i) ''ऐसे मामलों जिनमें समाशोधन गृह या तो सामान्य रूप से या विशेष रूप से निर्दिष्ट करता है, उनमें डिलीवरी देने और प्राप्त करने वाले क्लीयरिंग सदस्य'' शब्दों के लिए ''क्लीयरिंग सदस्य'' शब्दों को प्रतिस्थापित किया जाएगा।

ii) ''विनियमन'' शब्द के लिए ''नियम'' शब्द प्रतिस्थापित किया जाएगा।

4. एम सी एक्स उप-विधियों की उप-विधि 10.5 में,-

i) दूसरे पैरा के लिए निम्नलिखित पैरा प्रतिस्थापित किया जाएगा, नामतः

''संबद्ध प्राधिकारी बकाया स्थिति वाले बिक्री कर्ताओं, जो डिलीवरी आदेश जारी करने में विफल रहते हैं, अर्थदण्ड विनिर्धारित कर सकता है। खरीददार की चूक या बिक्रीकर्ता की चूक के मामलों में एक्सचेंज गैर-चूककर्ता पार्टी को किसी मौद्रिक हानि को पूरा करने के लिए वित्तीय मुआवजे की गारंटी करेगा''

ii) तीसरी पैरा के लिए निम्नलिखित पैरा प्रतिस्थापित किया जाएगा, नामतः

''खरीददार, जो डिलीवरी आदेश को स्वीकार करने में विफल रहता है, को निपटान मूल्य और देय तारीख की दर के बीच अंतर अदा करना अपेक्षित होगा और इसके अलावा उन्हें ऐसा अर्थदण्ड भी अदा करना अपेक्षित होगा, जैसाकि एक्सचेंज द्वारा निर्णय लिया जाता है। खरीददार की चूक या बिक्रीकर्ता की चूक के मामले में एक्सचेंज गैर-चूककर्ता पार्टी को किसी मौद्रिक हानि को पूरा करने के लिए वित्तीय मुआवजे की गारंटी देगा।''

5. एम सी एक्स उप-विधियों की उप-विधि 10.21 के पश्चात्‌ निम्नलिखित उप-विधि अंतःस्थापित की जाएगी, नामतः

''10.22 इन उप-विधियाोंं में कुछ भी होने के बावजूद एक्सचेंज ठीक डिलीवरी को सुनिश्चित करेगा।'

MULTI COMMODITY EXCHANGE OF INDIA LIMITED

MUMBAI

The Securities and Exchange Board of India (SEBI), in exercise of its powers under Section 9 of the Securities Contracts (Regulation) Act, 1956, has, vide its letter SEBI/HO/CDMRD/DEA/P/2017/024420/1 dated October 06, 2017, approved the following amendments to the Bye-laws of Multi Commodity Exchange of India Limited (MCX or the Exchange). The amendments to the Bye-laws of the Exchange shall be effective from the date of its publication in the Gazette of India.

AMENDMENTS IN THE BYE-LAWS OF MCX

1. In Bye-law 7.8.2 of the MCX Bye-laws, the second proviso appearing after the words "or documents between Members" shall be substituted with the following proviso, namely:-

"Provided however that the nature of guarantee by the Clearing House is strictly financial, that is : In case of buyer default or seller default, the Exchange shall guarantee financial compensation to make good any monetary loss to non-defaulting party."

2. For Bye-law 9.12 of the MCX Bye-laws, the following Bye-law shall be substituted, namely:-

"9.12 The Relevant Authority may determine and announce from time to time operational parameters regarding clearing of trades/transactions through the Clearing House of the Exchange to ensure guarantee to settlement of trades including good delivery."

3. In Bye-law 9.14 of the MCX Bye-laws,-

(i) for the words and symbol "In cases where the Clearing House may specify either generally or specifically, clearing members" the words "Clearing members" shall be substituted.

(ii) for the word "Regulations", the word "Rules" shall be substituted.

4. In Bye-law 10.5 of the MCX Bye-laws,-

(i) for the second paragraph, the following paragraph shall be substituted, namely;

"Relevant Authority may prescribe penalty on sellers with outstanding positions who fail to issue delivery orders. In case of buyer default or seller default, the Exchange shall guarantee financial compensation to make good any monetary loss to non-defaulting party.";

(ii) for the third paragraph, the following paragraph shall be substituted, namely;

"The buyer who fails to accept the delivery orders shall be required to pay the difference between the settlement price and the due date rate and in addition to the same, they shall be required to pay such penalty, as may be decided by the Exchange. In case of buyer default or seller default, the Exchange shall guarantee financial compensation to make good any monetary loss to non-defaulting party."

5. After Bye-law 10.21 of the MCX Bye-laws, the following Bye-law shall be inserted, namely;

"10.22 Notwithstanding anything contained in these bye-laws, the Exchange shall ensure good delivery".
