वार्षिक रिपोर्ट-2012-2013

वास्तुकला परिषद्‌ वास्तुविद्‌ अधिनियम, 1972 के अधीन मानव संसाधन विकास मंत्रालय, भारत सरकार के अधीन गठित किया गया एक सांविधिक निकाय है। परिषद्‌ को 31.03.2013 को समाप्त वित्तीय वर्ष के लिए परीक्षित लेखा विवरण सहित अपनी वार्षिक रिपोर्ट प्रस्तुत करने में प्रसन्नता हो रही है।

संगठनात्मक संरचनाः

वास्तुकला परिषद्‌ का प्रेसीडेंट सगंठन का प्रमुख होता है जिसके समग्र प्रभार के अधीन परिषद्‌ काम करती है। प्रो. उदय गडकरी को 01.10.2012 को तीन वर्ष की अवधि के लिए पे्रसीडेंट के रूप में चुना गया।

सांविधिक तथा अन्य समितियां :

वास्तुविद्‌ अधिनियम और उसके अधीन बनाए गए विनियमों के उद्‌देशों को पूरा करने के लिए परिषद्‌ ने सांविधिक समितियां गठित की हैं, यथा कार्यकारिणी समिति, जो परिषद्‌ के कार्यकारी प्राधिकारी के रूप में काम करती है, अनुशासन समिति, जो शिकायतों की जांच-पड़ताल करती है और वास्तुविदों के व्यावसायिक कदाचार के संबंध में जांच करती है, सलाहाकार समिति; (अपील) जो उन आवेदकों की अपीलों की सुनवाई करती है जिनके पंजीकरण के मामले परिषद्‌ द्वारा अस्वीकार कर दिए जाते हैं। इनके अलावा, विशेष/खास प्रयोजनों के लिए समय-समय पर अन्य समितियां गठित की जाती हैं।

परिषद्‌ और उसकी समितियों की बैठकेंः

रिपोर्टाधीन वर्ष के दौरान परिषद्‌ की एक बैठक हुई :- 23 जनवरी, 2013 को 59वीं बैठक।

रिपोर्टाधीन वर्ष के दौरान परिषद्‌ द्वारा लिए गए विभिन्न निर्णयों और कार्रवाइयों का सारांश नीचे दिया जा रहा है :- 1.0 वास्तुविद्‌ अधिनियम, 1972 के अधीन परिषद्‌ द्वारा रखे गए वास्तुविद्‌ रजिस्टर में नामों को फिर से चढ़ाना :

परिषद्‌ ने अपनी 59वीं बैठक में 01.02.2012 से 31.12.2012 तक की अवधि में 1997 चूककर्ता वास्तुविदों के नामों को वास्तुविद्‌ रजिस्टर में फिर से दर्ज करने का अनुमोदन प्रदान किया । इन वास्तुविदों के नाम अपेक्षित फीस प्राप्त हो जाने के बाद वास्तुविद्‌ रजिस्टर में पुनः दर्ज किए गए थे ।

2.0 निवेदन करने पर तथा निधन होने पर वास्तुविद्‌ रजिस्टर से नामों को हटाना :

परिषद्‌ ने अपनी 59वीं बैठक में वास्तुविद्‌ अधिनियम, 1972 के अनुच्छेद 29(1)(बी) के अधीन निम्नलिखित वास्तुविदों के नाम उनकी मृत्यु पर वास्तुविद्‌ रजिस्टर से हटा दिए :-

इसके अतिरिक्त परिषद्‌ ने वास्तुविद्‌ अधिनियम, 1972 के अनुच्छेद 29(1)(ए) के तहत निम्नलिखित वास्तुविदों के नाम भी उनके द्वारा निवेदन करने पर हटा दिए :-

1. श्री बिपलब नाथ, कोलकाता, (सीए/81/6431); 2. श्री हरिहर बासंतराव राज, नागपुर (सीए/75/6); 3. श्री राजेंद्र कुमार कपूर, मुंबई (सीए/75/107); 4. श्री बी.पी. नगदावने, गोंडीया (सीए/75/1153); और 5. श्री लक्षमीकांत एल. पाटकर, मुंबई (सीए/75/1839)।

3.0 अनुशासन समिति की बैठकें :

रिपोर्टाधीन वर्ष के दौरान परिषद्‌ की अनुशासन समिति की कोई बैठक नहीं हुई क्योंकि वास्तुकला परिषद्‌ नियमावली, 1973 में वर्ष 2009 में हुए संशोधन के अनुसार केंद्रीय सरकार को अनुशासन समिति का गठन करके उसे राजपत्र में अधिसूचित करना है । तथापि, माननीय मानव संसाधन विकास मंत्री को कई अनुरोधों और पत्राचार के बावजूद भी मंत्रालय ने अभी तक अनुशासन समिति का गठन नहीं किया है और इसीलिए सभी मामले लंबित पडे़ हैं ।

4.0 वास्तुविदों का पंजीकरण :

परिषद्‌ वास्तुविद्‌ अधिनियम की धारा 25 के अधीन वास्तुविद्‌ के रूप में ऐसे व्यक्ति का नाम पंजीकृत करती है, जो भारत में रहता हो या वास्तुकला का व्यावसाय करता हो और जो मान्यता प्राप्त वास्तुकलात्मक अर्हता रखता है ।

वर्ष (1 अप्रैल, 2012 से 31 मार्च, 2013) के दौरान परिषद्‌ ने वास्तुविदों के रूप में 4354 व्यक्तियों का पंजीकरण किया । इस प्रकार 31 मार्च, 2013 तक वास्तुकला परिषद्‌ में वास्तुविदों के रूप में कुल 59276 व्यक्तियों का पंजीकरण किया गया है । इस प्रकार, 31 मार्च, 2013 तक 48108 व्यक्तियों के पास वास्तुकला परिषद्‌ में वैध पंजीकरण है ।

5.0 परिषद्‌ के पदाधिकारियों का चुनाव :

दिनांक 01.10.2012 को वास्तुकला परिषद्‌ के विभिन्न पदों/कार्यालयों के लिए चुनाव हुए और जिनमें तीन वर्ष की अवधि के लिए संबंधित कार्यालयों के लिए केंद्रीय सरकार द्वारा नियुक्त चुनाव अधिकारी द्वारा निम्न व्यक्तियों को चयनित घोषित किया गया :-

श्री उदय गडकरी, अध्यक्ष/प्रेसीडेंट श्री के उदय, उपाध्यक्ष श्री आलोक रंजन, सदस्य, कार्यकारिणी समिति श्री प्रकाष देषमुख, सदस्य, कार्यकारिणी समिति श्रीमती माला मोहन, सदस्य, कार्यकारिणी समिति श्री किरन महाजनी, सदस्य, कार्यकारिणी समिति श्री राजीव मिश्रा, सदस्य, कार्यकारिणी समिति

6.0 भारतीय मानक ब्यूरो द्वारा निर्धारित राष्ट्रीय भवन संहिता (संषोधित), 2005 में वास्तुविद्‌ाें की अर्हता और सक्षमता का निर्धारण ः

भारतीय मानक ब्यूरो ने 2005 में राष्ट्रीय भवन संहिता 1995 का संषोधन किया और वास्तुविद्‌ों की सक्ष्मता और कार्यों को कम किया था तथा गैर-वास्तुविदों को वास्तुविदों के रूप में कार्य करने की अनुमति दी है। राष्ट्रीय भवन संहिता ने वास्तुविदों के व्यवसाय को राष्ट्रीय भवन कोड के अधीन विनियमित करने की कोषिष की है जोकि वास्तुविद्‌ अधिनियम, 1972 के प्रावधानों के विपरित है। परिषद्‌ और एक न्यास ''आर्किटेक्चर फॉर ऑल'' ने माननीय उच्च न्यायालय, दिल्ली के सामने इस मामले में याचिका दायर की है। 7.0 वास्तुविदों के विरूद्ध अनुशासनिक कार्रवाई :

प्रत्येक वास्तुविद्‌ से यह अपेक्षा की जाती है कि वह 2003 में संशोधित वास्तुविद्‌ (वृत्तिक आचरण) विनियमावली, 1989 के उपबंधों का पूर्णतः पालन करेगा। वास्तुविद्‌ अधिनियम में यह व्यवस्था की गई है कि यदि किसी वास्तुविद्‌ को जांच-पड़ताल और सुनवाई का अवसर प्रदान किए जाने के बाद वृत्तिक कदाचार का दोषी पाया जाता है तो उसके विरूद्ध कार्रवाई की जाएगी।

परिषद्‌ द्वारा अपनी 59वीं बैठक में वास्तुविदों के विरूद्ध व्यावसायिक अनाचार संबंधी 4 शिकायतों पर विचार किया गया जिसमें से 2 वास्तुविदों के विरूद्ध प्रथम दृष्टि में मामला पाया गया तथा मामले को विस्तृत जांच हेतु अनुशासन समिति को सौंप दिया गया।

8.0 शिक्षा-सत्र 2012-2013 में नई संस्थाओं का अनुमोदन :

रिपोर्टाधीन वर्ष के दौरान बैचलर ऑफ आर्कीटेक्चर पाठ्‌यक्रम प्रदान करने के लिए 67 नए संस्थानों को अनुमोदन प्रदान किया गया। पहले से विद्‌यमान संस्थानों में 12 नए एम. आर्की. डिग्री/स्नातकोत्तर पाठ्‌यक्रमों का अनुमोदन प्रदान किया गया।

इस प्रकार, 2012-2013 में परिषद्‌ के अनुमोदन से वास्तुकला में मान्यता प्राप्त पाठ्‌यक्रम प्रदान करने वाली संस्थानों की कुल संख्या बढ़कर 302 हो गई। छात्रों की वार्षिक प्रवेश संख्या अनुमानतः पूर्वस्नातक (यूजी) स्तर पर 19825, स्नाकोत्तर (पीजी) स्तर पर 1580 और पीएच-डी स्तर पर 30 है।

9.0 शिक्षा-सत्र 2012-2013 से आगे अनुमोदन की अवधि बढ़ानाः

वास्तुकला परिषद्‌ ने शिक्षा-सत्र 2012-2013 के लिए 67 संस्थानों के लिए बी. आर्की. और एम. आर्की पाठ्‌यक्रमों के अनुमोदन या अन्यथा की अवधि निम्नलिखित ढंग से बढ़ाईः

(i) वे संस्थाएं जिनमें 2012-2013 से आगे वर्तमान या अधिक दाखिले सहित बी. आर्की. पाठ्‌यक्रम के लिए अनुमोदन की अवधि बढ़ाई गईः 67.

(ii) वे संस्थाएं जिनमें 2012-2013 से आगे के लिए वर्तमान या अधिक दाखिले सहित एम. आर्की. पाठ्‌यक्रम के लिए अनुमोदन की अवधि बढ़ाई गईः 16.

(iii) वे संस्थाएं जिनमें वर्ष 2012-2013 के लिए कोई ''प्रवेश नहीं'' घोषित किया गया : शून्य

(iv) वे संस्थाएं जिनकी 2012-2013 हेतु 'मान्यता वापस' ली गई : शून्य

परिषद्‌ ने शिक्षा-सत्र 2013-2014 के लिए उन संस्थाओं का निरीक्षण करने की प्रक्रिया भी शुरू कर दी है जिनका निरीक्षण किया जाना है।

10.0 केंद्रीय सरकार द्वारा वास्तुविद्‌ अधिनियम, 1972 के अधीन विदेशी अर्हताओं की मान्यता :

परिषद्‌ को विदेषी यूनिवर्सिटियों द्वारा दी गई वास्तुकला डिग्री को मान्यता देने के लिए केंद्रीय सरकार से संदर्भ प्राप्त हुए हैं।

विदेशी योग्यताओं को मान्यता देने संबंधी सभी मामलों की जांच करने एवं विचार करने के लिए परिषद्‌ द्वारा विदेशी योग्यताओं को मान्यता प्रदान करने हेतु आवेदनों पर विचार करने के लिए एक समिति गठित की गई है। इस संबंध में परिषद्‌ की सिफारिशों को आगामी समय में केंद्र सरकार, मानव संसाधन विकास मंत्रालय को भेजा जाएगा।

11.0 मान्यता प्राप्त अर्हताओं वाले व्यक्तियों को वास्तुविद्‌ के रूप में पंजीकरण प्रदान करने से पूर्व वास्तुकला परिषद्‌ द्वारा वृत्तिक परीक्षा का संचालन :

परिषद्‌ ने वास्तुविद्‌ के रूप में पंजीकरण प्रदान करने से पूर्व वृत्तिक परीक्षा का संचालन करने से संबंधित मसौदा विनियमों का अनुमोदन कर दिया है। केंद्रीय सरकार का अनुमोदन प्राप्त करने के लिए विनियमों को मानव संसाधन विकास मंत्रालय, भारत सरकार को भेजा गया है।

12.0 प्रशिक्षण कार्यक्रम :

एनआईएएसए, पुणे (सीओए की एक शैक्षिक इकाई) में शिक्षकों और पेशेवर वास्तुविदों के लिए 07 प्रशिक्षण कार्यक्रम संचालित किए गए । इन कार्यक्रमों मे देषभर से 75 सहभागियों ने भाग लिया।

कार्यक्रमों का विवरण निम्न प्रकार हैः

कार्यषालाओं एवं प्रषिक्षण कार्यक्रमों में स्थलीय अनुभवों के अनेक सत्र सम्मिलित हैं। कार्यक्रमों में सम्मिलित विषय निम्न प्रकार हैं :-

1) रिसर्च मैथेडोलॉजी इन आर्किटेक्चर ( मोडयूल 1)ः 9 अप्रैल से 13 अप्रैल, 2012 समन्वयक : डॉ. आर. के. पंडित। 2) रिसर्च मैथेडोलॉजी इन आर्किटेक्चर (मोडयूल 2)ः 25 जून से 29 जून, 2012 समन्वयक : डॉ. आर. के. पंडित। 3) एप्लिकेषन ऑफ कम्प्यूटेषनल मैथड्‌स इन आर्किटेक्चर ः 2 जुलाई से 6 जुलाई, 2012 समन्वयक ः प्रो. अनिता कवाथेकर और प्रो. अनिरिध्धा जोगलेकर।

4) अर्ली फैकल्टी इंडक्षन प्रोग्राम : 30 जुलाई से 9 अगस्त, 2012 समन्वयक : डॉ. लक्ष्मी राव। 5) आर्किमेट्रीक्सः 10 दिसंबर से 14 दिसंबर, 2012 समन्वयक : डॉ आर. के. पंडित। 6) रिसर्च इन आर्किटेक्चरः 14 जनवरी से 18 जनवरी, 2013 समन्वयकः डॉ. उज्वला चक्रदेव और डॉ. लक्ष्मी राव। 7) आर्किटेक्चरल प्री. डिजाइन ः 25 फरवरी से 01 मार्च, 2013 समन्वयकः वास्तुविद नरेष शाह और वास्तुविद प्रसाद अनोरकर ।

13.0 राष्ट्रीय वास्तुकला अभिक्षमता परीक्षा :

ऐसे भावी छात्रों के लिए जो वास्तुकला पाठ्‌यक्रम में दाखिला लेने के इच्छुक हैं, उनके लिए वास्तुकला में राष्ट्रीय अभिक्षमता परीक्षा 1 मार्च, 2012 से 31 अगस्त, 2012 तक आयोजित की गई।

नाटा परीक्षा की स्थिति निम्नानुसार है :-

• विशिष्ट उम्मीदवारों की कुल संख्या : 25839 • एपाईंटमेंट की कुल संख्या : 31332 • परिणाम घोषित : 29512 • कुल उत्तीर्ण उम्मीदवार : (विषिष्ट प्रयास) 19984 • उच्चतम स्कोर : (विषिष्ट प्रयास) 165 • कुल उत्तीर्ण उम्मीदवार : (औसत पष्चात यदि लागू हो) 18193 • उच्चतम स्कोर : (औसत पष्चात यदि लागू हो,) 1517155 भाग III—खण्ड 4] भारत का राजपत्र, नवम्बर 29, 2014 (अग्रहायण 8, 1936) 14.0 राष्ट्रीय शोध-प्रबंध पुरस्कार कार्यक्रम :

वास्तुकला परिषद्‌ ने युवा प्रतिभाशाली उम्मीदवारों को प्रोत्साहित करने के लिए पूर्व-स्नातक शोध-प्रबंध परियोजनाओं हेतु सातवां राष्ट्रीय शोध-प्रबंध पुरस्कार कार्यक्रम शुरू किया। आंचलिक कार्यक्रम निम्नलिखित स्थानों पर आयोजित किए गएः-

आचंलिक जूरी के निम्नलिखित सदस्य थेः-

1. फगवाड़ा-वास्तुविद षरद पंचाल, वास्तुविद्‌ चित्रा विष्वनाथ और वास्तुविद्‌ एडगर डिमैलो। 2. सूरत-वास्तुविद्‌ इंद्रनील चैटर्जी, वास्तुविद्‌ अनूप नायक, वास्तुविद्‌ नीरा अदरकर। 3. मुंबई-वास्तुविद्‌ मोना डॉक्टर, वास्तुविद्‌ यषवंत रामामूर्ति, वास्तुविद्‌ आई एम चिष्ती। 4. मैसूर-वास्तुविद्‌ पार्थो रंजन दास, वास्तुविद्‌ रवि कदम, वास्तुविद्‌ यतिन पाण्डया। 5. उटी-वास्तुविद्‌ अनिरूद्ध पॉल, वास्तुविद्‌ षिरीष सुखात्मे, वास्तुविद्‌ सूर्या काकानी।

राष्ट्रीय जूरी का आयोजन पीलो-मूडी कॅालेज ऑफ आर्किटेक्चर, कटक में किया गया। नेषनल फाइनल के लिए जूरी के सदस्य थे-वास्तुविद्‌ जैमिनी मेहता, वास्तुविद्‌ वृंदा सौमाया एवं वास्तुविद्‌ रफीक आजम।

15.0 'वास्तुकला में महिलाएं' पर महा-सम्मेलन

'वास्तुकला में महिलाएं' पर महा-सम्मेलन (महा-कोन डब्ल्यू. आई. ए.) 24 और 25 जनवरी, 2013 को पुणे में बाल गंधर्व रंगमंदिर में इंडियन इंस्टीट्‌यूट ऑफ आर्किटेक्ट्‌स, महाराष्ट्र चेप्टर और पुणे सेंटर द्वारा संयुक्त रूप से वास्तुकला परिषद्‌ के सहयोग से आयोजित किया गया।

सम्मेलन में कार्यषालाएँ, हैरिटेज वॉक, स्थल भ्रमण एवं प्रदर्षनी तथा साथ ही साथ तीन तकनीकी सत्र एवं पैनल विचार-विमर्ष सम्मिलित था। श्री पृथ्वीराज चव्हान, माननीय मुख्यमंत्री, महाराष्ट्र उद्‌घाटन कार्यक्रम के मुख्य अतिथि थे। इस अवसर पर वास्तुविद्‌ प्रकाष देषमुख, अध्यक्ष, आई.आइ.ए. तथा प्रो. उदय गड़करी, अध्यक्ष, सीओए, तथा परिषद्‌ के सदस्यों ने भी तथा देष के कोने-कोने से आए 1000 से भी अधिक वास्तुविदों के बड़े समूह को संबोधित किया।

16.0 वास्तुकलात्मक प्रतियोगिताएंः

परिषद्‌ वास्तुकलात्मक प्रतियोगिताओं का संचालन करके अनेक प्रवर्तकों की उन्हें भवनों के निर्माण के लिए वास्तुविदों का चयन करने में सहायता करती रही है।

परिषद्‌ ने अनेक लोक प्राधिकारियों को लिखा है कि वे वास्तुविदों की नियुक्ति निविदा या बोली प्रक्रिया के जरिए न्यूनतम फीस की अदायगी के आधार पर न करके वास्तुकलात्मक प्रतियोगिता दिशा-निर्देशों के अनुसार करे। प्रवर्तकों और प्रतियोगियों ने प्रतियोगिताओं का संचालन करने मेें जब भी परिषद्‌ से दिशा-निर्देशों की आवष्यकता पड़ी उन्हें परिषद्‌ द्वारा तुरंत उपलब्ध कराया गया है।

17.0 वास्तुविद्‌ अधिनियम, 1972 और इसके अधीन तैयार विनियमों को लागू करनाः

वास्तुविद्‌ अधिनियम, 1972 की धारा 36 और 37 के अधीन वास्तुविद्‌ के रूप में अयथार्थ रूप प्रस्तुत करने के साथ-साथ वास्तुकला की पद्‌वी और शैली का दुरूपयोग निषेध है और इस का उल्लंघन एक दंडनीय अपराध है। वास्तुविद्‌ की पद्‌वी और शैली के दुरूपयोग के संबंध में शिकायत मिलने पर परिषद्‌ अनुच्छेद 39 के अधीन प्रथम श्रेणी मजिस्ट्रेट के समक्ष अपराधों का संज्ञान लेने के लिए शिकायत दर्ज कराती है।

परिषद्‌ उन व्यक्तियों के विरूद्ध मेट्रोपोलिटन मजिस्ट्रेट, नई दिल्ली में दर्ज की गई आपराधिक शिकायतों का तेजी से अनुसरण कर रही है जिन्होंने वास्तुविद अधिनियम, 1972 के उपबंधों का उल्लंघन किया है और वास्तुविद्‌ की पद्‌वी और शैली का अयथार्थ रूप प्रस्तुत या दुरूपयोग किया है। इस समय 21 शिकायतें न्यायालय के समक्ष न्यायनिर्णयन के लिए लंबित हैं।

इसके अतिरिक्त विभिन्न न्यायालयों में वास्तुविद्‌ अधिनियम, 1972 के उपबंधों को लागू करने से संबंधित और अन्य संबंधित मामलों के लगभग 103 मामले लंबित पड़े हैं जिनमें परिषद्‌ एक पक्षकार है।

18.0 प्रकाशनः

वास्तुकला परिषद्‌ द्वारा ''आर्किटेक्चर-टाइम स्पेस एंड पिपल'' नामक पत्रिका का प्र्रकाषन किया जा रहा है। यह पत्रिका निषुल्क तथा साथ ही साथ अंषदान के आधार पर प्रेषित की जा रही है। इस पत्रिका द्वारा परिषद्‌ की गतिविधियाँ तथा वास्तुकलात्मक कार्य, नवीनतम तकनीकी प्रगतियों तथा उपयोग में लाई गई उन्नत तकनीकों संबंधी विषयों के बारे में लाभप्रद सूचना प्रदान की जाती है।

हमने वास्तुकला परिषद्‌, इंडिया हैबिटेट सेंटर, कोर 6 ए, प्रथम तल, लोदी रोड, नई दिल्ली-110003 के 31 मार्च, 2013 के संलग्न तुलन-पत्र तथा 31 मार्च, 2013 को समाप्त वर्ष के आय-व्यय लेखा एवं प्राप्ति तथा अदायगी लेखा, इसमें परिषद्‌ के कार्यालयों के सभी लेखे शामिल हैं, की परीक्षा कर ली है । ये वित्तीय विवरण परिषद्‌ के प्रबंधन की जिम्मेदारी है और हमारी जिम्मेदारी लेखापरीक्षा पर आधारित इन वित्तीय विवरणों के बारे में राय व्यक्त करना है ।

ANNUAL REPORT 2012 -2013

The Council of Architecture, constituted under the Architects Act, 1972 under Ministry of Human Resource Development, Govt. of India, deems it a pleasure to present the Annual Report and Audited Statement of Accounts for the financial year ending on 31.03.2013.

Organisational Structure:

President, Council of Architecture is head of the organization under whose overall charge the Council functions. Prof. Uday Gadkari was elected as President on 01.10.2012 for a period of three years.

Statutory and Other Committees:

In order to carry out the objectives of the Act and Regulations framed thereunder, the Council constituted the statutory, committees, namely, the Executive Committee, which functions as an Executive Authority of the Council, Disciplinary Committee, which investigates the complaints and holds enquiries relating to professional misconduct of architects, Advisory Committee (Appeals), which hears the appeals of the applicants whose applications for registration are rejected. Apart from these several other committees are constituted from time to time for particular / special purposes.

Meetings of the Council and its Committees:

During the year under report, the Council during 2012-2013 met once i.e. 59th Meeting was held on 23rd January, 2013.

The various decisions and actions taken by the Council during the year under report are summarized as under:

1.0 RESTORATION OF NAMES TO THE REGISTER OF ARCHITECTS MAINTAINED BY THE COUNCIL

UNDER THE ARCHITECTS ACT, 1972:

The Council at its 59th meeting approved the restoration of names of 1997 defaulting architects, whose name were restored to the Register of Architects on receipt of requisite fee, during the period from 01.02.2012 to 31.12.2012.

2.0 REMOVAL OF NAMES FROM THE REGISTER OF ARCHITECTS DUE TO REQUEST AND DEATH :

The Council at its 59th Meeting removed the names of following architects from the Register of Architects upon their death as provided under section'29(1) (b) of the Architects Act, 1972:

Further, the Council also removed the names of following architects upon their request under section 29(1) (a) of the Architects Act, 1972:

1. Ar. Biplab Nath, Kolkata, (CA/81/6431); 2. Ar. Harihar Wasantrao Raj, Nagpur (CA/75/6); 3. Ar. Rajendra Kumar Kapur, Mumbai (CA/75/107); 4. Ar. B. P. Nagdavane, Gondia (CA/75/1153); and 5. Ar. Lakshmikant L. Patkar, Mumbai (CA/75/1839).

3.0 MEETINGS OF THE DISCIPLINARY COMMITTEE :

During the year-under report, no meeting of the Disciplinary Committee of the Council was held as under the Council of Architecture Rules, 1973 as amended in 2009 the Central Government has to constitute the same and notify in official gazette. However, despite several requests and even communications to Hon'ble Minister of HRD, till date the Ministry has not constituted the Disciplinary Committee and therefore all the cases are pending.

4.0 REGISTRATION OF ARCHITECTS :

The Council registers a person as an architect under Section 25 of the Act, who resides or carries on the profession of architecture in India and holds, a recognized architectural qualification.

During the year (1st April, 2012 to 31st March, 2013), the Council has registered 4354 persons as architects and with this as on 31st March, 2013, a total of 59276 persons have been registered as architects with Council of Architecture. As on 31st March, 2013, 48108 persons hold valid registration with the Council of Architecture.

5.0 ELECTIONS OF THE OFFICE BEARERS OF THE COUNCIL:

The elections for the various offices of the Council of Architecture were held on 01.10.2012 and following persons were declared elected by the Returning Officer appointed by the Central Government for respective offices, for a period of three years:

6.0 PRESCRIPTION OF QUALIFICATIONS AND COMPETENCE OF ARCHITECTS IN THE REVISED

NATIONAL BUILDING CODE 2005 PRESCRIBED BY BUREAU OF INDIAN STANDARDS:

The BIS has revised the National Building Code 1995 in 2005 and has reduced the competence and functions of Architects and allowed non-architects to act as Architects. The NBC also tried to regulate the profession of Architects under NBC contrary to the provisions of the Architects Act, 1972. The Council and a Trust Architecture for All have filed petitions in the matter before Hon'ble Delhi High Court.

7.0 COMPLAINTS FOR PROFESSIONAL MISCONDUCT AGAINST ARCHITECTS:

Each and every architect is required to observe and abide by the provisions of the Architects (Professional Conduct) Regulations, 1989, as amended in 2003. The Act provides for taking action against an architect who is found guilty of professional misconduct upon investigation and after providing opportunity of being heard to the Architect.

The Council at its 59th Meeting considered 4 complaints for professional misconduct against Architects out of which prima facie case was found against 2 architects and matter was referred to the Disciplinary Committee for detailed investigation.

8.0 APPROVAL OF NEW INSTITUTIONS IN THE ACADEMIC SESSION 2012 – 2013:

During the year under report 67 institutions were granted approval to impart Bachelor of Architecture Courses. 12 existing institutions were granted approval for M.Arch. Degree course.

With this, the total number of institutions imparting recognized courses in architecture with the approval of Council has risen to 302 in 2012-2013. The annual intake of students (approx.) Undergraduate (UG) level is 19825, Postgraduate (PG) level is 1580 and at Ph.D is 30.

9.0 EXTENSION OF APPROVAL FOR THE ACADEMIC SESSION 2012-2013 ONWARDS:

Council of Architecture granted extension of approval or otherwise for B.Arch. & M.Arch. Courses to 67 institutions for the academic session 2012-2013 as under:

i) Institutions granted extension of approval for B.Arch. Course for 2012-2013 onwards with existing or higher intake: 67.

ii) Institutions granted extension of approval for M.Arch. Course for 2012-2013 onwards with existing or higher intake: 16.

iii) Institutions put on 'No Admission' for 2012-2013: NIL iv) Institutions put on 'Withdrawal of recognition' for 2012-2013: NIL

The Council has also initiated the process of inspection for the academic session 2013-2014 of institutions, which are due for inspections.

10.0 RECOGNITION OF FOREIGN QUALIFICATIONS UNDER THE ARCHITECTS ACT, 1972, BY THE

CENTRAL GOVERNMENT:

The Council has received references from the Central Government for recognition of Architectural Degree awarded by foreign Universities. A committee for considering requests of Recognition of Foreign Qualifications has been constituted by the Council to examine and consider all cases relating to recognition of foreign qualifications. Recommendations of the Council in respect of the same shall be sent to the Central Government in the Ministry of HRD in due course.

11.0 CONDUCT OF PROFESSIONAL EXAMINATION BY THE COUNCIL OF ARCHITECTURE BEFORE

GRANTING REGISTRATION AS AN ARCHITECT TO PERSONS POSSESSING RECOGNISED

QUALIFICATIONS:

The Council approved the Draft Regulations for conduct of Professional Examination by it before registering any person as an architect. The Regulations have been sent to the Ministry of Human Resource Development, govt. of India, for conveying the approval of the Central Government.

12.0 TRAINING PROGRAMMES :

07 training programmes for teachers and professional Architects were conducted at NIASA, Pune (an academic unit of COA). The programmes were attended by 75 participants across the country.

The details of the programmes are as follows:

13.0 NATIONAL APTITUDE TEST IN ARCHITECTURE :

National Aptitude Test in Architecture was offered from 1st March, 2012 till 31st August, 2012 to prospective candidates looking forward to take up Architecture as career.

The Status of the NATA Examination is as follows:

14.0 NATIONAL THESIS AWARDS PROGRAM :

The Council initiated the Seventh National Thesis Awards Program for undergraduate thesis projects to encourage the young talent. The zonal juries were held at the following places:

5. Ooty - Ar. Anirudh Paul, Ar. Shirish Sukhatme, Ar. Surya Kakani.

The National Jury was held at Piloo-Mody College of Architecture, Cuttak. The members of Jury for National finals were Ar. Jaimini Mehta, Ar. Brinda Somaya, Ar. Rafiq Azam.

15.0 MAHA-CONFERENCE ON "WOMEN IN ARCHITECTURE":

Maha-Conference on "Women in Architecture" (Mahacon-WiA) was organised by Indian Institute of Architects, Maharashtra Chapter and Pune Center, jointly with the Council of Architecture, in Pune on the 24th and 25th January 2013 at the Bal Gandharva Rangamandir.

The conference included workshops, heritage walk, site visit and exhibition in addition to three technical sessions and a panel discussion. Shri Prithviraj Chavan, Hon'ble Chief Minister Maharashtra was the Chief Guest of the inaugural function. Ar. Prakash Deshmukh, President, IIA and Prof. Uday Gadkari, President COA, addressed a large gathering of over 1000 architects from all over India on this occasion and also by members of the Council.

13.0 ARCHITECTURAL COMPETITIONS:

The Council is assisting a number of promoters for the conduct of the architectural design competitions for selection of architects for construction of their buildings.

The Council also wrote to several public authorities to appoint architects as per Architectural Competition Guidelines and not to appoint through tender or bid process on payment of lowest fee. The guidelines and inputs required by the promoters and competitors from the Council in the conduct of the competitions were also made available as and when requests were received.

16.0 ENFORCEMENT OF THE ARCHITECTS ACT, 1972 AND REGULATIONS FRAMED THEREUNDER :

Sections 36 and 37 of the Architects Act, 1972, impose prohibition on misrepresentation as an architect as well as misuse of title and style of architect and violation of the prohibition is a punishable offence. Upon receipt of the complaints of misuse of title and style of architect, the Council files complaints u/s 39 before the First Class Magistrate for taking cognizance of the offences.

The Council is vigorously pursuing such criminal complaints filed before the Metropolitan Magistrate in New Delhi, against persons who have violated the provisions of the Architects Act, 1972 and misrepresented or misused the title and style of architect. Presently about 21 complaints are pending for adjudication before the Court.

Further, a total of about 103 cases are pending in different courts relating to enforcement of the provisions of the Architects Act, 1972 and other related matters where Council is one of the parties.

17.0 PUBLICATIONS

Council of Architecture has been publishing a magazine titled "architecture - time space & people". This magazine is being sent free of cost as well as on subscription basis. It provides useful information about the activities of the Council and issues concerning architectural profession and latest technological advancements and innovations applied.

The Council is printing and publishing this magazine with assistance of M/s. Lifestyle Media, New Delhi. The Council is likely to published its Directory of Architects and Handbook of Professional Documents.

18.0 ACKNOWLEDGEMENTS

The Council is functioning with skeleton staff strength and carrying out its statutory functions efficiently on all India level out of its own resources. The Council would like to place on record its appreciation and gratitude to the Central Government, all State Governments and all Schools of Architecture, for extending their cooperation to Council in implementation of the Architects Act, 1972. The Council also expresses its gratitude to the office bearers and members of the Council of Architecture, Experts, Auditor, Advocates, other professional bodies, practising architects, academicians and all advertisers for their cooperation, guidance, advice and support for furthering the objectives of the Architects Act, 1972.

These financial statements are the responsibility of the management of the Council. Our responsibility is to express an opinion on these financial statements based on our audit.

We have conducted the audit in accordance with the Auditing Standards generally accepted in India. These standards require that we plan and perform the audit to obtain reasonable assurance about whether the financial statements are free from material misstatements. An audit includes examining, on a test basis, evidence supporting the amounts and disclosures in the financial statements. An audit also includes assessing the accounting principles used and significant estimates made by the managment, as well as evaluating the overall financial statements presentation.
