नई दिल्ली, दिनांक 3 नवंबर 2015

सं. ओ 19018/6/2011-ओएनजी-I--जी.एस.आर. संख्या ........... ः दिनांक 19.07.1997 की कोल बेड मिथेन (सीबीएम) नीति अधिसूचना संख्या ओ-12011/1/97/ओएनजी.डीओ.IV में आंशिक संशोधन करते हुए भारत सरकार एतद्‌द्वारा कोल इंडिया लिमिटेड (सीआईएल) और उसकी सहायक कंपनियों को उन सभी कोयला युक्त क्षेत्रों, जिनके लिए उनके पास कोयला हेतु खनन पट्टा है, से कोल बेड मिथेन (सीबीएम) का अन्वेषण और संदोहन करने का अधिकार प्रदान करने के संबंध में निम्नानुसार अधिसूचित करती है :

1. ऐसे ब्लॉकों/क्षेत्रों के संबंध में सीबीएम प्रचालनों के लिए खनन पट्टा तेल क्षेत्र (विनियमन और विकास) अधिनियम, 1948 (ओआरडी अधिनियम 1948) और पेट्रोलियम और प्रा—तिक गैस नियम 1959 (पीएंडएनजी नियम 1959) के प्रावधानों के अनुसार प्रदान किया जाएगा और सीबीएम प्रचालन इन अधिनियमनों के प्रावधानों के तहत शासित होंगे।

2. खनन प्रचालन और सुरक्षा संबंधी मुद्दे संबंधित संविधियों के प्रावधानों के अनुसार शासित होंगे।

3. प्रस्तावित नामांकन प्रणाली के तहत सीआईएल और इसकी सहायक कंपनियों द्वारा किए जाने वाले सीबीएम प्रचालनों के लिए लागू निबंधन और शर्तें निम्नानुसार होंगी :

i) पट्टाधारक के रूप में कोल इंडिया लिमिटेड और इसकी सहायक कंपनियां ऐसे सभी ब्लॉकों में सीबीएम प्रचालनों के लिए ओआरडी अधिनियम-1948 और पीएंडएनजी नियम 1959 के प्रावधानों का अनुपालन करेंगे।

ii) पट्टाधारक प्रा—तिक गैस के उपयोग और इसके मूल्य निर्धारण के लिए भारत सरकार की मौजूदा नीति का अनुपालन करेंगी।

iii) पट्टाधारकों द्वारा राज्य/केन्द्र सरकार को समय समय पर लागू रायल्टी तथा अपेक्षित शुल्कों, प्रशुल्कों और करों का भुगतान प्रचलित दरों पर तथा उन भुगतानों के समतुल्य करना अपेक्षित होगा जो प्रा—तिक गैस के लिए और समय समय पर यथा संशोधित दरों के अनुसार किए जाने अपेक्षित हैं।

iv) दिनांक 17 मार्च, 2012 की अधिसूचना संख्या 12/2012 सीमाशुल्क के क्रम सं. 360 के तहत आयातों पर सीमा शुल्क का भुगतान नहीं करने की छूट लागू होगी।

v) आयकर अधिनियम, 1961 के अनुसार आयकर देय होगा।

vi) पट्टाधारक सीबीएम के लिए खनन पट्टा (एमएल) प्रदान करने हेतु पीएंडएनजी नियम के तहत एमओपीएंडएनजी को सेंट्रल माइन प्लानिंग एंड डिजाइन इंस्टीट्‌यूट लिमिटेड (सीएमपीडीआईएल) की विस्तृत सिफारिशों सहित आवेदन प्रस्तुत करेंगे।

vii) वार्षिक कोयला खनन योजनाओं में उस क्षेत्र के ब्यौरे शामिल होंगे जिसके लिए हाइड्रोकार्बन महानिदेशालय (डीजीएच) को वर्ष के दौरान प्रतिबद्ध कार्य कार्यक्रम और सीबीएम के उत्पादन हेतु लक्ष्य के लिए खनन पट्टा संबंधी आवेदन प्रस्तुत किया जाएगा और इन्हें कोयला मंत्रालय (एमओसी) और पट्टाधारक के बीच होने वाले समझौता ज्ञापन में शामिल किया जाएगा।

viii) सीबीएम खनन पट्टा प्रदान किए जाने से 24 माह के भीतर, पट्टाधारक कोयला मंत्रालय को सूचित करते हुए डीजीएच को क्षेत्र विकास योजना (एफडीपी) सूचनार्थ व रिकार्ड के लिए प्रस्तुत करेगा। इस प्रकार प्रस्तुत की गई क्षेत्र विकास योजना पट्टाधारक बोर्ड द्वारा अनुमोदित होगी।

ix) एफडीपी को प्रस्तुत करने की समय अवधि को एमओपीएंडएनजी द्वारा पर्याप्त औचित्य के साथ मामला दर मामला आधार पर 12 माह तक बढ़ाया जा सकता है।

x) मूल्यांकन योजना और एफडीपी को प्रस्तुत करने में 36 माह से अधिक के विलंब के लिए, पट्टाधारक एक लाख रुपए प्रति माह के अर्थदंड का भुगतान करने का उत्तरदायी होगा।

xi) पट्टेदार एफडीपी में निर्धारित तारीख से पहले ही उत्पादन शुरू करेगा। उत्पादन में विलंब के लिए, पट्टाधारक एक लाख रुपए प्रति माह के अर्थदंड का भुगतान करने का उत्तरदायी होगा।

xii) पट्टाधारक को सीबीएम पट्टा अधिकारों को हस्तांतरित करने की अनुमति नहीं होगी।

xiii) पट्टाधारक को सीबीएम प्रचालनों में अनुभव रखने वाले केन्द्रीय/राज्य पीएसयूज को छोड़कर इक्विटी भागीदारी के जरिए सीबीएम अन्वेषण के लिए तृतीय पक्षकारों को शामिल करने की अनुमति नहीं होगी; अधिकांश पण पट्टाधारक के पास होंगे।

xiv) सीबीएम खनन पट्टा का परित्याग कोल पट्टा के साथ/मंजूर की गई सीबीएम खनन पट्टा अवधि के अनुसार होगा।

xv) कोल खनन पट्टा क्षेत्र के तहत कवर किए गए सीबीएम क्षेत्रों का उपयोग पट्टाधारक द्वारा इस प्रकार किया जाएगा ताकि कोल खनन प्रचालनों से पूर्व अथवा कोल खनन प्रचालनों के साथ-साथ सीबीएम निकासी की सुविधा प्रदान की जा सके और सीबीएम को इष्टतम रूप से विकसित और संरक्षित किया जा सके।

xvi) पर्यावरण, सुरक्षा आदि से संबंधित सभी सांविधिक अपेक्षाओं का पट्टाधारक द्वारा पालन किया जाएगा।

No. O-19018/6/2011-ONG-I —GSR No._______: In partial modification of Coal Bed Methane (CBM) Policy Notification No.O-12011/1/97/ONG.DO.IV dated 19.07.1997 the Government of India hereby notifies that in respect of grant of right to exploration and exploitation to Coal India Limited (CIL) and its subsidiaries from all coal bearing areas for which they possess mining lease for coal as hereunder:

1. Mining lease for CBM operations in respect of such blocks/areas will be granted by the Ministry of Petroleum & Natural Gas (MoP&NG) under the provisions of Oilfields (Regulation & Development) Act 1948 (ORD Act 1948) and Petroleum & Natural Gas rules 1959 (P&NG Rules 1959) and CBM operations will be governed under the provisions of these enactments.

2. Mining operations and safety issues would be governed as per provisions of relevant statutes.

3. Terms and conditions applicable to CBM operations undertaken by CIL and its subsidiaries under the proposed nomination system will be as given under:

i) As a lease holder CIL, its subsidiaries will comply with the ORD Act 1948 and P&NG rules 1959 for CBM operations in all such blocks;

ii) Lessees would comply with existing policy of Government of India for utilization and pricing of natural gas.

iii) Lessees will be required to pay royalty and requisite fees, levies and taxes as applicable from time to time to State/Central Government at prevailing rates at par with payments which are required to be made for natural gas and as revised from time to time.

iv) Exemption from payment of customs duty on imports under SI no. 360 of notification no. 12/2012 customs dated 17th March, 2012 will be applicable.

v) Income tax will be payable as per the Income Tax Act, 1961.

vi) Lessees shall submit application under the P&NG Rules for grant of Mining Lease (ML) for CBM to MoP&NG along with detailed recommendations of Central Mine Planning & Design Institute Limited (CMPDIL).

vii) Annual coal mining plans will include details of the area for which ML application will be filed with Directorate General of Hydrocarbons (DGH), for committed work programme and target for production of CBM during the year, and the same will be incorporated in the MOU between Ministry of Coal (MOC) and the lessee.

viii) Within 24 months of grant of CBM mining lease, the lessee shall submit Field Development Plan (FDP) to DGH for information and record, under intimation to the MOC. FDP so submitted shall have the approval of the Board of the lessee.

ix) The time period for submission of FDP may be extended by 12 months by MoP&NG on a case to case basis with sufficient justifications.

x) For delay in submission of appraisal plan and FDP beyond 36 months, the lessee will be liable to pay a penalty of Rs. One lakh per month.

xi) The lessee shall start production not later than the projected date in the FDP. For delay in production;

lessee would be liable to pay a penalty of Rs. One lakh per month of delay.

xii) Lessee shall not be allowed to alienate CBM lease rights.

xiii) Lessee shall not be allowed to involve third parties for CBM exploitation except through equity participation with Central/State PSUs with experience in CBM operations; majority stake shall remain with Lessee.

xiv) Relinquishment of CBM mining lease will be co-terminus with coal lease.

xv) CBM areas covered under coal mining lease area will be utilized by the lessee in a manner so as to facilitate extraction of CBM prior to coal mining operations or simultaneously with coal mining operations to optimally develop and conserve CBM.

xvi) All statutory requirements relating to Environment, Safety, etc. shall be complied with 'by the' Lessee.
