सासासासा....काकाकाका....िनिनिनिन.... 45454545....————राष्ट्रपति, संविधान के अनु(cid:24)छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते $ए और कृ षि मंत्रालय, कृ िष और सहकारिता विभाग, विस्तार निदेशालय मुख्य कलाकार और कलाकार (ज्येष्ठ) समूह 'ख' भर्ती नियम, 2015 को उन बातों के सिवाय अधि;ान्त करते $ए जिन्हें ऐसे अधि;मण से पूर्व किया गया है या करने का लोप किया गया है, कृ षि एवं किसान कल्याण मंत्रालय, कृ षि, सहकारिता एवं किसान कल्याण विभाग के अधीन विस्तार निदेशालय में मुख्य कलाकार और कलाकार (ज्येष्ठ) के पदों पर भर्ती की पEति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:

1.1.1.1. संक्षिप्त नाम और प्रारम्भसंक्षिप्त नाम और प्रारम्भसंक्षिप्त नाम और प्रारम्भसंक्षिप्त नाम और प्रारम्भ....—(1) इन नियमों का संक्षिप्त नाम कृ षि एवं किसान कल्याण मंत्रालय, कृ षि, सहकारिता एवं किसान कल्याण विभाग, विस्तार िनदेशालय, मुख्य कलाकार और कलाकार (ज्येष्ठ) (समूह ख) भर्ती नियम, 2018 है।

(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे।

4.4.4.4. निरर्हताःनिरर्हताःनिरर्हताःनिरर्हताः वह Uक्ति,-

(क) जिसने ऐसे Uक्ति से, जिसका पति या जिसकी पVी जीवित है, विवाह किया है या विवाह की संविदा की है या,

(ख) जिसने अपने पति या अपनी पVी के जीवित रहते $ए किसी Uक्ति से विवाह किया है,विवाह की संविदा की है,

उक्त पदों पर नियुक्ति का पात्र नहW होगाः

परन्तु यदि के न्Yीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे Uक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुZेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी Uक्ति को इस नियम के प्रवर्तन से छू ट दे सके गी।

5. 5. 5. 5. शिथिल करने की शक्तिशिथिल करने की शक्तिशिथिल करने की शक्तिशिथिल करने की शक्ति....————जहां के न्Yीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबE करके तथा संघ लोक सेवा आयोग से परामर्श करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के Uक्तियों की बाबत आदेश द्वारा शिथिल कर सके गी।

6. 6. 6. 6. 0ावृ0ावृ0ावृ0ावृितितितित....————इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छू ट और अन्य रियायतों पर प्रभाव नहW डालेगी, जिनका के न्Yीय सरकार द्वारा इस संबंध में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूिचत जनजातियों, अन्य पिछडे वग', भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के Uक्तियों के लिए उपबंध करना अपेक्षित है।

(i) फोटोnाफिक और प्रदर्शनियों का दो वर्ष का अनुभव; या

(ii) आफसेट और लेटर प्रैस राइpटग का दो वर्ष का अनुभव; या

(iii) nामीण क्षेत्रों में कृ षि और सहबE विषयों पर प्रचार सामnी हेतु अभिन्यास तैयार करने का दो वर्ष का अनुभव।

टिप्पणःटिप्पणःटिप्पणःटिप्पणः पोषक प्रवर्ग के ऐसे विभागीय अधिकारी, जो प्रोन्नति की सीधी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहW होंगे । इसी प्रकार प्रतिनियुक्त Uक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहW होंगे।

(प्रतिनियुक्ति की अवधि, जिसके अंतर्गत के न्Yीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाq पद पर प्रतिनियुक्ति की अवधि सम्मििलत है, साधारणतया तीन वर्ष से अधिक नहW होगी ।

प्रतिनियुक्ति (जिसके अंतर्गत अल्पकालिक संविदा भी है) पर नियुक्ति के लिए अधिकतम आयु-सीमा आवेदन प्राप्त करने की अंितम तारीख को 56 वर्ष से अधिक नहW होगी ।

G.S.R. 45.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Ministry of Agriculture, Department of Agriculture and Cooperation, Directorate of Extension, Chief Artist and Artist (Senior), (Group 'B') Recruitment Rules, 2015, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Chief Artist and Artist (Senior), (Group 'B') in the Directorate of Extension, Pusa, New Delhi, Ministry of Agriculture and Farmers Welfare, Department of Agriculture, Cooperation and Farmers Welfare, namely:-

1. Short title and commencement.—(1) These rules may be called the Ministry of Agriculture and Farmers Welfare, Department of Agriculture, Cooperation and Farmers Welfare, Directorate of Extension, Chief Artist and Artist (Senior) Recruitment Rules, 2018.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification and level in the pay matrix.—The number of the posts, their classification and level in the pay matrix thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age-limit and other qualifications, etc.—The method of recruitment, age-limit, qualifications and other matters relating to the said posts shall be as specified in columns (5) to (13) of the aforesaid Schedule.

4. Disqualification.—No person,–

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to Relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservations, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

SCHEDULE

(ii) Two years' experience of preparing layout in colour and black and white for different publicity media such as Magazines, Books, Pamphlets, Leaflets, Folders in a Government department or Undertaking or Organisation or in any recognised Institution.

Or

(i) Diploma in Fine Arts or Commercial Art from a recognised University or Institute; (ii) Three years' experience in preparation of layout in Colour and Black and White for different publicity media such as Magazines, Books Pamphlets, Leaflets, Folders in a Government Department or Undertaking or Organisation or in any recongised Institution.

Desirable:

(i) Two years' experience of Photographic work and exhibits; or (ii) Two years' experience of Offset and Letter Press Writing; or (iii) Two years' experience of preparing Layout for publicity materials on Agricultural and allied subjects in Rural areas.

Note : The Departmental officers in the feeder category who are in the direct line of promotion will not be eligible for consideration for appointment on deputation. Similarly, the deputationists shall not be eligible for consideration for appointment by promotion.

(Period of deputation including period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organisation or Department of the Central Government shall ordinarily not to exceed three years. The Maximum age limit for appointment by deputation (Including Short Term Contract) shall be not exceeding 56 years as on the closing date of receipt of applications).

Method of recruitment, age-limit, qualifications, etc.—The method of recruitment, age-limit, qualifications and other matters shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification.—No person,

(a) who has entered into or contracted a marriage with a person having a spouse living,

or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

Shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

(i) for rule 2 the following shall be substituted, namely:—

(ii) In the Schedule,-

उक्त पद पर नियुक्ति का पात्र नहW होगा :

परन्तु यदि के न्Yीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे dयक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुZेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी dयक्ति को इस नियम के प्रवर्तन से छू ट दे सके गी।

2. Application.—These rules shall apply to the posts specified in column (I) of the Schedule annexed to these rules.

3. Number of posts, classification and level in pay matrix.—The number of the said posts, their classification and level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the said Schedule.

4. Method of recruitment, age limit, qualifications, etc.—The method of recruitment, age-limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the aforesaid Schedule.

5. Disqualification.—No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said posts :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

6. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

7. Saving.—Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-Servicemen, Other Backward Classes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

सभी शक्तियों का प्रयोग करते (cid:²8)ए राष्ट्रपित ,rn~}kjk राष्ट्रपति सचिवालय (भर्ती और सेवा शतX) नियमावली, ²⁰⁰⁷ संशोिधत करते हैं और राष्ट्रपति सचिवालय में निम्नलिखित पदों पर नियुक्त Zयक्तियों की भर्ती का तरीका और सेवा की शतN का विनियमन करने वाले निम्नलिखित संशोधित नियम बनाते हैं अर्थात् –

संक्षिप्त नाम और प्रारंभसंक्षिप्त नाम और प्रारंभसंक्षिप्त नाम और प्रारंभसंक्षिप्त नाम और प्रारंभ –

क) इन नियमों को राष्ट्रपति सचिवालय (भर्ती और सेवा की शत(cid:148)) िनयम, 2017 कहा जाएगा।

ख) ये िनयम 02 जून, 2017 से प्रवृत्त मान्य होंगे।

2. परिभाषाएंपरिभाषाएंपरिभाषाएंपरिभाषाएं ::::- इन नियमों में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हो –

क) "प्रतिनियुक्ति" का अर्थ किसी अधिकारी की सेवाओं का सचिवालय में और सचिवालय से किसी अन्य कार्यालय में अस्थायी स्थानांतरण से है, जहां स्थानांतरण की शतX समय-समय पर यथासंशोिधत भारत सरकार, का^मक एवं प्रशिक्षण विभाग के तारीख 17 जून, 2010 के का.Kा. सं. 6/8/2009- स्था. (वेतन

II) में उल्लिखित कें J सरकार के आदेशों के अधीन विनियमित की जाती है।

ख) "अिधकारी" का अर्थ सचिवालय में नियुक्त अथवा सचिवालय के काडर के Gक्ति से है।

ग) "पद" का अर्थ सचिवालय में पद से है और इसमें निम्नलिखित शामिल है :-

(i) अनुसूची -I में यथाविनिBदष्ट सिविल पद;

(ii) अनुसूची -II में यथाविनिSदष्ट सह विस्तारी पद; और

(iii) अनुसूची III में यथाविनिSदष्ट और सचिवालय में (cid:149)ूटी के लिए तैनात रक्षा सेवाओं के अधिकारी द्वारा धारित सावधिक पद।

घ) "राष्ट्रपति" का अर्थ भारत के राष्ट्रपति से है।

ड़) "अनुसूची" का अर्थ इन नियमों के साथ संलe अनुसूची से है।

च) "सिचवालय" का अर्थ राष्ट्रपति सचिवालय से है और इसमें राष्ट्रपति संपदा (प्रेसीडेंट) के उद्यानों में कार्यरत नियमित स्थापना के कर्मचारी शामिल हैं gकतु निम्नलिखित कर्मचारी शामिल नहI हैं :-

(i) सचिवालय की गृह प्रबंधन स्थापना के कर्मचारी और

(ii) राष्ट्रपति संपदा के उद्यानों की कार्यभारित स्थापना के कर्मचारी।

3. निम्नलिखित पदों के नाम, वर्गीकरण और पे मैट्रिक्स में लेवल :-

(क) इसके साथ पदों का नाम, उनका वर्गीकरण और इससे संल! पे मैट्रिक्स में लेवल, अनुसूची I, II और III में यथाविनि(दष्ट होंगा।

परंतु नियुक्ति प्राधिकारी समय-समय पर सामान्य अथवा विशेष आदेश द्वारा समय-समय पर इस संबंध में कें (cid:31) सरकार के आदेशानुसार किसी भी पद के वर्गीकरण अथवा पे मैट्रिक्स में लेवल, किसी अधिकारी के पे मैट्रिक्स में लेवल में आशोधन अथवा परिवर्तन कर सकता है।

(ख) अनुसूची I, II और III में विनि(दष्ट स्थायी और अस्थायी पदों की संख्या वही होगी जो मंजूरी के साथ वर्ष के बजट में शामिल है।

4. सह विस्तारी पदसह विस्तारी पदसह विस्तारी पदसह विस्तारी पद.– अनुसूची II में विनि(दष्ट पद राष्ट्रपति के प्रसादपय7त पदधारियों द्वारा मान्य हैं और ये प्रत्येक राष्ट्रपति के साथ सह विस्तारी होंगे। सचिवालय में या राष्ट्रपति सचिवालय की गृह प्रबंधन स्थापना में सह विस्तारी पद पर नियुक्त ?क्ति राष्ट्रपति सचिवालय में आमेलन अथवा नियमित नियुक्ति के लिए पात्र नहC होंगे; तथापि यदि ऐसे पदधारी अन्यथा सभी निर्धारित शतG और अर्हताओं (आयु सहित) को पूरा करते हैं तो वे सीधी भर्ती के अLयMथयों के साथ समान आधार पर प्रतिस्पर्धा के लिए पात्र होंगे।

ऐसे पद, जिनके लिए भुगतान रक्षा आकलनों से किया जाता है ....– अनुसूची III में विनि(दष्ट पद रक्षा सेवाओं के 5. ऐसे पद, जिनके लिए भुगतान रक्षा आकलनों से किया जाता है ऐसे पद, जिनके लिए भुगतान रक्षा आकलनों से किया जाता है ऐसे पद, जिनके लिए भुगतान रक्षा आकलनों से किया जाता है अधिकारियों द्वारा राष्ट्रपति के प्रसादपय7त मान्य हैं जिन पर उनकी सेवा की शतG को विनियमित करने वाले सभी मामलों में वे नियम लागू होंगे जो रक्षा सेवाओं में तदुनुरूप रैंक के अधिकारियों पर लागू होते हैं और ये ऐसे आशोधनों के अध्यधीन होंगे जिन्हें राष्ट्रपति सामान्य या विशेष आदेश द्वारा विनि(दष्ट करे।

6. नियुक्ति प्राधिकारीनियुक्ति प्राधिकारीनियुक्ति प्राधिकारीनियुक्ति प्राधिकारी .—इन पदों पर नियुक्तियां उपरोक्त अनुसूचियों में विनि(दष्ट संबंधित प्राधिकारी द्वारा की जाएंगी।

7. भर्ती की तरीका, आयुभर्ती की तरीका, आयुभर्ती की तरीका, आयुभर्ती की तरीका, आयु----सीमा, अर्हताएं आदिसीमा, अर्हताएं आदिसीमा, अर्हताएं आदिसीमा, अर्हताएं आदि .—पदों पर भर्ती का तरीका, आयु-सीमा, अर्हताएं और उक्त पदों से संबंधित अन्य मामले अनुसूची I, II, III और IV में यथाविनि(दष्ट होंगे।

8. सीधी भर्तीसीधी भर्तीसीधी भर्तीसीधी भर्ती.—जहाँ अनुसूची । में विनि(दष्ट पद के संबंध में भर्ती का तरीका सीधी भर्ती है –

(क) अनुसूची में संबंधित पद के तहत विनि1दष्ट विभागीय पदोन्नति समिति चयन बोर्ड के रूप में कार्य करेगी।

(ख) खंड (क) के तहत चयन बोर्ड अनुसूची III क में विनि(दष्ट प्रRिया का अनुपालन करेगा।

9. पदोन्नतिपदोन्नतिपदोन्नतिपदोन्नति :- जहाँ अनुसूची में विनि(दष्ट पद के संबंध में भर्ती का तरीका पदोन्नति द्वारा है –

(क) उस अनुसूची में विनि(दष्ट शतG के अधीन और नियम 14 क उपबंधों के अधीन भर्ती निम्न प्रकार से की जाएगी -[भाग II—खण्ड 3(i)] भारत का राजपत्रा : पफरवरी 3, 2018/माघ 14, 1939 313 (i) समूह क अथवा समूह ख (राजपत्रित) के किसी पद पर पदोन्नति के मामले में वरिष्ठता को ध्यान में रखे बिना चयन आधार पर भर्ती की जाएगी।

(ii) किसी अन्य पद पर पदोन्नति के मामले में अचयन आधार पर भर्ती की जाएगी।

(ख) यथाविनि1दष्ट विभागीय पदोन्नति समिति ऐसे पदों पर पदोन्नति के लिए उपयुक्त अBयCथयों की सिफारिश करेगी और उक्त समिति अनुसूची – IV में विनि1दष्ट प्रEिया का अनुपालन करेगी।

टिप्पणी :टिप्पणी :टिप्पणी :टिप्पणी : "जहां कनिष्ठों, जो कि अर्हक या पात्रता सेवा कर चुके हैं, पर पदोन्नति के लिए विचार किया जा रहा है, उनके वरिष्ठों पर भी विचार किया जाएगा बशतX कि उनकी अपेक्षित अर्हता या पात्रता सेवा विहित अर्हक या पात्र सेवा के आधे से अधिक या दो वर्ष से अधिक, जो भी कम हो, से कम न हो और उन कनिष्ठ कर्मचारियों के साथ-साथ अगले उYतर Zेड में पदोन्नति के लिए परिवीक्षा अविध सफलतापूर्वक पूरी कर ली हो जिन्होंने उक्त अर्हक या पात्रता सेवा पहले ही पूरी कर ली है।"

10. प्रतिनियुक्ति और आमेलनप्रतिनियुक्ति और आमेलनप्रतिनियुक्ति और आमेलनप्रतिनियुक्ति और आमेलन.—जब कोई अधिकारी इस सचिवालय में प्रतिनियुक्ति पर आता है या उसका आमेलन होता है तो उस पर समय-समय पर कें \ सरकार द्वारा यथानिर्धारित प्रतिनियुक्ति या आमेलन की शत] लागू होंगी अथवा जहां कहC आवश्यक हो, वित्त मंत्रालय के साथ परामर्श करके उसके मूल कार्यालय और सचिवालय के बीच यथास्वीकृ त शत] लागू होंगी।

11. (1) वरिष्ठतावरिष्ठतावरिष्ठतावरिष्ठता – (क) सीधी भर्तीसीधी भर्तीसीधी भर्तीसीधी भर्ती.—जब तक कि नियुक्ति आदेश में अन्यथा विनि(दष्ट न हो, सभी सीधी भर्ती के पदधारियों की सापेक्ष वरिष्ठता उस योग्यता Rम के अनुसार निर्धारित की जाएगी जिसमें ऐसी नियुक्ति के लिए उनका चयन किया गया है।

परंतु यह भी कि किसी पद पर नियमित रूप से नियुक्त ?क्ति की वरिष्ठता प्रारंभिक नियुक्ति के समय दर्शाए गए योग्यता Rम में निर्धारित की जाएगी, स्थायीकरण की तारीख से नहC।

(ख) पदोन्नतिपदोन्नतिपदोन्नतिपदोन्नति.—

(i) चयन पदों पर पदोन्नत Fक्तियों की सापेक्ष वरिष्ठता ऐसी पदोन्नति के लिए चयन के Eम में निर्धारित की जाएगी।

(ii) अचयन पदों पर पदोन्नत Fक्तियों की सापेक्ष वरिष्ठता उस Eम में निर्धारित की जाएगी जिस Eम में ऐसे Fक्तियों को पदोन्नत किया गया है।

परंतु यदि ऐसे पदों पर एक ही दिन कई Fक्तियों को पदोन्नत किया जाता है तो ऐसे Fक्तियों की सापेक्ष वरिष्ठता उस निचले Iेड में उनकी सापेक्ष वरिष्ठता के समान होगी जिससे उन्हें पदोन्नत किया गया है।

परंतु यह भी कि यदि प्रारंभ में अस्थायी आधार पर पदोन्नत Fक्तियों को बाद में उनकी पदोन्नति के समय दर्शाए गए योग्यता Eम से भिन्न Eम में स्थायी किया जाता है तो उनकी वरिष्ठता प्रारंभिक नियुक्ति के समय दर्शाए गए Eम में निर्धारित की जाएगी, स्थायीकरण की तारीख से नहL।

(ग) प्रतिनियुक्ति अथवा आमेलनप्रतिनियुक्ति अथवा आमेलनप्रतिनियुक्ति अथवा आमेलनप्रतिनियुक्ति अथवा आमेलन.— प्रतिनियुक्ति अथवा आमेलन द्वारा नियुक्ति के मामले में Fक्ति की वरिष्ठता समकक्ष पद में उसकी सेवावधि और अन्य संगत कारकों को ध्यान में रखते Nए आमेलन की तारीख से निर्धारित की जाएगी।

11(2). उप नियम (1) के उपबंध इन नियमों के प्रारंभ की तारीख को अथवा उसके बाद की गई सभी नियुक्तियों पर लागू होंगे और सचिवालय में उस तारीख से पहले किसी भी Zेड में नियुक्त ?क्तियों की सापेक्ष वरिष्ठता उस समय प्रवृत्त आदेशों के अनुसार निर्धारित की जाएगी।

12. परिवीक्षा और स्थायीकरणपरिवीक्षा और स्थायीकरणपरिवीक्षा और स्थायीकरणपरिवीक्षा और स्थायीकरण.—(क) सचिवालय में किसी भी पद पर सीधी भर्ती से या पदोन्नति से नियुक्त

अLयर्थी अनुसूची I में विनि(दष्ट अवधि के लिए परिवीक्षा पर रहेंगे।

परंतु नियुक्ति प्राधिकारी स्वविवेक से उक्त अवधि का परिकलन करने के लिए निम्नलिखित को हिसाब में ले सकता है :-

(i) अBयर्थी द्वारा समकक्ष पदों पर अथवा उOतर जिम्मेदारी वाले पदों पर की गई सेवावधि,

(ii) किसी भी पद पर पदोन्नत Fक्ति के मामले में उस पद पर उसके द्वारा की गई स्थानापन्न सेवा की अवधि :

परंतु यह भी कि किसी ?क्ति विशेष अथवा पद के मामले में नियुक्तिकर्ता प्राधिकारी के आदेश से परिवीक्षावधि बढ़ाई जा सकती है।

परंतु यह भी कि नियुक्ति प्राधिकारी परिवीक्षावधि के संतोषजनक ढंग से पूरा करने की शर्त के रूप में परिवीक्षावधि के दौरान अLयर्थी से ऐसे प्रशिक्षण पाdRम पूरा करने और ऐसी परीक्षाएं पास करने की अपेक्षा कर सकता है, जो वह उचित समझे।

ख) परिवीक्षा अवधि पूरी करने के उपरांत यदि अLयर्थी को स्थायी नियुक्ति के लिए उपयुक्त पाया जाता है तो उसे उसके सेवाकाल में के वल एक बार प्रवेश के समय Zेड वाले पद पर स्थायी किया जाएगा।

ग) यदि परिवीक्षा अवधि या बढ़ाई गई अवधि के समाप्त होने पर या परिवीक्षा अवधि के दौरान, जैसी भी स्थिति हो, यदि नियुक्ति प्राधिकारी का यह मानना हो कि यह अLयर्थी स्थायी नियुक्ति के लिए उपयुक्त नहC है तो वह बिना कोई कारण बताए उस कर्मचारी को कायर्मुक्त कर सकता है या उसे उसके पूर्व पद पर प्रत्यावMतत कर सकता है या इस संबंध में उपयुक्त समझे अनुसार आदेश पारित कर सकता है।

13. सेवा शत2सेवा शत2सेवा शत2सेवा शत2 .—

क) सामान्यसामान्यसामान्यसामान्य .— अिधकारियों की सेवा शतG को विनियमित करने के जिन विषयों के लिए इन नियमों

में कोई प्रावधान नहC किए गए हैं उनके संबंध में इन नियमों में कें \ीय सचिवालय के समान लेवल में समान वेतन मैट्रिक्स का पद धारित करने वाले अधिकारियों पर लागू होने वाले नियम लागू होंगे परंतु यह राष्ट्रपति द्वारा समय-समय पर इन नियमों में आदेश द्वारा किए आशोधन, परिवर्तन या अपवर्जन के अध्याधीन होंगे, यदि कोई किए गए हों।

ख) स्थानांतरणस्थानांतरणस्थानांतरणस्थानांतरण .– प्रत्येक कर्मचारी को भारत में किसी भी स्थान पर विशेष रूप से द रिट्रीट, मशोबरा, शिमला और राष्ट्रपति निलयम, बोलारम, सिकं दराबाद, हैदराबाद और ऐसे स्थानों पर तैनात किया जा सकता है जहां तत्समय राष्ट्रपति का अधिष्ठापन हो।

ग) आचरणआचरणआचरणआचरण .— प्रत्येक अधिकारी कें \ीय सिविल सेवा (आचरण) नियमावली, 1964 समय-समय पर यथा संशोधित या ऐसी अन्य संगत नियमावली द्वारा शासित होगा जो उस सेवा पर लागू होती हो जिसका वह सदस्य है।

घ) अनुशासन और नियंत्रणअनुशासन और नियंत्रणअनुशासन और नियंत्रणअनुशासन और नियंत्रण.— प्रत्येक अधिकारी कें \ीय सिविल सेवा (वर्गीकरण, नियंत्रण और अपील िनयमावली), 1965, समय-समय पर यथासंशोधित या ऐसी अन्य संगत नियमावली द्वारा शासित होगा जो उस सेवा पर लागू होती हो जिसका वह सदस्य है।

ङ) अस्थायी अधिकारीअस्थायी अधिकारीअस्थायी अधिकारीअस्थायी अधिकारी.—प्रत्येक अस्थायी अधिकारी कें \ीय सिविल सेवा (अस्थायी सेवा) िनयमावली, 1965, समय-समय पर यथासंशोधित द्वारा शासित होगा।

14. 5ावृत्ति5ावृत्ति5ावृत्ति5ावृत्ति.—इन नियमों में उपबंधित किसी भी बात का अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों अन्य विशिष्ट iेणियों के ?क्तियों को कें \ सरकार द्वारा समय समय पर जारी आदेशों के अनुसार प्रदत्त आरक्षण, आयु-सीमा में छू ट और अन्य रियायतों पर प्रतिकू ल प्रभाव नहC होगा।

15. िविनयम िविनयम िविनयम िविनयम .— राष्ट्रपति उन सभी मामलो के संबंध में इन नियमों के संगत नियम बना सकते हैं जो इन नियमों को प्रभावी बनाने के प्रयोजन के लिए इनमें उपबंध करना आवश्यक या समीचीन हो।

16. शिथिल करने की शक्तिशिथिल करने की शक्तिशिथिल करने की शक्तिशिथिल करने की शक्ति.—यदि राष्ट्रपति का यह मानना हो कि किसी अधिकारी के किसी वर्ग या iेणी के संबंध में इन नियमों के प्रावधानों में छू ट देना लोक हित में आवश्यक या समीचीन है तो राष्ट्रपति आदेश जारी करके नियमों को िशिथल कर सकते हैं जब कभी इन नियम का आiय लेते kए कोई कार्रवाई की जाती है तो इसके कारणों को रिकार्ड किया जाए।

17. 5ाख्या5ाख्या5ाख्या5ाख्या.—इन नियमों की ?ाख्या से संबंधित विवादों को निर्णय के लिए राष्ट्रपति के समक्ष भेजा जाएगा।

18. निरसन और 5ावृत्तिनिरसन और 5ावृत्तिनिरसन और 5ावृत्तिनिरसन और 5ावृत्ति.—

क) इन नियमों में अभि?क्त रूप से अन्यथा उपबंधित के सिवाय, इन नियमों से संगत तथा इन संशोधित नियमों के लागू होने से तत्काल पहले लागू होने वाले सभी नियमों और आदेशों को निरस्त किया जाता है।

ख) इस निरसन के होते kए भी इन निरसित नियमों और आदेशों के तहत किया गया कोई कार्य या की गई कोई कार्रवाई इन नियमों के संगत उपबंधों के तहत की गई मानी जाएगी।

चयन बोर्ड का गठन और इसके कार्य

अनुसूची- I में विनि(दष्ट पदों पर नियुक्ति करने के लिए उपयुक्त अLयMथयों की सिफारिश करने के संबंध में चयन बोडG का उल्लेख प्रत्येक पद के सामने किया जाएगा।

2. सीधी भर्ती से भरे जाने वाले रिक्त पदों को स्थानीय रोजगार कें \,सरप्लस सेल में िव(cid:129)ापित या अिधसूिचत किया जाएगा इनमें वे रिक्त पद शामिल नहC होंगे जिन्हें संघ लोक सेवा आयोग / कर्मचारी चयन आयोग द्वारा भरा जाना है |

3. प्राप्त आवेदनों को यह सुनिƒित करने के िलए छांटा जाएगा कि अLयर्थी पद के िलए आयु-सीमा, शैक्षिक योग्यता और अनुभव संबंधी पात्रता शतG को पूरा करते हैं।

4. परीक्षा के स्वरूप का, चाहे यह परीक्षा िलिखत हो या मौिखक हो या दोनों ही हो या इनके अलावा कोई शारीरिक जांच हो,निर्धारण राष्ट्रपति के सचिव द्वारा किया जाएगा तथा वह ही चयन का मापदंड भी निर्धारित करेगा और परीक्षा इसी मापदंड के आधार पर ली जाएगी :

परंतु जहां नियुक्ति प्राधिकारी राष्ट्रपति होंगे वहां राष्ट्रपति का सचिव राष्ट्रपति की पूर्व अनुमति लेकर ही इस तरह का निर्णय लेगा और ऐसे मापदंड निर्धारित करेगा ।

5.परीक्षा के आधार पर, चयन बोर्ड उपयुक्त अLयMथयों की एक चयन सूची तैयार करेगा जो इन पदों पर उनकी नियुक्ति पर विचार करने के लिए योग्यता के Rम में तथा घोषित रिक्त पदों की संख्या के अनुसार जारी की जाएगी और बोर्ड एक आरक्षित सूची भी तैयार करेगा । इस आरक्षित सूची का उपयोग उस स्थिति में किया जाएगा जब अंितम सूची में शामिल कोई ?क्ति घोषित रिक्त पदों में से किसी पर कार्यZहण नहC करता है । यदि सभी घोषित रिक्त पद अंतिम सूची में शामिल अLयMथयों से भर लिए जाते हैं तो यह आरक्षित सूची स्वत: रद्द हो जाएगी ।

6. अंतिम सूची की वैधता सामान्य रूप से एक वर्ष होगी:

बशतX कि अंतिम सूची की वैधता घोषित रिक्त पद भरे जाने तक, यथा स्थिति, राष्ट्रपति या राष्ट्रपति के सचिव द्वारा 1 वर्ष से अधिक कर दी जाती है ।

अनुसूची- I में विभिन्न पदों के लिए यथा उपबंिधत विभागीय पदोन्नति समिति के कार्य

1. सिमित के कासिमित के कासिमित के कासिमित के कार्यर्यर्यर्य - विभागीय पदोन्नति समिति निम्नलिखित सभी मामले देखेगी:

(i) सरकारी कर्मचारियों की चयन एवं अचयन पदों पर पदोन्नति ;

(ii) सरकारी कर्मचारियों का उनके संबंधित Iेड या पद में स्थायीकरण ;

(iii) परिवीक्षाMथयों के कार्य और आचरण का आकलन ताकि उनको सेवा में बनाए रखने के लिए उनकी उपयुक्तता के बारे में या उन्हें सेवामुक्त कर दिए जाने के बारे में या उनकी परिवीक्षा की निर्धारित अवधि को बढ़ा दिए जाने के बारे में निर्णय लिया जा सके ।

2. अपनाई जाने वाली अपनाई जाने वाली अपनाई जाने वाली अपनाई जाने वाली प्र(िcid:21)याप्र(िcid:21)याप्र(िcid:21)याप्र(िcid:21)या ---- पैनल तैयार करने के लिए विभागीय पदोन्नति समिति निम्नलिखित सि}ांतों का पालन करेगी:

क) लेवल 12 और उससे ऊपर के विभिन्न लेवल पर पदोन्नति के लिए -

(i) पदोन्नति की प}ति अनुसूची 1 में संबंधित पद के सामने दी गई प}ति के अनुसार होगी । (ii) बेंचमार्क 'बNत अ(cid:133)छा' होगा ।

(iii) डीपीसी (विभागीय पदोन्नति समिति) अधिकारियों का मूल्यांकन बेंचमार्क 'बkत अ…छा' के

संदर्भ में के वल 'योग्य' या 'अयोग्य' होने का ही करेगी । जिन्हें ' योग्य' iेणी में रखा जाएगा, के वल उन्हें ही डीपीसी (विभागीय पदोन्नति समिति) द्वारा तैयार किए गए चयन पैनल में उनके फीडर Zेड में उनकी परस्पर वरिष्ठता के Rम में शामिल किया जाएगा ।

ख) लेवल 12 से नीचे के Iेडों पर पदोन्नति के लिए (इसमें निचले समूह से Iुप 'क' के पदों /Iेडों/सेवाओं में की गई पदोन्नति भी शामिल है )

(i) पदोन्नति 'चयन' प†ति से की जाएगी ।

(ii) बेंचमार्क 'अ…छा' होगा ।

(iii) डीपीसी उक्त wेणियों के पदों / Iेडों / सेवाओं में पदोन्नति के लिए अधिकारियों को 'अ(cid:133)छा' के बेंचमार्क के संदर्भ में ' योग्य' या 'अयोग्य' wेणी में वर्गीकृ त करेगी। जिन्हें 'योग्य' wेणी में रखा जाएगा के वल उन्हें ही डीपीसी द्वारा तैयार किए गए चयन पैनल में उनके फीडर Iेड में उनकी परस्पर वरिष्ठता के Eम में शामिल किया जाएगा ।

3. अचयन अचयन अचयन अचयन पदों पर पदोन्नतिपदों पर पदोन्नतिपदों पर पदोन्नतिपदों पर पदोन्नति .— जहां भर्ती नियमों के अनुसार अचयन आधार पर पदोन्नतियां की जानी होती हैं वहां विभागीय पदोन्नति समिति को अधिकारियों के रिकॉर्ड का तुलनात्मक मूल्यांकन करने की आवश्यकता नहL होती है और इसे अधिकारियों को पदोन्नति के लिए उनके सेवा रिकॉर्ड के मूल्यांकन के आधार पर 'योग्य' या 'अयोग्य' wेणी में वर्गीकृ त करना चािहए । 'योग्य' wेणी में वर्गीकृ त किए गए अधिकारियों को उस Iेड में उनकी वरिष्ठता के Eम में पैनल में शामिल किया जाएगा जिससे पदोन्नतियां की जानी हैं ।

4. स्थायीकरण के लिएस्थायीकरण के लिएस्थायीकरण के लिएस्थायीकरण के लिए.—स्थायीकरण के मामले में विभागीय पदोन्नति समिति को अधिकारियों की सापेक्ष योग्यता का निर्धारण नहL करना चाहिए बल्कि इसे स्थायीकरण के लिए अधिकारियों के 'योग्य' या 'अयोग्य' होने का मूल्यांकन उनकी बारी के अनुसार उस पद पर उनके कार्य निष्पादन के आधार पर करना चाहिए जैसे सेवा रिकॉर्ड के संदर्भ में मूल्यांकन किया जाता है ।

5. परिवीक्षापरिवीक्षापरिवीक्षापरिवीक्षा....———— परिवीक्षा के मामले में विभागीय पदोन्नति समिति को अधिकारियों की सापेक्ष Iेडिग नहL करनी चािहए, बल्कि के वल यह तय करना चाहिए कि उनके द्वारा परिवीक्षा अवधि संतोषजनक ढंग से पूरी कर लिए जाने की घोषणा की जा सकती है या नहL । अगर किसी भी परिवीक्षार्थी का प्रदर्शन संतोषजनक नहL रहा है तो विभागीय पदोन्नति समिति यह सलाह दे सकती है कि उसकी परिवीक्षा की अवधि बढ़ाई जानी चाहिए या उसे सेवा से हटा दिया जाना चाहिए।

6. समिति की बैठकेंसमिति की बैठकेंसमिति की बैठकेंसमिति की बैठकें .—विभागीय पदोन्नति समिति नियमित अंतरालों पर या राष्ट्रपति के सचिव द्वारा दिए गए निदेशानुसार बैठक करेगी और विभिन्न पैनल तैयार करेगी जिसका उपयोग एक वर्ष के दौरान रिक्त होने वाले पदों पर पदोन्नति किए जाने के लिए किया जाएगा । समिति की सिफारिश पर तैयार किया गया पैनल नियुक्ति प्राधिकारी द्वारा अनुमोदित किए गए अनुसार, आम तौर पर 1 वर्ष के लिए वैध होगा। यह यथा स्थिति राष्ट्रपति या राष्ट्रपति के सचिव द्वारा लिए गए निर्णय के अनुसार 1 वर्ष की अवधि की समाप्ति पर या विस्तारित अवधि की समाप्ति पर या कोई नया पैनल तैयार किए जाने पर इनमें से जो भी पहले हो, समाप्त हो जाएगा । पदोन्नति उस Eम में की जाएगी जिसमें अBयCथयों को पैनल में रखा जाएगा।

राष्ट्रपति सचिवालय के वरिष्ठ सचिवालय सहायक (सीमित विभागीय प्रतियोगी परीक्षा) के संचालन के िलए िविनयम

1. परिभाषाएँपरिभाषाएँपरिभाषाएँपरिभाषाएँ --- (1) इन िवनियमों में जब तक कि संदर्भ से अन्यथा विनि1दष्ट न हो -

(क) 'निर्णायक तारीख' का अर्थ है परीक्षा आयोजित किए जाने वाले संबंधित कै लेंडर वर्ष की 1 अगस्त को अBयर्थी ने कनिष्ठ सचिवालय सहायक के Iेड में न्यूनतम 5 वर्ष की अनुमोदित और िनरंतर सेवा पूरी कर ली है ।

परन्तु अगर उसे सीिमत विभागीय परीक्षा सिहत प्रतियोगी परीक्षा के परिणाम घोषित होने पर कनिष्ठ सचिवालय सहायक Zेड में नियुक्त किया गया था, तो उस परीक्षा का परिणाम इस अंितम तारीख से कम से कम 5 साल पहले घोषित किया गया होना चािहए और इस Zेड में उसकी न्यूनतम 4 वर्ष की अनुमोदित और निरंतर सेवा पूरी होनी चािहए ।

(ख) "परीक्षा" का अर्थ है नियुक्ति प्राधिकारी द्वारा या उसके द्वारा प्राधिकृ त किए गए किसी अन्य प्राधिकारी द्वारा आयोिजत की गई अर्हक सीमित विभागीय प्रतियोगी परीक्षा।

(2) इन विनियमों में प्रयुक्त अन्य सभी शब्द और अभि?क्तियां जिन्हें यहां परिभाषित नहC किया गया है लेकिन जिन्हें राष्ट्रपति सचिवालय (भर्ती और सेवा शत]) िनयमावली, 2017 में परिभाषित किया गया है, का अर्थ वही होगा जैसा इन नियमों में है ।

2. परीक्षा परीक्षा परीक्षा परीक्षा का का का का आयोजआयोजआयोजआयोजनननन ::::

(1) राष्ट्रपित सचिवालय में वरिष्ठ सचिवालय सहायक पद के िलए परीक्षा का आयोजन नियुक्ति प्राधिकारी अथवा उसकी ओर से प्रािधकृ त किए गए किसी अन्य प्राधिकारी द्वारा किया जाएगा। (2) वित्तीय वर्ष में रिक्त होने वाले पदों को भरने के िलए उस वित्तीय वर्ष में एक बार परीक्षा आयोजित की जाएगी ।

(3) परीक्षा की तारीख (तारीखों), समय और स्थान का निर्धारण नियुक्ति प्राधिकारी द्वारा किया जाएगा ।

(2) सक्षम प्रािधकारी के अनुमोदन से बा‡ संवर्ग पद पर प्रतिनियुक्ति पर गए कनिष्ठ सिचवालय सहायक भी अन्यथा उपयुक्त होने पर परीक्षा में भाग लेने के पात्र हैं ।

(3) बा‡ संवर्ग पद पर स्थानांतरण आधार पर नियुक्त किया गया ऐसा कनिष्ठ सिचवालय सहायक िजसका राष्ट्रपति सचिवालय में कनिष्ठ सिचवालय सहायक के पद पर लियन नहC है इस परीक्षा में भाग लेने का पात्र नहC होगा ।

4. आयु आयु आयु आयु : ऐसे कनिष्ठ सचिवालय सहायक परीक्षा में भाग लेने के लिए पात्र नहC होंगे लेने जिनकी आयु 'निर्णायक तारीख' को 50 वर्ष से अधिक हो ।

5.(1) निम्नलिखित योजना के अनुसार परीक्षा आयोजित की जाएगी :-

भाग भाग भाग भाग 1111 : उप-िविनयम 2 में बताए गए अनुसार अिधकतम 300 अंकों की लिखित परीक्षा

भाग भाग भाग भाग 2222: लिखित परीक्षा में, नियुक्ति प्राधिकारी द्वारा मानक रिक्त पदों की संख्या को ध्यान में रखते kए यथा निर्धारित न्यूनतम योग्यता मानक प्राप्त करने वाले ऐसे अLयMथयों की सेवा के रिकार्ड का मूल्यांकन विभागीय पदोन्नति समिति द्वारा किया जाएगा । सेवा रिकॉर्ड के अधिकतम अंक 100 हैं ।

पेपर 1 वस्तुनिष्ठ-बk-िवकल्पीय होगा, जबकि पेपर 2 वर्णनात्मक स्वरूप का होगा

(2) परीक्षा का पा(cid:136)Eम विनियमों में उल्लेखानुसार होगा ।

टिप्पणी टिप्पणी टिप्पणी टिप्पणी 1111 : अLयर्थी को टिप्पणी-लेखन, प्रारूपण और कार्यालय प†ति संबंधी पेपर 2 के उत्तर अंZेजी या हिदी दोनों में से किसी भी एक भाषा में देने का विकल्प होगा ।

6. परीक्षा का पाdRम निम्नानुसार होगा::::----

परीक्षा में भारत और इसके पड़ोसी देशों से संबंधित, विशेष रूप से इतिहास, संस्कृ ति, भूगोल, अर्थशा~ीय परिदृश्य, सामान्य राजनीति और वै(cid:129)ानिक अनुसंधान से संबंधित प्रˆ भी शािमल किए जाएंगे ।

7. योग्यता सूचीयोग्यता सूचीयोग्यता सूचीयोग्यता सूची----

(1) परीक्षा के आधार पर भरे जाने वाले रिक्त पदों की अनुमानित संख्या को ध्यान में रखते kए नियुक्ति प्राधिकारी परीक्षा में न्यूनतम अर्हक अंक निर्धारित कर सकता है।

(2) योग्यता सूची परीक्षा के परिणामों के आधार पर योग्यता के Rम में और भरे जाने वाले रिक्त पदों की संख्या के अनुसार परीक्षा के आधार पर तैयार की जाएगी तथा इसे तैयार करते समय अनुसूिचत जाित, अनुसूिचत जनजातियों और अन्य वगG के ?क्तियों के आरक्षण से संबंधित आदेशों को ध्यान में रखा जाएगा ।

8. चयन सूचीचयन सूचीचयन सूचीचयन सूची –

(1) वरिष्ठ सचिवालय सहायक के पद पर नियुक्ति के लिए चयन सूची मौजूदा और अनुमानित रिक्त पदों को ध्यान में रखते निम्नलिखित अLयMथयों में से 3:1 के अनुपात में तैयार की जाएगी :

(क) उस काडर में कनिष्ठ सचिवालय सहायक Iेड के पदधारी जिन्होंने Iेड में कम से कम 8 साल की नियमित सेवा की है और उस Iेड में वरिष्ठता की रेंज में हैं।

(ख) चौथी रिक्ति पर उस पदधारी को नियुक्त किया जाएगा जिसका नाम िविनयम 7 के तहत तैयार की गई योग्यता सूची में आता है और िजसे विभागीय पदोन्नति समिति संगत नियमों के अनुसार पदोन्नति के लिए उपयुक्त घोिषत करती है ।

(2) उक्त दो wेणियों के Fक्तियों को बारी-बारी से wेणी (क) से 3 Fक्ति और wेणी (ख) से 1 Fक्ति लेते Nए और इसी Eम में बढ़ते Nए चयन सूची में शामिल किया जाता है।

(3) चयन सूची संगत नियमों और अनुदेशों के अनुसार विभागीय पदोन्नति समिति द्वारा तैयार की जाएगा और सक्षम प्राधिकारी द्वारा अनुमोदित की जाएगी ।

(4) इस परीक्षा में उत्तीर्ण होने वाले Fक्तियों की परस्पर रैं(cid:149)कग उनकी योग्यता के Eम में होगी और जिन Fक्तियों ने कोई पूर्व परीक्षा उत्तीर्ण की है उन सभी को बाद में परीक्षा उत्तीर्ण करने वाले Fक्तियों से वरिष्ठ माना जाएगा । वे रिक्त पद जो एक वर्ष में ऐसी पदोन्नति के लिए योग्य कनिष्ठ सिचवालय सहायक के अभाव में नहL भरे जा सकें गे उन्हें परीक्षा के आधार पर चयनित उम्मीदवारों से भरा जाएगा ।

PRESIDENT'S SECRETARIAT (RECRUITMENT AND CONDITIONS OF SERVICES) RULES 2017

G.S.R. 55.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and of all other powers enabling in this behalf, the President hereby amends the President's Secretariat (Recruitment and Conditions of Service) Rules, 2007 and makes the following amended rules regulating the recruitment and conditions of service of persons appointed to posts in the President's Secretariat, namely:-

1. Short title and commencement.—(a) These rules may be called the President's Secretariat (Recruitment and Conditions of Service) Rules, 2017.

(b) They shall deemed to have come into force on the 2nd June 2017.

2. Definitions.—In these rules, unless the context otherwise requires -

(a) "deputation" means the temporary transfer of the services of an officer to the Secretariat and vice versa, where the terms of transfer are regulated under the orders of the Central Government contained in the Government of India, Department of Personnel and Training O.M. No. 6/8/2009-Estt. (Pay II), dated 17th June, 2010, as amended from time to time;

(b) "officer" means a person appointed to, or borne on the cadre of Secretariat.

(c) "post" means a post in the Secretariat and includes :-

(i) a Civilian post as specified in Schedule-I;

(ii) a co-terminus post as specified in Schedule-II; and

(iii) a tenure post as specified in Schedule III and held by an officer of the Defence Services posted for duty in the Secretariat.

(d) "President' means the President of India.

(e) "Schedule" means a Schedule appended to these rules;

(f) "Secretariat" means the President's Secretariat and includes the Regular establishment pertaining to the Gardens attached to the President's Estate, but does not include –

(i) Staff borne on the Household Establishment of the Secretariat, and

(ii) Workcharged Establishment of the Gardens to the President's Estate.

3. Name, classification and LEVEL in the PAY MATRIX of Posts –

(a) The names of the posts, their classification and the LEVEL in the PAY MATRIX attached thereto, shall be as specified in Schedules I, II and III.

Provided that the appointing authority may from time to time, by general or special order amend or alter the classification or the LEVEL in the PAY MATRIX of any post, or the LEVEL in the PAY MATRIX of an officer, in accordance with the orders of the Central Government in this regard from time to time.

(b) The number of permanent and temporary posts specified in Schedules I, II and III, shall be such as are included in the budget of the year with the sanction.

4. Co-terminus posts.—The posts specified in Schedule II are tenable by the incumbents during the pleasure of the President and shall be co-terminus with the each President. The persons holding co-terminus appointments in the Secretariat or Household Establishment of the President's Secretariat shall not be eligible for absorption or regular appointment in the President's Secretariat; however, such incumbents if otherwise meet all prescribed conditions and qualifications (including age), they would be eligible to compete on equal basis with candidates for direct recruitment.

5. Posts paid from Defence Estimates.—The posts specified in Schedule III are tenable during the pleasure of the President by officers of the Defence Services who shall be governed in all matters regulating their conditions of service by such rules as are applicable to officers holding corresponding rank in the Defence Services subject to such modifications, as the President may, by general or special order, specify.

6. Appointing authority.—Appointments to the posts shall be made by the respective authorities specified in the schedules.

7. Method of recruitment, age-limit, qualifications, etc.—The method of recruitment to the posts, age limit, qualifications and other matters relating to the said posts shall be as specified in Schedules I, II, III and IV.

8. Direct recruitment.—Where in respect of a post specified in Schedule I, the method of recruitment is direct recruitment –

(a) DPC as specified under the respective post in the Schedule will function as Selection Board;

(b) The Selection Board as under clause (a) shall follow the procedure as specified in Schedule III-A.

9. Promotion.—Where in respect of a post specified in the Schedule the method of recruitment is by promotion – (a) the recruitment shall, subject to the conditions specified in that Schedule and subject to the provisions of rule 14.

(i) in the case of promotion to any post in Group A or Group B (Gazetted), be made by Selection, irrespective of seniority.

(ii) in the case of promotion to any other post, be made on the Non-Selection basis;

(b) the Departmental Promotion Committee as specified will recommend suitable candidates for promotion to such posts and the said Committee shall follow the procedure specified in Schedule-IV.

NOTE: "Where juniors who have completed their qualifying/eligibility service are being considered for promotion,

their seniors would also be considered provided they are not short of the requisite qualifying service by more than

half of such qualifying/ eligibility service or two years, whichever is less, and have successfully completed probation

period for promotion to the next higher grade along with their juniors who have already completed such qualifying/

eligibility service."

10. Deputation and absorption.—An officer while on deputation or absorption in this Secretariat shall be governed by such general terms and conditions of deputation or absorption as may be laid down by the Central Government from time to time, or such terms and conditions as may be settled between his parent office and the Secretariat, in consultation with the Ministry of Finance, where necessary.

11.(1) Seniority.—(a) Direct recruits – The relative seniority of all direct recruits shall be determined by the order of merit in which they are selected for such appointment, unless otherwise specified in the order of appointment.

Provided further that the seniority of a person regularly appointed to a post shall be determined by the order of merit indicated at the time of initial appointment and not date of confirmation.

(b) Promotees –

(i) The relative seniority of persons promoted to Selection posts shall be determined in the order of selection for such promotion.

(ii) The relative seniority of persons promoted to Non-Selection posts shall be determined in the order in which such persons are promoted.

Provided that where persons are promoted to such posts on the same day, the relative seniority of such persons shall be the same as the relative seniority in the lower grades from which they are promoted.

Provided further that where persons promoted initially on a temporary basis are confirmed subsequently in an order different from the order of merit indicated at the time of their promotion, seniority would be determined by the order indicated at the time of initial appointment and not according to the date of confirmation.

(c) Deputation or Absorption – In the case of appointments by deputation or absorption, seniority of a person shall be determined at the time of absorption with due regard to his length of service in equivalent posts and other relevant factors.

11.(2) The provision of sub-rule (1) shall apply to all appointments made on or after the date of commencement of these rules and the relative seniority of persons appointed before such date in the Secretariat to any grade shall be in accordance with the orders in force at that time.

12. Probation and confirmation – (a) Candidates appointed to posts in the Secretariat, either by direct recruitment or by promotion shall be on probation for the period specified in Schedule-I.

Provided that the appointing authority may, at its discretion, take into account for the purpose of computing the said period –

(i) any period of service rendered by the candidate in posts carrying equivalent or higher responsibilities;

(ii) in the case of a promotee to any post, any period of officiating service rendered by him in that post:

Provided further that the period of probation may, in the case of a particular person or post, be extended by order of the appointing authority.

Provided also that the appointing authority may require a candidate to undergo during the period of probation such courses of training and to pass such tests as it may think fit, as a condition to the satisfactory completion of the period of probation.

(b) On the completion of the period of probation, the candidates shall, if considered fit for permanent appointment, be confirmed in their appointments, only once in the service of an official which shall be in the entry grade.

(c) If on the expiration of the period of probation or of any extended period thereof, or during the period of probation, as the case may be, the appointing authority is of opinion that the candidate is not fit for388 THE GAZETTE OF INDIA : FEBRUARY 3, 2018/MAGHA 14, 1939 [PART II—SEC. 3(i)] permanent appointment, it may discharge him or revert to his previous post, without assigning any reason or pass such orders as it may think fit.

13. Conditions of service –

(a) General – In respect of all matters regulating the conditions of service of officers for which no provision has been made in these rules, the officers shall be governed by such rules as are applicable to the officers holding posts in the corresponding LEVEL in the PAY MATRIX in the Central Secretariat, subject to such modifications, variations or exceptions, if any, in any such rule, as the President may, from time to time, by order, specify.

(b) Transfer – Every employee shall be liable to posted anywhere in India more particularly to 'The Retreat', Mashobra, Shimla and 'Rashtrapati Nilayam', Bolarum, Secunderabad, Hyderabad and to the places where the President's establishment for the time being may be.

(c) Conduct – Every officer shall be governed by the Central Civil Service (Conduct Rules), 1964, as amended from time to time, or such other corresponding rules as are applicable to the service of which he is a member.

(d) Discipline and control – Every officer shall be governed by the Central Civil Service (Classification, Control and Appeal Rules), 1965, as amended from time to time, or such other corresponding rules as are applicable to the service of which he is a member.

(e) Temporary officers – Every temporary officer shall be governed by the Central Civil Services (Temporary Service) Rules, 1965, as amended from time to time.

14. Savings –

"Nothing in those rules shall affect reservations, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-Servicemen and other special categories of persons, in accordance with the orders issued by the Central Government from time to time in this regard".

15. Regulations – The President may make regulations, not inconsistent with these rules, to provide for all matters for which provision may be necessary or expedient for the purpose of giving effect to these rules.

16. Power to relax – The President may, if of opinion that it is necessary or expedient so to do in the public interest, by order, relax any of the provisions of these rules with respect to any class or category of officers. Reasons will be recorded in writing whenever action is taken invoking this rule.

17. Interpretation – All questions relating to the interpretation of these rules shall be referred to the President for decision.

18. Repeal and Saving –

(a) Save as otherwise expressly provided in these rules, all rules and orders corresponding to these rules and in force immediately before the commencement of these amended rules are hereby repealed.

(b) Notwithstanding such repeal, anything done or any action taken under the rules or orders so repealed shall be deemed to have been done or taken under the corresponding provisions of these rules.
