मल्टी कमोडिटी एक्सचेंज क्लियरिंग कॉर्पोरेशन लिमिटेड के उप-नियमों में संशोधन
1. एमसीएक्ससीसीएल के उप-नियम 8.2.4 में, द्वितीय प्रावधानों के खंड (a) में, 'क्लियरिंग हाउस' शब्द के लिए जहां भी हो, 'क्लियरिंग कॉर्पोरेशन' शब्द को प्रतिस्थापित किया जाएगा।
2. एमसीएक्ससीसीएल के उप-नियम 8.2.4 में, द्वितीय प्रावधानों के खंड (b) के लिए, निम्नलिखित खंड को प्रतिस्थापित किया जाएगा, अर्थात् -
"b. क्लियरिंग कॉर्पोरेशन द्वारा दी जाने वाली गारंटी की प्रकृति पूरी तरह से वित्तीय होती है, अर्थात, क्रेता या विक्रेता के डिफॉल्ट होने की स्थिति में, क्लियरिंग कॉर्पोरेशन गैर-डिफॉल्ट पक्ष को होने वाले किसी भी मौद्रिक क्षति को पूरा करने के लिए वित्तीय क्षतिपूर्ति की गारंटी देगा।"
3. एमसीएक्ससीएलएल के उप-नियम 8.5.2, 'नवाचार दो कॉन्ट्रैक्ट्स में परिणत होगा' से पहले, निम्नलिखित शब्दों और प्रतीकों को डाला जाएगा, अर्थात्
"नवाचार के अंतर्गत, डेलिवरी के चिह्नांकन के बाद (वस्तु या निधियों के पे-इन में) डिफॉल्ट होने की स्थिति में, क्लियरिंग कॉर्पोरेशन का उत्तरदायित्व डेलिवरी के चिह्नांकन तक निधियों के पे-आउट तथा वित्तीय क्षतिपूर्ति (गैर-डिफॉल्टिंग पक्ष को हुए नुकसान की भरपाई के लिए) की गारंटी देना होगा। डेलिवरी किए जाने के बाद गुणवत्ता या मात्रा/किसी क्षति के संबंध में होने वाले विवाद होने की स्थिति में उसका निपटान शिकायत निवारण प्रणाली के माध्यम से किया जाएगा जिसमें क्लियरिंग कॉर्पोरेशन की मध्यस्थता प्रणाली शामिल है और वित्तीय क्षतिपूर्ति के संबंध में उसका निपटान किया जा सकता है।"

PROPOSED AMENDMENTS IN THE BYE-LAWS OF MCXCCL
1. In Bye-law 8.2.4 of the MCXCCL Bye-laws, in clause (a) of second proviso,for the word "Clearing House" wherever they occur, the word "Clearing Corporation" shall be substituted.
2. In Bye-law 8.2.4 of the MCXCCL Bye-laws, for clause (b) of second proviso, the following clause shall be substituted,namely:-
"b.the nature of the guarantee by the Clearing Corporation is strictly financial, that is, in case of buyer default or seller default, the Clearing Corporation shall guarantee financial compensation to make good any monetary loss to non-defaulting party."
3. In Bye-law 8.5.2 of the MCXCCL Bye-laws, before the words "Novation shall result into two contracts" the following words and symbols shall be inserted, namely :—
"The responsibility of Clearing Corporation under novation shall be for guarantee of funds pay-out till marking of delivery and for guarantee of financial compensation (to make good losses of non-defaulting party) in case of default (in goods or funds pay-in) after marking of delivery. In case of disputes pertaining to quality or quantity / any damages arising after the delivery shall be addressed through the complaint redressal mechanism, including arbitration mechanism of the Clearing Corporation and can be settled in terms of financial compensation."
