आ.अ.आ.अ.आ.अ.आ.अ. 46464646....----———— यत:, भारत निर्वाचन आयोग का समाधान हो गया है कि मेघालय राज्य में विधानसभा के साधारण निर्वाचन 2013 में नीचे की सारणी में अपने नाम के सामने के स्तंभ (3) में विनि"दष्ट निर्वाचन क्षेत्र से स्तंभ (4) में विनि"दष्ट निर्वाचन लड़ने वाला अ(यर्थी लोक प्रतिनिधित्व अिधिनयम, 1951 तथा त-ीन बनाए गए नियमों के अंतर्गत यथा अपेक्षित उक्त सारणी के स्तम्भ (5) में यथा द4शत अपने निर्वाचन 6यय का लेखा दाखिल करने में असफल रहा है;
और यत: उक्त अ(यर्थी ने निर्वाचन आयोग द्वारा सम्यक नोटिस दिए जाने के बावजूद उक्त असफलता के िलए या तो कोई कारण अथवा स्पष्टीकरण नह@ दिया है या निर्वाचन आयोग का यह समाधान हो गया है कि उक्त असफलता के िलए उनके पास कोई उपयुक्त या न्यायोचित कारण नह@ है;
अत: अब उक्त अिधिनयम की धारा 10-क के अनुसरण में, निर्वाचन आयोग नीचे की सारणी के स्तंभ (4) में विनि"दष्ट 6यक्ति को संसद के किसी सदन या किसी राज्य या संघ राज्य-क्षेत्र से लोक सभा या विधानसभा अथवा विधान परिषद् के लिए सदस्य चुने जाने और होने के िलए, इस आदेश की तारीख से तीन वर्ष की अवधि के लिए निर4हत करता है:-

O.N.46.— Whereas, the Election Commission of India is satisfied that the contesting candidate specified in column 4 of the Table below at the General Election to the Legislative Assembly 2013, in the Meghalaya State held from the constituency specified in column 3 against his name, has failed to lodge the account of his election expenses as shown in column 5 of the said Table as required by the Representation of the People Act, 1951 and the Rules made thereunder;
And whereas, the said candidate has either not furnished any reason or explanation for the said failure even after due notice by the Election Commission or the Election Commission is satisfied that he has no good reason or justification for the said failure;
Now, therefore, in pursuance of section 10A of the said Act, the Election Commission hereby declares the person specified in column 4 of the Table below to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order:

साधारण निर्वाचन, 2014 में नीचे की सारणी में अपने नाम के सामने के स्तम्भ (3) में विनि"दष्ट निर्वाचन क्षेत्र से स्तम्भ (4)
में विनि"दष्ट निर्वाचन लड़ने वाला प्रत्येक अ(यर्थी; लोक प्रतिनिधित्व अधिनियम, 1951 तथा त-ीन बनाए गए नियमों के [भाग IIखण्ड 3(iii)]भारत का राजपत्रा : जुलाई 16, 2016/आषाढ़25, 1938 183
अंतर्गत यथा अपेक्षित उक्त सारणी के स्तम्भ (5) में यथा द4शत अपने निर्वाचन Zयों का लेखा दाखिल करने में असफल रहा है;
और यतः, उक्त अ(य4थयों ने निर्वाचन आयोग द्वारा सम्यक नोटिस दिए जाने के बावजूद उक्त असफलता के लिए या तो कोई कारण अथवा स्पष्टीकरण नह@ दिया है या उनके द्वारा दिए गए अ(यावेदन यदि कोई हो; पर विचार करने के उपरान्त निर्वाचन आयोग का समाधान हो गया है कि उक्त असफलता के लिए उनके पास कोई उपयुक्त या न्यायोचित कारण नह@ है;

आआआआ....अअअअ.... 48484848....—जबकि, भारत निर्वाचन आयोग का समाधान हो गया है कि नीचे की सारणी के स्तम्भ (2) में यथा विनिर्दिष्ट उत्तर प्रदेश राज्य की विधान सभा के साधारण निर्वाचन, 2012 के लिए, जो स्तम्भ (3) में विनिर्दिष्ट निर्वाचन क्षेत्र से हुआ है, स्तम्भ (4) में उसके सामने विनिर्दिष्ट निर्वाचन लड़ने वाला प्रत्येक अभ्यर्थी, लोक प्रतिनिधित्व अधिनियम, 1951 तथा तद्धीन बनाए गए नियमों द्वारा अपेक्षित उक्त सारणी के स्तम्भ (5) में यथा दर्शित अपने निर्वाचन व्ययों का लेखा दाखिल करने में असफल रहे हैं; और
जबकि, उक्त अभ्यर्थियों ने सम्यक् सूचना दिए जाने पर भी उक्त असफलता के लिए या तो कोई कारण अथवा स्पष्टीकरण नहीं दिया है या उनके द्वारा दिए गए अभ्यावेदनों पर, यदि कोई हो, विचार करने के पश्चात् निर्वाचन आयोग का यह समाधान हो गया है कि उनके पास उक्त असफलता के लिए कोई पर्याप्त कारण या न्यायौचित्य नहीं है;

आआआआ....अअअअ.... 49494949....—यतः निर्वाचन आयोग का समाधान हो गया है कि उत्तर प्रदेश राज्य से विधान सभा के लिए उप निर्वाचन 2015 में 315-फरेन्दा विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी श्री किशुन, ग्राम-सिंहपुर अयोध्या, पो0-बरगदवा हरैया, तहसील-फरेन्दा, जिला-महराजगंज, उत्तर प्रदेश लोक प्रतिनिधित्व अधिनियम, 1951 तथा तद्धीन बनाए गए नियमों के अधीन अपने निर्वाचन व्ययों का लेखा दाखिल करने में असफल रहे हैं ;
और जबकि अभ्यर्थी श्री किशुन ने सम्यक् सूचना दिए जाने पर भी उक्त असफलता के लिए कोई कारण अथवा स्पष्टीकरण नहीं दिया है और निर्वाचन आयोग का यह समाधान हो गया है कि उनके पास उक्त असफलता के लिए कोई पर्याप्त कारण या न्यायौचित्य नहीं है ;

O.N. 49.—Whereas, the Election Commission is satisfied that Shri Kishun, Vill.-Singhpur Ayodhya, Post- Bargadwa Haraiya, Tehsil- Pharenda, Distt.-Maharajganj, Uttar Pradesh, a contesting candidate for the Bye Election to the Legislative-Assembly, 2015 from 315-Pharenda Assembly Constituency in the State of Uttar Pradesh has failed to lodge any account of his election expenses as required by the Representation of the People Act, 1951 and Rules and Order made thereunder; and
Whereas, Shri Kishun has not furnished any reason or explanation for the said failure even after due notice and the Election Commission is thus satisfied that he has no good reason or justification for the said failure;
Now, therefore, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission hereby declares the said Shri Kishun to be disqualified for being chosen as, and for being, a member of either House of the Parliament or of the Legislative Assembly or Legislative Council of a State for a period of three years from the date of this order.

आआआआ....अअअअ.... 50505050....—यतः निर्वाचन आयोग का समाधान हो गया है कि उत्तर प्रदेश राज्य से विधान सभा के लिए उप निर्वाचन 2014 में 173-लखनऊ पूर्व विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी श्री अनूप श्रीवास्तव, सी-4, नेहरू विहार कल्यानपुर, लखनऊ 226022, उत्तर प्रदेश लोक प्रतिनिधित्व अधिनियम, 1951 तथा तद्धीन बनाए गए नियमों के अधीन अपने निर्वाचन व्ययों का लेखा दाखिल करने में असफल रहे हैं ;
और जबकि अभ्यर्थी श्री अनूप श्रीवास्तव ने सम्यक् सूचना दिए जाने पर भी उक्त असफलता के लिए कोई कारण अथवा स्पष्टीकरण नहीं दिया है और निर्वाचन आयोग का यह समाधान हो गया है कि उनके पास उक्त असफलता के लिए कोई पर्याप्त कारण या न्यायौचित्य नहीं है ;
अतः अब, निर्वाचन आयोग एतद्द्वारा उक्त अधिनियम की धारा 10-क के अनुसरण में श्री अनूप श्रीवास्तव को संसद के किसी भी सदन के या किसी राज्य की विधान सभा अथवा विधान परिषद् के सदस्य चुने जाने और होने के लिए इस आदेश की तारीख से तीन वर्श की कालावधि के लिए निरर्हित घोषित करता है ;

O.N. 50.—Whereas, the Election Commission is satisfied that Shri Anup Srivastava, C-4, Nehru Vihar Kalyanpur, Lucknow.226022, Uttar Pradesh, a contesting candidate for the Bye Election to the Legislative Assembly, 2014 from 173-Lucknow East Assembly Constituency in the State of Uttar Pradesh has failed to lodge any account of his election expenses as required by the Representation of the People Act, 1951 and Rules and Order made thereunder; and
Whereas, Shri Anup Srivastava has not furnished any reason or explanation for the said failure even after due notice and the Election Commission is thus satisfied that he has no good reason or justification for the said failure;
Now, therefore, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission hereby declares the said Shri Anup Srivastava to be disqualified for being chosen as, and for being, a member of either House of the Parliament or of the Legislative Assembly or Legislative Council of a State for a period of three years from the date of this order.

आआआआ....अअअअ.... 51515151.—यत:, निर्वाचन आयोग ने दिनांक 31 दिसम्बर, 2013 के अपने आदेश सं. 76/असम- वि.स./2011 के द्वारा वर्ष 2011 में आयोजित 54-गुवाहाटी प/िम विधान सभा निर्वाचन क्षेत्र से असम विधान सभा के साधारण निर्वाचन में निर्वाचन लड़ने वाले अ6यर्थी, 9ी रंजीत कु मार डेका, मकान सं. 78, वार्ड-35, चेनीकु ठी, गुवाहाटी-3, असम को विधि द्वारा अपेक्षित रीति से निर्वाचन <य का अपना लेखा दाखिल नह> करने के
िलए, लोक प्रतिनिधित्व अधिनियम की धारा 10क के अधीन संसद के किसी सदन या किसी राज्य की विधान सभा या विधान परिषद के लिए सदस्य चुने जाने और होने के लिए तीन वर्ष की अवधि के लिए निरGहत घोषित कर दिया था।
और यतः उक्त 9ी रंजीत कु मार डेका ने उक्त आदेश के विMN लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 11 के अधीन एक अपील दायर की थी तथा दिनांक 23 फरवरी, 2016 की कथित अपील में दिए गए कारणों के आधार पर निरर्हता हटाने के लिए अनुरोध किया था।
यत:, सक्षम प्राधिकारी ने लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 11 के अधीन अपील पर निर्णय
लेने के लिए उपयु र्क्त आवेदक को वैयक्तिक सुनवाई का अवसर देने का निर्णय लिया तथा उसे सुनने के प/ात दिनांक 16 मई, 2016 के अपने आदेश के द्वारा यह निर्णय लिया है कि दिनांक 31 दिसम्बर, 2013 के आदेश सं. 76/असम-वि.स/2011 द्वारा उक्त 9ी रंजीत कु मार डेका पर अधिरोपित निरर्हता तत्काल प्रभाव से हटा ली जाए।
अतः, अब, आयोग के दिनांक 31 दिसम्बर, 2013 के आदेश सं. 76/असम-वि.स/2011 से संलT सारणी के Uम सं. 5 पर उल्लिखित 9ी रंजीत कु मार डेका का नाम 16 मई, 2016 से हटा दिया जाए।

O.N.51.—Whereas, the Election Commission vide its Order No.76/AS-LA/2011 dated 31st December, 2013 had disqualified under Section 10A of the Representation of the People Act, Shri Ranjeet Kr. Deka, House No. 78, Ward –35,Chenikuthi, Guwahati-3, Assam, a contesting candidate in the General Election to the Assam Legislative Assembly from 54-Guwahati West Legislative Assembly Constituency, held in the year 2011, for being chosen as, and for being a member of either House of the People or of the Legislative Assembly or Legislative Council of a State for a period of three years, for not lodging his account of election expenses in the manner required by law.
And Whereas, the said Shri Ranjeet Kr. Deka , had preferred an appeal under Section 11 of the Representation of People Act, 1951 against the said Order and had requested for the removal of the disqualification for the reasons stated in the said appeal dated 23rd February, 2016.
Whereas, the Competent Authority decided to give a personal hearing to the aforesaid applicant for deciding the appeal under section 11 of the Representation of the People Act,1951 and having heard him, has decided vide its order dated 16th May, 2016 that the disqualification imposed on said Shri Ranjeet Kr. Deka vide Order No. 76/AS- LA/2011 dated 31st December, 2013 shall be revoked with immediate effect.
Now, Therefore, the name of Shri Ranjeet Kr. Deka appearing at Serial no.5 of the Table appended with Commission's Order no. . 76/AS-LA/2011 dated 31st December, 2013 be omitted w.e.f. 16th May, 2016.
