सा.का.नि. 266.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारतीय लेखा परीक्षा और लेखा विभाग में सेवा कर रहे व्यक्तियों के संबंध् में भारत के नियंत्राक-महालेखापरीक्षक से परामर्श करने के पश्चात्् केंद्रीय सिविल सेवा ;पेंशनद्ध नियम, 1972 का और संशोध्न करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात् :—
1. ;1द्ध इन नियमों का संक्षिप्त नाम केंद्रीय सिविल सेवा ;पेंशनद्ध ;पांचवा संशोध्नद्ध नियम, 2014 है ।
;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. केंद्रीय सिविल सेवा ;पेंशनद्ध नियम, 1972 के नियम 9 में उप-नियम ;5द्ध के पश्चात्् निम्नलिखित उप-नियमों को अंतःस्थापित किया जाएगा, अर्थात्ः-
'';5कद्ध राष्ट्रपति किसी भी समय, स्वप्रेरणा से या अन्यथा, किसी जांच के अभिलेखों को मांग सकते हैं और इन नियमों के अध्ीन किए गए किसी आदेश की, संघ लोक सेवा आयोग से परामर्श करने के पश्चात््, पुनरीक्षा कर सकते हैं और आदेश की पुष्टि, उपांतरण या अपास्त कर सकते हैं, या किसी प्राध्किारी को यह निर्देश देते हुए विप्रेषित कर सकते हैं कि वह आगे ऐसी जांच करे जो वह मामले की परिस्थितियों में उपयुक्त समझे, या ऐसे अन्य आदेशों को पारित कर सकते हैं जिन्हें वह ठीक समझें।

;5खद्ध ऐसी परिशमनकारी या विशेष परिस्थितयां जो पुनर्विलोकन के लिए समुचित आधर हैं या कोई नई सामग्री या साक्ष्य जिसे पुनरीक्षाध्ीन आदेश के पारित किए जाने के समय प्रस्तुत नहीं किया जा सका था, या उपलब्ध् नहीं थी और जो मामले के स्वरूप में परिवर्तन करने का प्रभाव रखती हैं, के नोटिस में आने या लाए जाने पर, राष्ट्रपति किसी भी समय, स्वप्रेरणा से या अन्यथा इन नियमों के अध्ीन पारित किसी आदेश का पुनर्विलोकन कर सकते हैंः

G. S. R. 266.-—In exercise of the powers conferred by the proviso to article 309 and after consultation with the Comptroller and Auditor General in relation to persons serving in the Indian Audit and Accounts Department, the President hereby makes the following rules further to amend the Central Civil Services (Pension) Rules, 1972, namely :—
1. (1) These rules may be called the Central Civil Services (Pension) (Fifth Amendment) Rules, 2014.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Central Civil Services (Pension) Rules, 1972, in rule 9, after sub-rule (5), the following sub-rules shall be inserted, namely:—
"(5A) The President may at any time, either on his own motion or otherwise call for the records of any inquiry and revise any order made under these rules, after consultation with the Union Public Service Commission, and may confirm, modify or set aside the order; or remit the case to any authority directing such authority to make such further enquiry as it may consider proper in the circumstances of the case; or pass such other orders as he may deem fit.
1594 THE GAZETTE OF INDIA : DECEMBER 27, 2014/PAUSA 6, 1936 [[PART II—SEC. 3(i)]Provided that no order enhancing the amount of the pension or gratuity to be withheld or withdrawn, shall be made by the President unless the Government servant concerned has been given a reasonable opportunity of making a representation against the order proposed and except after consultation with the Union Public Service Commission, "(5B) The President may at any time, either on his own motion or otherwise review any order passed under these rules, where extenuating or special circumstances exist to warrant such review or when any new material or evidence which could not be produced or was not available at the time of passing the order under review and which has the effect of changing the nature of the case, has come, or has been brought, to his notice.
Provided that no order enhancing the amount of the pension or gratuity to be withheld or withdrawn, shall be made by the President unless the Government servant concerned has been given a reasonable opportunity of making a representation against the order proposed and except after consultation with the Union Public Service Commission."
