नई दिल्ली, दिनांक 31 अगस्त 2015

सं. एफ-10-1/2015-यू.3(ए)--जबकि केन्द्र सरकार को विश्वविद्यालय अनुदान आयोग, की सलाह पर विश्वविद्यालय अनुदान आयोग (यूजीसी) अधिनियम, 1956 की धारा 3 के अन्तर्गत किसी उच्चतर शिक्षा संस्था को सम-विश्वविद्यालय संस्था के रूप में घोषित करने का अधिकार प्राप्त है।

2. और जबकि, विश्वविद्यालय अनुदान आयोग की सलाह पर इस मंत्रालय की दिनांक 13.08.2007 की अधिसूचना सं. एफ. 9- 37/2006-यू3(ए) के माध्यम से उपर्युक्त अधिनियम के उद्देश्यार्थ गांधी प्रौद्योगिकी एवं प्रबन्ध संस्थान, (जीआईटीएएम) रूशीकोण्डा, विशाखापट्टनम-530045, आन्ध्र प्रदेश को 'सम-विश्वविद्यालय संस्थान' के रूप में घोषित किया गया था, जिसमें प्रारंभ में दो कॉलेज नामतः (i) इंजीनियरिंग कॉलेज एवं (ii) विज्ञान कॉलेज थे। इसके बाद, दिनांक 13.06.2008 की अधिसूचना संख्या एफ. 10-6/ 2007-यू3(ए) के माध्यम से दो और कॉलेजों नामतः (i) प्रबन्धन अध्ययन कॉलेज एवं (ii)(भेषज शिक्षा कॉलेज को सम-विश्वविद्यालय संस्थान के अधिकार क्षेत्र में शामिल किया गया था। भारत सरकार ने विश्वविद्यालय अनुदान आयोग की सलाह पर दिनांक दिसम्बर 2008 की अधिसूचना संख्या एफ. 10-10/2008-यू3(ए) के माध्यम से सम-विश्वविद्यालय को अकादमिक सत्र 2009-10 से हैदराबाद के बाहरी छोर पर स्थित रूद्रराम गांव में एक बा]य परिसर केन्द्र प्रारंभ करने की अनुमति प्रदान की थी। इसके बाद भारत सरकार ने यूजीसी की सलाह पर 27 सितम्बर 2012 की अधिसूचना सं. 10-3/2012-यू3(ए) के माध्यम से इस सम-विश्वविद्यालय को अकादमिक सत्र 2012-13 के नागादेनाहल्ली, डोडाबलापुर तालुक, बंगलौर, कर्नाटक में एक और बा]य परिसर केन्द्र आरंभ करने की अनुमति प्रदान की थी।

3. और जबकि 'सम-विश्वविद्यालय ने 04 जून, 2015 में जीआईटीएएम आयुर्विज्ञान एवं शोध संस्थान के नाम से येनदाडा, विशाखापट्टनम, आन्ध्र प्रदेश में एक बा]य परिसर केन्द्र स्थापित करने संबंधी एक प्रस्ताव प्रस्तुत किया है।

4. और जबकि, मंत्रालय द्वारा अपने दिनांक 24 जून, 2015 को पत्र संख्या 10-1/2015-यू3(ए) द्वारा यूजीसी (विश्वविद्यालयवत्‌ संस्थान) विनियम, 2010 के प्रावधानों और 2014 तथा 2015 में किए गए संशोधनों के अनुसार परीक्षण के लिए यूजीसी को जीआईटीएएम सम-विश्वविद्यालय का प्रस्ताव अग्रेषित किया गया।

5. और जबकि, यूजीसी ने अपने दिनांक 29 जुलाई, 2015 के पत्र संख्या 10-2/2015 (सीपीपी-I/डीयू) द्वारा जीआईटीएएम विज्ञान और अनुसंधान चिकित्सा संस्थान के नाम से येनदाडा, विशाखापट्टनम, आन्ध्र प्रदेश में बा]य परिसर में प्रारम्भ करने के लिए गांधी प्रौद्योगिकी और प्रबंध संस्थान, को अपनी सिफारिश सूचित की है, जो यूजीसी द्वारा 6 वर्षों के लिए द्विवार्षिक और उसके तत्पश्चात 5 वर्षों के बाद बा]य परिसर केन्द्र की समीक्षा करने के अध्यधीन होगा।

6. और जबकि, यूजीसी विशेषज्ञ समिति की रिपोर्ट और सिफारिशों की मंत्रालय में जांच की गई और यह पाया गया कि यूजीसी (विश्वविद्यालय संस्थान) विनियम, 2010 के तहत कुछ निर्धारित शर्तों में से एक खण्ड 12.07 है जिसके द्वारा नए बा]य परिसर केन्द्र/उपतटीय परिसर प्रारंभ करने के इच्छुक विश्वविद्यालयवत्‌ संस्थानों को प्रस्तावित केन्द्र को प्रारम्भ करने की तारीख के कम-से-कम 6 माह पहले निर्धारित फार्मेट में भारत सरकार को आवेदन करना अनिवार्य बना दिया गया है, इस विश्वविद्यालयवत्‌ संस्थान द्वारा पूर्ण रूप से पूरा नहीं किया गया है।

7. और जबकि, चूंकि यूजीसी विशेषज्ञ समिति ने निरीक्षण, प्रबंधन के साथ विचार-विमर्श, संकाय, गैर-शिक्षण कर्मचारी और विद्यार्थियों के साथ पारस्परिक विचार विमर्श और दस्तावेजों के सत्यापन के आधार पर यह सिफारिश की थी कि उपलब्ध सुविधाएं आवश्यकताओं के अनुरूप हैं और प्रस्तावित बा]य परिसर केन्द्र में उपलब्ध वास्तविक अवसंरचना पर्याप्त है, मंत्रालय का यह विचार है कि येनदाडा, विशाखापट्टनम, आंध्र प्रदेश में जीआईटीएएम आयुर्विज्ञान और अनुसंधान संस्थान के नाम से प्रस्तावित बा]य परिसर केन्द्र को आवेदन को जमा करने की तारीख (जो 4 जून, 2015 थी) से 6 माह पूरे होने पर अर्थात्‌ 3 दिसम्बर, 2015 से वैध माना जाए।

8. इसलिए, अब, और विश्वविद्यालय अनुदान आयोग अधिनियम, 1956 की धारा 3 द्वारा प्रदत्त शक्तियों को प्रयोग करते हुए केन्द्र सरकार, विश्वविद्यालय अनुदान आयोग की सलाह पर एतद्‌द्वारा गांधी प्रौद्योगिकी एवं प्रबन्धन संस्थान (जीआईटीएएम)900 भारत का राजपत्र, अक्तूबर 3, 2015 (आश्विन 11, 1937) [भाग I—खण्ड 1 सम-विश्वविद्यालय, विशाखापट्टनम, आन्ध्र प्रदेश को 3 दिसम्बर, 2015 से जीआईटीएएम आयुर्विज्ञान और अनुसंधान संस्थान के नाम से येनदाडा, विशाखापट्टनम, आन्ध्र प्रदेश में बा]य परिसर केन्द्र प्रारम्भ करने के लिए अपना अनुमोदन प्रदान करती है, जो इसमें संलग्न शर्तों और शैक्षिक पाठ्‌यक्रमों/कार्यक्रमों को आयोजित करने के लिए उपर्युक्त अधिनियम के उद्देश्यार्थ यूजीसी (विश्वविद्यालयवत्‌ संस्थान) विनियम, 2010 और 2014 और 2015 में इसके संशोधनों के तहत निर्धारित सामान्य निबंधन एवं शर्तों के अध्यधीन 6 वर्षों के लिए द्विवार्षिक और इसके बाद प्रत्येक 5 वर्ष में यूजीसी द्वारा बा]य परिसर केन्द्र की समीक्षा के अध्यधीन होगा।

9. उपर्युक्त पैरा 8 में की गई घोषणा इस अधिसूचना के पृष्ठांकन के क्रम संख्या 6 में उल्लिखित शर्तों को पूरा किए जाने के अध्यधीन होगी।

सं. एफ. 12-12/2010-यू.3(ए)--जबकि, यूजीसी अधिनियम, 1956 की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्र सरकार ने यूजीसी की सलाह पर, अपने दिनांक 7 जून 2000, की अधिसूचना सं. 9-19/94-यू3 द्वारा बिहार योग भारती, मुंगेर, बिहार को उपर्युक्त अधिनियम के उद्देश्यार्थ विश्वविद्यालयवत्‌ संस्था के रूप में घोषित किया था।

2. और जबकि, बिहार योग भारती, (सम-विश्वविद्यालय), मुंगेर बिहार ने अपने दिनांक 12 जून, 2008 के पत्र द्वारा यूजीसी से इस तथ्य के दृष्टिगत सम-विश्वविद्यालय दर्जा वापस लेने का अनुरोध किया था कि वह अपने इष्टतम प्रयासों के बावजूद यूजीसी और संबंधित सांविधिक निकायों के दिशा-निर्देशों/विनियमों के अनुसार सम-विश्वविद्यालय द्वारा अनुसरण किए जाने वाली बाध्यताओं और अपेक्षाओं को पूरा करने में असमर्थ था।

3. और जबकि, यूजीसी ने दिनांक 10.09.2008 को आयोजित अपनी 451वीं बैठक में बिहार योग भारती, (सम-विश्वविद्यालय), मुंगेर, बिहार के अनुरोध पर विचार किया और निम्नलिखित प्रस्ताव पारित किया :--

''आयोग ने बिहार योग भारती के सम-विश्वविद्यालय दर्जे को वापस लेने के अनुरोध पर विचार किया और मानव संसाधन विकास मंत्रालय को इसकी सिफारिश करने के लिए इस शर्त के अध्यधीन सहमत हुआ कि जो विद्यार्थी पहले से नामांकित हों वे अपना पाठ्‌यक्रम पूरा कर सकते हैं या संस्थान विद्यार्थियों की संतुष्टि के लिए वैकल्पिक प्रबंध करे''।

4. और जबकि, मंत्रालय के सक्षम प्राधिकारी ने बिहार योग भारती, (सम-विश्वविद्यालय), मुंगेर, बिहार के सम-विश्वविद्यालय दर्जे को वापस लेने की यूजीसी की उपर्युक्त सिफारिश को स्वीकार कर लिया है और तद्‌नुसार इसे अन-अधिसूचित करने का आदेश दिया है।

5. इसलिए, अब, यूजीसी अधिनियम, 1956 की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्र सरकार एतद्‌द्वारा यह घोषणा करती है कि दिनांक 7 जून, 2000, की अधिसूचना सं. 9-19/94-यू3 को जिसमें बिहार योग भारती, मुंगेर, बिहार को विश्वविद्यालयवत्‌ संस्था घोषित किया था उसे विद्यार्थियों के अंतिम बैच के उत्तीर्ण होने की तारीख से समाप्त माना जाए। इसके अतिरिक्त, बिहार योग संस्थान के संस्थापक का व्यक्तिगत उत्तरदायित्व होगा कि वह उनके द्वारा नामांकित विद्यार्थियों के अंतिम बैच के हितों की रक्षा करें।

समिति के कार्य

यह समिति, केन्द्रीय हिंदी समिति और राजभाषा विभाग द्वारा समय-समय पर निर्धारित नीतियों और मार्गदर्शी सिद्धांतों के अनुसार, पोत परिवहन मंत्रालय के सरकारी काम-काज में हिंदी के प्रगामी प्रयोग से संबंधित मामलों में सलाह देगी।

कार्यकाल

इस समिति का कार्यकाल, सामान्य रूप से इसके गठन की तारीख से निम्नलिखित बातों के अधीन 3 वर्ष का होगा :-- (क) जो संसद सदस्य, इस समिति के सदस्य हैं, वे संसद-सदस्य नहीं रहने पर इस समिति के सदस्य नहीं रहेंगे;

(ख) जो संसद सदस्य, संसदीय राजभाषा समिति के सदस्य होने की हैसियत से इस समिति के सदस्य हैं, वे संसदीय राजभाषा समिति के सदस्य नहीं रहने पर इस समिति के सदस्य नहीं रहेंगे;

(ग) इस समिति के पदेन सदस्य अपने पद पर कार्य करते रहने तक इस समिति के सदस्य रहेंगे; तथा

(घ) यदि किसी सदस्य की मृत्यु हो जाने के कारण अथवा किसी सदस्य द्वारा समिति की सदस्यता से त्याग-पत्र दे दिए जाने के कारण कोई स्थान खाली हुआ, तो उस स्थान पर नियुक्त सदस्य, इस समिति के कार्यकाल की शेष अवधि तक ही सदस्य रहेगा।

यात्रा तथा अन्य भत्ते

इस समिति के गैर सरकारी सदस्यों को इस समिति की बैठकों में हिस्सा लेने के लिए राजभाषा विभाग के दिनांक 22 जनवरी, 1987 के कार्यालय ज्ञापन सं. 11/20034/4/86-रा.भा. (क-2) में निहित मार्गदर्शी सिद्धांतों के अनुरूप और भारत सरकार द्वारा समय-समय पर यथा संशोधित निर्धारित दरों एवं नियमों के अनुसार यात्रा-भत्ता तथा दैनिक भत्ता दिया जाएगा।

सामान्य

समिति का मुख्यालय नई दिल्ली में होगा, लेकिन आवश्यक होने पर समिति की बैठकें किसी अन्य स्थान पर भी आयोजित की जा सकती है।

इस समिति का कार्य भारत के संविधान में राजभाषा के संबंध में की गई व्यवस्था, राजभाषा अधिनियम तथा उसके अंतर्गत बनाए गए नियमों, केन्द्रीय हिंदी समिति के निर्णयों तथा राजभाषा विभाग द्वारा जारी किए गए अनुदेशों के कार्यान्वयन तथा दूरसंचार विभाग और उसके संबद्ध और अधीनस्थ कार्यालयों, निगमों/उपक्रमों के कामकाज में हिंदी के प्रगामी प्रयोग के बारे में सलाह देना है।

4. समिति का कार्यकाल

समिति के सदस्यों का कार्यकाल इसके गठन की तारीख अर्थात्‌ इस संकल्प के जारी होने की तारीख से तीन वर्ष तक रहेगा बर्शत कि :--

(क) जो संसद सदस्य, समिति के सदस्य हैं, वे संसद सदस्य न रहने पर समिति के सदस्य नहीं रहेंगे।

(ख) समिति के पदेन सदस्य अपने पद पर कार्य करते रहने तक समिति के सदस्य रहेंगे।

(ग) यदि किसी सदस्य की मृत्यु हो जाने के कारण अथवा समिति की सदस्यता से त्याग-पत्र देने के कारण स्थान रिक्त होता है तो उस स्थान पर नियुक्त सदस्य तीन वर्ष का कार्यकाल में से शेष अवधि के लिए ही सदस्य रहेगा।

(घ) विशेष परिस्थितियों में समिति का कार्यकाल घटाया या बढ़ाया जा सकता है।

5. सामान्य

समिति का मुख्यालय नई दिल्ली में होगा, तथापि, समिति अपनी बैठकें आवश्यकता पड़ने पर दिल्ली से बारह किसी अन्य स्थान पर भी कर सकती है।

6. यात्रा तथा अन्य भत्ते

राजभाषा विभाग, गृह मंत्रालय के दिनांक 03 फरवरी, 2006 के कार्यालय ज्ञापन संख्या II/20034/04/2005-रा.भा. (नीति-2) द्वारा यह उल्लेख किया गया है कि चूंकि केन्द्रीय मंत्रालयों/विभागों द्वारा गठित हिंदी सलाहकार समितियों में नामित 15 गैर-सरकारी सदस्यों में 06 संसद सदस्य होते हैं, अतः यात्रा/दैनिक भत्ता प्रावधान को अधिक स्पष्ट करते हुए निम्न प्रावधान किया जाता है :--

(क) समिति में नामित सांसदों को ''संसद सदस्य (वेतन, भत्ता एवं पेंशन) अधिनियम, 1954'' के प्रावधानों एवं समय-समय पर जारी किए गए संशोधनों तथा उनके अधीन बनाए गए नियमों के अनुसार यात्रा भत्ता तथा दैनिक भत्ता दिया जाएगा।

(ख) समिति में अन्य गैर-सरकारी सदस्यों को राजभाषा विभाग के दिनांक 22 जनवरी, 1987 के कार्यालय ज्ञापन संख्या II/20034/04/86-रा.भा.(क-2) में निहित दिशा निर्देशों के अनुरूप और भारत सरकार द्वारा समय-समय पर संशोधित निर्धारित दरों एवं नियमों के अनुसार यात्रा भत्ता तथा दैनिक भत्ता देय होगा।

No.F.10-1/2015-U.3(A)—Whereas the Central Government is empowered under Section 3 of the University Grants Commission (UGC) Act, 1956 to declare, on the advice of the UGC, an Institution of higher learning as a Deemed to be University;

2. And whereas, on the advice of the UGC, Gandhi Institute of Technology and Management (GITAM), Rushikonda, Visakhapatnam, Andhra Pradesh was declared as an 'Institution Deemed to be University' initially consisting of two colleges viz (i) College of Engineering and (ii) College of Science for the purposes of the aforesaid act, vide this Ministry's notification No.F.9-37/2006-U3(A) dated 13.08.2007. Later on, two more colleges viz. (i) College of Management Studies and (ii) College of Pharmacy were brought under the ambit of Deemed to be University vide Notification No. F.10- 6/2007-U3(A) dated 13.06.2008. The Government of India vide Notification No. F.10-10/2008-U3(A) dated December, 2008, allowed the Deemed to be University to start an off-campus centre from the academic year 2009-10 at Rudraram Village on the outskirts of Hyderabad, on the advice of UGC. Further, the Government of India vide its Notification No.10- 3/2012/U3(A) dated 27th September, 2012, on the advice of UGC, also permitted the Deemed to be University to start another off-campus centre at Nagadenahalli, Dodaballapur Taluk, Bangalore, Karnataka from the academic year 2012-13;

3. And whereas, the Institution "Deemed to be University" submitted a proposal to Ministry of Human Resource Development on 4th June, 2015 for establishment of an off-campus centre at Yendada, Visakhapatnam, Andhra Pradesh in the name of GITAM Institute of Medical Sciences & Research;

4. And further whereas, the Ministry vide its letter No. F.10-1/2015/U3(A) dated 24th June, 2015 forwarded the proposal of GITAM Deemed to be University to UGC for examination in accordance with the provisions of UGC (Institutions Deemed to be Universities) Regulations, 2010 and amendments in 2014 and 2015;

5. And whereas, the UGC vide its communication No.10-2/2015 (CPP-I/DU) dated 29.07.2015 conveyed its recommendation to Gandhi Institute of Technology and Management (GITAM) to start an off-campus centre at Yendada, Visakhapatnam, Andhra Pradesh in the name of GITAM Institute of Medical Sciences & Research subject to review of the off-campus centre by the UGC biennially for six years and subsequently after five years;

6. And whereas, the report of UGC Expert Committee and its recommendations were examined in the Ministry and found that one of the conditions stipulated under Clause 12.07 of the UGC (Institutions Deemed to be Universities) Regulations, 2010 whereby an Institution Deemed to be University intending to start a new off-campus centre / off-shore campus is made compulsory to apply to the Government of India in the prescribed format at least six months prior to the proposed dated of starting the centre, is not being fulfilled by the Deemed to be University;

7. And further whereas, since the UGC Expert Committee, based on an inspection, discussion with management, interaction with faculty, non-teaching staff and students and verification of documents, had recommended that the facilities available are in consonance with the requirements and the academic and physical infrastructure available at proposed off- campus centre are adequate, the Ministry is of the opinion that the proposed off-campus centre at Yendada, Visakhapatnam, Andhra Pradesh in the name of GITAM Institute of Medical Sciences & Research may be treated as valid from the completion of six months from the date of submission of the applications (which was on 4th June, 2015), i.e. from 3rd December, 2015;

8. Now, therefore, in exercise of the powers conferred by Section 3 of the UGC Act, 1956, the Central Government, on the advice of the University Grants Commission (UGC), do hereby accord its approval to the Gandhi Institute of Technology and Management (GITAM) Deemed to be University, Visakhapatnam, Andhra Pradesh to start an off-campus centre at Yendada, Visakhapatnam, Andhra Pradesh in the name of GITAM Institute of Medical Sciences & Research with effect from 3rd December, 2015, for the purposes of the aforesaid Act for conduct of academic course/programmes and the conditions attached thereto, subject to review of the off-campus centre by the UGC biennially for six years and subsequently after every five year subject to usual terms and conditions as prescribed under the UGC (Institutions Deemed to be Universities) Regulations, 2010 and its amendments in 2014 and 2015;

9. The declaration as made in Para 8 above is further subject to fulfillment of the conditions mentioned at Sr. No.6 of the endorsement to this notification;

No.F.12-12/2010-U.3(A)—Whereas, in exercise of the powers conferred under Section 3 of the University Grants Commission (UGC) Act 1956, the Central Government vide its Notification No.9-19/94-U3 dated 7th June, 2000, on the advice of the UGC, declared Bihar Yoga Bharati, Munger, Bihar as institution Deemed to be University for the purposes of the aforesaid Act.

2. And whereas, Bihar Yoga Bharati (Deemed to be University), Munger, Bihar vide its letter dated 12th June, 2008 requested the UGC for withdrawal of Deemed to be University status in view of the fact that it was unable to meet the compliance of obligation and requirements to be followed by Deemed to be University as per the existing guidelines/regulations of UGC and statutory bodies concerned despite its consistent endeavours.

3. And whereas, UGC in its 451st meeting held on 10.09.2008 considered the request of Bihar Yoga Bharati (Deemed to be University), Munger, Bihar and resolved as under:

"The Commission considered the request of Bihar Yoga Bharati for withdrawal of Deemed to be University status and agreed to recommend the same to the Ministry of Human Resource Development subject to the condition that the students who are already enrolled may complete their course or the Institute may make alternate arrangement to the satisfaction of the students".

4. And whereas, the Competent Authority of the Ministry has accepted the aforesaid recommendation of UGC for withdrawal of Deemed to be University status to Bihar Yoga Bharati, Munger, Bihar and accordingly ordered for de- notification.

5. Now, therefore, in exercise of the powers conferred by Section 3 of the UGC Act, 1956, the Central Government hereby declares that the Notification No. 9-19/94-U3 dated 7th June, 2000 declaring Bihar Yoga Bharati, Munger, Bihar as an Institution Deemed to be University may be treated as withdrawn with effect from passing out of the last batch of admitted students. Further, it would be sole responsibility of the promoter of Bihar Yoga Institute to safeguard the interest of the last batch of students enrolled by them.

Functions of the Committee

The Samiti will advise on the matters relating to the progressive use of Hindi in Official Work of the Ministry of Shipping, in accordance with the policies laid down by the Kendriya Hindi Samiti and the guidelines issued by the Department of Official Language in this regard from time to time.

Tenure

The Tenure of the Samiti will ordinarily be three years from the date of its constitution provided that:-

(a) The Members of the Parliament who are the members of the Samiti shall cease to be the members of the samiti as soon as they cease to be the Members of Parliament.

(b) The Members of Parliament who are the members of the Samiti by virtue of their being members of the Committee of the Parliament on Official Language shall cease to be the members of the samiti as soon as they cease to be the Members of the Committee of the Parliament on Official Language;

(c) Ex-officio members of the Samiti shall continue to be the Members of the Samiti as long as they hold the office by virtue of which they are the members of the Samiti; and

(d) if any vacancy arises in the Samiti owing to the death of a member or owing to tendering of resignation by a member, the member so appointed against that vacancy shall hold office for the residual term of the Samiti.

Travelling and other allowances

The Non-Official Members of the Samiti will be paid travelling and other allowances for attending its meetings in accordance with the guidelines contained in the Department of Official Language O.M.No. II/20034/4/86-O.L. (A-2), dated January, 22, 1987 and as per prescribed rates and rules of the Government of India as amended from time to time.

General

Headquarter of the Committee will be at New Delhi, but it may hold its meeting at any other station also.
