आ.अ. 95.—यतः, आयोग ने 60-रूपौली विधन सभा निर्वाचन क्षेत्रा से वर्ष 2010 में हुए बिहार विधन सभा के साधरण निर्वाचन के लिए निर्वाचन लड़ने वाले अभ्यर्थी श्री दिलीप जायसवाल, ग्राम-रामपुर परिहट, पो,-चपहरी-थाना-रूपौली, जिला-पूर्णिया, बिहार द्वारा अपने निर्वाचन व्ययों का लेखा दाखिल नहीं करने के कारण लोक प्रतिनिध्त्वि अध्निियम, 1951 की धरा 10क के अध्ीन अपने दिनांक 26 पफरवरी, 2014 के आदेश संख्या 76/बिहार-वि.स./2010 द्वारा संसद के किसी भी सदन के या किसी राज्य/संघ राज्य क्षेत्रा की विधन सभा अथवा विधन परिषद के सदस्य चुने जाने के लिए अथवा होने के लिए निरर्हत कर दिया था ।
और, यतः, उक्त श्री दिलीप जायसवाल ने लोक प्रतिनिध्त्वि अध्निियम, 1951 की धरा 11 के अध्ीन उक्त आदेश के विरू( एक अपील दिनांक 2-9-2014 दायर की थी और अपनी उस अपील में बताए गए कारणों के आधर पर निरर्हता हटाने के लिए अनुरोध् किया था ।
और यतः, सक्षम प्राध्किारी ने लोक प्रतिनिध्त्वि अध्निियम, 1951 की धरा 11 के अन्तर्गत अपील पर निर्णय लेने के लिए उपरोक्त आवेदक की व्यक्तिगत रूप से सुनवाई करने का निर्णय लिया और उसकी सुनवाई करके अपने आदेश दिनांक 1 अक्तूबर, 2015 के द्वारा यह निर्णय लिया कि उक्त श्री दिलीप जायसवाल पर दिनांक 26 पफरवरी, 2014 के आदेश सं. 76/बिहार-वि.स./2010 के द्वारा आरोपित निरर्हता तत्काल प्रभाव से रद््द कर दी जाएगी ।
296 THE GAZETTE OF INDIA : OCTOBER 10, 2015/ASVINA 18, 1937 [PART II—SEC. 3(iii)] अतः, अब, आयोग के तारीख 26 पफरवरी, 2014 के आदेश संख्या 76/बिहार-वि.स./2010 के साथ संलग्न सारणी की क्रम संख्या 20 पर स्थित श्री दिलीप जायसवाल का नाम 1 अक्तूबर, 2015 से हटा दिया जाएगा ।[सं. बिहार-वि.स./60/2010]

New Delhi, the 1st October, 2015
O. N. 95.—Whereas, the Commission, vide its Order No. 76/BR-LA/2010 dated 26th February, 2014 had disquali- fied under Section 10A of the Representation of the People Act, 1951 Sh. Dilip Jaiswal, Vill-Rampur Parihat, P.O.-Chapahari, P.S.-Rupauli, Dist.-Purnia, Bihar a constesting candidate for the General Election to the Bihar Legislative Assembly from 60- Rapauli Assembly Constituency, held in the year 2010, for being chosen as, and for being a member of either House of the People or of the Legislative Assembly or Legislative Council of a State for a Period of three years, for not lodging his account of election expenses in the manner required by law.
And, whereas, the said Sh. Dilip Jaiswal had preferred an appeal dated 2-9-2015 under Section 11 of the Represen- tation of the People Act, 1951 against the said order and had requested for the removal of the disqualification for the reasons stated in the said appeal.
And, whereas, the competent authority decided to give a personal hearing to the aforesaid applicant for deciding the appeal under section 11 of the Representation of People Act, 1951 and having heard him, has decided, vide its order dated 1st October, 2015 that the disqualification imposed on said Sh Dilip Jaiswal, vide Order No. 76/BR-LA/2010 dated 26th February, 2014 shall be revoked with immediate effect.
Now, therefore, the name of Sh. Dilip Jaiswal, appearing at Serial No. 20 of the Table appended with Commission's Order No. 76/BR-LA/2010 dated 26th February, 2014, shall be omitted w.e.f. 1st October, 2015.
