का.नि.आ. 26.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारतीय सैन्य अकादमी ;वेतन और लेखा अध्किारी, श्रेणी I और श्रेणी IIद्ध भर्ती नियम, 1984 को, उन बातों के सिवाय अध्क्रिांत करते हुए, जिन्हें ऐसे अध्क्रिमण से पहले किया गया है या करने का लोप किया गया है, रक्षा मंत्राालय के सेना प्रशिक्षण निदेशालय के अध्ीन भारतीय सेना अकादमी, देहरादून में वेतन और लेखा अध्किारी, श्रेणी I और वेतन और लेखा अध्किारी, श्रेणी II के पदों पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम रक्षा मंत्राालय, भारतीय सेना अकादमी, देहरादून ;वेतन और लेखा अध्किारी, श्रेणी I और वेतन और लेखा अध्किारी, श्रेणी IIद्ध भर्ती नियम, 2015 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. लागू होना.—ये नियम इन नियमों से उपाब( अनुसूची के स्तम्भ ;1द्ध में विनिर्दिष्ट पदों पर लागू होेंगे ।

3. पद संख्या, वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान.—पद संख्या, उनका वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान वे होंगे, जो उक्त अनुसूची के स्तम्भ ;2द्ध से स्तम्भ ;4द्ध में विनिदष्ट हैं ।

5. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से, जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है या विवाह की संविदा की है, या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है या विवाह की संविदा की हैऋ

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके, तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

7. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

;iiiद्ध जिन्होंने केन्द्रीय सरकार के किसी संगठित लेखा विभाग द्वारा संचालित अध्ीनस्थ लेखा सेवा या समतुल्य परीक्षा उत्तीर्ण किया है ।

टिप्पण 1 : बाह्‌य व्यक्तियों के साथ वेतन बैंड-2, वेतनमान 9300—34800 रुपए + ग्रेड वेतन 4600 रुपए में ऐसे विभागीय वेतन और लेखा अध्किारी पर भी विचार किया जाएगा जिन्होंने नियमित आधर पर नियुक्ति के पश्चात्‌ उस श्रेणी में तीन वर्ष सेवा की है और यदि उस पद पर नियुक्ति के लिए उसका चयन कर लिया जाता है तो वह पद प्रोन्नति द्वारा भरा समझा जाएगा ।

टिप्पण 2ः प्रतिनियुक्ति की अवध् िजिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धरित किसी अन्य काडर बाह्‌य पद पर प्रतिनियुक्ति की अवध् िहै साधरणतया तीन वर्ष से अध्कि नहीं होगी ।

टिप्पण 3ः-प्रतिनियुक्ति द्वारा नियुक्ति के लिए अध्कितम आयु-सीमा आवेदन प्राप्त करने की अंतिम तारीख को छप्पन वर्ष से अध्कि नहीं होगी ।

;खद्ध जिनके पास केन्द्रीय सरकार के किसी विभाग/कार्यालय से रोकड़, लेखा और बजट कार्य में तीन वर्ष का अनुभव है ।

टिप्पण 1 : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में, जिन्होंने अपनी अर्हक या पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो, जहां उनके ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परंतु यह तब जब कि उनके द्वारा की गई ऐसी अर्हक या पात्राता सेवा अपेक्षित अर्हक या पात्राता सेवा के आध्े से अध्कि से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक या पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध् िसपफलतापूर्वक पूरी कर ली हो ।

टिप्पण 2 : प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना करने के प्रयोजन के लिए किसी अध्किारी द्वारा 01 जनवरी, 2006 से पहले या उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को उक्त वेतन आयोग की सिपफारिशों पर आधरित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान में की गई सेवा समझी जाएगी ।

प्रतिनियुक्ति :

केन्द्रीय सरकार के अध्ीन ऐसे अध्किारी :

;iiiद्ध जिनके पास भारत सरकार के किसी विभाग/कार्यालय में रोकड़, लेखा और बजट कार्य में तीन वर्ष का अनुभव है ।

टिप्पण 1 : पोषक प्रवर्ग के ऐसे विभागीय अध्किारी, जो प्रोन्नति की सीधी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे ।

टिप्पण 2 : प्रतिनियुक्ति की अवध्,ि जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धरित किसी अन्य काडर बाह्‌य पद पर प्रतिनियुक्ति की अवध् िहै, साधरणतया तीन वर्ष से अध्कि नहीं होगी ।

New Delhi, the 8th July, 2015

S.R.O. 26.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Indian Military Academy (Pay and Accounts Officers, Grade I and Grade II) Recruitment Rules, 1984, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Pay and Accounts Officer, Grade I and Pay and Accounts Officer, Grade II, in the Indian Military Academy, Dehradun under the Military Training, Directorate of Ministry of Defence, namely :—

1. Short title and commencement.—(1) These rules may be called the Ministry of Defence, Indian Military Academy, Dehradun (Pay and Accounts Officer, Grade I and Pay and Accounts Officer, Grade II) Recuritment Rules, 2015.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application.—These rules shall apply to the posts specified in column (1) of the Schedule annexed to these rules.

3. Number of post, classification, pay band and grade pay or pay scale.—The number of the said posts, their classification and the pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the said Schedule.

4. Method of recruitment, age-limit, other qualifications, etc.—The method of recruitment, age-limit, qualifications and other matters relating to the said post shall be as specified in columns (5) to (13) of the said Schedule.

5. Disqualification.—No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who having a spouse living, has entered into or contracted a marriage with any person;

shall be eligible for appointment to the said posts :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rules.

6. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

7. Saving.—Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen and other special categories of persons, in accordance with the orders issued by the Central Government from time to time in this regard.

(i) undergone training in the cash and accounts work from the Institute of Secretariat Training and Management or equivalent; and

(ii) possess experience in cash, accounts and

budget work from any departments/offices under Government of India; or

(iii) passed in the Subordinate Accounts Service or equivalent examination conducted by any of the organised accounts departments of the Central Government.

Note 1 : The Departmental Pay and Accounts Officer Grade II in the Pay Band-2, Rs. 9300–34800 plus grade Pay of Rs. 4600 with three years service in the grade rendered after appointment thereto on regular basis shall also be considered alongwith outsiders and in case he is selected for appointment to the post, the same shall be deemed to

have been filled by promotion.

Note 2 : Period of deputation including the period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organisation or department of the Central Government shall ordinarily not to exceed three years.

Note 3 : The maximum age-limit for appointment by deputation shall be not exceeding fifty-six years as on the closing date of receipt of applications.

(b) possessing any one of the following education qualification :

(ii) a pass in the Subordinate Accounts Service or equivalent examination conducted by any of the Organised Accounts Departments of the Central Government; or

(ii) successful completion of training in the Cash and Accounts Work in the Institute of Secretariat Training and Management or equivalent; and

Note 1 : The departmental officers in the feeder category who are in the direct line of promotion will not be eligible for consideration for appointment on deputation. Similarly, the deputationists shall not be eligible for consideration for appointment by promotion.

का.नि.आ. 27.—केन्द्रीय सरकार, तटरक्षक अध्निियम, 1978 ;1978 का 30द्ध की धरा 123 की उप-धरा ;1द्ध द्वारा प्रदत्त शक्तियों

का प्रयोग करते हुए तटरक्षक ;साधरणद्ध नियम, 1986 का और संशोध्न करने के लिए निम्नलिखित नियत बनाती है, अर्थात्‌ :—

1. ;1द्ध इन नियमों का संक्षिप्त नाम तटरक्षक ;साधरणद्ध नियम, 2015 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. तटरक्षक ;साधरणद्ध नियम, 1986 ;जिसे इसमें इसके पश्चात्‌ उक्त नियम कहा गया हैद्ध के नियम 7 के खंड ;कद्ध में,

उप-खंड ;iद्ध के पश्चात्‌ निम्नलिखित उप-खंड रखा जाएगा, अर्थात्‌ :—

'';iकद्ध अपर महानिदेशक'' ।

3. उक्त नियम के नियम 19 में शब्दों और अंकों ''अध्निियम की धरा 57 और धरा 58 के उपबंधें के अध्ीन रहते हुए'' के स्थान

पर निम्नलिखित रखा जाएगा, अर्थात्‌ :—

''कमान की शक्ति—''अध्निियम की धरा 57 और धरा 58 के उपबंधें के अध्ीन रहते हुए'' शब्दों और अंकों को रखा जाएगा'' ।

4. उक्त नियम के नियम 21 की सारणी के ''सक्षम प्राध्किारी'' स्तंभ 1 में ''उप महानिदेशक'' शब्दों के स्थान पर ''अपर महानिदेशक'' शब्दों को रखा जाएगा ।

5. उक्त नियम के नियम 22 में,—

;कद्ध उप-नियम ;5द्ध में,—

;iद्ध खंड ;खद्ध में, ''सेवा से हटा लिया जाए'' शब्दों के स्थान पर ''सेवा से हटा दिया जाएऋ या'' शब्दों को रखा जाएगा ।

;गद्ध उप-नियम ;8द्ध में, ''अध्किारी को पदच्युत करने या सेवा से हटाए जाने का आदेश कर सकेगी'' जो वह उचित समझे, शब्दों के स्थान पर ''अध्किारियों को पेंशन या उपदान के साथ पदच्युत करने या सेवा से अनिवार्य पदच्युत कर सकेगी, जो उसे अनुज्ञेय हो, यदि कोई हो'' शब्दों को रखा जाएगा ।

6. उक्त नियम के नियम 23 के उप-नियम ;1द्ध, उप-नियम ;3द्ध, उप-नियम ;4द्ध और उप-नियम ;5द्ध में ''उप महानिदेशक'' शब्दों के स्थान पर ''अपर महानिदेशक'' शब्दों को रखा जाएगा ।

7. उक्त नियम के नियम 24 के उप-नियम ;1द्ध और उप-नियम ;3द्ध में ''उप महानिदेशक'' शब्दों के स्थान पर ''अपर महानिदेशक'' शब्दों को रखा जाएगा ।

8. उक्त नियम के नियम 25 में ''उप महानिदेशक'' शब्दों के स्थान पर ''अपर महानिदेशक'' शब्दों को रखा जाएगा ।

12. उक्त नियम के नियम 37 में निम्नलिखित परंतुक को अंतःस्थापित किया जाएगा, अर्थात्‌ :—

''परंतु यह कि जब किसी अध्किारी का चरित्रा या ख्याति एक तात्विक मुद्‌दा हो, तब ऐसी जांच के पीठासीन अध्किारी जहां तक संभव हो, उस अध्किारी से ज्येष्ठ पंक्ति का होगा और अन्य सदस्य कम से कम उसकी पंक्ति के समतुल्य होंगे ।''

S.R.O. 27.—In exercise of the powers conferred by sub-section (1) of Section 123 of the Coast Guard Act, 1978 (30 of 1978), the Central Government hereby makes the following rules further to amend the Coast Guard (General) Rules, 1986, namely :–

1. (1) These rules may be called the Coast Guard (General) Amendment Rules, 2015.

(2) The shall come into force on the date of their publication in the Official Gazette.

2. In the Coast Guard (General) Rules, 1986 (hereinafter referred to as the said rules), in rule 7, in clause (a), after sub-clause (i), the following sub-clause shall be inserted, namely :–

''(ia) Additional Director General''.

3. In the said rules, in rule 19, for the words ''Subject to the'', the following shall be substituted, namely :– ''Power of Command.–Subject to the''.

4. In the said rules, in rule 21, in the table, in column 1 relating to ''Competent Authority'', for the words ''Deputy Director General'', the words ''Additional Director General'' shall be substituted.

5. In the said rules, in rule 22,–

(a) in sub-rule (5),–

(i) in clause (b), for the words ''the service'', the words ''the service; or'' shall be substituted;

(ii) after clause (b), the following clause shall be inserted, namely :–

''(c) Compulsorily retired from the service.'';

(b) in sub-rule (6), for the words ''or remove the officer from the service'', the words ''or remove the officer from the service or compulsorily retire him from the service with pension and gratuity, if any, admissible to him'' shall be substituted.

(c) in sub-rule (8), for the words ''order as it may deem fit for the dismissal or removal of the officer'', the words ''order as it may deem fit for the dismissal or removal of the officer or compulsorily retire him from the service with pension and gratuity, if any, admissible to him'' shall be substituted.

6. In the said rules, in rule 23, in sub-rules (1), (3), (4) and (5), for the words ''Deputy Director General'', the words ''Additional Director General'' shall be substituted.

7. In the said rules, in rule 24, in sub-rules (1) and (3), for the words ''Deputy Director General'', the words ''Additional Director General'' shall be substituted.

8. In the said rules, in rule 25, for the words ''Deputy Director General'', the words ''Additional Director General'' shall be substituted.

9. In the said rules, in rule 26, in sub-rules (4) and (5), for the words ''Deputy Director General'', the words ''Additional Director General'' shall be substituted.

10. In the said rules, in rule 27, in sub-rules (2) and (3), for the words ''Deputy Director General'', the words ''Additional Director General'' shall be substituted.

11. In the said rules, in rule 29, in the table, in column (4) relating to ''Prescribed authority'',–

(i) aginst Section 9, in item 3, for the words ''Deputy Director General'', the words ''Additional Director General'' shall be substituted.

(ii) against Section 13(1), in item 2, for the words ''Deputy Director General'', the words ''Additional Director General'' shall be substituted.

12. In the said rules, in rule 37, the following proviso shall be inserted, namely :

''Provided that when character or reputation of an officer is likely to be a material issue, the Presiding Officer of such inquiry where ever possible, will be senior in rank and other members at least equivalent in rank to that officer.''
