of devotion to duty thereby contravening the provisions of Clauses (ii) of Sub Rule (1) of Rule 3 of the Central Civil Services (Conduct) Rules, 1964;

2. AND WHEREAS the said Shri Meena was informed of the charges and of the action proposed to be taken against him under Rule 14 of the CCS (Classification, Control and Appeal) Rules, 1965, vide Memorandum no. 7(2)/2012/Vig./ 5469 dated 22.06.2012;

3. AND WHEREAS the said Shri Meena submitted his written statement of defence on 09.07.2012 to the charge Memorandum dated 22.06.2012;

4. AND WHEREAS in his representation dated 09.07.2012,

the said Shri Meena denied charges;

5. AND WHEREAS an inquiry was ordered into the charge framed against the said Shri Meena and accordingly Shri C.K. Radhakrishnan, Administrative Officer-II, CDM, BARC as Inquiry Authority vide Order No. 7(2)/2012/Vig./6634 dated 02.08.2012 to inquire into the said charges and Shri Y. Ramanjaneyulu, Assistant Personnel Officer, Personnel Division, BARC was appointed as Presenting Officer to present the case on behalf of the undersigned;

6. AND WHEREAS the Inquiry Officer submitted his report dated 14.09.2012 stating that the said Shri Meena had admitted the charge unconditionally during the preliminary hearing held on 12.09.2012 and holding the charge against the said Shri Meena as proved;

7. AND WHEREAS a copy of the Inquiry report was forwarded to the said Shri Meena on 25.09.2012 advising him to make his representation/submission, if any, thereon;

8. AND WHEREAS the said Shri Meena submitted his

representation dated 11.10.2012 where he has stated that :

(1) The Inquiry Authority had compelled him to accept the charges levelled upon him misguiding him that he will be pardoned if he does so.

(2) The written statement of defence accepting the charges levelled upon him was prepared by himself or his assistants.

(3) If he felt he was guilty he would have accepted it long

before even before the order of the inquiry.

(4) Shri Meena had also requested for personal hearing.

9. AND WHEREAS the Inquiry Authority has further stated

that:

(1) There was no compulsion whatsoever during the preliminary hearing for Shri Meena to accept or deny the charges framed against him.

(2) Though necessary assistance was provided to Shri Meena for typing out his written statement of defence, he had voluntarily submitted the written statement under his signature.

(3) Shri Meena was free to accept or deny the charges framed against him anytime during the course of disciplinary proceedings. Shri Meena accepted the charges unconditionally during the preliminary hearing held on 12.09.2012 by applying his mind.

10. AND WHEREAS the said Shri Meena was accorded a personal hearing on 18.11.2013 during which he gave a letter dated 18.11.2013 explaining that due to his ill health, he couldn't join duties till now. He did not produce any Medical Certificate from any Doctor in support of his ill health. He further assured that he will resume duties within 10 days and will come to work regularly. However, he did not join duty;

11. AND WHEREAS the undersigned has carefully gone through the Inquiry report. The said Shri Meena had admitted the charges unconditionally during the inquiry and therefore PART III—SEC. 1] THE GAZETTE OF INDIA, MARCH 15, 2014 (PHALGUNA 24, 1935) 267

accept the findings of Inquiry Officer. Further taking into consideration his submission during personal hearing and his letter dated 18.11.2013, the undersigned finds that the said Shri Meena has been unauthorisedly absent from duty from 03.11.2011 and holds the charges levelled against him a proved;

12. AND WHEREAS the undersigned has considered all the facts and circumstances of the case and has come to the conclusion that even after more than two years of unauthorized absence, Shri Meena is yet to resume his duties. It is very clear that he is not interested in continuing in Government Service. Taking into account all the facts and casual attitude of the said Shri Meena, the undersigned feels that ends of justice would meet in this case by imposing the penalty of 'removal from service', on the said Shri Meena with immediate effect;

13. NOW, THEREFORE, the undersigned in exercise of the powers conferred on him under clause (b) of Sub Rule (2) of Rule 12 of the Central Civil Services (Classification, Control & Appeal) Rules, 1965 read with Department of Atomic Energy Order No. 1/6(1)/2009/Vig./Vol-II dated 16.05.2013 hereby imposes the penalty of removal from services, with immediate effect, on the said Shri Meena;

14. It is further ordered that the period of unauthorized absence from 03.11.2011 to 11.09.2012 and from 13.09.2012 to date of issue of this order shall be treated as "dies-non".

15. Shri Meena is informed that an appeal against the above order lies with Head P&CD, BARC, the Appellate Authority. The appeal, if any, should be preferred within a period of 45 (forty-five) days from the date of receipt of this order.
