आ.अ.आ.अ.आ.अ.आ.अ. ^52525252....————यतः, श्री सतपॉल ने पंजाब विधन सभा के साधरण निर्वाचन, 2012 में 33-करतारपुर विधन सभा निर्वाचन-क्षेत्रा से निर्वाचन लड़ा था, जिसका परिणाम 06.03.2012 को घोषित किया गया था और लोक प्रतिनिध्त्वि अध्निियम, 1951 की धरा 78 के अनुसार उनके लिए अपेक्षित था कि वे निर्वाचन की तारीख से तीन दिनों के भीतर जिला निर्वाचन अध्किारी, जालंध्र के समक्ष विध् ि द्वारा अपेक्षित रीति से निर्वाचन खर्चों के लेखे की अपनी सत्य प्रतिलिपि दाखिल करें।

यत:, (cid:1)ी सतपॉल लोक प्रतिनिधित्व अिधिनयम, 1951 की उक्त धारा 78 के अंतर्गत यथा-विनि(cid:28)दष्ट विधि द्वारा अपेक्षित रीति से जिला निर्वाचन अधिकारी, जालंधर के समक्ष निर्वाचन खच' का अपना लेखा दाखिल करने में विफल रहे जैसा कि निर्वाचनों का संचालन नियम, 1961 के नियम 89 के अंतर्गत जिला निर्वाचन अिधकारी, जालंधर द्वारा सूचित किया गया है कि अ3यर्थी ने अपने लेखे में वाहन खच' के मद में 5. 11660/- (5पए ग्यारह हजार छह सौ साठ मात्र) की धनरािश कम करके बताई है ।

यत:, भारत निर्वाचन आयोग द्वारा नोटिस दिनांक 15.9.2014 जारी किया गया था जिसमें उनसे अपेक्षा की गई थी कि वे नोटिस मिलने के 20 दिनों के भीतर विहित रीति से अपना लेखा प्रस्तुत करें, ऐसा नहJ करने पर यह कहा गया था

3439 GI/2016 (189)190 GAZETTE OF INDIA : JULY 23, 2016/SRAVANA 1, 1938 [PART II—SEC. 3 (iii)] कि उन्हें तीन वष' की अवधि के लिए निर्वाचन लड़ने से निरNहत कर दिया जाएगा। उन्हें नोटिस 2 अक्तूबर, 2014 को सPपा गया था, और

यत:, जिला निर्वाचन अधिकारी एवं जिला कलेक्टर, जालंधर जिला ने अपने पत्र सं. निर्वाचन-2015/1987, दिनांक 30.11.2015 के जरिए सूचित किया था कि (cid:1)ी सतपॉल ने रिपोर्ट की तारीख तक विधि द्वारा अपेक्षित रीति से निर्वाचन खच' का अपना लेखा दाखिल नहJ किया था और इसिलए, भारत निर्वाचन आयोग ने उक्त अधिनियम और तदंतर्गत बनाए गए नियम और किए गए आदेश के द्वारा अपेक्षित रीति से निर्वाचन खच' का अपना लेखा दाखिल करने में विफल रहने के िलए, लोक प्रतिनिधित्व अिधिनयम, 1951 की धारा 10क के अंतर्गत अपने आदेश सं. 76/पीबी-एलए/2015 (1) दिनांक 7 जून, 2016 के जरिए (cid:1)ी सतपॉल को संसद/राज्य विधान मंडल के किसी भी सदन का निर्वाचन लड़ने से निरNहत कर दिया;

और

यत:, (cid:1)ी सतपॉल ने आयोग के समक्ष शपथ-पत्र के साथ एक आवेदन यह कहते Zए दाखिल किया कि उन्होंने पहले ही जिला निर्वाचन अधिकारी, जालंधर के समक्ष 29.3.2012 को अपना निर्वाचन [यय लेखा दाखिल कर दिया था और उन्हें प्रचार अवधि के दौरान किसी भी प्रकार की न्यूनोक्ति के बारे में सूचित नहJ किया गया था।

यत:, (cid:1)ी सतपॉल ने वाहन [यय के मद में 5 11600/- की अंतर-राशि के समर्थन में शपथ-पत्र दिनांक 16.06.2016 भी इस अनुरोध के साथ दाखिल किया है कि उसे उनके कु ल [यय, जो 5 518675/- बन जाएगा और जो पंजाब के विधान सभा निर्वाचन-क्षेत्र के निमित्त 5. 16 लाख की ऊपरी सीमा से काफी कम है। साथ ही, उन्होंने अपनी निरर्हता हटाने का अनुरोध भी किया है।

अत:, अब, मामले के सभी तथ्यों एवं परिस्थितियों पर विचार करने और (cid:1)ी सतपॉल द्वारा दिए गए अ3यावेदन पर िवचार करने के उपरांत, आयोग ने लोक प्रतिनिधित्व अिधिनयम, 1951 की धारा 11 द्वारा प्रदत्त शक्ति का प्रयोग करते Zए, उन पर दिनांक 07.06.2016 को अधिरोपित निरर्हता हटाने का निर्णय लिया है। परिणामत:, आयोग के आदेश सं. 76/पीबी- एलए/2015, दिनांक 07.06.2016 में aम सं. 37 पर उल्लिखित उक्त अ3यर्थी, (cid:1)ी सतपॉल का नाम उक्त आदेश से, दिनांक 06.07.2016 से छोड़ा Zआ माना जाए।

New Delhi, the 6th July, 2016

O.N. 52.—Whereas, Sh. Satpaul contested the General Election to the Legislative Assembly of Punjab, 2012 from 33-Kartarpur Assembly Constituency, result thereof was declared on 06.03.2012 and as per Section 78 of the Representation of People Act, 1951, he was required to file his true copy of the account of election expenses in the manner required by law before the District Election Officer, Jalandhar within thirty days from the date of election.

Whereas, Sh. Satpaul failed to file his account of election expenses in the manner required by law as stipulated under the said Section 78 of the Representation of the People Act, 1951 before the District Election Officer, Jalandhar as reported by the District Election Officer, Jalandhar under Rule 89 of the Conduct of Election Rules, 1961 as the candidate has understated an amount of Rs. 11660/- (Eleven Thousand six hundred sixty) on account of vehicle expenses in his accounts.

Whereas, a Notice dated 15.9.2014 was issued by the Election Commission of India, requiring him to submit his accounts in manner within 20 days of the receipt of notice failing which it was stated that he would be disqualified from contesting elections for a period of three years. The notice was delivered to him on 2nd October, 2014, and

Whereas, the District Election Officer & District Collector, Jhalandhar District had intimated vide his letter No. Elec-2015/1987, dated 30.11.2015 that Sh. Satpaul had not filed his account of election expenses in the manner required by law on the date upto report and so the Election Commission of India vide its order No. 76/PB-LA/2015 (1) dated 7th June, 2016 disqualified Sh. Satpaul from the contesting election of any House of the Parliament/State Legislative under[भाग IIखण्ड 3(iii)]भारत का राजपत्रा : जुलाई 23, 2016/श्रावण1, 1938 191 section 10A of the Representation of the People Act, 1951 for failure to lodge his account of election expenses in the manner as required by the said Act and the Rule and order made there under; and

Whereas, Sh. Satpaul filed an application alongwith affidavit before the Commission stating that he had already lodged his election expenditure account on 29.3.2012 before the District Election Officer, Jalandhar and he was not informed about any understatement during campaign period.

Whereas, Sh. Satpaul has also filed an affidavit dated 16.06.2016 in support of difference amount of Rs. 11660/- towards vehicle expenditure with a request to add the same to his total expenditure which would become Rs. 518675/- which is far below the ceiling of Rs. 16 Lakh meant for an Assembly Constituency of Punjab with request to remove his disqualification.

Now, therefore, after taking into consideration all facts and circumstances of the case and the submission made by Sh. Satpaul, the Commission in exercise of the power conferred by Section 11 of the Representation of the People Act, 1951, has decided to remove the disqualification imposed upon him on 07.06.2016. Consequently, the name of the said candidate Sh. Satpaul appearing at Sl. No. 37 in the Commission Order No. 76/PB-LA/2015, dated 07.06.2016 shall be deemed to have been omitted from the said order with effect from 06.07.2016.

आदेशआदेशआदेशआदेश नई दिल्ली, 7 जुलाई,2016 आ.अ. ⁵³.—यतः निर्वाचन आयोग का समाधान हो गया है कि नीचे की सारणी के स्तम्भ ;2द्ध में यथा विनिर्दिष्ट बिहार राज्य से लोक सभा के साधारण निर्वाचन, 2014 के लिए जो स्तम्भ ;3द्ध में विनिर्दिष्ट निर्वाचन क्षेत्रा से हुआ है स्तम्भ ;4द्ध में उसके सामने विनिर्दिष्ट निर्वाचन लड़ने वाला प्रत्येक अभ्यर्थी, लोक प्रतिनिध्त्वि अध्निियम, 1951 तथा तद्‌ध्ीन बनाए गए नियमों द्वारा अपेक्षित उक्त सारणी के स्तम्भ ;5द्ध में यथादर्शित अपने निर्वाचन व्ययों का कोई भी लेखा दाखिल करने अथवा रीति के अनुसार लेखा दाखिल करने में असपफल रहा है

और, यतः उक्त अभ्यर्थियों ने, सम्यक्‌ सूचना दिए जाने पर भी उक्त असपफलता के लिए कोई कारण अथवा स्पष्टीकरण नहीं दिया है या उनके द्वारा दिये गये अभ्यावेदनों पर, यदि कोई हो, विचार करने के पश्चात्‌ निर्वाचन आयोग का यह समाधन हो गया है कि उनके पास उक्त असपफलता के लिए कोई पर्याप्त कारण या न्यायौचित्य नहीं है

अतः अब, निर्वाचन आयोग उक्त अध्निियम की धरा 10-क के अनुसरण में नीचे की सारणी के स्तम्भ ;4द्ध में विनिर्दिष्ट व्यक्तियों को संसद के किसी भी सदन के या किसी राज्य/संघ राज्य की विधन सभा अथवा विधन परिषद्‌ के सदस्य चुने जाने और सदस्य होने के लिए इस आदेश की तारीख से तीन वर्ष की कालावध् िके लिए निरर्हित घोषित करता है :-

O.N. 53— Whereas, the Election Commission is satisfied that each of the contesting candidates specified in

column (4) of the Table below at the General Election to the House of the People, 2014 from the State of Bihar as specified in column (2) held from the constituency specified in column (3) against his/her name, has failed to lodge any account of his/her election expenses at all or in the manner as required by the Representation of the People Act, 1951, and the rules made thereunder as shown in column (5) of the said Table;

And whereas, the said candidates have either not furnished any reason or explanation for the said failure even after due notice of the Election Commission, or after considering the representation, if any made by them, the Election Commission is satisfied that they have no good reason or justification for the said failure;

Now, therefore, pursuance of Section 10A of the said Act, the Election Commission hereby declares the persons specified in column(4) of the Table below to be disqualified for being chosen as, and for being a member of either House of the Parliament or of the Legislative Assembly or Legislative Council of a State/Union Territory for a period of three years from the date of this order:-
