एतद~द्वारा सूचना प्रदान की जाती है कि कं पनीज़ अिधिनयम, 1956 की धारा 433 तथा 434 के अन्तर्गत माननीय उ/ न्यायलय, नई दिल्ली द्वारा ितिथ 19.11.2015 में उपरोक्त प्रतिवादी कं पनी को समाप्ति (वाइंडिग अप) हेतु एक यािचका जे एस आई 2591 DG/2018

माननीय उ/ न्यायkलय, नई दिल्ली के पारित आदेश दिनांक ¹⁶.¹⁰.²⁰¹⁷ सी.पी. संख्या ⁸⁶⁷/²⁰¹⁵ में शासकीय समापक को कं पनी के अंतरिम परिसमापक नियुक्त किया है और याचिका का वि$ापन प्रकाशित करने का निदGश दिया गया है। याचिका में सुनवाई की अगली तारीख 07.08.2018 के लिए तय की गई है।

कोई लेनदार, अंशदायी अथवा अन्य Iक्ति किथत यािचका में समर्थन या आपत्ति का इKछु क कोई अन्य Iक्ति स्वयं की इKछा की सूचना कार्यालय अधोहस्ताक्षरी को प्रेषित करनी चािहए तथा इस प्रकार सूचना कार्यालय अधोहस्ताक्षरी को यािचका की सुनवाई हेतु निर्धारित ितिथ अर्थात 07.08.2018 से पूर्व 5 दिनों से अधिक विलम्ब नहS प(cid:2)aचना चािहए तथा उक्त प्रयोजन हेतु स्वयं Iक्ति रूप में अथवा स्वयं के अधिवक्ता द्वारा सुनवाई में उपस्थित होना चािहए। यािचका की एक प्रति कार्यालय अधोहस्ताक्षरी द्वारा उक्त लेनदार तथा अंशदायी को निर्धारित शुल्क के भुगतान पर उपलब्ध की जाएगी।

कोई शपथ पत्र यािचका हेतु प्रतिवाद में उपयोग हेतु इKछु क न्यायालय में निर्धारित सुनवाई ितिथ से पूर्व 5 दिनों से अिधक विलम्ब नहS प्रस्तुत करना चािहए। इसकी एक प्रति अधोहस्ताक्षरी को भी देनh चािहए।

Notice is hereby given that a petition under Section 433 and 434 of the Companies Act, 1956 for the winding up of the above Respondent Company by the Hon'ble High Court at New Delhi was presented on 19.11.2015 to the Hon'ble High Court by JSIW Infrastructure Pvt. Ltd., 4, Asstt Mitre Estate, Near Vadilal Factory, Dudheshwar Road, Ahmedabad, Gujarat – 380 004, creditor of the Respondent Company.

The Hon'ble High Court of Delhi vide order dated 16.10.2017 passed in C.P.No.867/2015 appointed the Official Liquidator as the Provisional Liquidator of the company and directed the Official Liquidator to publish the advertisement of petition. The next date of hearing in the said petition is fixed for 07.08.2018 at 10:30AM.

Any creditor, contributory or other person desirous of supporting or opposing the making of an order on the said petition should send to the undermentioned notice of his intention signed by him or his advocate with his name and address so as to reach the undermentioned not later than 5 days before the date fixed for the hearing of the petition i.e. 07.08.2018 and appear at the hearing for the purpose in person or by his advocate. A copy of the petition will be furnished by the undermentioned to any creditor or contributory on payment of the prescribed charges for the same.

Any affidavit intended to be used in opposition to the petition should be filed in Court and a copy served on the undermentioned not less than 5 days before the date fixed for the hearing.
