आ.अ. 94.—यतः, आयोग ने 107-दरौली107-दरौली107-दरौली107-दरौली107-दरौली विधान सभा निर्वाचन क्षेत्र से वर्श 2010 में हुए बिहार विधान सभा
श्री रघुनाथ राम, ग्राम पो.-रामपुर, पो.-रामपुर टोला, श्री रघुनाथ राम, ग्राम पो.-रामपुर, पो.-रामपुर टोला, के साधारण निर्वाचन के लिए निर्वाचन लड़ने वाले अभ्यर्थी श्री रघुनाथ राम, ग्राम पो.-रामपुर, पो.-रामपुर टोला, श्री रघुनाथ राम, ग्राम पो.-रामपुर, पो.-रामपुर टोला, श्री रघुनाथ राम, ग्राम पो.-रामपुर, पो.-रामपुर टोला, जिला-सिवान, जिला-सिवान, जिला-सिवान, जिला-सिवान, जिला-सिवान, बिहार द्वारा अपने निर्वाचन व्ययों का लेखा दाखिल नहीं करने के कारण लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अधीन अपने दिनांक 7 अगस्त, 2014 के आदेष संख्या 76/बिहार-वि.स./2010 द्वारा संसद के किसी भी सदन के या किसी राज्य/संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिशद के सदस्य चुने जाने के लिए अथवा होने के लिए निरर्हत कर दिया था।
294 THE GAZETTE OF INDIA : SEPTEMBER 26, 2015/ASVINA 4, 1937 [PART II—SEC. 3(iii)] और, यतः, उक्त श्री रघुनाथ रामश्री रघुनाथ रामश्री रघुनाथ रामश्री रघुनाथ रामश्री रघुनाथ राम ने लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 11 के अधीन उक्तआदेष के विरूद्ध एक अपील दिनांक शून्य दायर की थी और अपनी उस अपील में बताए गए कारणों के आधार पर
निरर्हता हटाने के लिए अनुरोध किया था।
और, यतः, सक्षम प्राधिकारी ने लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 11 के अन्तर्गत अपील
पर निर्णय लेने के लिए उपरोक्त आवेदक की व्यक्तिगत रूप से सुनवाई करने का निर्णय लिया और उसकी सुनवाई
करके अपने आदेष दिनांक 11 सितम्बर, 201511 सितम्बर, 201511 सितम्बर, 201511 सितम्बर, 201511 सितम्बर, 2015 के द्वारा यह निर्णय लिया कि उक्त श्री रघुनाथ रामश्री रघुनाथ रामश्री रघुनाथ रामश्री रघुनाथ रामश्री रघुनाथ राम पर दिनांक
7 अगस्त, 2014 के आदेष सं. 76/बिहार-वि.स./2010 के द्वारा आरोपित निरर्हता तत्काल प्रभाव से रद्द कर दी
जाएगी।
अतः, अब, आयोग के तारीख 7 अगस्त, 2014 के आदेष संख्या 76/बिहार-वि.स./2010 के साथ
संलग्न सारणी की क्र्रम संख्या 07 पर स्थित श्री रघुनाथ राम का नाम 11 सितम्बर, 2015 से हटा दिया जाएगा।

ELECTION COMMISSION OF INDIA
ORDER
New Delhi, the 11th September, 2015
O. N. 94.— Whereas, the Commission, vide its Order No. 76/BR-LA/2010 dated 7th August, 2014, had disqualified under Section 10A of the Representation of the People Act, 1951, Sh. Raghunath Ram, Vill + Post-Rampur, PO-Rampur Tola, Dist-Siwan, Bihar a contesting candidate for the General Election to the Bihar Legislative Assembly from 107- Darauli Assembly Constituency, held in the year 2010, for being chosen as, and for being a member of either House of the People or of the Legislative Assembly or Legislative Council of a State for a period of three years, for not lodging his account of election expenses in the manner required by law.
And, whereas, the said Shri Raghunath Ram had preferred an appeal dated nil under Section 11 of the Representation of the People Act, 1951 against the said order and had requested for the removal of the disqualification for the reasons stated in the said appeal.
And, whereas, the competent authority decided to give a personal hearing to the aforesaid applicant for deciding the appeal under section 11 of the Representation of People Act, 1951 and having heard him, has decided, vide its order dated 11th September, 2015 that the disqualification imposed on said Shri Raghunath Ram, vide Order No. 76/BR-LA/2010 dated 7th August, 2014, shall be revoked with immediate effect.
Now, therefore, the name of Sh Raghunath Ram, appearing at Serial no. 07 of the Table appended with Commission's Order no. 76/BR-LA/2010 dated 7th August, 2014 , shall be omitted w.e.f. 11th September, 2015.
