एसीई डेरीवेटिव्स एंड कोमोडिटी एक्सचेंज लिमिटेड, मुंबई के उप नियमों में किए गए निम्नलिखित संशोधनों के लिए भारत सरकार, वाणिज्य और उद्योग मंत्रालय की दिनांक 4 मई, 1960 की अधिसूचना सं. एस. ओ. 1162 के साथ पठित वायदा संविदा (विनियमन) अधिनियम, 1952 (1952 का 74वां) की धारा 6 (3) के अंतर्गत उप निदेशक, वायदा बाजार आयोग का अनुमोदन 01 अगस्त, 2014 को प्राप्त किया गया है और उपर्युक्त अधिनियम की धारा 9 क की उप धारा 2 के अंतर्गत एतद्‌द्वारा इन्हेेंं अधिसूचित किया जाता है।

संशोधन

एसीई डेरीवेटिव्स एंड कोमोडिटी एक्सचेंज लिमिटेड के नियमों में किए गए संशोधन

उपर्युक्त नियमों में मौजूदा खंड 5.33.10 को निम्नलिखित के द्वारा प्रतिस्थापित किया जाएगाः

''5.33.10. सदस्यता छोड़ने (अर्थात उसका त्याग होने) पर आरंभ में जमा की गई सुरक्षा जमा राशि संबंधित सदस्य को निम्नलिखित ढ़ंग से अथवा वायदा बाजार आयोग द्वारा समय-समय पर यथाविनिर्दिष्ट ढ़ंग से लौटाई (रिफंड की) जाएगीः

क) ऐसे सदस्यों के मामले में, जिन्होंने एक्सचेंज प्लेटफॉर्म पर कभी भी व्यापार (ट्रेड) नही किया है-विज्ञापन प्रकाशित होने की तारीख से 6 (छः) माह के पश्चात जमा राशि लौटाई जाएगी।

ख) ऐसे सदस्यों के मामले में, जिन्होंने एक्सचेंज प्लेटफॉर्म पर किसी भी समय व्यापार (ट्रेड) किया है-विज्ञापन प्रकाशित होने की तारीख से 3 (तीन) वर्ष के पश्चात जमा राशि लौटाई जाएगी।

हालांकि उपर्युक्त (ख) के अंतर्गत आने वाले सदस्य अपनी मौजूदा जमा राशियों के स्थान पर सावधि जमा, बैंक गारंटी आदि जैसे गैर-नकदी के रूप में अपनी जमा राशि बनाए रख सकते हैं।

जमा राशियों का लौटाया जाना वायदा बाजार आयोग/एक्सचेंज द्वारा सदस्यता वापस लेने के लिए अनुमोदन और एक्सचेंज के उप-नियमों, नियमों, व्यापार नियमों तथा उनके अंतर्गत जारी किए गए परिपत्र (परिपत्राें) के अधीन सभी देयताओं/अनुपालनों को पूरा करने की शर्त के अध्यधीन होगा । यदि सदस्यता छोड़ने के अनुमोदन के पश्चात अथवा सुरक्षा जमा राशि जारी करने के लिए यथाविनिर्दिष्ट तारीख से पहले कोई पूरी न की गई बाध्यता, निवेशक की शिकायत, अनुशासनिक कार्रवाई आदि की जानकारी एक्सचेंज के संज्ञान में लाई जाती है, तो एक्सचेंज द्वारा जमा राशियों को विनिर्दिष्ट अवधि के बाद भी रोका जा सकता है।

NOTIFICATION

The approval of the Deputy Director, Forward Markets Commission, under section 6 (3) of the Forward Contracts (Regulation) Act, 1952 (74 of 1952) read with the Government of India, Ministry of Commerce and Industry Notification No. S.O.1162 dated 4th May, 1960 has been obtained on the 1st August, 2014, to the following amendments, made to the Rules of the ACE Derivatives and Commodity Exchange Ltd., Mumbai and the same is hereby notified under Sub- Section 2 of Section 9A of the said Act.

AMENDMENTS

Amendments to the Rules of the Ace Derivatives and Commodity Exchange Ltd

In the said Rules, the existing clause 5.33.10 shall be substituted by the following:

"5.33.10. On surrender of Membership, the initial security deposit will be refunded to the member in the following manner or as may be specified by Forward Markets Commission from time to time:

a) In case of members who have never traded on the Exchange platform - The deposit will be refunded to them after 6 (six) months of the date of advertisement for surrender of membership.

b) In case of members who have traded on Exchange platform anytime - The deposits shall be refunded after 3 (three) years of the date of advertisement for surrender of membership as hitherto.

Provided, however, that the members covered under (b) above can maintain the deposit in non- cash form such as Fixed Deposit, Bank Guarantee etc. in place of their existing deposits.

The refund of deposits will be subject to approval of surrender of membership by FMC/ Exchange and fulfillment of all dues/compliances under Bye-laws, Rules, Business Rules of the Exchange and Circular/s issued there under. The deposits may be retained by the Exchange beyond the stipulated period, if any unfulfilled obligations, investor complaints, disciplinary action, etc. against the member come to exchange's notice after the approval of surrender and before the stipulated date of release of security deposit.
