आ.अ. 33.—जबकि, निर्वाचन आयोग का समाधन हो गया है कि नीचे की सारणी के स्तम्भ ;2द्ध में यथा विनिर्दिष्ट उत्तर प्रदेश राज्य की विधन सभा के साधरण निर्वाचन के लिए, जो स्तम्भ ;3द्ध में विनिर्दिष्ट निर्वाचन क्षेत्रा से हुआ है, स्तम्भ ;4द्ध में उसके सामने विनिर्दिष्ट निर्वाचन लड़ने वाला प्रत्येक अभ्यर्थी, लोक प्रतिनिध्त्वि अध्निियम, 1951 तथा त(ीन बनाए गए नियमों द्वारा अपेक्षित उक्त सारणी के स्तम्भ ;5द्ध में यथा दर्शित अपने निर्वाचन व्ययों का लेखा दाखिल करने में असपफल रहे हैंऋ और
जबकि, उक्त अभ्यर्थियों ने सम्यक, सूचना दिए जाने पर भी उक्त असपफलता के लिए या तो कोई कारण अथवा स्पष्टीकरण नहीं दिया है या उनके द्वारा दिए गए अभ्यावेदनों पर, यदि कोई हो, विचार करने के पश्चात्् निर्वाचन आयोग का यह समाधन हो गया है कि उनके पास उक्त असपफलता के लिए कोई पर्याप्त कारण या न्यायौचित्य नहीं हैः-
अतः अब, निर्वाचन आयोग एतद््द्वारा उक्त अध्निियम की धरा 10-क के अनुसरण में नीचे की सारणी के स्तम्भ ;4द्ध में विनिर्दिष्ट व्यक्तियों को संसद के किसी भी सदन के या किसी राज्य/संघ राज्य क्षेत्रा की विधन सभा अथवा विधन परिषद्् के सदस्य चुने जाने और सदस्य होने के लिए इस आदेश की तारीख से तीन वर्ष की कालावध् िके लिए निरर्हित घोषित करता है।

O. N. 33.—Whereas, the Election Commission is satisfied that each of the contesting candidates specified in column (4) of the table below at the General Elections to the Legislative Assembly in the State of Uttar Pradesh as specified in column (2) held from the Constituency specified in column (3) against his name has failed to lodge the account of his election expenses as required by the Representation of the People Act, 1951 and the rules made there under as shown in column (5) of the said table;
And, whereas, the said candidates have either not furnished any reason or explanation for the said failure even after due notices or the Election Commission, after considering the representation made by them, if any is satisfied that they have no good reason or justification for the said failure;
Now, therefore, in pursuance of Section 10A of the said Act, the Election Commission hereby declares the persons specified in column (4) of the table below to be disqualified for being chosen as, and for being a member of either House of the Parliament or of the Legislative Assembly or Legislative Council or a State/Union Territiory for a period of three years from the date of this order:-

आ.अ. 34.—यतः आयोग ने 24-माण्डु विधन सभा निर्वाचन क्षेत्रा से झारखण्ड विधन सभा के साधरण निर्वाचन, 2009 के लिए निर्वाचन लड़ने वाले अभ्यर्थी श्री अरूण प्रसाद, ग्राम-पो.-चैनपुर, थाना-माण्डू, जिला-रामगढ़, झारखण्ड द्वारा अपने निर्वाचन व्ययों का लेखा विध् िद्वारा अपेक्षित रीति से दाखिल नहीं करने के कारण लोकप्रतिनिध्त्वि अध्निियम, 1951 की धरा 10क के तहत दिनांक 9 जुलाई, 2012 के आदेश संख्या 76/झार-वि.स./2009 द्वारा संसद के किसी भी सदन के या किसी राज्य/संघ राज्य क्षेत्रा की विधन सभा अथवा विधन परिषद के सदस्य चुने जाने के लिए अथवा होने के लिए और निरर्हित कर दिया थाऋ
और, यतः उक्त श्री अरूण प्रसाद ने लोक प्रतिनिध्त्वि अध्निियम, 1951 की धरा 11 के अध्ीन उक्त आदेश के विरू( एक अपील दिनांक 21-10-2014 दायर की है और अपनी उस अपील में बताए गए कारणों के आधर पर निरहर्ता हटाने के लिए अनुरोध् किया है।
अतः लोक प्रतिनिध्त्वि अध्निियम, 1951 की धरा 11 के अध्ीन दायर की गई उक्त अपील को सुनने और अपीलकर्ता को सुनने के पश्चात्् सक्षम प्राध्किारी ने निर्णय किया है कि दिनांक 9 जुलाई, 2012 के आदेश संख्या 76/झार-वि.स./2009 के द्वारा श्री अरूण प्रसाद पर लगाई गई निरहर्ता 5 नवम्बर, 2014 से हटा दी जायेगी।
अतः अब, आयोग के तारीख 9 जुलाई, 2012 के आदेश सं 76/झार-वि.स./2009 के साथ संलग्न सारणी के क्रम संख्या 18 पर स्थित श्री अरूण प्रसाद का नाम 5 नवम्बर, 2014 से हटा दिया जाएगा।

N. 34.—Whereas, the Commission, vide its Order No. 76/JKD-LA/2009 dated 9th July, 2012, had disqualified under Section 10A of the Representation of the People Act, 1951, Shri Arun Prasad, Vill.+Post Chainpur, P.S.-Mandu, Dist.- Ramgarh, Jharkhand, a contesting candidate for the General Election to the Jharkhand Legislative Assembly from 24- Mandu Assembly Constituency, held in the year 2009, for being chosen as, and for being a member of either House of the People or of the Legislative Assembly or Leislative Council of a State for a period of three years from 9th July, 2012 for not lodging his account of election expanses in the manner required by law.
AND, Whereas, the said Shri Arun Prasad has pereferred an appeal under Section 11 of the Representation of the People Act, 1951 against the said order and has requested for the removal of the disqualification for the reasons stated in the said appeal dated 21st October, 2014.
Whereas, the competent authority heard the aforsaid applicant to decide the appeal under section 11 of the R.P. Act, 1951 and having heard him has decided that the disqualification imposed on said Shri Arun Prasad vide order No. 76/JKD- LA/2009 dated 9th July, 2012, shall be removed with effect from 5th November, 2014 onwards.
Now, therefore, the name of Shri Arun Prasad appearing at Serial No. 18 of the Table appended with Commission's order No. 76/JKD-LA/2009 dated 9th July, 2012 shall be omitted w.e.f. 5th November, 2014.
