नई दिल्ली, दिनांक 27 मई 2015
सं. एफ.9-43/2006-यू.3 (ए)--जबकि केन्द्र सरकार ने, विश्वविद्यालय अनुदान आयोग (यूजीसी) अधिनियम 1956 की धारा 3 के तहत प्रदत्त शक्तियों का प्रयोग करते हुए, यूजीसी की सलाह पर अपनी दिनांक 6 जून, 2007 की अधिसूचना संख्या 9-43/2006/यू3(ए) द्वारा यह घोषित किया है कि स्वामी राम विद्यापीठ, स्वामी राम नगर, पोस्ट ऑफिस डोईवाला, देहरादून, उत्तराखंड जिसमें केवल चिकित्सा कॉलेज आता है, उपर्युक्त अधिनियम के उद्देश्यार्थ उस तारीख से सम-विश्वविद्यालय होगा जिस तारीख से स्वामी राम विद्यापीठ अपने चिकित्सा कालेज (हिमालयन चिकित्सा विज्ञान संस्थान) को संबद्ध विश्वविद्यालय अर्थात् हेमवती नंदन बहुगुणा, गढ़वाल विश्वविद्यालय, श्रीनगर (गढ़वाल) उत्तराखंड से असंबद्ध करता है। यह अधिसूचना निम्नलिखित शर्तों के पूरा होने के अध्यधीन जारी की गई हैः
(i) स्वामी राम विद्यापीठ और इसके चिकित्सा कालेज, (हिमालय चिकित्सा विज्ञान संस्थान) की चल-परिसंपत्तियां विद्यार्थियों, संकाय सदस्यों, कर्मचारियों के भविष्य के हित में 'सम-विश्वविद्यालयी' संस्था का प्रबंध और उच्चतर शिक्षा मानकों का रख-रखाव करने के लिए सृजित न्यास के पूर्ण नियंत्रण में होंगी।
(ii) स्वामी राम विद्यापीठ को यूजीसी के अनुदेशों के अनुसार यूजीसी के पूर्व अनुमोदन के बिना परिसम्पत्तियों के निर्धारण, परिसम्पत्तियों का अन्यत्र प्रयोग (Non-Diversion) और यूजीसी परिसंपत्तियों आदि के सम-विश्वविद्यालय को बंद करने या विलय करने की दशा में उपबन्ध बनाने और नियंत्रण में लेने के मामलों के संबंध में कानूनी वचनबद्धता प्रस्तुत करनी होगी।
(iii) स्वामी राम विद्यापीठ और न्यास जो इसे संचालित करेंगे, उन्हें ऐसे कार्यकलाप प्रारंभ नहीं करने चाहिए जिनकी प्र—ति व्यावसायिक और लाभ कमाने की हो।
(iv) स्वामी राम विद्यापीठ या इसकी कोई भी घटक इकाई ऐसा कोई भी पाठ्यक्रम कार्यक्रम संचालित नहीं करेगी जो स्वास्थ्य और परिवार कल्याण मंत्रालय और उपयुक्त सांविधिक परिषदों जैसे भारतीय चिकित्सा परिषद्, भारतीय दंत परिषद् आदि द्वारा जैसा भी मामला हो, विधिवत् रूप से अनुमोदित न हों।
(v) प्रवेश, विद्यार्थियों की दाखिला क्षमता, नए पाठ्यक्रम/कार्यक्रम आदि को प्रारंभ करने के मामले में संगत सांविधिक परिषदों और अन्य संबंधित प्राधिकरणों के सभी निर्धारित मानक और प्रक्रियाएं लागू रहेंगी और इनका विद्यापीठ और इसकी संघटित इकाई द्वारा कठोरता से पालन किया जाएगा।
(vi) स्वामी राम विद्यापीठ अपने चिकित्सा कालेज द्वारा चलाए जा रहे पाठ्यक्रम के संबंध में केवल उन विद्यार्थियों को डिग्री आदि प्रदान करेगा जो विद्यार्थी उस तारीख के बाद जिसको यूजीसी अधिनियम 1956 के उद्देश्य के लिए यह अधिसूचना जारी की गई थी संस्थाओं/कालेजों में नामांकित हुए हों।
(vii) जो छात्र इस अधिसूचना से पहले विद्यापीठ/चिकित्सा कालेज में पहले से ही नामांकित हों वे विद्यार्थी अपना अध्ययन वर्तमान संबद्ध विश्वविद्यालय नामतः हेमवती नंदन बहुगुणा, गढ़वाल विश्वविद्यालय, श्रीनगर गढ़वाल, उत्तराखंड के तहत जारी रखेंगे, जो ऐसे पाठ्यक्रमों/कार्यक्रमों की जांच करेगा और उन्हें सफलतापूर्वक पूरा करने पर डिग्री प्रदान करेगा जिन्हें वे वर्तमान में कर रहे हों।
(viii) स्वामी राम विद्यापीठ या उसकी संघटक इकाई कोई भी डिग्री जैसा भी मामला हो, जो यूजीसी द्वारा निर्दिष्ट न हो, प्रदान नहीं करेगी। यह भी सुनिश्चित किया जाएगा कि इसके द्वारा प्रदान की गई डिग्रियों की नाम पद्धतियां यूजीसी अधिनियम, 1956 की धारा 22 के तहत यूजीसी द्वारा विनिर्दिष्ट की गई हों।
[भाग I—खण्ड 1 भारत का राजपत्र, सितम्बर 5, 2015 (भाद्रपद 14, 1937) 844(ix) स्वामी राम विद्यापीठ, परिवार एवं स्वास्थ्य कल्याण मंत्रालय और अन्य उपयुक्त सांविधिक परिषदों को संचालित किए जाने वाले पाठ्यक्रमों, छात्रों इत्यादि के प्रवेश की क्षमता, के संबंध में अपेक्षित नवीकरण का अनुमोदन/अनुमति, जैसा भी मामला हो, निर्धारित समय-सीमा के तहत नियमित रूप से प्राप्त करेगा।
(x) स्वामी राम विद्यापीठ यूजीसी के दिनांक 12 मार्च, 2007 के परिपत्र संख्या एफ6-1(7)/2006 (सीपीपी-1) के तहत जारी अनुदेशों के अनुसार वैध प्रत्यायन प्राप्त करने के लिए सभी अपेक्षित कदम उठाएगा।
(xi) स्वामी राम विद्यापीठ यूजीसी और दूरस्थ शिक्षा परिषद् के पूर्व अनुमोदन के बिना कोई भी दूरस्थ शिक्षा कार्यक्रम नहीं चलाएगा।
(xii) स्वामी राम विद्यापीठ यूजीसी का अपेक्षित पूर्व अनुमोदन प्राप्त किए बिना कोई भी अध्ययन केन्द्र/कैंपस से बाहर केन्द्र नहीं चलाएगा।
(xiii) स्वामी राम विद्यापीठ उस यूजीसी विशेषज्ञ समिति द्वारा दिए गए सुझावों का कार्यान्यन और उनका कड़ाई से पालन करेगा जिसने अवसंरचना सुविधाओं के क्षेत्रों में सुधार और अनुसंधान कार्यकलाप के लिए संबंधित संस्थाओं का दौरा किया था और जांच की थी।
(xiv) संस्थान जब भी आवश्यक हो, यूजीसी के परामर्श और सहमति से अपने संगम ज्ञापन और नियमों को उपयुक्त रूप से संशोधित और अद्यतन करेगा।
(xv) स्वामी राम विद्यापीठ और इसकी संघटक इकाई यूजीसी, परिवार और स्वास्थ्य कल्याण मंत्रालय और उपयुक्त सांविधिक परिषदों (जैसे एमसीआई, डीसीआई आदि) और अन्य संबंधित प्राधिकरणों द्वारा सम-विश्वविद्यालय के रूप में संस्थाओं को अधिसूचित करने से संबंधित समय-समय पर निर्धारित मानकों और दिशा-निर्देशों का पालन करेगा।
2. और जबकि, स्वामी राम विद्यापीठ ने, स्वामी राम विद्यपीठ को मूल सोसायटी अर्थात् हिमालयन हास्पिटल ट्रस्ट संस्थान (एचआईएचटी) में विलय और स्वामी राम विद्यपीठ का नाम एचआईएचटी विश्वविद्यालय में बदलने के लिए एक प्रस्ताव प्रस्तुत किया है। तत्पश्चात्, केन्द्र सरकार ने यूजीसी की सलाह पर दिनांक 4 मार्च, 2008 की अधिसूचना संख्या 9-43/2006/यू 3 द्वारा स्वामी राम विद्यापीठ की मूल समिति अर्थात् एचआईएचटी को विश्वविद्यालय में बदलने हेतु प्रस्ताव को तत्काल प्रभाव से अनुमोदित कर दिया है जिसमें केवल चिकित्सा कालेज ही है।
3. और इसके अतिरिक्त, जबकि, एचआईएचटी, ने दिनांक 19.8.2013 को प्रबंध बोर्ड द्वारा पास किए गए संकल्प के बाद यूजीसी (सम विश्वविद्यालय संस्थान) विनियम, 2010 के खण्ड 22.4 के अनुसरण में सम-विश्वविद्यालय के दर्जे को समाप्त करने के लिए 21 अगस्त 2013 के अपने पत्र द्वारा भारत सरकार को आवेदन किया है। विनियमों के खण्ड 22.4 में कहा गया है कि यदि कोई विश्वविद्यालयवत् संस्था, सम-विश्वविद्यालय संस्थान के दर्जे से स्वयं को या अपने संघटकों को इसके दर्जे को समाप्त करना चाहता है तो वह केन्द्र सरकार की पूर्व-अनुमति से ऐसा कर सकता है। ऐसे दर्जे को तभी समाप्त किया जाएगा जब उसमें तब नामांकित छात्रों को अंतिम बैच विश्वविद्यालय संस्था से उत्तीर्ण हो जाए।
4. बाद में, केन्द्र सरकार ने दिनांक 30 सितम्बर, 2013 के अपने पत्र संख्या 9-43/2006 यू 3(ए) द्वारा सम-विश्वविद्यालय के दर्जे को समाप्त करने के लिए माननीय उच्चतम न्यायालय से निर्देश प्राप्त करने की सलाह दी क्योंकि यह मामला सम-विश्वविद्यालय के वर्ग 'ग' से संबंधित मामला है जो वर्तमान में उच्च न्यायालय में न्यायाधीन है।
5. और जबकि, एचआईएचटी विश्वविद्यालय ने सम विश्वविद्यालय के दर्जे को समाप्त करने के लिए अनुरोध के साथ अन्तवर्ती आवेदन संख्या 67 दायर किया है। माननीय उच्चतम न्यायालय ने अपने दिनांक 5.5.2014 के आदेश से यह स्पष्ट किया है कि इस न्यायालय द्वारा पास किया गया यथास्थिति आदेश प्रतिवादी संख्या 33 अर्थात् एचआईएचटी विश्वविद्यालय (आईए संख्या 67) के समक्ष कोई अड़चन पैदा नहीं करेगा जिसमें दर्जा समाप्त करने की मांग और भारत संघ सरकार से दर्जा समाप्त करने का प्रमाणपत्र मंजूर करने की मांग की गई है।
6. अब इसलिए, केन्द्र सरकार ने यूजीसी अधिनियम 1956 की धारा 3 के तहत प्रदत्त शक्तियों का प्रयोग करते हुए एतद्द्वारा यह घोषित किया है कि एचआईएचटी को सम-विश्वविद्यालय संस्था के रूप में घोषित करने वाली दिनांक 6 जून 2007 की अधिसूचना को दाखिल किए गए विद्यार्थियों के अंतिम बैच के उत्तीर्ण होने की तारीख से दर्जा समाप्त किया हुआ माना जा सकता है। इसके अतिरिक्त, एचआईएचटी सम-विश्वविद्यालय के संस्थापक का यह मुख्य उत्तरदायित्व होगा कि वह उनके द्वारा नामांकित विद्यार्थियों के अंतिम बैच के छात्रों के हितों की रक्षा करें।

2. कार्य
यह समिति सरकारी प्रयोजनों के लिए हिन्दी के प्रगामी प्रयोग और संबद्ध मामलों पर जल संसाधन, नदी विकास और गंगा
संरक्षण मंत्रालय को सलाह देगी ।
3. कार्यकाल
समिति का कार्यकाल, निम्नलिखित व्यवस्था के अध्यधीन, उसके गठन की तारीख से तीन वर्षों का होगा :
(क) समिति में नामजद संसद सदस्य, उनकी संसद की सदस्यता समाप्त होते ही इस समिति के सदस्य भी नहीं रहेंगे ।
(ख) समिति के पदेन-सदस्य उस समय तक ही समिति के सदस्य रहेंगे जब तक कि वे उस पद पर रहे जिसके कारण वे
समिति के सदस्य बने हैं; और
(ग) यदि किसी सदस्य की मृत्यु हो जाने अथवा त्याग-पत्र दे देने के परिणामस्वरूप समिति में कोई रिक्ति हो जाती है तो
उनके स्थान पर नियुक्त सदस्य शेष कार्यकाल तक पद धारण करेंगे।
4. सामान्य
समिति का मुख्यालय नई दिल्ली में होगा । दिल्ली के बाहर भी समिति की बैठक आयोजित की जा सकती है ।
5. यात्रा तथा अन्य भत्ते
समिति की बैठकों में भाग लेने के लिए गैर-सरकारी सदस्यों को राजभाषा विभाग के दिनांक 22 जनवरी, 1987 के कार्यालय
ज्ञापन सं. 11/20034/4/86-रा.भा.(क-2) में निहित दिशा-निर्देशों के अनुरूप भारत सरकार द्वारा समय-समय पर यथा संशोधित
निर्धारित दरों एवं नियमों के अनुसार यात्रा भत्ता और दैनिक भत्ता दिया जाएगा ।
आदेश
आदेश दिया जाता है कि इस संकल्प की एक-एक प्रति समिति के सभी सदस्यों, सभी राज्य सरकारों तथा संघ राज्य
प्रशासनों, राष्ट्रपति सचिवालय, प्रधान मंत्री कार्यालय, मंत्रिमंडल सचिवालय, संसदीय कार्य मंत्रालय, लोक सभा सचिवालय, राज्य सभा
सचिवालय, भारत के नियंत्रक तथा महालेखा परीक्षक और भारत सरकार के सभी मंत्रालयों/विभागों को भेज दी जाए।
यह भी आदेश दिया जाता है कि यह संकल्प जनसाधारण की जानकारी के लिए भारत के राजपत्र में प्रकाशित किया जाए।

New Delhi, the 27th May 2015
No.F.9-43/2006-U.3(A)—Whereas, in exercise of the powers conferred under Section 3 of the University Grants Commission (UGC) Act 1956, the Central Government vide its Notification No.9-43/2006/U3(A) dated 6th June, 2007, on the advice of the UGC, declared that Swami Rama Vidyapeeth, Swami Rama Nagar, P.O. Doiwala, Dehradun, Uttarakhand, consisting of Medical College only, shall be Deemed to be University for the purpose of the aforesaid Act, with effect from the date the Swami Rama Vidyapeeth disaffiliates its Medical College (Himalayan Institute of Medical Sciences) from the affiliating University, viz. Hemwanti Nandan Bahuguna Garhwal University, Srinagar (Garhwal), Uttarakhand. The Notification was issued subject to fulfillment of following conditions:
I. The moveable assets of Swami Rama Vidhyapeeth and its Medical College (Himalayan Institute of Medical Sciences) shall come under the total control of the Trust created to manage the 'deemed-to-be university' institution in the interest of future of students, members of faculty, employees and for maintaining the standards of higher education.
II. Swami Rama Vidyapeeth should submit a legal undertaking as per the instruction of the UGC pertaining to the issues of earmarking of assets, non-diversion of assets without prior approval of the UGC and making a provision for the UGC to take control of assets, etc. in the event of winding up of or dissolution of the deemed- to-be university.
III. Swami Rama Vidhyapeeth and the Trust that will manage it, should not undertake any activities that are of commercial and profit making in nature.
IV. Swami Rama Vidhyapeeth or any of its constituent unit shall not offer or conduct any course programme that is not duly approved by the Ministry of Health and Family Welfare and relevant Statutory Councils like Medical Council of India (MCI), Dental Council of India(DCI), etc. as the case may be.
V. All the prescribed norms and procedures of the relevant Statutory Councils and others authorities concerned in the matter of admission, intake capacity of students, starting of new courses /programmes, etc. will continue to be in force, and shall be strictly compiled with by the Vidyapeeth and its constituent unit.
VI. Swami Rama Vidhyapeeth shall award degrees, etc in respect of the courses run by its Medical College only to those students who are enrolled with the institutions/ colleges subsequent to the date on which this Notification takes effect for the purpose of the UGC Act, 1956.
VII. As for the students who are already enrolled with the Vidyapeeth/ Medical College prior to the date of this Notification, they shall continue to pursue their courses of the study under affiliation to the present affiliating university, namely, the Hemwati Nandan Bahuguna Garhwal University, Srinagar (Garhwal), Uttarakhand, which shall examine and award degrees to them on successful competition of the courses/ programmes they are pursing there presently.
VIII. Swami Rama Vidhyapeeth or it constituent unit shall not offer/award, as the case may be, any degrees that are not specified by the UGC. It will also ensure that the nomenclatures of the degrees awarded by it are specified by the UGC under Section 22 of the UGC Act, 1956.
IX. Swami Rama Vidhyapeeth shall regularly obtain the requisite 'renewal' of approval / permission of Ministry of Health and Family Welfare and other relevant Statutory Councils, as the case may be well within the prescribed time limit, in respect of the courses offered, intake capacity of students, etc.
X. Swami Rama Vidhyapeeth shall take all the required steps to get valid accreditation in terms of instructions issues by the UGC vide its circular No. F.6-1(7)/2006 (CPP-I) dated the 12th March, 2007.
XI. Swami Rama Vidhyapeeth shall not conduct any distance education programmes without prior approval of UGC and Distance Education Council (DEC).
XII. Swami Rama Vidhyapeeth shall not run any study centre / off-campus centre without obtaining the requisite prior approval of the UGC.
XIII. Swami Rama Vidhyapeeth shall strictly comply with and implement the suggestions made by the UGC's Expert Committee that visited and inspected the institutions concerned for improvement in the areas of infrastructural facilities and research activities /ambience848 THE GAZETTE OF INDIA, SEPTEMBER 5, 2015 (BHADRA 14, 1937) [PART I—SEC. 1 XIV. As and when necessary, the Institute shall suitably amend and update its Memorandum of Association and Rules in consultation and concurrence with the UGC.
XV. Swami Rama Vidhyapeeth and its constituent unit will abide by all the norms and guidelines laid down by the UGC, Ministry of Health and Family Welfare and other relevant Statutory Councils (such as MCI, DCI, etc.) & other authorities concerned, from time to time pertaining to the institutions notified as Deemed-to-be Universities.
2. And whereas, Swami Rama Vidyapeeth submitted a proposal to amalgamate Swami Rama Vidyapeeth with the parent society i.e. Himalayan Institute of Hospital Trust (HIHT), and to change the name of Swami Rama Vidyapeeth to HIHT University. Thereafter, the Central Government vide its Notification No.9-43/2006/U3 dated 4th March, 2008, on the advice of UGC, approved the proposal for amalgamation of Swami Rama Vidyapeeth with the parent society i.e. HIHT and changed its name to HIHT University comprising medical college only with immediate effect.
3. And further whereas, HIHT, after a resolution passed by the Board of Management on 19.08.2013, applied to the Government of India vide its letter dated 21st August, 2013 for withdrawal of the status of Deemed to be University in accordance with the Clause 22.4 of the UGC (Institutions Deemed to be Universities) Regulations, 2010. Clause 22.4 of the Regulations states that "If an institution deemed to be university wishes to withdraw itself or its constituents from the status of 'institution deemed to be university', it may do so with the prior permission of the Central Government. Such withdrawal shall take effect only after the last batch of students then enrolled, passes out of the institution deemed to be university".
4. Subsequently, the Central Government vide its letter No.9-43/2006/U.3A dated 30th September, 2013 advised the Institute to seek direction from Hon'ble Supreme Court for withdrawal of Deemed to be University status as the matter related to Category 'C' Deemed to be Universities matter is currently sub-judice in Hon'ble Court.
5. And whereas, HIHT University filed an Interlocutory Application No. 67 with the prayer to surrender the Deemed University status. The Hon'ble Supreme Court vide its order dated dated 05/05/2014 made it clear that the status quo order passed by this Court will not stand in the way of respondent No. 33 i.e. HIHT University (IA No.67) seeking withdrawal and the Union of India in granting the issue of withdrawal certificate.
6. Now, therefore, in exercise of power conferred under Section 3 of the UGC Act, 1956, the Central Government hereby declares that the Notification dated 6th June, 2007 declaring HIHT as an Institution Deemed to be University may be treated as withdrawn with effect from passing out of the last batch of admitted students. Further, it would be sole responsibility of the promoter of HIHT Deemed University to safeguard the interests of the last batch of students enrolled by them.

2. Function
The Samiti will advise the Ministry of Water Resources, River Development & Ganga Rejuvenation on matters relating to progressive use of Hindi for official purpose and allied issues.
3. Tenure
The term of the Samiti will be three years from the date of its constitution provided that:
(a) A Member, who is a Member of Parliament, ceases to be a Member of the Samiti as soon as he ceases to be a Member of Parliament.
(b) Ex-Officio Members of the Samiti shall continue as members as long as they hold the office by virtue of which they are members of the Samiti; and
(c) If a vacancy arises in the Samiti due to death or resignation of a member, the member appointed that capacity shall hold office for the residual term.
4. General
The Headquarter of the Samiti shall be at New Delhi but it may hold its meeting at any other station also.
5. Travelling and Other Allowances
The Non-Official Members will be paid travelling and daily allowances for attending the meeting of the Samiti as per the guidelines of Department of Official Language contained in the office Memorandum No. 11/20034/4/86-OL (A-2) dated 22nd January, 1987 and in accordance with the prescribed rate and rules as amended from time to time by Government of India.

Ordered that a copy of this Resolution be communicated to all the members of the Samiti, all State Governments and Union Territory Administrations, President's Secretariat, Prime Minister's Office, Cabinet Secretariat, Ministry of Parliamentary Affairs, Lok Sabha Secretariat, Rajya Sabha Secretariat, Comptroller and Auditor General of India and all the Ministries/Departments of Government of India.
