का.नि.आ. 37.—राष्टश्पति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रद;बपकरू217द्धा षक्तियों का प्रयोग करते हुए और रक्षा अनुसंधन तथा विकास संगठन, रक्षा मंत्राालय, निजी सचिव और वैयक्तिक सहायक 'ग' पद भर्ती नियम, 2000 और रक्षा अनुसंधन तथा विकास संगठन, रक्षा मंत्राालय, समूह 'ग' ;वैयक्तिक सहायकद्ध पद भर्ती नियम, 1998 को उन बातों के सिवाय अध्;िबपकरू216द्ध ांत करते हुए, जिन्हें ऐसे अध्;िबपकरू216द्ध मण से पहले किया गया है या करने का लोप किया गया है, रक्षा अनुसंधन तथा विकास संगठन, रक्षा मंत्राालय में ज्येष्ठ निजी सचिव, निजी सचिव और आषुलिपिक ग्रेड-I पदों पर भर्ती की प३ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम रक्षा मंत्राालय, रक्षा अनुसंधन और विकास संगठन, ज्येष्ठ निजी सचिव, निजी सचिव और आषुलिपिक ग्रेड-I पद भर्ती नियम, 2015 है ।

;2द्ध ये राजपत्रा में प्रकाषन की तारीख को प्रवश्;बपकरू217द्धा होंगे ।

2. आरंभिक गठन.—इन नियमों के प्रारंभ पर रक्षा अनुसंधन तथा विकास संगठन में निम्नलिखित पदों के पदधरियों को नीचे यथा

;कद्ध ज्येष्ठ निजी सचिव ज्येष्ठ निजी सचिव ;खद्ध निजी सचिव 'ख' ;गद्ध निजी सचिव 'क' निजी सचिव ;घद्ध वैयक्तिक सहायक 'ग' ;चद्ध वैयक्तिक सहायक 'ख' आषुलिपिक ग्रेड-I

टिप्पण 1ः इन नियमों के प्रारंभ होने से पहले निजी सचिव 'ख' तथा निजी सचिव 'क' के पदों के पदधरियों द्वारा की गई नियमित सेवा ;बपकरू216द्ध मषः ज्येष्ठ निजी सचिव तथा निजी सचिव के पुनरीक्षित पदों पर की गई सेवा मानी जाएगी । इसी प्रकार, इन नियमों के प्रांरभ होने से पहले वैयक्तिक सहायक 'ग' के पद पर पदधरियों द्वारा की गई नियमित सेवा, आषुलिपिक 'ग' के पद पर पदधरियों द्वारा की गई नियमित सेवा, आषुलिपिक ग्रेड-I के विलयित पद में की गई सेवा मानी जाएगी ।

टिप्पण 2ः 01 जनवरी 2006 से आगे वैयक्तिक सहायक 'ख' के पद के पदधरियों द्वारा की गई नियमित सेवा, आषुलिपिक ग्रेड-I के पुनरीक्षित पदो पर की गई सेवा मानी जाएगी ।

टिप्पण 3ः वैयक्तिक सहायक 'ग' का पद धरण करने वाले अध्किारी, जिसे 29 अगस्त, 2008 को नियमित आधर पर 5500-9000 रु. के पूर्व-पुनरीक्षित वेतनमान में आषुलिपिक ग्रेड-I कर दिया गया है, वह 5000-8000 रु. के पूर्व-पुनरीक्षित वेतनमान में वैयक्तिक सहायक 'ख' के पदों को धरण करने वाले अध्किारियों से सामूहिक रूप से ज्येष्ठ होेंगे ।

3. पदों की संख्या, वर्गीकरण, वेतन बैंड या ग्रेड वेतन या वेतनमान.—पदों की संख्या, उसका वर्गीकरण और वेतन बैंड और ग्रेड वेतन या वेतनमान वह होगा जो इन नियमों से उपाब३ अनुसूची के स्तम्भ ;2द्ध से स्तम्भ ;4द्ध में विनिदष्ट हैं ।

4. भर्ती की प३ ति, आयु-सीमा और अन्य अर्हताएं, आदि.—उक्त पद पर भर्ती की प३ति, आयु-सीमा, अर्हताएं और उससे संबंध्ति अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ ;5द्ध से स्तम्भ ;13द्ध में विनिदष्ट हैं ।

5. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया हैऋ या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त किसी भी पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. षिथिल करने की षक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवष्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब३ करके और संघ लोक सेवा आयोग से परामर्ष करके इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेष द्वारा षिथिल कर सकेगी ।

7. व्यावश्;िबपकरू217द्धा.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेषों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विषेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

प्रोन्नति द्वारा जिसके न हो सकने पर प्रतिनियुक्ति द्वारा प्रोन्नति : वेतन बैंड-2, 9300-34800 रु. ग्रेड वेतन 4600 रु. के वेतनमान

में ऐसा निजी सचिव जिसने उस श्रेणी में दो वर्ष नियमित सेवा की हो ।

टिप्पण 1ः-जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में जिन्होंने अपनी अर्हक अथवा पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो, वहां उनसे वरिष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परंतु यह तब जब कि उनके द्वारा की गई अर्हक अथवा पात्राता सेवा, अपेक्षित अर्हक अथवा पात्राता सेवा के आध्े से अध्कि से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक अथवा पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध् िसपफलतापूर्वक पूरी कर ली है ।

टिप्पण 2ः-प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना करने के प्रयोजन के लिए 1-1-2006 अथवा वह तारीख जिसको छठे केन्द्रीय वेतन आयोग की सिपफारिषों पर आधरित पुनरीक्षित वेतन संरचना विस्तारित गई है, से पूर्व किसी अध्किारी द्वारा नियमित आधर पर की गई सेवा वेतन आयोग की सिपफारिषों पर आधरित तत्स्थानी वेतन/वेतनमान में की गई सेवा समझी जाएगी ।

;11द्ध

प्रतिनियुक्ति :-केन्द्रीय सरकार के अध्ीन आषुलिपिक काडर में पद धरण करने वाले ऐसे अध्किारी :-

;iद्ध जो मूल काडर या विभाग में नियमित आधर पर सदश्ष पद धरण किए हुए हैंऋ या

;iiद्ध जिन्होंने मूल काडर अथवा विभाग में वेतन बैंड-2, 9300-34800 रु. ग्रेड वेतन 4600 रु. के या समतुल्य वेतनमान में नियमित आधर पर उस पद पर नियुक्ति के पष्चात उस श्रेणी में दो वर्ष नियमित सेवा की होऋ और

टिप्पण 1ः-पोषक प्रवर्ग के ऐसे विभागीय अध्किारी, जो प्रोन्नति की सीाी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे ।

टिप्पण 2ः-प्रतिनियुक्ति की अवध्,ि जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धरित किसी अन्य काडर बाह्‌य पद पर प्रतिनियुक्ति की अवध् िषामिल है, साधरणतया तीन वर्ष से अध्कि नहीं होगी । प्रतिनियुक्ति द्वारा नियुक्ति के लिए अध्कितम आयु-सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अध्कि नहीं होगी ।

टिप्पण 3ः- प्रतिनियुक्ति के आधर पर नियुक्ति के प्रयोजनों के लिए 01 जनवरी, 2006 या वह तारीख जिसको छठे केन्द्रीय वेतन आयोग की सिपफारिषों पर आधरित पुनरीक्षित वेतन संरचना विस्तारित की गई है, से पूर्व किसी अध्किारी द्वारा नियमित आधर पर की गई सेवा छठे केन्;बपकरू230द्ध ीय वेतन आयोग की सिपफारिषों के आधर पर विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान में की गई सेवा समझी जाएगी सिवाय उसके जहां एक से अध्कि पूर्व पुनरीक्षित वेतनमान का विलय समान ग्रेड वेतन या वेतनमान के साथ में हुआ है और जहां यह पफायदा केवल उस पद या उन पदों के लिए विस्तारित किया गया है जिनके लिए वह ग्रेड वेतन या वेतनमान किसी उन्नयन के बिना सामान्य प्रतिस्थापन ग्रेड है ।

टिप्पण 1ः-जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में जिन्होंने अपनी अर्हक अथवा पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो, वहां उनसे वरिष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा बषते– उनके द्वारा की गई अर्हक अथवा पात्राता सेवा अपेक्षित अर्हक अथवा पात्राता सेवा के आध्े से अध्कि से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक या पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध् िसपफलतापूर्वक पूरी कर ली है ।

है।द्ध टिप्पण 1ः आयु-सीमा अवाारित करने के लिए निर्णायक तारीख भारत में अभ्यथयों से आवेदन प्राप्त करने के लिए नियत की गई अंतिम तारीख होगी ;न कि वह अंतिम तारीख जो असम, मेघालय, अरफणाचल प्रदेष, मिजोरम, मणिपुर, नागालैंड, त्रिापुरा, सिक्किम, जम्मू-कष्मीर राज्य के लद्‌दाख खंड, हिमाचल प्रदेष के लाहौल और स्पीति जिले तथा चम्बा जिले के पांगी उप-खंड, अंडमान और निकोबार द्वीप या लक्षद्वीप के अभ्यथयों के लिए विहित की गई है।द्ध

टिप्पण 1ः प्रोन्नत किए जाने वाले अर्थात्‌ आषुलिपिक ग्रेड-2 के पद पर विद्यमान पदधरियों के लिए षैक्षणिक अर्हता निम्नानुसार होगीः

S.R.O. 37.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Defence Research and Development Organisation, Ministry of Defence, Private Secretaries and Personal Assistant 'C' posts Recruitment Rules, 2000 and the Defence Research and Development Organisation, Ministry of Defence, Group 'C' (Personal Assistants) posts Recruitment Rules, 1998 except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Senior Private Secretary, Private Secretary and Stenographer Grade-I in the Defence Research and Development Organisation, Ministry of Defence, namely:—

1. Short title and commencement.— (1) These rules may be called the Ministry of Defence, Defence Research and Development Organisation, Senior Private Secretary, Private Secretary and Stenographer Grade-I posts Recruitment Rules, 2015.

(2) They shall come into force on the date of their publication in the official Gazette.

2. Initial Constitution.—The incumbents of the following posts in the Defence Research and Development Organisation at the commencement of these rules shall be re-designated as indicated below:-

(a) Senior Private Secretary Senior Private Secretary (b) Private Secretary 'B' (c) Private Secretary 'A' Private Secretary (d) Personal Assistant 'C' (e) Personal Assistant 'B' Stenographer Grade- I

Note 1: The regular service rendered by the incumbents of the posts of Private Secretary 'B' and Private Secretary 'A', prior to commencement of these rules, shall be deemed to be service rendered in the revised posts of Senior Private Secretary and Private Secretary respectively. Similarly, the regular service rendered by the incumbents of the post of Personal Assistant 'C' prior to commencement of these rules, shall be deemed to be service rendered in the merged post of Stenographer Grade-I,

Note 2: The regular service rendered by the incumbents of the post of Personal Assistant 'B' from 1st January, 2006 onwards, shall be deemed to be service rendered in the revised post of Stenographer Grade-I.

Note 3: The officer holding the post of the Personal Assistant 'C' revised to Stenographer Grade-I in the pre- revised scale of Rs. 5500-9000 on regular basis on 29th August, 2008 will be en-bloc senior to those Personal Assistant 'B' holding the posts in pre- revised scale of Rs. 5000-8000.

3. Number of the post, Classification, Pay Band or Grade Pay or Pay Scale.— The number of post, its classification and the pay band, grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

4. Method of recruitment, age limit and other qualifications, etc..—The method of recruitment to the said post, age limit, qualification and other matters relating to the said post shall be as specified' in columns (5) to (13) of the Schedule.

5. Disqualifications.— No person,

(a) who, has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person;

shall be eligible for appointment to any of the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

6. Power to relax.— Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing and in consultation with Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

Note 1 : The departmental officers in the feeder category who are in the direct line of promotion will not be eligible for consideration for appointment on deputation. Similarly, deputationists shall not be eligible for consideration for appointment by promotion. Note 2 : The period of deputation including the period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organisation or department of the Central Government shall ordinarily not exceed three years. The maximum age limit for appointment by deputation shall be 'not exceeding 56 years' as on the closing date of receipt of applications. Note 1: The departmental officers in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation. Similarly, the deputationists shall not be eligible for consideration for appointment by promotion.

Note 2: For the purpose of appointment on deputation basis, the service rendered on a regular basis by an officer prior to 1.1.2006 or the date from which the revised pay structure based on the Sixth Central Pay Commission recommendation has been extended) shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the Pay Commission except where there has been merger of more than one pre revised scale of pay into one grade with a common Grade Pay or Pay Scale and where this benefit will extend only for the post(s) for which that Grade Pay or Pay Scale is the normal replacement grade without any upgradation.
