आआआआ....अअअअ.... 98989898....————यतः, लोक प्रतिनिधित्व अिधिनयम, 1951 की धारा 61 में यह उपबंिधत है कि निर्वाचकों के प्रतिरूपण का िनवारण करने की दृष्टि से उक्त अिधिनयम की धारा 62 के अधीन वास्तविक निर्वाचकों को उनके मत देने के अिधकार को और अिधक प्रभावी बनाया जा सके , उक्त अिधिनयम के अधीन नियमों द्वारा मतदान के समय निर्वाचकों की पहचान सुनि%ित करने के उद्देश्य से निर्वाचकों के िलए निर्वाचक फोटो पहचान पत्र के प्रयोग हेतु

नियमों के द्वारा उपबंधों को बनाया जा सकता है, तथा

2. यतः, निर्वाचकों का रजिस्ट्रीकरण िनयम, 1960 को िनयम 28 निर्वाचन आयोग को, इस दृष्टि से कि निर्वाचकों के प्रतिरूपण का िनवारण हो सके तथा मतदान के समय उनकी पहचान को सरल बनाया जा सके । निर्वाचकों को राज्य की लागत पर फोटोयुक्त निर्वाचक फोटो पहचान पत्र जारी करने के िलए निद3श देने की शक्ति प्रदान करता है, तथा

3. यतः, निर्वाचनों का संचालन िनयम, 1961 के िनयम 49ज(3) तथा 49ट(2)(ख) में यह अनुबंिधत है कि जहां किसी निर्वाचन क्षेत्र के निर्वाचकों का निर्वाचक रजिस्ट्रीकरण िनयम, 1960 के िनयम 28 के उक्त उपबंधों के अधीन निर्वाचक फोटो पहचान पत्र दिये जाते हैं, निर्वाचकों को मतदान के न्9 में अपना

4. यतः, उक्त अिधिनयम तथा िनयमों के उपयु र्क्त उपबंधों को िमलाकर एवं सामंजस्यपूर्ण ढंग से उनके अध्ययन से यह स्पष्ट होता है कि यद्यपि मत देने का अिधकार निर्वाचक नामावली में नाम के होने पर ही होता है, यह निर्वाचन आयोग द्वारा राज्य की लागत पर, मतदान के समय उनकी पहचान सुनि%ित करने के उद्देश्य से प्रदान करवाए गए निर्वाचक फोटो पहचान पत्र के प्रयोग पर भी निर्भर करता है, तथा दोनों को एक साथ प्रयोग करना होता है,

5. यतः, निर्वाचन आयोग ने समयबB योजना के अनुसार सभी निर्वाचकों को निर्वाचक फोटो पहचान पत्र (ईपीआईसी) जारी करने के निद3श देते Cए दिनांक 28 अगस्त, 1993 को एक आदेश जारी किया है, तथा 6. यतः, बिहार राज्य के निर्वाचकों को कापी हद तक उD प्रतिशत में निर्वाचक फोटो पहचान पत्र जारी किए जा चुके हैं, तथा

7. यतः, इसके अलावा, आयोग ने यह आदेश दिया है कि वतर्मान साधारण निर्वाचन की मतदान ितिथ से पूर्व मतदाताओं को """"प्रमाणिकप्रमाणिकप्रमाणिकप्रमाणिक फोटोफोटोफोटोफोटो मतदातामतदातामतदातामतदाता पर्चीपर्चीपर्चीपर्ची"""" बांटी जाएगी,

I. पासपोर्ट

II. Kाइविग लाइसेंस

III. राज्य/के न्9 सरकार, सार्वजनिक क्षेत्र के उपNमों/ पब्लिक िलिमटेड कम्पनियों द्वारा अपने कर्मचारियों को जारी किए गए फोटोयुक्त सेवा पहचान पत्र

IV. बैंकों/ डाकघरों द्वारा जारी किए गए फोटोयुक्त पासबुक

V. पैन कार्ड

VI. आरजीआई एवं एनपीआर द्वारा जारी किए गए स्मार्ट कार्ड

VII. मनरेगा जॉब कार्ड

VIII. Sम मंत्रालय की योजना के अTतर्गत जारी स्वास्थ्य बीमा स्मार्ट कार्ड

IX. फोटोयुक्त पेंशन दस्तावेज,

X. निर्वाचन तंत्र द्वारा जारी प्रमाणिक फोटो मतदाता पर्ची, एवं

XI. सांसदों, विधायकों/िवधान परिषद सWस्यों को जारी किए गए सरकारी पहचान पत्र ।

9. ईपीआईसी के संबंध में, लेखन अशुBि, वर्तनी की अशुBि इत्यादि को नजरअंदाज कर देना चािहए बशत3 मतदाता की पहचान ईपीआईसी से सुनि%ित की जा सके । यदि कोई मतदाता फोटो पहचान पत्र प्रदXशत करता है, जो कि किसी अन्य सभा निर्वाचन क्षेत्र के निर्वाचन रजिस्ट्रीकरण ऑफिसर द्वारा जारी किया गया है, ऐसे ईपीआईसी भी पहचान स्थापित करने हेतु स्वीकृ त किए जाएंगें बशत3 निर्वाचक का नाम जहां वह[भाग II—खण्ड 3 (iii)] भारत का राजपत्रा : नवम्बर 14, 2015/dkfrZd 23, 1937 305 मतदान करने आया है उस मतदान स्थल से संबंिधत निर्वाचक नामावली में उपलब्ध होना चािहए। यदि

फोटोZाफ इत्यादि के बेमेल होने के कारण मतदाता की पहचान सुनि%ित करना संभंव न हो तब मतदाता

को उपयुक्त पैरा 8 में वXणत किसी एक वैकल्पिक फोटो दस्तावेज को प्रस्तुत करना होगा।

10. उक्त पैरा 8 में किसी बात के होते Cए भी, प्रवासी निर्वाचक जो अपने पासपोर्ट में विवरणों के आधार पर

लोक प्रतिनिधित्व अिधिनयम, 1950 की धारा 20क के अधीन निर्वाचक नामावलियों में पंजीकृ त हैं, उन्हें

मतदान के न्9 में उनके के वलके वलके वलके वल मूल पासपोर्ट (तथा कोई अन्य पहचान दस्तावेज नह;) के आधार पर ही

पहचाना जाएगा ।

ELECTION COMMISSION OF INDIA

New Delhi, the 12th November, 2015

O.N. 98.—Whereas, Section 61 of the Representation of the People Act, 1951 provides that with a view to preventing impersonation of electors, so as to make the right of genuine electors to vote under section 62 of that Act more effective, provisions may be made by rules under that Act for use of Electors Photo Identity Card for electors as the means of establishing their identity at the time of polling; and

2. Whereas, Rule 28 of the Registration of Electors Rules, 1960, empowers the Election Commission to direct, with a view to preventing impersonation of electors and facilitating their identification at the time of poll, the issue of Electors Photo Identity Card to electors bearing their photographs at State cost; and 3. Whereas, Rules 49H (3) and 49K (2) (b) of the Conduct of Elections Rules, 1961, stipulate that where the electors of a constituency have been supplied with Electors Photo Identity Card under the said provisions of Rule 28 of the Registration of Electors Rules, 1960, the electors shall produce their Electors Photo Identity Card at the polling station and failure or refusal on their part to produce those Electors Photo Identity Card may result in the denial of permission to vote; and 4. Whereas, a combined and harmonious reading of the aforesaid provisions of the said Act and the Rules, makes it clear that although the right to vote arises by the existence of the name in the electoral roll, it is also dependent upon the use of the Electors Photo Identity Card, where provided by the Election Commission at State cost, as the means of establishing their identity at the time of polling and that both are to be used together; and

5. Whereas, the Election Commission made an Order on the 28th August, 1993, directing the issue of Electors Photo Identity Card (EPIC) to all electors, according to a time bound programme; and

6. Whereas, Electors Photo Identity Card have been issued to almost all registered electors in the States of Madhya Pradesh, Manipur, Mizoram, Meghalaya and Telangana;

7. Whereas, in addition the Commission has directed that 'Authenticated Photo Voters Slip' shall be distributed to the electors before the date of poll for the current bye-elections;

8. Now, therefore, after taking into account all relevant factors and the legal and factual position, the Election Commission hereby directs that for bye-elections to the House of the People from 24-Ratlam (ST) Parliamentary Constituency in Madhya Pradesh & 15-Warangal (SC) Parliamentary Constituency in Telangana and to the State Legislative Assemblies from 171- Devas Assembly Constituency in Madhya Pradesh, 9-Thangmeiband & 5-Thongju Assembly Constituency in Manipur, 12-Aizwal North-III(ST) Assembly Constituency in Mizoram & 32-Nongstoin (ST) Assembly in Meghalaya, which have been notified on 28-10-2015, all electors who have been issued EPIC shall produce the EPIC for their identification at the polling station before casting their votes. Those electors who are not able to produce the EPIC shall produce one of the following alternative photo identity documents for establishing their identity:-

(i) Passport;

(ii) Driving License; (iii) Service Identity Cards with photograph issued to employees by Central/State Govt. PSUs/Public Limited Companies;

(iv) Passbooks with photograph issued by Bank/Post Office; (v) PAN Card; (vi) Smart Card issued by RGI under NPR; (vii) MNREGA Job Card; (viii) Health Insurance Smart Card issued under the scheme of Ministry of Labour; (ix) Pension document with photograph; and (x) Authenticated Photo Voter Slip issued by the election machinery, and (xi) Official identity cards issued to MPS/MLAs/MLCs.

9. In the case of EPIC, clerical errors, spelling mistakes, etc. should be ignored provided the identity of the elector can be established by the EPIC. If an elector produces an Electors Photo Identity Card, which has been issued by the Electoral Registration Officer of another Assembly Constituency, such EPICs shall also be accepted for identification provided the name of that elector finds place in the electoral roll pertaining to the polling station where the elector has turned up for voting. If it is not possible to establish the identity of the elector on account of mismatch of photograph, etc. the elector shall have to produce one of the alternative photo documents mentioned in para 8 above.

10. Notwithstanding anything in Para 8 above, overseas electors who are registered in the electoral rolls under Section 20A of the Representation of the People Act, 1950, based on the particulars in their Passport, shall be identified on the basis of their original passport only (and no other identity document) in the polling station.

2. यत: आयोग ने मध्य प्रदेश के 24-रतलाम(अ.ज.जा.) संसदीय निर्वाचन क्षेत्र एवं तेलंगाना के 15-वारंगल

(अ.जा.) संसदीय निर्वाचन क्षेत्र तथा मध्य प्रदेश के 171-देवास िवधान सभा निर्वाचन क्षेत्र, मिणपुर के 9-

थांगमेईबांद एवं 5- थोगजु िवधान सभा निर्वाचन क्षेत्रों, िमजोरम के 12-उत्तरी एजवाल-III (अ.ज.जा.) िवधान

सभा निर्वाचन क्षेत्र तथा मेघालय के 32-नोंगस्टोइन िवधान सभा निर्वाचन क्षेत्र की परिस्थितियों पर िवचार किया है तथा इस बात से संतुष्ट है कि उपयु र्क्त संसदीय एवं िवधान सभा निर्वाचन क्षेत्रों में मतदान कराए जाने के िलए पर्याप्त संख्या में इलैक्ट्रॉनिक वोaटग मशीनें उपलब्ध हैं । मतदान कर्मचारी इलैक्ट्रॉनिक वोaटग मशीनों की कार्यप्रणाली से पूर्णतया परिचित हैं तथा मतदाता भी इलैक्ट्रॉनिक वोaटग मशीनों के संचालन के साथ पूरी तरह परिचित हैं।

3. अतः, अब भारत निर्वाचन आयोग एतHारा हरियाणा एवं महाराष्ट्र के वतर्मान राज्य िवधान सभा साधारण

निर्वाचन में मध्य प्रदेश के 24-रतलाम(अ.ज.जा.) संसदीय निर्वाचन क्षेत्र एवं तेलंगाना के 15-वारंगल (अ.ज.)

संसदीय निर्वाचन क्षेत्र तथा मध्य प्रदेश के 171-देवास िवधान सभा निर्वाचन क्षेत्र, मिणपुर के 9-थांगिमबंद एवं

5-थोगजु िवधान सभा निर्वाचन क्षेत्रों, िमजोरम के 12-आइजवाल उत्तर-III (अ.ज.जा.) िवधान सभा निर्वाचन क्षेत्र

तथा मेघालय के 32-नोन्गस्टोइन िवधान सभा निर्वाचन क्षेत्र, जहां पर उप-निर्वाचन हो रहे हैं, को ऐसे निर्वाचन

क्षेत्रों के रूप में विनि\दष्ट करता है जिसमें 28-10-2015 (बुधवार) को अिधसूिचत किए गए लोकसभा एवं राज्य

िवधान सभा के वतर्मान उप-निर्वाचनों में, निर्वाचनों का संचालन िनयम, 1961 के अधीन निर्धारित रीित से

इलैक्ट्रॉनिक मतदान मशीनों के माध्यम से मत डाले और रिकॉर्ड किए जाएगें जैसा कि इस िवषय पर आयोग द्वारा

समय-समय पर अनुपूरक अनुदेश जारी किए जाते हैं।

O.N. 99.—Whereas, Section 61A of the Representation of the People Act, 1951, provides that the giving and recording of votes by Voting Machines in such manner as may be prescribed, may be adopted in such constituencies as the Election Commission of India may, having regard to the circumstances of each case specify; and

2. Whereas, the Commission has considered the circumstances in 24-Ratlam (ST) Parliamentary Constituency in Madhya Pradesh & 15-Warangal (SC) Parliamentary Constituency in Telangana and 171-Devas Assembly Constituency in Madhya Pradesh, 9-Thangmeiband & 5-Thongju Assembly Constituencies in Manipur, 12-Aizwal North-III (ST) Assembly Constituency in Mizoram and 32-Nongstoin(ST) Assembly Constituency in Meghalaya and is satisfied that sufficient number of Electronic Voting Machines are available for taking the poll in the abovementioned Assembly Constituencies, the polling personnel are well trained in efficient handling of the Electronic Voting Machines and the electors are also fully conversant with the operation of the Electronic Voting Machines;

3. Now, therefore, the Election Commission of India hereby specifies 24-Ratlam (ST) Parliamentary Constituency in Madhya Pradesh & 15-Warangal (SC) Parliamentary Constituency in Telangana and 171-Devas Assembly Constituency in Madhya Pradesh, 9-Thangmeiband & 5-Thongju Assembly Constituencies in Manipur, 12-Aizwal North-III (ST) Assembly Constituency in Mizoram and 32-Nongstoin(ST) Assembly Constituency in Meghalaya as the Constituencies in which the votes at the current bye- elections to the House of the People and State Legislative Assemblies from the said Constituencies notified on 28-10-2015 (Wednesday), shall be given and recorded by means of Electronic Voting Machines in the manner prescribed under the Conduct of Elections Rules, 1961, and the supplementary instructions issued by the Commission from time to time on the subject.
