संदर्भ : वर्श 2012 में आयोजित विधान सभा के साधारण निर्वाचन में 108-भोगांव विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी श्री शैलेन्द्र सिंह उर्फ बिल्टन पर लोक प्रतिनिधित्व अधिनियम, 1951 (1951 का 43) की धारा 10क के अधीन अधिरोपित निरर्हता को हटाने के लिए उक्त अधिनियम की धारा 11 के अधीन अपील ।

आ. अ. 4.—यतः, विधान सभा साधारण निर्वाचन, 2012 के दौरान उत्तर प्रदेश राज्य में 108-भोगांव विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी श्री शैलेन्द्र सिंह उर्फ बिल्टन को आयोग के दिनांक 07.12.2016 के आदेश संख्या 76/उ.प्र.-वि.स./2012 के द्वारा निर्वाचन व्ययों का लेखा दाखिल न करने के कारण लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अधीन निरर्हित घोषित कर दिया गया था; और यतः, आयोग के दिनांक 07.12.2016 के निरर्हता आदेष प्राप्त कर लेने के पश्चात्‌ श्री शैलेन्द्र सिंह उर्फ बिल्टन ने आयोग के उपरोक्त आदेष द्वारा उन पर अधिरोपित निरर्हता हटाने के लिए, सुसंगत दस्तावेजों सहित, उक्त अधिनियम की धारा 11 के अधीन तथा माननीय उच्च न्यायालय, इलाहाबाद के आदेष दिनांक 03.01.2017 के आलोक में दिनांक 09.01.2017 को अपने अभ्यावेदन के द्वारा एक अपील प्रस्तुत की थी; और

यतः, उन्हें इस संदर्भ में उन्हें व्यक्तिगत सुनवाई का मौका दिया गया; और

यतः, अपीलीय प्राधिकारी द्वारा दिनांक 23.01.2017 को आयोग के सचिवालय में श्री शैलेन्द्र सिंह उर्फ बिल्टन को व्यक्तिगत रूप से सुना गया; औरयतः, श्री शैलेन्द्र सिंह उर्फ बिल्टन को सुनने के पश्चात्‌ अपीलीय प्राधिकारी का यह समाधान हो गया है कि उनके पास विधि द्वारा अपेक्षित रीति तथा समय-सीमा के अंदर लेखे को प्रस्तुत करने में असफल रहने का पर्याप्त कारण था; और इसके अतिरिक्त उन्होंने यह भी नोट किया कि उपर्युक्त अभ्यर्थी ने अब अपना निर्वाचन लेखा अपेक्षित रीति से दाखिल कर दिया है; और यतः, अपीलीय प्राधिकारी ने दिनांक 07.12.2016 के उपर्युक्त आदेष द्वारा उन पर अधिरोपित निरर्हता को प्रतिसंहरित करने का निर्णय लिया है और यह भी निर्णय लिया है कि इसे 23.01.2017 से प्रतिसंहरित किया जाए; और 369 GI/2017 (19) 20 THE GAZETTE OF INDIA : FEBRUARY 4, 2017/MAGHA 15, 1938 [PART II—SEC. (iii)] अब, इसलिए श्री शैलेन्द्र सिंह उर्फ बिल्टन, जो एक निर्वाचन लड़ने वाले अभ्यर्थी हैं, पर आयोग के दिनांक 07.12.2016 के आदेश संख्या 76/उ.प्र.-वि.स./2012 द्वारा अधिरोपित निरर्हता को दिनांक 23.01.2017 से प्रतिसंहरित किया जाता है । [सं. 76/उ.प्र.-वि.स./108/2012] आदेष से,

ORDER

New Delhi, the 23rd January, 2017

In re: Appeal under Section 11 of the Representation of the People Act, 1951 (43 of 1951) for

removal of disqualification imposed under Section 10A of the said Act on Shri Shailendra

Singh @ Bilton, a contesting candidate from 108-Bhogaon Assembly Constituency in the

State of Uttar Pradesh at the General Election to Legislative Assembly held in 2012.

O. N. 4.—Whereas, Shri Shailendra Singh @ Bilton, a contesting candidate from 108-Bhogaon Assembly Constituency in the State of Uttar Pradesh during Legislative Assembly General Election, 2012, had been disqualified under Section 10A of the Representation of People Act, 1951, for not filing account of election expenses, vide Commission's Order No. 76/UP-LA/2012, dated 07.12.2016; and

Whereas, after receipt of the Commission's disqualification order dated 07.12.2016, Shri Shailendra Singh @ Bilton, has presented, an appeal dated 09.01.2017 in light of the Order dated 03.01.2017 of Hon'ble High Court of Allahabad, under Section 11 of the aforesaid Act, along with relevant documents, for removal of disqualification imposed on him vide Commission's aforesaid order; and

Whereas, he has been given a personal hearing in this regard; and

Whereas, the Appellate Authority has heard Shri Shailendra Singh @ Bilton, in person on 23.01.2017 in the Commission's Secretariat; and

Whereas, on hearing Shri Shailendra Singh @ Bilton, the Appellate Authority is satisfied that he has good reasons for his failure to lodge any account within the time and in the manner prescribed by law and has further noted that the aforesaid candidate has now filed his election account in the manner prescribed; and

Whereas, the Appellate Authority has decided to revoke disqualification imposed upon him vide aforesaid Order dated 07.12.2016 and has further decided to revoke it with effect from 23.01.2017; and

Now, therefore, the disqualification imposed upon Shri Shailendra Singh @ Bilton, a contesting candidate vide Commission's Order 76/UP-LA/2012, dated 07.12.2016 is revoked with effect from 23.01.2017.
