2. यह तदर्थ नियुक्ति उन्हें उप विधायी परामर्शी (भारतीय विधि सेवा का ग्रेड III) के ग्रेड में नियमित नियुक्ति के लिए न तो कोई दावा करने का अधिकार प्रदान करेगी और न ही उनके द्वारा प्रदत्त तदर्थ सेवाओं की गणना इस ग्रेड में वरिष्ठता के प्रयोजनार्थ अथवा अगले उच्चतर ग्रेड में उनकी प्रोन्नति के लिए की जाएगी।

सं. 2015 की अधिसूचना सं. 04 (फा. सं. ए-24012/08/2007-प्रषा.VI(क)(भाग-II)--श्रीमती अनुपमा सिंह (94027) जेसीआईटी, हैदराबाद, बोर्ड के दिनांक 18.2.2003 के आदेश के तहत आंध्र प्रदेश महिला सहकारी वित्त निगम, हैदराबाद में प्रबंध निदेशक के पद पर, अपने इस पद पर कार्यभार संभालने की तारीख से दो वर्ष की अवधि तक अथवा अगले आदेश तक के लिए प्रतिनियुक्ति पर गई थी। उनकी इस प्रतिनियुक्ति की अवधि को 9.3.2006 तक के लिए बढ़ा दिया गया था। दिनांक 9.3.2006 के बाद दो वर्ष की और अवधि के लिए उनकी प्रतिनियुक्ति की अवधि को और आगे बढ़ाये जाने के उनके अनुरोध को आंध्र प्रदेश सरकार ने1168 भारत का राजपत्र, दिसम्बर 26, 2015 (पौष 5, 1937) [भाग I—खण्ड 2 स्वीकार नहीं किया था और दिनांक 24.3.2006 से उनके मूल कैडर में उनका प्रत्यावर्तन कर दिया गया था। इसके पश्चात, श्रीमती अनुपमा सिंह ने अपने मूल संवर्ग में ड्‌यूटी के लिए रिपोर्ट नहीं किया।

2. श्रीमती अनुपमा सिंह को केन्द्रीय सिविल सेवा (छुट्टी) नियमावली, 1972 के नियम 25(2) और केन्द्रीय सिविल सेवा (आचरण) नियमावली, 1964 के नियम 3(1) (III) के प्रावधानों का उल्लंघन करने के कारण केन्द्रीय सिविल सेवा (वर्गीकरण नियंत्रण और अपील), नियमावली, 1965 के नियम 14 के अनुसार दिनांक 9.11.2011 को आरोप पत्र जारी किया गया था।

3. श्रीमती अनुपमा सिंह, जेसीआईटी, हैदराबाद, 25.3.2006 से आज की तारीख तक अप्राधि—त रूप से ड्‌यूटी से अनुपस्थित रही है। श्रीमती सिंह जांच अधिकारी के समक्ष उपस्थित होकर अपनी बात कहने का यथोचित अवसर दिए जाने के बावजूद भी वह जांच अधिकारी के समक्ष कभी भी उपस्थित नहीं हुई। श्रीमती अनुपमा सिंह (94027), जेसीआईटी की, निरन्तर अप्राधि—त अनुपस्थित की कुल अवधि 5 वर्ष से अधिक हो गई है।

4. केन्द्रीय सिविल सेवा (छुट्टी) नियमावली, 1972 के नियम 12(2) के साथ पठित डीओपीटी के सा.का.नि. 261(अ), दिनांक 29.3.2012 में यह प्रावधान है कि कोई भी सरकारी कर्मचारी जो कि विदेश सेवा को छोड़कर अपने कार्यभार से लगातार पांच वर्ष से अधिक की अवधि तक, अवकाश या अवकाश के बिना, अनुपस्थित रहता है तो उसके बारे में यह माना जाएगा कि उसने सरकार की सेवा से त्याग पत्र दे दिया है।

5. भारत के राष्ट्रपति ने सा.का.नि.261(अ), दिनांक 29.3.2012 के अंतर्गत प्रदत्त शक्तियों का प्रयोग करते हुए श्रीमती अनुपमा सिंह, जेसीआईटी, हैदराबाद की इस प्रकार की निरंतर अनुपस्थित को केन्द्रीय सिविल सेवा (छुट्टी) नियमावली, 1972 के नियम 12(2) के अंतर्गत दिनांक 25.3.2006 से भारतीय राजस्व सेवा से त्याग पत्र माने जाने के लिए अपनी सहमति दे दी है।

6. उक्त अधिकारी सेवानिवृत्ति की कोई भी प्रसुविधाएं पाने का हकदार नहीं होगा।

Anupama Singh, (94027), JCIT, Hyderabad had gone on deputation as Managing Director, Andhra Pradesh Women Cooperative Finance Corporation, Hyderabad for a period of two years with effect from the date she assumed charge of the post or until further order vide Board's order dated 18.02.2003. Her deputation period was further extended upto 09.03.2006. Her request for further extension of deputation period for another two years beyond 09.03.2006 was not accepted by the State Government of Andhra Pradesh and she was repatriated to her parent cadre on 24.03.2006. Thereafter, Smt. Anupama Singh did not report for duty in the parent cadre.

2. Smt. Anupama Singh was issued charge sheet dated 09.11.2011 in accordance with Rules 14 of CCS(CCA) Rules, 1965 for violating the provisions of Rule 25(2) of CCS(Leave) Rules, 1972 and Rule 3(1)(ii) and 3(1)(iii) of CCS(Conduct) Rules, 1964.

3. Smt. Anupama Singh, JCIT, Hyderabad has been unauthorizedly by absent from duty w.e.f 25.03.2006 till date. Smt. Singh has never appeared before the Inquiry officer to present her case despite reasonable opportunity provided to her. The total continuous period of unauthorized absence of Smt. Anupama Singh (94027), JCIT is more than five years.

4. DoPT G.S.R 261(E) dated 29.03.2012 read with Rule 12(2) of CCS(leave) Rules, 1972 provides that a government servant who remains absent from duty for a continuous period exceeding five years other than foreign service, with or without leave, shall be deemed to have resigned from the Government Service.

5. In exercise of power conferred under GSR 261(E) dated 29.3.2012, the President of India has accorded his consent to treat continuous absence of Smt. Anupama Singh, JCIT, Hyderabad as deemed resignation from India Revenue Service with effect from 25.03.2006 under Rule 12(2) of CCS(Leave) Rules, 1972.

6. The officer will not be entitled for any retirement benefits.
