11.17.1 यदि किसी सदस्य को एक्सचेंज के संगत प्राधिकारी द्वारा एक चूककर्ता घोषित किया जाता है तो एक्सचेंज अन्य कोमोडिटी एक्सचेंजों को सदस्य द्वारा की गई ऐसी चूक की सूचना देगा।
11.17.2 यदि सदस्यता किसी निगमित निकाय के नाम पर ली जाती है तो एक्सचेंज द्वारा अन्य कोमोडिटी एक्सचेंजों को प्रोमोटर (प्रोमोटरों), ऐसे चूककर्ता सदस्यों के प्रमुख शेयरहोल्डरों के नामों की भी सूचना दी जाएगी।

11.17.4 ऐसा कोई व्यक्ति जो एक्सचेंज का सदस्य था और उसे एक चूककर्ता घोषित किया गया है अथवा एक्सचेंज द्वारा उसे निष्कासित कर दिया गया है, उसको इस प्रकार चूककर्ता घोषित किए जाने/निष्कासित किए जाने की तारीख से पांच वर्ष की अवधि के लिए एक्सचेंज की सदस्यता पुनः प्रदान नहीं की जाएगी।
11.17.5 यदि किसी सदस्य को अन्य कोमोडिटी एक्सचेंज द्वारा एक चूककर्ता घोषित किया जाता है तो एक्सचेंज में उसकी जमा राशियां/सुरक्षा जमा राशियां अथवा कोई अन्य निधियां एक्सचेंज द्वारा रोक कर रखी जाएंगी। चूककर्ता सदस्य की ऐसी परिसंपत्तियों को एक्सचेंज की किन्हीं भी बकाया राशियों/दावों का समायोजन करने के बाद अन्य एक्सचेंजों पर दावों के अनुसार एक्सचेंजवार आनुपातिक रूप से समायोजित किया जाएगा।''

ACE DERIVATIVES AND COMMODITY EXCHANGE LIMITED

The approval of the Deputy Director, Forward Markets Commission, under Section 12 (1) of the Forward Contracts (Regulation) Act, 1952 (74 of 1952) read with the Government of India, Ministry of Commerce and Industry Notification "11.17 Procedure to be adopted if a member is declared a defaulter by the Relevant Authority of the Exchange / other Commodity Exchange
11.17.1 If a member is declared as a defaulter by the Relevant Authority of the Exchange, the Exchange shall inform other Commodity Exchanges about such default by the member.
11.17.2 If membership is held in the name of a corporate body, then the names of the promoter(s), dominant shareholders of such defaulting members shall also be intimated by the Exchange to other Commodity Exchanges.
11.17.3 If a member is declared as defaulter by other Commodity Exchange and if associate (s) of such members hold membership at the Exchange, action shall be taken against such associate members by the Relevant Authority on examining the relevant facts in the said matter.
11.17.4 No person who was a member of the Exchange and declared a defaulter or expelled by the Exchange shall be readmitted to the membership of the Exchange for a period of five years from the date he is declared a defaulter/ expelled.
11.17.5 If the member is declared a defaulter at other Commodity Exchange, the deposits/security deposits or any other funds lying with the Exchange shall be withheld by the Exchange. Such assets of the defaulter member shall be apportioned exchange wise as per the claims at each of other exchanges after adjusting any dues/claims of the Exchange. "
"11.12.2 In the event of any shortfall in the settlement of the claims the Exchange can seek surplus amount of such member withheld by other exchanges and utilize such funds for settlement of the claim."

— Any advertisement / publicity made by the member highlights only the benefits of futures market without highlighting risks involved.
