सा.का.नि. 124.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और लाल बहादुर शास्त्राी राष्ट्रीय प्रशासन अकादमी ;कैंटीन पदद्ध भर्ती नियमावली, 2001 को, जहां तक उन का संबंध् हलवाई, रसोइया चाय/कापफी बनाने वाला बैरा और वाश बॉय के पदों से, उन बातों के सिवाय अध्क्रिांत करते हुए, जिन्हें ऐसे अध्क्रिमण से पहले किया गया है या करने का लोप किया गया है, हलवाई-सह-रसोइया, सहायक हलवाई-सह-रसोइया और कैंटीन परिचर के पदों पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम कामक लोक, शिकायत और पेंशन मंत्राालय, कामक और प्रशिक्षण विभाग, लाल बहादुर शास्त्राी राष्ट्रीय प्रशासन अकादमी, मसूरी ;हलवाई-सह-रसोइया, सहायक हलवाई-सह-रसोइया और कैंटीन परिचरद्ध भर्ती नियम, 2015 है ।

2. लागू होना.- ये नियम और इन नियमों से उपाब( अनुसूची के स्तम्भ ;iद्ध में विनिर्दिष्ट पदों के संबंध् में लागू होंगे ।

3. पदों की संख्या, वर्गीकरण, वेतन बैंड, ग्रेड वेतन या वेतनमान.—पद संख्या, उनका वर्गीकरण तथा वेतन बैंड और ग्रेड वेतन या वेतनमान वे होंगे, जो इन नियमों से उपाब( अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

4. भर्ती की प(ति, आयु-सीमा, अर्हताएं, आदि.—भर्ती की प(ति, आयु-सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;13द्ध में विनिदष्ट हैं ।

5. निरर्हताएँ .—वह व्यक्ति —

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है या विवाह की संविदा की हैऋ या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है या विवाह की संविदा की है,

उक्त पदों पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

7. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

1.हलवाई- 1*;2015द्ध साधरण केन्द्रीय वेतन बैंड-1, अचयन 18-25 वर्ष सह-रसोइया *कार्यभार के सेवा, ;समूह 'ग'द्ध 5200-20200 रु. ;केंद्रीय सरकार द्वारा जारी किए गए आधर पर अराजपत्रिात, ग्रेड वेतन आदेशों के अनुसार सरकारी सेवकों परिवर्तन किया अननुसचिवीय 2000 रु. के लिए साधरण अभ्यर्थियों की दशा में शिथिल करके 40 वर्ष तक तथा अनुसूचित जा सकता है। जातियों और अनुसूचित जनजातियों के अभ्यर्थियों की दशा में शिथिल करके 45 वर्ष तक की जा सकती हैद्ध।

टिप्पण 1ः- आयु-सीमा अवधारित करने के लिए निर्णायक तारीख वह अंतिम तारीख होगी जिस तक रोजगार कार्यालय से नाम भेजने के लिए कहा गया है।

टिप्पण 2 : यदि पद रोेजगार समाचार या समाचार पत्रा में विज्ञापित किया जाता है तो आयु-सीमा अवधरित करने के लिए निर्णायक तारीख वह अंतिम तारीख होगी जिस तक रोजगार कार्यालय से नाम भेजने के लिए कहा गया है ।

सीध्े भर्ती किए जाने वाले व्यक्तियों के लिए सीध्े भर्ती किए जाने वाले परिवीक्षा की अवध्,ि यदि कोई हो अपेक्षित शैक्षिक और अन्य अर्हताएं

व्यक्तियों के लिए विहित आयु और शैक्षिक अर्हताएं प्रोन्नत व्यक्तियों की दशा में लागू होंगी या नहीं

आवश्यक : किसी मान्यता प्राप्त बोर्ड या संस्थान से दसवीं कक्षा उत्तीर्ण सहित खान पान में प्रमाण पत्रा या डिप्लोमा ।

;खद्ध खाना पकाने संबंध्ी व्यवसाय कौशल परीक्षण अभ्यर्थी की उपयुक्तता का मूल्यांकन करने के लिए संचालित किया जाएगा ।

वांछनीय :

किसी सरकारी विभाग/उपक्रम में सहायक हलवाई-सह रसोइया या समतुल्य के रूप में दो वर्ष का अनुभव रखने वाले व्यक्ति को अध्मिानता दी जाएगी ।

टिप्पण 2 : अनुभव संबध्ी अर्हता ;अर्हताएं द्धसक्षम प्राध्किारी के विवेकानुसार अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तब शिथिल की जा सकती है, जब चयन के किसी प्रक्रम पर सक्षम प्राध्किारी की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध् होने की संभावना नहीं है ।

भर्ती की प(ति : भर्ती सीध्े होगी या प्रोन्नति द्वारा या प्रतिनियुक्ति प्रोन्नति या प्रतिनियुक्ति या आमेलन द्वारा भर्ती की दशा में वे श्रेणियां, या आमेलन द्वारा तथा विभिन्न प(तियों द्वारा भरी जाने वाली जिनसे प्रोन्नति या प्रतिनियुक्ति या आमेलन किया जाएगा रिक्तियों की प्रतिशतता

प्रोन्नति जिसके न हो सकने पर प्रतिनियुक्ति द्वारा प्रोन्नति : ऐसा सहायक हलवाई-सह-रसोइया जिसने वेतन बैंड-1, और दोनों के न हो सकने पर सीध्ी भर्ती द्वारा । 5200-20200 रु. ग्रेड वेतन 1900 रु. में कम से कम तीन वर्ष नियमित

सेवा की है ।

टिप्पण 1ः-प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना करने के प्रयोजन के लिए किसी अध्किारी द्वारा 01 जनवरी, 2006 से पहले या उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को उक्त वेतन आयोग की सिपफारिशों पर आधरित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान में की गई सेवा समझी जाएगी ।

टिप्पण 2ः-जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में, जिन्होंने अपनी अर्हक या पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा988 THE GAZETTE OF INDIA : JULY 4, 2015/ASADHA 13, 1937 [PART II—SEC. 3(i)] ;11द्ध रहा हो, वहां उनके ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परंतु यह तब जब कि उनके द्वारा की गई ऐसी अर्हक या पात्राता सेवा अपेक्षित अर्हक या पात्राता सेवा के आध्े से अध्कि से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक या प्रोन्नति के लिए अपनी परिवीक्षा की अवध् िसपफलतापूर्वक पूरी कर ली हो ।

प्रतिनियुक्ति :-केन्द्रीय सरकार के ऐसे अध्किारी :

;कद्ध ;iद्ध जो नियमित आधर पर सदृृश पद धरण किए हुए हैंऋ या

;iiद्ध ऐसा सहायक हलवाई-सह-रसोइया जिसने वेतन बैंड-1, 5200-20200 रु. ग्रेड वेतन 1900 रुपये कम से कम तीन वर्ष नियमित सेवा की है, और

;खद्ध जिनके पास निम्नलिखित अर्हताएं और अनुभव है :-

;iद्ध किसी मान्यताप्राप्त बोर्ड या संस्थान से दसवीं कक्षा उत्तीर्ण सहित खान पान में प्रमाण पत्रा या डिप्लोमा ।

;iiद्ध किसी सरकारी विभाग या उपक्रम में दो वर्ष का अनुभव रखने वाले व्यक्ति को अध्मिानता दी जाएगी ।

टिप्पण 1ः-प्रतिनियुक्ति की अवध्,ि जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धरित किसी अन्य काडर बाह्‌य पद पर प्रतिनियुक्ति की अवध् ि है साधरणतया तीन वर्ष से अध्कि नहीं होगी ।

टिप्पण 2ः-प्रतिनियुक्ति द्वारा नियुक्ति के लिए अध्कितम आयु-सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अध्कि नहीं होगी।

टिप्पण 3ः-पोषक प्रवर्ग के ऐसे विभागीय अध्किारी, जो प्रोन्नति की सीधी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे ।

टिप्पण 4ः-प्रतिनियुक्ति के आधर पर नियुक्ति के प्रयोजन केे लिए किसी अध्किारी द्वारा 01 जनवरी, 2006 से पहले या उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को उक्त आयोग की सिपफारिशों के आधर पर विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान में की गई सेवा समझा जाएगा । सिवाय उस दशा के, जहां एक से अध्कि पूर्व पुनरीक्षित वेतनमान का साधरण ग्रेड वेतन या वेतनमान सहित एक श्रेणी में विलय हो गया है और वहां यह लाभ केवल उस पद ;उन पदोंद्ध पर विस्तारित होगा, जिसके लिए ग्रेड वेतन या वेतनमान बिना किसी उन्नयन का साधरण प्रतिस्थापन ग्रेड है उक्त वेतन आयोग की सिपफारिशों पर आधरित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी ।

हलवाई/रसोइया के सहायक के रूप में एक वर्ष का अनुभव ।

;गद्ध खाना पकाने जिसमें स्वच्छता आदि बनाए रखना भी है, के लिए संबंध्ी व्यवसाय कौशल परीक्षण अभ्यर्थी की उपयुक्तता का निर्धरण विभागीय प्रोन्नति समिति संचालित किया जाएगा ।

G.S.R.124 .—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Lal Bahadur Shastri National Academy of Administration (Canteen Posts) Recruitment Rules, 2001, in so far as they relate to the posts of Halwai, Cook, Tea/Coffee Maker, Bearers and Wash Boy, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Halwai-cum-Cook, Assistant Halwai-cum-Cook and Canteen Attendant, namely:-

1. Short title and commencement.— (1) These rules may be called the Ministry of Personnel, Public Grievances and Pensions, Department of Personnel and Training, Lal Bahadur Shastri National Academy of Administration, Mussoorie (Halwai-cum-Cook, Assistant Halwai-cum-Cook and Canteen Attendant) Recruitment Rules, 2015.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application.—These rules shall apply to the posts specified in column (1) of the Schedule annexed to these rules.

3. Number of posts, classification, pay band and grade pay or pay scale.— The number of the post, their classification and the pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the said Schedule.

4. Method of recruitment, age-limit, qualifications, etc.— The method of recruitment, age-limit, qualifications and other matters relating to the said posts shall be as specified in columns (5) to (13) of the said Schedule.

5. Disqualifications.— No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

6. Power to relax.— Where the Central Government is of the opinion that it is necessary or expedient so to do, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

7. Saving.— Nothing in these rules shall affect reservation, relaxation of age-limit, and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note 1: For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to 1st January, 2006 or the date from which the revised pay structure based on the Sixth Central Pay Commission recommendations has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the said Commission.

(ii) Assistant Halwai-cum-Cook with at least three years regular service in the pay band- 1, Rs. 5200-20200 plus grade pay of Rs. 1900; and

(b) possessing the following qualifications and experience:

(i) 10th class pass with a certificate or diploma in catering from a recognized Board or Institute;

(ii) two years experience in a Government Department or Undertaking preferred.

Note1: The period of deputation including period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organisation or Department of the Central Government shall ordinarily not exceed three years.

Note 2: The maximum age-limit for appointment is 56 years as on the closing date of receipt of application.

Note 3: The departmental officials in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation. Similarly, deputationists shall not be eligible for consideration for appointment by promotion.

4. भर्ती की प(ति, आयु-सीमा, अर्हताएं, आदि.—उक्त पदों पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से ;13द्ध में विनिदष्ट हैं ।

5. निरर्हता .—वह व्यक्ति, —

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया हैऋ या

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह, उस व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध् िके अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके, तथा संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध् को, किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

7. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछडे़ वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

टिप्पण 1ः- जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में, जिन्होंने अपनी अर्हक या पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो, वहां उनसे ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परंतु यह तब जब कि उनके द्वारा की गई ऐसी अर्हक या पात्राता सेवा अपेक्षित अर्हक या पात्राता सेवा के आध्े से अध्कि से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक या पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध्ि सपफलतापूर्वक पूरी कर ली हो ।

टिप्पण 2ः-प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना करने के प्रयोजन के लिए किसी अध्किारी द्वारा 01 जनवरी, 2006 से पहले या उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को उक्त वेतन आयोग की सिपफारिशों के आधर पर विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान में की गई सेवा समझी जाएगी ।

टिप्पण :-पोषक प्रवर्ग के ऐसे विभागीय अध्किारी, जो प्रोन्नति की सीधी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे ।

टिप्पण 1ः- जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में, जिन्होंने अपनी अर्हक या पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो, वहां उनके ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परंतु यह तब जब कि उनके द्वारा की गई ऐसी अर्हक या पात्राता सेवा अपेक्षित अर्हक या पात्राता सेवा के आध्े से अध्कि से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक या पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध्ि सपफलतापूर्वक पूरी कर ली हो ।

66.67 प्रतिशत प्रोन्नति द्वारा जिसके न हो सकने पर प्रतिनियुक्ति प्रोन्नति :- ;जिसके अंतर्गत अल्पकालिक संविदा भी हैद्ध द्वारा ऐसे ज्येष्ठ तकनीकी सहायक श्रेणी-2 ;सहकारिता/ट्टणद्ध जिन्होंने वेतन 33.33 प्रतिशत प्रतिनियुक्ति ;जिसके अंतर्गत अल्पकालिक संविदा बैंड-2, 9300-34800 रु. ग्रेड वेतन 4200 रु.सहित या समतुल्य में उस भी हैद्ध द्वाराऋ श्रेणी में आठ वर्ष नियमित सेवा की है और सहकारिता या ट्टण क्षेत्रा में जिसके न हो सकने पर सीध्े भर्ती द्वारा 2 से 4 सप्ताह का प्रशिक्षण सपफलतापूर्वक पूरा किया हो ।

टिप्पण 1ः- जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में, जिन्होंने अपनी अर्हक या पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो, वहां उनसे ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परंतु यह तब जब कि उसके द्वारा की गई ऐसी अर्हक या पात्राता सेवा अपेक्षित अर्हक या पात्राता सेवा के आध्े से अध्कि से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक या पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध्ि सपफलतापूर्वक पूरी कर ली हो ।

G.S.R. 125 .—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Department of Agriculture and Cooperation Senior Technical Assistant (Credit) Recruitment Rules, 1988; the Department of Agriculture and Cooperation Senior Technical Assistant (Cooperation) Recruitment Rules, 1988; and the Department of Agriculture and Cooperation, Chief Director, Deputy Chief Director, Director, Deputy1014 THE GAZETTE OF INDIA : JULY 4, 2015/ASADHA 13, 1937 [PART II—SEC. 3(i)] Director and Assistant Director in the Cooperation and Credit Division Recruitment Rules, 1994, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to Group 'A' and Group 'B' posts in the Ministry of Agriculture, Department of Agriculture and Cooperation, Cooperation and Credit Division, namely:-

1. Short title and commencement.— (1) These rules may be called the Ministry of Agriculture, Department of Agriculture and Cooperation (Cooperation and Credit Division), Group 'A' and Group 'B' Technical posts Recruitment Rules, 2015.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application.— These rules shall apply to the posts specified in column (1) of the Schedule annexed to these rules.

3. Number of posts, classification, pay band and grade pay or pay scale.— The number of said posts, their classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the aforesaid Schedule.

4. Method of recruitment, age limit, qualifications, etc.—The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.

5. Disqualifications:— No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other, grounds for so doing, exempt any person from the operation of this rule.

6. Power to relax.— Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

7. Saving.— Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

सा.का.नि. 127.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए स्वास्थ्य सेवाएं महानिदेशालय ;जैव चिकित्सा इंजीनियर और ज्येष्ठ जैव चिकित्सा इंजीनियरद्ध समूह 'क' पद भर्ती नियम, 2013 को, उन बातों के सिवाय अध्क्रिांत करते हुए, जिन्हें ऐसे अध्क्रिमण से पहले किया गया है या करने का लोप किया गया है, स्वास्थ्य सेवां महानिदेशालय के केंद्रीय औषध्ि मानक नियंत्राण संगठन में जैव चिकित्सा इंजीनियर और ज्येष्ठ जैव चिकित्सा इंजीनियर के पदों पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम स्वास्थ्य सेवाएं महानिदेशालय ;जैव चिकित्सा इंजीनियर और ज्येष्ठ जैव चिकित्सा इंजीनियरद्ध समूह 'क' पद भर्ती नियम, 2015 है ।

;2द्ध ये राजपत्रा में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. ये नियम इन नियमों से उपाब( अनुसूची के स्तम्भ ;1द्ध में विनिर्दिष्ट पदों को लागू होंगे ।

3. पदों की संख्या, वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान.— पद की संख्या, उनका वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान वे होंगे, जो इन नियमों से उपाब( अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

4. भर्ती की प(ति, आयु-सीमा, अर्हताएं आदि.—उक्त पदों पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से ;13द्ध में विनिदष्ट हैं ।

5. निरर्हता : वह व्यक्ति :—

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :-

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध् िके अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके, तथा संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

7. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछडे़ वर्गों भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

G.S.R.127 .— In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Directorate General of Health Services (Bio- medical Engineer and Senior Bio-medical Engineer) Group 'A' Posts Recruitment Rules, 2013, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Bio-medical Engineer and Senior Bio-medical Engineer in the Central Drugs Standard Control Organisation, Directorate General of Health Services, namely: -

1. Short title and commencement. — (1) These rules may be called the Directorate General of Health Services (Bio-medical Engineer and Senior Bio-medical Engineer) Group 'A' Posts Recruitment Rules, 2015.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application. — These rules shall apply to the posts specified in column (1) of the Schedule annexed to these rules.

3. Number of post, classification, pay band and grade pay or pay scale. — The number of said posts, their classification, the pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the said Schedule.

4. Method of recruitment, age-limit, qualifications, etc. — The method of the recruitment, age-limit, qualifications and other matters relating to the said posts shall be as specified in columns (5) to (13) ofthe said Schedule.

5. Disqualification. — No person,

(a) who, has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said posts:

6. Power to relax. — Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, in consultation with the Union Public Service Commission, and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

7. Saving.— Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note 1: Qualifications are relaxable at the discretion of the Union Public Service Commission for reasons to be recorded in writing, in case of candidates otherwise well qualified.

Note 2: The qualifications regarding experience are relaxable at the discretion of the Union Public Service Commission, for reasons to be recorded in writing, in the case of candidates belonging to the Scheduled Castes or the Scheduled Tribes if, at any stage of selection, the Union Public Service Commission is of the opinion that sufficient number of candidates from these communities possessing the requisite experience are not likely to be available to fill up the posts reserved for them.

(iii) with six years' service in the grade rendered after appointment thereto on a regular basis in the pay band- 2, Rs.9300-34800 with grade pay of Rs.4800 or equivalent in the parent cadre or department; and

(b) possessing the educational qualifications and experience prescribed for direct recruits under column (7).

Note 1: Period of deputation (including short-term contract) including the period of deputation (including short-term contract) in another ex-cadre post held immediately preceding this appointment in the same or some other organisation or department of the Central Government shall not exceed four years.

Note 2: The maximum age-limit for appointment by deputation (including short-term contract) shall not be exceeding 56 years as on the closing date of receipt of applications.

Note 3: For the purpose of appointment on deputation basis, the service rendered on a regular basis by an officer prior to 1st January, 2006 or the date from which the revised pay structure based on the Sixth Central Pay Commission recommendations has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the said Pay Commission, except where there has been merger of more than one pre-revised scale of pay into one grade with a common grade pay or pay scale, and where this benefit will extend only for the post(s) for which that grade pay or pay scale, is the normal replacement grade without any upgradation.
