आ.अ. 15.—यत: श्री रणवीर सिह गुढा ने 31-खेतड़ी विधान सभा निर्वाचन क्षेत्र से राजस्थान विधान सभा के साधारण निर्वाचन, 2013 का निर्वाचन लड़ा था जिसका परिणाम 08.12.2013 को घोषित हुआ था और लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन की तारीख से तीस दिनों के अंदर जिला निर्वाचन अधिकारी, झुन्झुनू के समक्ष उन्हें अपने निर्वाचन व्यय के लेखे की सत्य प्रतिलिपि विधि द्वारा अपेक्षित तरीके से दाखिल करना अपेक्षित था।
यत:, श्री रणवीर सिह गुढा ने निर्वाचन का संचालन नियम, 1961 के नियम 89 के अधीन जिला निर्वाचन अधिकारी, झुन्झुनू द्वारा यथासूचित जिला निर्वाचन अधिकारी, झुन्झुनू के समक्ष लोक प्रतिनिधित्व अधिनियम 1951 की उक्त धारा 78 के अधीन यथा निर्धारित विधि द्वारा अपेक्षित तरीके से निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे क्योंकि अभ्यर्थी ने अपने लेखे में वाहन व्यय के संबंध में, रु.1,08,500/- (एक लाख आठ हज़ार पांच सौ रूपये) की धनराशि की न्यूनोक्ति की थी।
यत:, भारत निर्वाचन आयोग द्वारा दिनॉक 05.11.2014 को एक नोटिस जारी किया गया था जिसमें उनसे नोटिस की प्राप्ति के 20 दिनों के अंदर लेखा सही तरीके से प्रस्तुत करने की अपेक्षा की गई थी, जिसके न करने पर ऐसा कहा गया था कि उन्हें तीन वर्षों की अवधि के लिए निर्वाचन लड़ने से निरहित घोषित कर दिया जाएगा। उक्त नोटिस 08 जून, 2015 को उन्हें डेलीवर कर दिया गया था, और

(83) यत:, जिला निर्वाचन अधिकारी-सह-जिला-कलेक्टर, झुन्झुनू जिला ने दिनांक 09.12.2015 की पत्र संख्या एफ 37(3)(9)वी.एस./निर्वा/14/1765 और दिनांक 12.04.2016 के पत्र संख्या एफ37(3)(9)वी.एस./निर्वा/13/348 के द्वारा सूचित किया था कि श्री रणवीर सिह गुढा ने रिपोर्ट की तारीख तक विधि द्वारा अपेक्षित तरीके से अपने निर्वाचन व्यय के लेखे दाखिल नहीं किए थे और इसलिए भारत निर्वाचन आयोग ने दिनांक 07 जून, 2016 के अपने आदेश संख्या 76/राजस्थान- वि.स/2013 के द्वारा श्री रणवीर सिह गुढा को लोक प्रतिनिधित्व अधिनियम, 1951 और तद्धीन बनाए गए नियम और आदेश द्वारा यथापेक्षित विधि से अपने निर्वाचन व्यय का लेखा प्रस्तुत करने में असफल रहने के कारण संबंधित अधिनियम की धारा 10 के अधीन संसद/विधान-मंडल के किसी भी सदन से निर्वाचन लड़ने से निरहित घोषित कर दिया था;
और
यत:, श्री रणवीर सिह गुढा ने शपथपत्र के साथ यह कहते हुए एक आवेदन प्रस्तुत किया कि प्रचार अवधि के दौरान संबंधित आर ओ द्वारा न्यूनोक्ति के संबंध में उन्हें एक नोटिस, दिनांक 27.11.2013, दिया गया था। उसके पश्चात, उन्होंने दिनांक 29.11.2013 को उसका जवाब प्रस्तुत कर दिया था। तत्पश्चात्, उन्होंने दिनांक 07.01.2014 अर्थात् लेखा दाखिल करने की अंतिम तारीख को अपना लेखा दाखिल किया था, तथापि जिला निर्वाचन अधिकारी, झुन्झुनू ने रिर्पोट किया था कि डीईएमसी ने दिनॉक 09.01.2014 को हुई अपनी बैठक में निर्णय लिया था कि उनके लेखे में 1,08,500/- रूपये की न्यूनोक्ति राशि का हिसाब लिया जाए किन्तु इस संबंध में उन्हें कभी संसूचित नहीं किया गया। यदि वाहन भाड़े पर लेने की रु. 1,08,500/- रूपये की न्यूनोक्ति सम्बन्धी राशि को भी उनके निर्वाचन व्यय में जोड़ दिया जाए तब भी कु ल व्यय 5 लाख रूपये से अधिक नहीं होता है जो कि निर्धारित सीमा से बहुत कम है और उन्होंने आयोग से अनुरोध किया कि लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 11 के अधीन दिनांक 07.06.2016 के निरर्हता आदेश को हटा दिया जाए।
अत:, अब मामले के सभी तथ्यों और परिस्थितियों और श्री रणवीर सिह गुढा द्वारा किए गए निवेदन पर विचार करते हुए, आयोग ने लोक प्रतिनिधित्व अधिनियम 1951 की धारा 11 के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, उन पर दिनांक 07.06.2016 को अधिरोपित निरर्हता को हटाने का निर्णय लिया है। परिणामस्वरूप, आयोग के दिनांक 07.06.2016 के आदेश संख्या 76/राज-वि.स./2016 में क्रम संख्या 19 पर प्रदशित उक्त अभ्यर्थी श्री रणवीर सिह गुढा का नाम दिनांक 03.05.2017 से उक्त आदेश से छोड़ा हुआ माना जाएगा।

Whereas, the District Election Officer-cum-District Collector, Jhunjhunu District had intimated vide his letters No. F 37(3)(9)V.S./Elec./14/1765, dated 9.12.2015 and F 37(3)(9)V.S./Elec./13/348, dated 12.04.2016 that Sh. Ranveer Singh Gudha had not filed his account of election expenses in the manner required by law on the date upto report and so the Election Commission of India vide its order No. 76/RJ/LA/2013, dated 07.06 2016 disqualified Sh. Ranveer Singh Gudha from contesting election of any House of the Parliament/State Legislative under section 10A of the Representation of the people Act, 1951 for failure to lodge his account of election expenses in the manner as required by the said Act and the Rule and Order made thereunder; and
Whereas, Sh. Ranveer Singh Gudha has submitted a representation alongwith and affidavit stating therein during the campaign period, a notice dated 27.11.2013 was served upon him by the RO concerned regarding understatement of expenditure and he had submitted reply thereof on dated 29.11.2013. After that he had filed his accounts on 07.01.2014 i.e. the last date of filling of accounts, however, the District Election Officer, Jhunjhunu reported that the DEMC in its meeting held on 09.01.2014 decided to account for the understated amount of Rs. 1,08,500/- in his account and even it was never communicated to him. Even if understated expenditure amount Rs. 1, 08,500/- on account of vehicle hiring is added to his election expenditure account even then the total expenditure does not cross Rs. 5 lakhs which is much below than the prescribed limit and has requested the commission to remove the disqualification order dated 07.06.2016 under section 11 of R.P. Act.1951.
Now, therefore, after taking into consideration all facts and circumstances of the case and the submission made by Sh. Ranveer Singh Gudha, the commission in exercise of the power conferred by Section 11 of the Representation of the People Act, 1951, has decided to remove the disqualification imposed upon him on 07.06.2016. Consequently, the name of the said candidate Sh. Ranveer Singh Gudha appearing at Sl. No.19 in the Commission Order No. 76/RJ- LA/2016, dated 07.06.2016 shall be deemed to have been omitted from the said order with effect from 03.05.2017.
