आआआआ....अअअअ.... 11111111....----यतः, भारत निर्वाचन आयोग का समाधान हो गया है कि अरूणाचल प्रदेश राज्य में विधान सभा के साधारण निर्वाचन 2014 में नीचे की सारणी में स्तंभ (4) में विनिर्दिष्ट निर्वाचन क्षेत्र से लड़ने वाला अभ्यर्थी अपने नाम के सामने स्तम्भ (3) में विनिर्दिष्ट निर्वाचन क्षेत्र से आयोजित निर्वाचन में लोक प्रतिनिधित्व अधिनियम, 1951 तथा तद्धीन बनाए गए नियमों के अंतर्गत यथा अपेक्षित उक्त सारणी के स्तम्भ (5) में यथा दर्शित अपने निर्वाचन व्ययों का लेखा दाखिल करने में असफल रहा है ;
और यतः, उक्त अभ्यर्थी ने निर्वाचन आयोग द्वारा सम्यक नोटिस दिए जाने के बावजूद, उक्त असफलता के लिए या तो कोई उपयुक्त कारण अथवा स्पष्टीकरण नहीं दिया है, या उसके द्वारा दिए गए अभ्यावेदन, यदि कोई होंं, पर विचार करने के उपरान्त, भारत निर्वाचन आयोग का यह समाधान हो गया है कि उक्त असफलता के लिए उनके पास कोई उपयुक्त या न्यायोचित कारण नहीं है ;
अतः, अब, निर्वाचन आयोग उक्त अधिनियम की धारा 10क के अनुसरण में, नीचे की सारणी के स्तंभ (4) में विनिर्दिष्ट व्यक्तियों को संसद के किसी सदन या किसी राज्य/संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद् के लिए सदस्य चुने जाने और होने के लिए इस आदेश की तारीख से तीन वर्ष की अवधि के लिए निरर्हित घोषित करता हैः-

ELECTION COMMISSION OF INDIA

New Delhi, the 8th February, 2016
O. N. 11.—Whereas, the Election Commission of India is satisfied that the contesting candidate specified in column 4 of the Table below at the General Election to the Legislative Assembly, 2014 in the State of Arunachal Pradesh held from the constituency specified in column 3 against his name has failed to lodge the account of his election expenses as shown in column 5 of the said Table as required by the Representation of the People Act, 1951 and the Rules made thereunder;
And whereas, the said candidate has either not furnished any reason or explanation for the said failure even after due notice by the Election Commission or after considering the representation made by him, if any, the Election Commission is satisfied that he has no good reason or justification for the said failure;
Now, therefore, in pursuance of section 10A of the said Act, the Election Commission hereby declares the person specified in column 4 of the Table below to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order:

आआआआ....अअअअ.... 12121212....----यतः निर्वाचन आयोग का समाधान हो गया है कि नीचे की सारणी के स्तम्भ …2 में यथा विनिर्दिश्ट छत्तीसगढ़ राज्य से विधान सभा के साधारण निर्वाचन, 2013 के लिए जो स्तम्भ …3 में विनिर्दिश्ट निर्वाचन क्षेत्र से हुआ है स्तम्भ …4 में उसके सामने विनिर्दिश्ट निर्वाचन लड़ने वाला प्रत्येक अभ्यर्थी, लोक प्रतिनिधित्व अधिनियम, 1951 तथा तद्धीन बनाए गए नियमों द्वारा अपेक्षित उक्त सारणी के स्तम्भ…5 में यथादर्षित अपने निर्वाचन व्ययों का कोई भी लेखा दाखिल करने अथवा रीति के अनुसार लेखा दाखिल करने में असफल रहा है;
और, यतः उक्त अभ्यर्थियों ने, सम्यक् सूचना दिए जाने पर भी उक्त असफलता के लिए कोई कारण अथवा स्पश्टीकरण नहीं दिया है या उनके द्वारा दिये गये अभ्यावेदनों पर, यदि कोई हो, विचार करने के पष्चात् निर्वाचन आयोग का यह समाधान हो गया है कि उनके पास उक्त असफलता के लिए कोई पर्याप्त कारण या न्यायौचित्य नहीं है ;

N. 12.—Whereas, the Election Commission is satisfied that each of the contesting candidates specified in column (4) of the Table below at the General Election to the Legislative Assembly, 2013 from the State of Chhattisgarh as specified in column (2) held from the constituency specified in column(3) against his/her name, has failed to lodge any account of his/her election expenses at all or in the manner as required by the Representation of the People Act, 1951, and the rules made thereunder as shown in column(5) of the said Table;
And whereas, the said candidates have either not furnished any reason or explanation for the said failure even after due notice of the Election Commission, or after considering the representation if any, made by them, the Election Commission is satisfied that they have no good reason or justification for the said failure;

आआआआ....अअअअ.... 13131313....----लोक प्रतिनिधित्व अधिनियम, 1950 (1950 का 43) की धारा 13-क की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए भारत निर्वाचन आयोग गोवा राज्य सरकार के परामर्ष से एतद्द्वारा श्री प्रषांत गोयल, आई.ए.एस. के स्थान पर श्री अमज़द टाक, आई.ए.एस.(ए.जी.एम.यू.ः 2005) को उनके कार्यभार ग्रहण करने की तारीख से आगामी आदेषों तक के लिए गोवा राज्य के मुख्य निर्वाचन अधिकारी के रूप में नामित करता है।
2. श्री अमज़द टाक गोवा सरकार के अधीन सभी पदभार या किसी कार्य के पदभारों कोे तत्काल सौंप देंगे या धारण करना समाप्त कर देंगे जो कि वह ऐसा पदभार ग्रहण करने से पहले धारण कर रहे थे।
3. श्री अमज़द टाक, मुख्य निर्वाचन अधिकारी गोवा के रूप में कार्य करते हुए गोवा सरकार के अधीन किसी भी प्रकार का कोई अतिरिक्त कार्यभार ग्रहण नहीं करेंगे सिवाय इसके कि उनको राज्य सचिवालय में निर्वाचन विभाग के प्रभारी, सरकार का सचिव पदाभिहित किया जाएगा।

O. N. 13.—In exercise of the powers conferred by sub-section (1) of section 13A of the Representation of the People Act, 1950 (43 of 1950), the Election Commission of India in consultation with the Government of Goa hereby nominates Shri Amjad Tak, IAS (AGMU:2005) as the Chief Electoral Officer for the State of Goa with effect from the date he takes over charge and until further orders vice Shri Prashant Goyal , IAS.
2. Shri Amjad Tak shall cease to hold and hand over forthwith the charge of all or any charges of work under the Government of Goa, which he may be holding before such assumption of office.
3. Shri Amjad Tak while functioning as the Chief Electoral Officer, Goa shall not hold any additional charge whatsoever under the Government of Goa except that he should be designated Secretary to the Government in charge of Election Department in the State Secretariat.
