आ.अ.72 .—यतः, आयोग ने 108-रघुनाथपुर विधन सभा निर्वाचन क्षेत्रा से वर्ष 2010 में हुए बिहार विधन सभा के साधरण निर्वाचन के लिए निर्वाचन लड़ने वाले अभ्यर्थी डॉ. चन्द्रमा सह, ग्राम+नवादा, पोस्ट-थाना-रघुनाथापुर, जिला-सिवान, बिहार द्वारा अपने निर्वाचन व्ययों का लेखा विध् िद्वारा अपेक्षित रीति से दाखिल नहीं करने के कारण लोक प्रतिनिध्त्वि अध्निियम, 1951 की धरा 10क के अध्ीन अपने दिनांक 7 अगस्त, 2014 के आदेश संख्या 76/बिहार-वि.स./2010 द्वारा संसद के किसी भी सदन के या किसी राज्य/संघ राज्य क्षेत्रा की विधन सभा अथवा विधन परिषद्‌्‌ के सदस्य चुने जाने के लिए अथवा होने के लिए निरर्हत कर दिया था ।

और यतः, उक्त डॉ. चन्द्रमा सह ने लोक प्रतिनिध्त्वि अध्निियम, 1951 की धरा 11 के अध्ीन उक्त आदेश के विरु( एक अपील दिनांक 30 सितम्बर, 2014 को दायर की थी और अपनी उस अपील में बताए कारणोंं के आधर पर निरर्हता हटाने के लिए अनुरोध् किया था।

और यतः, सक्षम प्राध्किारी ने लोक प्र्रतिनिध्त्वि अध्निियम, 1951 की धरा 11 के अन्तर्गत अपील पर निर्णय लेने के लिए उपरोक्त आवेदक की व्यक्तिगत रूप से सुनवाई करने का निर्णय लिया और उसकी सुनवाई करके अपने आदेश दिनांक 31 जुलाई, 2015 के द्वारा यह निर्णय लिया कि उक्त डॉ. चन्द्रमा सह पर दिनांक 7 अगस्त, 2014 के आदेश सं. 76/बिहार-वि.स./2010 के द्वारा आरोपित निरर्हता तत्काल प्रभाव से रद्‌्‌द कर दी जाएगी ।

New Delhi, the 31st July, 2015

O. N. 72 .—Whereas, the Commission, vide its Order No. 76/BR-LA/2010 dated 7th August,2014, had dis- qualified under Section 10A of the Representation of the People Act, 195 1, Dr. Chandrama Singh, Vill-Nawada, Post+PS- Raghunathpur, Dist- Siwan, Bihar, a contesting candidate for the General Election to the Bihar Legislative Assembly from 108-Raghunathpur Assembly Constituency, held in the year 2010, for being chosen as, and for being a member of either House of the People or of the Legislative Assembly or Legislative Council of a State for a period of three years, for not lodging his account of election expenses in the manner required by law.

And, whereas, the said Dr. Chandrama Singh, had preferred an appeal under Section 11 of the Representation of the People Act, 1951 against the said order and had requested for the removal of the disqualification for the reasons stated in the said appeal dated 30th September, 2014.

And, whereas, the competent authority decided to give a personal hearing to the aforesaid applicant for deciding the appeal under section 11 of the Representation of People Act, 1951 and having heard him, has decided, vide its order dated 31 st July, 2015 that the disqualification imposed on said Dr. Chandrama Singh, vide Order No. 76/BR-LA/2010 dated 7th August, 2014, shall be revoked with immediate effect.

Now, therefore, the name of Dr. Chandrama Singh, appearing at Serial no. 10 of the Table appended with Commission's Order no. 76/BR-LA/2010 dated 7th August, 2014, shall be omitted w.e.f. 31st July, 2015.

H.Nagar, Dist- Siwan, Bihar, a contesting candidate for the General Election to the Bihar Legislative Assembly from 108-Raghunathpur Assembly Constituency, held in the year 2010, for being chosen as, and for being a member of either House of the People or of the Legislative Assembly or Legislative Council of a State for a period of three years, for not lodging his account of election expenses in the manner required by law.

And, whereas, the said Shri Hamidraza Khan, had preferred an appeal under Section 11 of the Representation of the People Act, 1951 against the said order and had requested for the removal of the disqualification for the reasons stated in the said appeal dated 23rd September, 2014.

And, whereas the competent authority decided to give a personal hearing to the aforesaid applicant for deciding the appeal under section 11 of the Representation of People Act, 1951 and having heard him, has decided, vide its order dated 31st July, 2015 that the disqualification imposed on said Shri Hamidraza Khan, vide Order No. 76/BR-LA/2010 dated 7th August, 2014, shall be revoked with immediate effect.

Now, therefore, the name of Shri Hamidraza Khan, appearing at Serial No. 12 of the Table appended with Commission's Order no. 76/BR-LA/2010 dated 7th August, 2014, shall be omitted w.e.f. 31st July, 2015.

आ.अ. 75 .— लोक प्रतिनिध्त्वि अध्निियम, 1950 ;1950 के 43द्ध की धरा 13-क की उप-धरा ;1द्ध प्रदत्त शक्तियों का प्रयोग करते हुए भारत निर्वाचन आयोग उत्तर प्रदेश राज्य क्षेत्रा के प्रशासन के परामर्श से एतद्‌्‌द्वारा, श्री अरूण सघल, आई. ए. एस., ;1987द्ध को उनके कार्यभार ग्रहण की तारीख से आगामी आदेशों तक के लिए उत्तर प्रदेश राज्य के मुख्य निर्वाचन अध्किारी के रूप में नामित करता है ।

2. श्री अरूण सघल, आई. ए. एस., उत्तर प्रदेश सरकार के अध्ीन सभी पदभार या किसी कार्य के पदभारों को तत्काल सौंप देंगे या धरण करना समाप्त कर देंगे जो कि वे ऐसा पदभार ग्रहण करने से पहले धरण कर रहे थे ।

3. श्री अरूण सघल, आई. ए. एस., मुख्य निर्वाचन अध्किारी उत्तर प्रदेश के रूप में कार्य करते हुए उत्तर प्रदेश सरकार के अध्ीन किसी भी प्रकार का कोई अतिरिक्त कार्यभार ग्रहण नहीं करेंगे सिवाय इसके कि उनको राज्य सचिवालय में निर्वाचन विभाग के प्रभारी, सरकार का सचिव पदाभिहित किया जायेगा ।

N. 75 .—In exercise of the powers conferred by sub - section (1) Section 13A of the Representation of the People Act, 1950 (43 of 1950), the Election Commission of India in consultation with the State Government concerned hereby nominates Shri Arun Singhal, IAS (1987) as the Chief Electoral Officer, Uttar Pradesh with effect from the date he takes over charge and until further orders.

2. Shri Arun Singhal, IAS, shall cease to hold and hand over forthwith the charge of all or any work under the Government of Uttar Pradesh, which he may be holding before such assumption of office.

3. Shri Arun Singhal, IAS while functioning as the Chief Electoral Officer, Uttar Pradesh shall not hold any additional Charge whatsoever under the Government of Uttar Pradesh except that he should be designated Secretary to the Government in charge of Election Department in the State Secretariat.
