सं.फा.9-25/2000-यू3(ए) भाग.3.—जबकि, 'अमृता विB विद्यापीठम' कोयम्बटूर, तिमलनाडु, जिसमें निम्नलिखित पांच संस्थाएं हैं, को इस मंत्रालय की दिनांक 13 जनवरी, 2003 की अिधसूचना सं. एफ.9-25/2000-यू.3 द्वारा विBविद्यालय अनुदान आयोग (यूजीसी) अिधिनयम, 1956 की धारा 3 के तहत समविBविद्यालय घोिषत किया गया था, जो पांच वषG के बाद समीक्षा के अध्यधीन है :

i. अमृता प्रौद्योगिकी और विJान संस्थान, एKीमडई परिसर, कोयम्बटूर;

ii. अमृता प्रबंधन संस्थान, एKीमडई परिसर, कोयम्बटूर;

iii. अमृता चिकित्सा विJान और अनुसंधान कें < संस्थान, कोAि;

iv. अमृता इंस्टिQूट ऑफ़ फार्मास्युटिकल्स साइंसेज, कोAि; और

v. अमृता इंस्टिQूट ऑफ़ नSसग साइंसेज, कोAि

2. और जबकि, मंत्रालय की दिनांक 13.01.2003 की अिधसूचना के प्रावधानों के अनुसार, विBाविद्यालय अनुदान आयोग द्वारा अमृता विB विद्यापीठम, कोयम्बटूर की कायG की समीक्षा करने के िलए एक विशेषJ सिमित का गठन किया गया था।

3. और जबकि, कें < सरकार ने दिनांक 30 िसतंबर, 2016 की अपनी अिधसूचना सं. 9-25/2000-यू.3ए की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते Uए और यूजीसी की सलाह पर, 'अमृता विB विद्यापीठम' कोयम्बटूर, तिमलनाडु के सम विBविद्यालय के दजV को अगले पांच वषG की अविध अर्थात 13.01.2008 से 12.01.2013 तक बढ़ाया है।

4. और इसके अलावा जबकि, यूजीसी ने एक विशेषJ सिमित के माध्यम से 'अमृता विBा विद्यापीठम' कोयम्बटूर, तिमलनाडु और इसकी घटक इकाइयों की समीक्षा की है| इसके अतिरिक्त, कें < सरकार ने धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते Uए, दिनांक 27 मार्च, 2017 की अपनी अिधसूचना सं. 9-25/2000-यू.3(ए) भाग.3 द्वारा, यूजीसी की सलाह पर, 'अमृता विB विद्यापीठम' कोयम्बटूर, तिमलनाडु के सम विBविद्यालय के दजV को अगले पांच वषG की अविध अर्थात 13.01.2008 से 12.01.2013 तक बढ़ाया है जो इस शर्त के अध्यधीन होगा कि दजV को भविष्य में तभी आगे बढ़ाया जायेगा जब सम विBविद्यालय के नाम पर एक अलग सोसाइटी बनाई जाएगी और सभी चल-अचल संपत्तियों को नवनि1मत सोसाइटी में कानूनी रूप से अंतरित कर दिया जायेगा। किमयां दूर किए जाने तक, अमृता विश्व विद्यापीठम, कोयंबटूर, तिमलनाडु को आगे विस्तार करने की अनुमित नहX दी जाएगी।

5. और जबकि, अमृता विश्व विद्यापीठम, कोयंबटूर, तिमलनाडु के अनुरोध और यूजीसी की सलाह के अनुसार, मंत्रालय ने यूजीसी अिधिनयम, 1956 की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते Uए, अमृता विश्व विद्यापीठम, कोयंबटूर, तिमलनाडु के सम विश्वविद्यालय दजV को दिनांक 13.1.2018 से 12.7.2018 तक 6 माह की अविध के िलए आगे बढ़ाया/िनयिमितकरण किया।

6. और जबकि, अमृता विश्व विद्यापीठम, कोयंबटूर, तिमलनाडु ने यूजीसी से एक शैक्षिक वर्ष के िलए सम विश्वविद्यालय के दजV को आगे बढ़ाने का पुन: अनुरोध किया िजससे उसके शैक्षिक कार्यकलाप प्रभावित न हो। आयोग द्वारा दिनांक 20.3.2018 को आयोिजत अपनी 530वX बैठक (मद सं. 2.19) में संस्था के अनुरोध पर िवचार किया गया और अमृता विश्व विद्यापीठ, कोयंबटूर, तिमलनाडु के सम विश्वविद्यालय दजV को दिनांक 13.7.2018 से 12.7.2019 तक 1 वर्ष की और अविध के िलए आगे बढ़ाने की सिफारिश की।

7. अत: अब, यूजीसी अिधिनयम, 1956 की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते Uए, कें < सरकार ने, एतदद्वारा यूजीसी की सलाह पर, अमृता विश्व विद्यापीठम, कोयंबटूर, तिमलनाडु के सम विश्वविद्यालय दजV को दिनांक 13.7.2018 से 12.7.2019 तक 1 वर्ष की अविध के िलए आगे बढ़ाया/िनयिमितकरण किया िजसके दौरान संस्था दिनांक 27 मार्च, 2017 के इस मंत्रालय के आदेश की शतG का अनुपालन करेगी अन्यथा इस कारण से भविष्य में उसके दजV को आगे नहX बढ़ाया जाएगा।

8. अमृता विश्व विद्यापीठम, कोयंबटूर, तिमलनाडु इस मंत्रालय की पूर्व अधिसूचनाओं में दर्शायी गई अन्य शतG का अनुपालन करता रहेगा।

सं.एफ. 9-19/2005-यू.3 (भाग 1) .—जबकि, के न्< सरकार को विBविद्यालय अनुदान आयोग (यूजीसी) अिधिनयम, 1956 की धारा 3 के तहत, यूजीसी की सलाह पर, किसी उ]चतर अिधगम संस्था को सम-विBविद्यालय के रूप में घोिषत करने की शक्ति प्राप्त है।

2. और जबकि, के न्< सरकार ने यूजीसी अिधिनयम, 1956 की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते Uए, अपनी दिनांक 21.08.2005 की अिधसूचना सं. 9-19/2005-यू.3 के जरिए यूजीसी की सलाह पर, अकादमी ऑफ मैरीटाइम एजुके शन ए_ड ट्रेनिग, कनाथुर, तिमलनाडु को इसके संबंधन विश्वविद्यालय से संस्था की सम्बaता समाप्त होने की तारीख से पांच वषG की अनंितम अविध के िलए नई bेणी के तहत समविBविद्यालय संस्था घोिषत किया था।

3. और इसके अतिरिक्त जबकि, यूजीसी द्वारा इसकी विशेषJ सिमित की मदद से 31 जनवरी से 2 फरवरी, 2018 के दौरान अकादमी ऑफ मैरीटाइम एजुके शन ए_ड ट्रेनिग, कनाथुर, तिमलनाडु के कार्यकरण की समीक्षा की गई थी। विशेषJ सिमित की रिपोर्ट दिनांक 20.03.2018 को आयोिजत इसकी 530वX बैठक (मद सं. 2.06) में आयोग के समक्ष प्रस्तुत की गई थी। आयोग ने रिपोर्ट पर िवचार किया था और इस मंत्रालय को निम्निलिखत संकल्प संप्रेषित किया गया था:

''िवचार किया गया और इसके अध्यधीन अनुमोदन किया कि विजिdटग विशेषJ सिमित द्वारा सुझावों पर, यदि कोई हों, छह माह की समयाविध के भीतर िवचार किया जाएगा और यूजीसी को दस्तावेजी प्रमाण सिहत अनुपालन रिपोर्ट प्रस्तुत की जाएगी।''

4. अत: अब, के न्< सरकार यूजीसी अिधिनयम, 1956 की धारा 3 के तहत प्रदत्त शक्तियों का प्रयोग करते Uए, एतदद्वारा यूजीसी की सलाह पर अकादमी ऑफ मैरीटाइम एजुके शन ए_ड ट्रेनिग, कनाथुर, तिमलनाडु के समविश्वविद्यालय के दजV को दिनांक 21.08.2012 से 30.06.2019 तक आगे बढ़ाती/िविनयिमत करती है जो इसके अध्यधीन होगा कि संस्था यूजीसी विशेषJ सिमित द्वारा बताए गए सुझावों/ बताई गई कमियों के संदर्भ में अनुपालन रिपोर्ट प्रस्तुत करेगी। इसके अलावा, यह इस शर्त के अध्यधीन होगा कि समविश्वविद्यालय अपनी एनआईआरएफ/ एनएएसी में अपनी रैंfकग/gेडिग के जरिए अपने कार्य- निष्पादन में सुधार करेगा।

5. अकादमी ऑफ मैरीटाइम एजुके शन ए_ड ट्रेनिग, कनाथुर, तिमलनाडु द्वारा इस मंत्रालय की पूर्व अिधसूचना(ओं) में उल्लिखित सभी अन्य शतG के साथ-साथ यूजीसी और अन्य सांिविधक परिषदों द्वारा समय-समय पर जारी किए जाने वाले नियमों/ विनियमों का पालन किया जाएगा।

सं.एफ.9-38/2006-यू3(ए) भाग.3.—जबकि, के न्< सरकार को विBविद्यालय अनुदान आयोग (यूजीसी) अिधिनयम, 1956 की धारा 3 के तहत, यूजीसी की सलाह पर, किसी उAतर अिधगम संस्था को समविBविद्यालय के रूप में घोिषत करने की शक्ति प्राप्त है।

2. और जबकि, कें < सरकार ने यूजीसी अिधिनयम, 1956 की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते Uए, अपनी दिनांक 16.12.2008 की अिधसूचना सं.9-38/2006-यू3(ए) के माध्यम से, यूजीसी की सलाह पर, बी.एस. अब्दुर रहमान hिसेंट इंजीनियdरग कॉलेज, वांदालुर, चेन्नई, तिमलनाडु को, इसके संबधन विBविद्यालय से संबaता समाप्त होन की ितिथ से पांच वर्ष की अनंितम अविध के िलए बी.एस. अब्दुर रहमान विJान और प्रौद्योगिकी संस्थान के नाम पर समविBविद्यालय संस्था के रूप में घोिषत किया था।

3. और इसके अलावा जबकि, यूजीसी द्वारा दिनांक 29-31 जनवरी, 2018 के दौरान, अकादमी ऑफ़ मेरीटाइम एजुके शन एंड ट्रेनिग कनाथुर, तिमलनाडु के कायG की विशेषJ सिमित की सहायता से समीक्षा की गई थी। विशेषJ सिमित की रिपोर्ट दिनांक 20.03.2018 को Uई इसकी 530वX बैठक (मद सं. 2.13) में आयोग के समक्ष प्रस्तुत की गई थी। आयोग ने रिपोर्ट पर िवचार किया था और इस मंत्रालय को निम्नलिखित संकल्प अgेषित किया गया था:

4. अब इसिलए, कें < सरकार एतदद्वारा, यूजीसी अिधिनयम, 1956 की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते Uए, यूजीसी की सलाह पर, बी.एस. अब्दुर रहमान विJान और प्रौद्योगिकी संस्थान, वांदालुर, चेन्नई, तिमलनाडु के समविBविद्यालय के दजV को 16.12.2013 की ितिथ से आगे निम्नलिखित शतG के साथ बढ़ाती है:

i. समविBविद्यालय समय-समय पर इसके एमओए/नियमों और इसके विभिन्न निकायों के संघटन को यथासंशोिधत यूजीसी (सम विBविद्यालय संस्थाएं) िविनयम, 2016 के प्रावधानों के अनुसार संशोधन करेगा।

2. और जबकि, के न्< सरकार ने यूजीसी अिधिनयम, 1956 की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते Uए, यूजीसी के परामर्श पर, अपनी दिनांक 29.02.2008 की अिधसूचना सं. 9-37/2007-यू.3(ए) द्वारा bी बी.एम. पाटिल मेिडकल कॉलेज, अस्पताल और अनुसंधान कें <, बीजापुर, कर्नाटक को, इसके संबधन विश्वविद्यालय अर्थात् राजीव गांधी स्वास्थ्य विJान विश्वविद्यालय, बंगलौर से संबaता समाप्त होने की तारीख से 5 वषG की अंनितम अविध के िलए 'बीएलडीई विश्वविद्यालय' के नाम और शैली में सम-विश्वविद्यालय संस्था के रूप में घोिषत किया था। यह घोषणा इस शर्त के अध्यधीन थी कि यूजीसी की विशेषJ सिमित की निरीक्षण और मूल्यांकन रिपोर्ट और यूजीसी की सिफारिशों के आधार पर 5 वषG की अविध के बाद की समविश्वविद्यालय के दजV की पुष्टि जाएगी।

3. और आगे जबकि, माननीय उ]चतम न्यायालय ने ओिडशा लिnट इरिगेशन कापoरेशन िलिमटेड बनाम रबी शंकर पेट्रो एवं अन्य द्वारा दायर िसिवल अपील सं. 17869-17870/2017 (एसएलपी (सी) सं. 19807-19808/2012 से उत्पन्न) और िवजय कु मार एवं अन्य बनाम करतार सिह एवं अन्य शीर्षक िसिवल अपील सं. 17902-17905/2017 (एसएलपी सी सं. 35793-96/2012 से उत्पन्न) में अपने दिनांक 03.11.2017 के आदेश में यह फै सला किया कि यूजीसी, आज से एक माह के भीतर यूजीसी अिधिनयम की धारा 23 के कार्यान्वयन और समविश्वविद्यालयों को ''विश्वविद्यालय'' शब्द का उपयोग करने पर प्रतिबंध लगाने के समुिचत उपाय करेगा।

4. और जबकि, के न्< सरकार ने माननीय उ]चतम न्यायालय के निदVशों के अनुसार और यूजीसी के परामर्श पर, यूजीसी अिधिनयम, 1956 की धारा 3 के तहत प्रदत्त शक्तियों का प्रयोग करते Uए अपनी दिनांक 11 जनवरी, 2018 की अिधसूचना सं. 9-37/2007-यू.3(ए) द्वारा "बीएलडीई विश्वविद्यालय" के नाम से 'विश्वविद्यालय' शब्द का िवलोपन कर 'बीएलडीई' करती है बशतV कि बीएलडीई अपने नाम के आगे 'विश्वविद्यालय' शब्द को प्रयोग नहX करेगा लेकिन, इसके आगे कोष्ठकों के भीतर "समविBविद्यालय'' प्रत्यय शब्द का उल्लेख कर सकता है।

5. और जबकि, यूजीसी द्वारा अपनी विशेषJ सिमित की सहायता से दिनांक 22-24 िसतंबर, 2017 के दौरान 'बीएलडीई', बीजापुर, कर्नाटक के कार्यकलापों की समीक्षा की गई थी। विशेषJ सिमित की रिपोर्ट को दिनांक 22.12.2017 को आयोिजत इसकी 527वX बैठक (मद सं. 2.01) में आयोग के समक्ष रखा गया। आयोग ने रिपोर्ट पर िवचार किया था और निम्निलिखत संकल्प इस मंत्रालय को अgेषित किया गया था:

6. और आगे जबकि, इस मंत्रालय में यूजीसी की सिफारिशों के साथ साथ यूजीसी विशेषJ सिमित की रिपोर्ट की जांच की गई थी और निम्निलिखत तथ्य प्रस्तुत किए गए:

i. समविश्वविद्यालय संस्था को अपनी सोसायटी, भूिम शीर्षक, लेखों, काियक िनिध इत्यादि के नाम को नए नाम अर्थात बीएलडीई में करना है।

II. समविश्वविद्यालय संस्था को अपने सभी लेटर हेड, वेबसाइट और अपने सभी पत्र-pयवहारों में नये नाम को शािमल करना है।

III. समविश्वविद्यालय संस्था को अपने एमओए/िनयमावली में नए नाम को शािमल करना है।

IV. संस्था को यूजीसी विशेषJ सिमित द्वारा दिए गए सुझावों के संबंध में अनुपालन रिपोर्ट प्रस्तुत करना है।

V. समविश्वविद्यालय संस्था नवीनतम भारतीय रैंfकग अर्थात एनआईआरएफ रैंfकग के शीर्ष 200 में स्थान बनाने में िवफल रही।

VI. समविश्वविद्यालय संस्था को राष्ट्रीय मूल्यांकन और प्रत्यायन परिषद (एनएएसी) द्वारा दिनांक 16.11.2015 से 15.11.2020 तक की अविध के िलए 'बी' gेड (सीजीपीए 2.90) के साथ प्रत्याियत किया गया है।

7. अब, इसिलए, के न्< सरकार, यूजीसी अिधिनयम, 1956 की धारा 3 के तहत प्रदत्त शक्तियों का प्रयोग करते Uए, यूजीसी के परामर्श पर, 'बीएलडीई', बीजापुर, कर्नाटक के सम विश्वविद्यालय के दजV को निम्निलिखत शतG के साथ दिनांक 28.02.2013 से 30.06.2019 तक आगे बढ़ाती है:

i. समविश्वविद्यालय संस्था अपनी सोसायटी, भूिम शीर्षक, लेखों, काियक िनिध इत्यादि के नाम को नए नाम अर्थात बीएलडीई में परिव1तत करेगी।

ii. समविश्वविद्यालय संस्था अपने सभी लेटर हेड, वेबसाइट और अपने सभी पत्र-pयवहारों में नये नाम को शािमल करेगी।

iii. समविश्वविद्यालय संस्था अपने एमओए/िनयमावली में नए नाम को शािमल करेगी।

5. और जबकि, यूजीसी द्वारा अपनी विशेषJ सिमित की मदद से 14-16 दिसंबर, 2017 के दौरान hाईस्ट, बंगलौर, कर्नाटक की समीक्षा की गई थी। विशेषJ सिमित की रिपोर्ट दिनांक 08.02.2018 को आयोिजत इसकी 529वX बैठक (मद सं. 2.05) में आयोग के समक्ष प्रस्तुत की गई थी। आयोग ने रिपोर्ट पर िवचार किया था और निम्निलिखत संकल्प इस मंत्रालय को अgेषित किया गया था:

6. और जबकि, यूजीसी विशेषJ सिमित की रिपोर्ट के साथ-साथ यूजीसी की सिफारिशों की मंत्रालय में जांच की गई थी और निम्निलिखत तथ्य प्रस्तुत किए गए:

i. समविBविद्यालय संस्था को अपनी सोसायटी, भू-शीर्षक, लेखों, काियक िनिध आदि का नाम बदलकर नए नाम अर्थात ''hाईस्ट'' के नाम में करनी है।

ii. समविBविद्यालय संस्था को अपने संगम Jापन/नियमों में नए नाम को समाविष्ट करना है।

iii. समविBविद्यालय संस्था को यूजीसी विशेषJ सिमित द्वारा दिए गए सुझावों के संबंध में अनुपालन रिपोर्ट प्रस्तुत करना है।

iv. समविBविद्यालय संस्था, नवीनतम भारतीय रैंfकग अर्थात एनआईआरएफ रैंfकग की शीर्ष 200 संस्थाओं में स्थान हािसल करने में िवफल रही है।

7. अब, अत:, के न्< सरकार एतद्वारा यूजीसी अिधिनयम, 1956 की धारा 3 के तहत प्रदत्त शक्तियों का प्रयोग करते Uए, यूजीसी की सलाह पर, hाईस्ट, बंगलौर, कर्नाटक के सम-विश्वविद्यालय दजV को निम्निलिखत शतG पर दिनांक 22.07.2013 से 30.06.2019 तक बढ़ाती/ िविनयिमत करती है।

i. समविBविद्यालय संस्था अपनी सोसायटी, भू-शीर्षक, लेखों, काियक िनिध आदि का नाम बदलकर नए नाम अर्थात ''hाईस्ट'' के नाम में परिव1तत करेगी।

ii. समविBविद्यालय संस्था, सभी लेटर हैड, वेबसाइट और अपने भावी पत्राचार में नए नाम को समाविष्ट करेगी।

iii. समविBविद्यालय संस्था, अपने संगम Jापन/ नियमों में नए नाम को समाविष्ट करेगी।

iv. समविBविद्यालय संस्था, यूजीसी विशेषJ सिमित द्वारा दिए गए सुझावों के संबंध में अनुपालन रिपोर्ट प्रस्तुत करेगी।

v. समविBविद्यालय संस्था, एनआईआरएफ में अपनी रैंfकग से अपने कार्य-निष्पादन में सुधार करेगी।

3. और इसके अतिरिक्त जबकि, यूजीसी द्वारा इसकी विशेषJ सिमित की मदद से 26-27 अक्टूबर, 2017 के दौरान चेन्नई मैथेमेटिकल इंस्टीQूट, चेन्नई, तिमलनाडु के कार्यकरण की समीक्षा की गई थी। विशेषJ सिमित की रिपोर्ट दिनांक 02.12.2017 को आयोिजत इसकी 527वX बैठक (मद सं. 2.13) में आयोग के समक्ष प्रस्तुत की गई थी। आयोग ने रिपोर्ट पर िवचार किया था और इस मंत्रालय को निम्निलिखत संकल्प संप्रेषित किया गया था:

2. और जबकि, के न्< सरकार ने यूजीसी अिधिनयम, 1956 की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते Uए, अपनी दिनांक 03.07.2008 की अिधसूचना सं. 9-16/2007-यू.3 (ए) के जरिए यूजीसी की सलाह पर, भारतीय अंतरिक्ष विJान और प्रौद्योगिकी संस्थान (आईआईएसएसटी), तिरूवनंतपुरम, के रल को पांच वषG की अनंितम अविध के िलए नई bेणी के तहत समविBविद्यालय संस्था घोिषत किया था। यह घोषणा इसके अध्यधीन थी कि आईआईएसएसटी को दिए गए दजV की, यूजीसी की विशेषJ सिमित की कार्य-निष्पादन रिपोर्ट और तत्संबंधी आयोग की सिफारिश के आधार पर, पांच वर्ष के बाद पुष्टि की जाएगी और अंतरिक्ष िवभाग, यूजीसी द्वारा विनिर्धारित मॉडल संगम Jापन/िनयमावली के अनुसार और आयोग की सहमित से आईआईएसएसटी के संगम Jापन (एमओए) और िनयमावली को अंितम रूप देगा।

3. और जबकि, यूजीसी द्वारा अपनी विशेषJ सिमित की मदद से 29-31 जनवरी, 2018 के दौरान 'भारतीय अंतरिक्ष विJान और प्रौद्योगिकी संस्थान (आईआईएसएसटी), तिरूवनंतपुरम, के रल की समीक्षा की गई थी। विशेषJ सिमित की रिपोर्ट दिनांक 20.03.2018 को आयोिजत इसकी 530वX बैठक (मद सं. 2.12) में आयोग के समक्ष प्रस्तुत की गई थी। आयोग ने रिपोर्ट पर िवचार किया था और इस मंत्रालय को निम्निलिखत संकल्प अgेषित किया गया था:

4. और इसके अतिरिक्त जबकि, भारत के माननीय उ]चतम न्यायालय ने ओिडशा लिnट इरिगेशन कापoरेशन िलिमटेड बनाम रिबशंकर पात्रो एवं अन्य द्वारा दायर िसिवल अपील सं. 17869-17870/2017 (एसएलपी (सी) सं. 19807-19808/2012 से उत्पन्न) और िवजय कु मार एवं अन्य बनाम करतार सिह एवं अन्य शीर्षक िसिवल अपील सं. 17902-17905/2017 (एसएलपी सी सं. 35793-96/2012 से उत्पन्न) में अपने दिनांक 03.11.2017 के आदेश में यह निर्णय दिया था कि यूजीसी, आज से एक माह के भीतर यूजीसी अिधिनयम की धारा 23 के कार्यान्वयन और समविश्वविद्यालयों को ''विश्वविद्यालय'' शब्द का उपयोग करने पर प्रतिबंध लगाने के समुिचत उपाय करेगा।

5. और जबकि, के न्< सरकार ने माननीय उ]चतर न्यायालय के निदVशों के अनुसार और यूजीसी की सलाह पर, यूजीसी अिधिनयम 1956 की धारा 3 के तहत प्रदत्त शक्तियों का प्रयोग करते Uए अपनी दिनांक 11.01.2018 की अिधसूचना सं. 9-57/2007-यू3(ए) के जरिए ''जैन विश्वविद्यालय'' के नाम से 'विश्वविद्यालय' शब्द का िवलोपन करके इसका नाम बदलकर 'जैन' किया था बशतr कि 'जैन' अपने नाम में 'विश्वविद्यालय' प्रत्यय शब्द का उपयोग नहX करेगा लेकिन इसके आगे कोष्ठकों के भीतर ''समविश्वविद्यालय'' प्रत्यय शब्द का उल्लेख कर सकता है।

6. और इसके अतिरिक्त जबकि, यूजीसी द्वारा इसकी विशेषJ सिमित की सहायता से 21-23 दिसंबर, 2017 के दौरान जैन, बंगलौर, कर्नाटक के कार्यकरण की समीक्षा की गई थी। विशेषJ सिमित की रिपोर्ट को 20.03.2018 को आयोिजत इसकी 530वX बैठक (मद संख्या 2.09) में आयोग के समक्ष प्रस्तुत किया गया था। आयोग ने रिपोर्ट पर िवचार किया था और निम्निलिखत संकल्प इस मंत्रालय को संप्रेषित किया गया था:

7. और जबकि, यूजीसी विशेषJ सिमित की रिपोर्ट के साथ-साथ यूजीसी की सिफारिशों की मंत्रालय में जांच की गई थी और निम्निलिखत तथ्य प्रस्तुत किए गए:

i. समविश्वविद्यालय ने मौजूदा विनियमों के अनुसार अपने संगम Jापन/नियमों को प्रस्तुत नहX किया है।

ii. माननीय उ]चतम न्यायालय द्वारा समविश्वविद्यालयों को उनके नाम में 'विश्वविद्यालय' शब्द का उपयोग करने का िनषेध करने वाले दिनांक 03.11.2017 के आदेश के बावजूद समविश्वविद्यालय अभी भी अपने नाम के साथ 'विश्वविद्यालय' शब्द का उपयोग कर रहा है।

iii. समविश्वविद्यालय संस्था को अपनी सोसाइटी, भूिम शीर्षक, लेखा, काियक िनिध आदि का नाम बदलकर नए नाम अर्थात जैन के नाम में करनी है।

iv. समविश्वविद्यालय ने नवीनतम राष्ट्रीय संस्थागत रैfकग कार्यढांचा (एनआईआरएफ) में भाग नहX िलया है।

v. संस्था को यूजीसी विशेषJ सिमित द्वारा दिए गए सुझावों के संबंध में अनुपालना रिपोर्ट प्रस्तुत करनी है।

8. अब, अत: के न्< सरकार एतद्दवारा यूजीसी अिधिनयम, 1956 की धारा 3 के तहत प्रदत्त शक्तियों का प्रयोग करते Uए, यूजीसी के परामर्श पर, जैन, बंगलौर, कर्नाटक के समविश्वविद्यालय के दजV को निम्निलिखत शतG पर दिनांक 19.12.2013 से 30.06.2019 तक बढ़ाती/िविनयिमत करती है:

i. समविश्वविद्यालय समय-समय पर यथासंशोिधत यूजीसी (समविश्वविद्यालय संस्थाएं) िविनयम, 2016 के अनुसार अपने संगम Jापन/नियमों को संशोिधत करेगा।

ii. समविश्वविद्यालय अपने नाम के साथ 'विश्वविद्यालय' शब्द का प्रयोग नहX करेगा लेकिन वह उसके आगे कोष्ठकों के भीतर 'समविश्वविद्यालय' प्रत्यय शब्द का उल्लेख कर सकता है।

iii. समविश्वविद्यालय अपनी सोसायटी, भू-शीर्षक, लेखों, काियक िनिध आदि का नाम बदलकर नए नाम अर्थात जैन के नाम में परिव1तत करेगा।

iv. समविश्वविद्यालय नवीनतम राष्ट्रीय संस्थागत रैfकग कार्यढांचा (एनआईआरएफ) में भाग लेगा और अपनी वेबसाइट पर अपनी रैfकग प्रद1शत करेगा।

v. संस्था यूजीसी विशेषJ सिमित द्वारा दिए गए सुझावों के संबंध में अनुपालन रिपोर्ट प्रस्तुत करेगी।

9. 'जैन', बंगलौर, कर्नाटक द्वारा इस मंत्रालय की पूर्व अिधसूचना(ओं) में उल्लिखित सभी अन्य शतG के साथ-साथ यूजीसी और अन्य सांिविधक परिषदों द्वारा समय-समय पर जारी किए जाने वाले नियमों/विनियमों का अनुपालन किया जाएगा।

सं. एफ.9-21/2005-यू.3 (ए) भाग.1.—जबकि, कें < सरकार को विBविद्यालय अनुदान आयोग (यूजीसी) अिधिनयम,1956 की धारा 3 के तहत, यूजीसी की सलाह पर, किसी उAतर अिधगम संस्था को बतौर समविBविद्यालय घोिषत करने के िलए शक्ति प्राप्त है।

2. और जबकि, के न्< सरकार ने यूजीसी अिधिनयम,1956 की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते Uए, अपनी दिनांक 30.08.2006 की अिधसूचना संख्या 9-21/2005-यू3(ए) के जरिए, यूजीसी की सलाह पर, एमजीएम स्वास्थ्य विJान संस्थान, नवी मुम्बई को, जिसमें दो संघटक मेिडकल कॉलेज अर्थात् (i) महात्मा गांधी िमशन मेिडकल कॉलेज, नवी मुम्बई और (ii) महात्मा गांधी िमशन मेिडकल कॉलेज, औरंगाबाद (महाराष्ट्र) शािमल हैं, को उपयु र्क्त कॉलेजों का उनके संबंधन विश्वविद्यालयों से उनका संबधन समाप्त होने की तारीख से पांच वर्ष की अनंितम अविध के िलए समविश्वविद्यालय संस्था घोिषत किया था।

3. और इसके अतिरिक्त, जबकि यूजीसी द्वारा अपनी विशेषJ सिमित की सहायता से 27-29 सितम्बर, 2017 के दौरान एमजीएम स्वास्थ्य विJान संस्थान, नवी मुम्बई, महाराष्ट्र के कार्यकरण की समीक्षा की गई थी। विशेषJ सिमित की रिपोर्ट दिनांक 22.12.2017 को आयोिजत इसकी 527वX बैठक (मद संख्या 2.11) में आयोग के समक्ष रखी गई थी। आयोग ने रिपोर्ट पर िवचार किया था और इस मंत्रालय को निम्निलिखत संकल्प अgेषित किया गया था:

''िवचार किया गया और इसके अध्यधीन अनुमोदन किया कि विजिdटग विशेषJ सिमित द्वारा दिए गए सुझावों पर, यदि कोई हों, छह माह की समयाविध के भीतर िवचार किया जाएगा और यूजीसी को दस्तावेजी प्रमाण सिहत अनुपालन रिपोर्ट प्रस्तुत की जाएगी।''478 [Hkkx Iµ[k.M 1 Hkkjr dk jkti=] tqykbZ 21] 2018 ¼vk"kk<+ 30] 1940½ 4. और इसके अतिरिक्त, जबकि मंत्रालय में यूजीसी विशेषJ सिमित की रिपोर्ट के साथ-साथ यूजीसी की सिफारिशों की जांच की गई थी और निम्निलिखत तथ्य पाए गए:

i. अचल परिसंपत्तियां अर्थात् संस्था की भूिम, समविश्वविद्यालय के नाम नहX है।

ii. समविश्वविद्यालय संस्था, नवीनतम भारतीय रैंfकग अर्थात् एनआईआरएफ रैंfकग के शीर्ष 200 रैंfकग में स्थान पाने में िवफल रही।

5. अब इसिलए, कें < सरकार एतदद्वारा यूजीसी अिधिनयम, 1956 की धारा 3 के तहत प्रदत्त शक्तियों का प्रयोग करते Uए, यूजीसी की सलाह पर, एमजीएम स्वास्थ्य विJान संस्थान, नवी मुम्बई, महाराष्ट्र के समविश्वविद्यालय के दजV को निम्निलिखत शतG पर दिनांक 30.08.2011 से 30.06.2019 तक बढ़ाती है:

i. प्रायोजक ट्रस्ट, सभी चल-अचल परिसंपत्तियों को िविधक रूप से समवविश्वविद्यालय के नाम में अंतरित करेगा।

ii. समविश्वविद्यालय संस्था, राष्ट्रीय संस्थागत रैंfकग uे मवर्क (एनआईआरएफ) में अपनी रैंfकग के जरिए अपने कार्य-निष्पादन में सुधार करेगी।

iii. संस्था, यूजीसी विशेषJ सिमित द्वारा दिए गए सुझावों के बारे में अनुपालन रिपोर्ट प्रस्तुत करेगी।

6. एमजीएम स्वास्थ्य विJान संस्थान, नवी मुम्बई, महाराष्ट्र द्वारा इस मंत्रालय की पूर्व अिधसूचना(ओं) में उल्लििखत सभी अन्य शतG के साथ- साथ और यूजीसी एवं अन्य सांिविधक परिषदों द्वारा समय-समय पर जारी किए गए नियमों/विनियमों का अनुपालन किया जाएगा।

4. और इसके अतिरिक्त जबकि, के न्< सरकार ने यूजीसी अिधिनयम, 1956 की धारा 3 के तहत प्रदत्त शक्तियों का प्रयोग करते Uए माननीय उ]चतम न्यायालय के निदVश अनुसार और यूजीसी के परामर्श पर अपनी दिनांक 11 जनवरी, 2018 की अिधसूचना सं.9-48/2007-यू.3(ए) के माध्यम से gाफिक एरा यूनिव1सटी के नाम से विश्वविद्यालय शब्द का िवलोपन करके इसका नाम बदलकर ''gाफिक एरा'' किया था बशतV कि479 Hkkx Iµ[k.M 1] Hkkjr dk jkti=] tqykbZ 21] 2018 ¼vk"kk<+ 30] 1940½ अपने नाम में ''gाफिक ऐरा'' ''विश्वविद्यालय'' प्रत्यय शब्द का उपयोग नहX करेगा लेकिन, इसके आगे कोष्ठकों के भीतर "समविBविद्यालय'' प्रत्यय शब्द का उल्लेख कर सकता है।

5. और जबकि, यूजीसी द्वारा अपनी विशेषJ सिमित की सहायता से 11 से 13 अक्टूबर, 2017 के दौरान gाफिक एरा, देहरादून, उत्तराखंड के कार्यकलापों की समीक्षा की गई थी। विशेषJ सिमित की रिपोर्ट को दिनांक 22.12.2017 को Uई इसकी 527वX बैठक (मद सं. 2.10) में आयोग के समक्ष रखा गया। आयोग ने रिपोर्ट पर िवचार किया था और निम्निलिखत संकल्प इस मंत्रालय को अgेषित किया गया था।

6. अब, इसिलए, के न्< सरकार, यूजीसी अिधिनयम, 1956 की धारा 3 के तहत प्रदत्त शक्तियों का प्रयोग करते Uए, यूजीसी के परामर्श पर, इस शर्त के साथ कि संस्थान निम्निलिखत पर 6 माह की अविध के भीतर यूजीसी को अनुपालन रिपोर्ट प्रस्तुत करेगा, 14.08.2013 से gाफिक एरा, देहरादून, उत्तराखंड के सम-विश्वविद्यालय के दजV को एतदद्वारा िनयिमत/आगे बढ़ाती है:

I. सम-विश्वविद्यालय संस्था को अपनी सोसायटी, भूिम शीर्षक, लेखाओं, काियक िनिध इत्यादि नाम को बदलकर नए नाम अर्थात gाफिक एरा में करनी है।

II. सम-विश्वविद्यालय संस्था नये नाम को सभी पत्र शीर्षकों, वेबसाइट और उसके सभी पत्र-pयवहारों में शािमल करेगा।

III. सम-विश्वविद्यालय संस्था अपने एमओए (संगम Jापन)/िनयमावली में नए नाम को शािमल करेगा।

IV. सम-विश्वविद्यालय संस्था अपने नाम की अनुमोदित नामावली का उपयोग करेगा।

V. संस्था यूजीसी विशेषJ सिमित द्वारा दिए गए सुझावों के संबंध में अनुपालन रिपोर्ट प्रस्तुत करेगी।

7. gाफिक एरा, देहरादून, उत्तराखंड द्वारा इस मंत्रालय की पहले की अिधसूचना(ओं) के साथ-साथ यूजीसी और सांिविधक परिषदों, समय-समय पर जारी िनयम/विनियमों में उल्लिखित अन्य सभी शतG का अनुपालन किया जाएगा।

2. और जबकि, कें < सरकार ने यूजीसी अिधिनयम, 1956 की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते Uए, दिनांक 17.07.2017 की अपनी अिधसूचना सं.9-33/2002-यू.3 के जरिए, यूजीसी की सलाह पर, शिक्षा 'ओ' अनुसंधान, भुवनेBर, ओिडशा, जिसमें निम्नलिखित पांच संस्थाएं शािमल हैं; को निम्नलिखित संस्थाओं के उनके संबधन विBविद्यालयों से संबंधन समाप्ति की तारीख से दो वर्ष के बाद उनकी समीक्षा के अध्यधीन समविBिवद्यालय संस्था घोिषत किया था:

i. तकनीकी शिक्षा एवं अनुसंधान संस्थान

ii. pयवसाय एवं कम्यूटर अध्ययन संस्थान

v. एसयूएम नSसग कॉलेज

3. और इसके अतिरिक्त जबकि, कें < सरकार ने यूजीसी अिधिनयम, 1956 की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते Uए, अपनी दिनांक 17.09.2007 की अिधसूचना सं. 9-33/2002-यू.3 तथा दिनांक 19.09.2007 की अिधसूचना सं. 9-33/2002-यू.3 के जरिए, यूजीसी की सलाह पर, दो संस्थाओं hमश: औषध विJान स्कू ल, भुवनेBर, ओिडशा और आयु1वJान संस्थान एवं एसयूएम हॉस्पिटल, भुवनेBर को शिक्षा 'ओ' अनुसंधान (सम-विBविद्यालय), भुवनेBर, ओिडशा के क्षेत्राधिकार में शािमल किया था।

4. और जबकि, यूजीसी द्वारा अपनी विशेषJ सिमित की सहायता से 28-30 जनवरी, 2018 के दौरान शिक्षा 'ओ' अनुसंधान, भुवनेBर, ओिडशा के कार्यकरण की समीक्षा की गई थी। विशेषJ सिमित की रिपोर्ट दिनांक 20.03.2018 को आयोिजत इसकी 530वX बैठक (मद सं.2.11) में आयोग के समक्ष रखी गई थी। आयोग ने िवचार किया तथा इस मंत्रालय को निम्नलिखित संकल्प अgेषित किया:

5. अत: अब, कें < सरकार एतदद्वारा यूजीसी अिधिनयम, 1956 की धारा 3 के अन्तर्गत प्रदत्त शक्तियों का प्रयोग करते Uए, यूजीसी की सलाह पर, इस शर्त के अध्यधीन कि संस्था, यूजीसी विशेषJ सिमित द्वारा दिये गए सुझावों/ बताई गई कमियों के संबंध में अनुपालन रिपोर्ट प्रस्तुत करेगी, शिक्षा 'ओ' अनुसंधान, भुवनेBर, ओिडशा के समविBविद्यालय के दजV को दिनांक 17.07.2009 से आगे बढ़ाती/िविनयिमत करती है।

6. शिक्षा 'ओ' अनुसंधान, भुवनेBर, ओिडशा द्वारा इस मंत्रालय की पूर्व अिधसूचना(ओं) में उल्लििखत सभी अन्य शतG के साथ-साथ और यूजीसी एवं अन्य सांिविधक परिषदों द्वारा समय-समय पर जारी किए गए नियमों/विनियमों का अनुपालन किया जाएगा।

सं.एफ. 9-3/2000-यू.3 (खंड-2).— जबकि, के न्< सरकार को विश्वविद्यालय अनुदान आयोग (यूजीसी) अिधिनयम, 1956 की धारा 3 के तहत यूजीसी की सलाह पर किसी उ]चतर अिधगम संस्था को सम-विश्वविद्यालय के रूप में घोिषत करने की शक्ति प्राप्त है।

2. और जबकि, के न्< सरकार ने यूजीसी अिधिनयम, 1956 की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते Uए, यूजीसी की सलाह पर, अपनी दिनांक 23.06.2004 की अिधसूचना सं.9-3/2000-यू-3 के तहत करू_या प्रौद्योगिकी और विJान संस्थान, कोयम्बटूर, तिमलनाडु को तीन वर्ष की अनंितम अविध के िलए तत्काल प्रभाव से सम-विश्वविद्यालय संस्था के रूप में घोिषत किया था।

3. और इसके अतिरिक्त जबकि, यूजीसी ने अपनी विशेषJ सिमित की सहायता से सम-विश्वविद्यालय से दिनांक 09-11 नवंबर, 2017 के दौरान करू_या प्रौद्योगिकी और विJान संस्थान, कोयम्बटूर, तिमलनाडु के कार्यकरण की समीक्षा की थी। विशेषJ सिमित की रिपोर्ट को दिनांक 09.01.2018 को आयोिजत इसकी 528वX बैठक (मद संख्या 2.06) में इस आयोग के समक्ष प्रस्तुत किया गया था। आयोग ने रिपोर्ट पर िवचार किया था और निम्निलिखत संकल्प मंत्रालय को अgेषित किया गया था:

''िवचार किया गया और इसके अध्यधीन अनुमोदन किया कि विजिdटग विशेषJ सिमित द्वारा दिए गए सुझावों पर, यदि कोई हो, छह माह की समयाविध के भीतर िवचार किया जाएगा और यूजीसी को दस्तावेजी प्रमाण सिहत अनुपालन रिपोर्ट, प्रस्तुत की जाएगी।''481 Hkkx Iµ[k.M 1] Hkkjr dk jkti=] tqykbZ 21] 2018 ¼vk"kk<+ 30] 1940½ 4. और जबकि, यूजीसी विशेषJ सिमित की रिपोर्ट के साथ-साथ यूजीसी की सिफारिशों की मंत्रालय में जांच की गई थी और निम्निलिखत तथ्य प्रस्तुत किए गए:

i. समविश्वविद्यालय के नाम से कोई अलग और िवशेष सोसाइटी/ट्रस्ट/कम्पनी नहX है।

ii. समविश्वविद्यालय के नाम से कोई चल और अचल सम्पत्ति नहX है।

iii. समविश्वविद्यालय को राष्ट्रीय मूल्यांकन और प्रत्यायन परिषद (एनएएसी) द्वारा दिनांक 25.05.2016 से 24.05.2021 तक पांच वषG की अविध के िलए ख gेड (सीजीपीए 2.91) के साथ प्रत्याियत किया गया है।

iv. समविश्वविद्यालय के संगम Jापन/िनयमावली यूजीसी की विद्यमान विनियमों के अनुरूप नहX है।

v. संस्था को यूजीसी विशेषJ सिमित द्वारा दिए गए सुझावों पर अनुपालन रिपोर्ट प्रस्तुत करनी है।

5. अब, अत:, के न्< सरकार ने यूजीसी की सलाह पर यूजीसी अिधिनयम, 1956 की धारा 3 के तहत शक्तियों का प्रयोग करते Uए करू_या प्रौद्योगिकी और विJान संस्थान, कोयम्बटूर, तिमलनाडु को एतदद्वारा दिनांक 23.06.2007 से 30.06.2019 तक की अविध के िलए निम्निलिखत शतG के अधीन आगे बढ़ाती है:

i. समविश्वविद्यालय के नाम से एक अथवा और अलग और िवशेष सोसाइटी/ट्रस्ट/कम्पनी बनाई जाएगी।

ii. समविश्वविद्यालय के नाम से चल और अचल सम्पत्ति को कानूनी तौर पर पंजीकृ त किया जाएगा।

iii. समविश्वविद्यालय संस्था एनएएसी gेडिग के माध्यम अपने कार्य निष्पादन में सुधार करेगा।

iv. समविश्वविद्यालय संस्था अपने संगम Jापन/िनयमावली को यूजीसी (समविश्वविद्यालय संस्थाएं) िविनयम, 2016 और इसमें समय- समय पर Uए संशोधनों के अनुरूप बनाएगा।

v. समविश्वविद्यालय यूजीसी के मानदंडों/विनियमों के िवपरीत कोई पाjhम/िवभाग, ऑफ कै म्पस सेंटर शुरू नहX करेगा।

2. और जबकि, के न्< सरकार ने, यूजीसी अिधिनयम,1995 की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते Uए, अपनी दिनांक 21.10.2008 की अपनी अिधसूचना के जरिए, यूजीसी की सलाह पर, मानव रचना अंतर्राष्ट्रीय विश्वविद्यालय, फरीदाबाद, हरियाणा, जिसमें एक समविश्वविद्यालय संस्था के रूप में कै रियर प्रौद्योगिकी और प्रबंधन संस्थान शािमल है, को उस तारीख, जब पूवoक्त संस्थान ने अपने संबंधन विश्वविद्यालय अर्थात् मह1ष दयानंद विश्विद्यालय, रोहतक, हरियाणा से स्वयं अपना संबaन समाप्त कर िलया था, से पांच वर्ष की अनंितम अविध के िलए एक समविश्वविद्यालय संस्था घोिषत किया था। यह घोषणा इस शर्त के अध्यधीन थी कि यूजीसी, विशेषJ समीक्षा सिमित की निरीक्षण और मूल्यांकन रिपोर्ट और तत्संबंधी यूजीसी सिफारिशों के आधार पर समविश्वविद्यालय के दजV की पुष्टि की जाएगी।

3. और इसके अतिरिक्त, जबकि, भारत के माननीय उAतम न्यायालय ने ओिडशा लिnट इरिगेशन कापoरेशन िलिमटेड बनाम रिबशंकर पात्रो एवं अन्य द्वारा दायर िसिवल अपील सं. 17869-17870/2017 (एसएलपी (सी) सं. 19807-19808/2012 से उत्पन्न) और िवजय कु मार एवं अन्य बनाम करतार सिह एवं अन्य शीर्षक िसिवल अपील सं. 17902-17905/2017 (एसएलपी सी सं. 35793-96/2012 से उत्पन्न) में अपने दिनांक 03.11.2017 के आदेश में यह निर्णय दिया है कि यूजीसी, आज से एक माह के अंदर यूजीसी अिधिनयम की धारा 23 के कार्यान्वयन और समविBविद्यालयों को ''विBविद्यालय'' शब्द का उपयोग करने पर प्रतिबंध लगाने के समुिचत उपाय करेगा।

4. और इसके अतिरिक्त, जबकि कें < सरकार ने माननीय उ]]तम न्यायालय के निदVश और यूजीसी की सलाह पर यूजीसी अिधिनयम, 1956 की धारा 3 के तहत प्रदत्त शक्तियों का प्रयोग करते Uए 'मानव रचना अंतर्राष्ट्रीय विश्वविद्यालय', फरीदाबाद, हरियाणा का नाम अपनी अिधसूचना सं. 9-3/2017-यू 3(ए), दिनांक 11 जनवरी, 2018 के जरिए बदलकर, संस्थान द्वारा यथा वांिछत नाम 'मानव रचना अंतर्राष्ट्रीय अनुसंधान तथा अध्ययन संस्थान' कर दिया था जो इस शर्त के अध्यधीन था कि 'मानव रचना अंतर्राष्ट्रीय अनुसंधान और अध्ययन संस्थान' अपने नाम के बाद 'विश्वविद्यालय' शब्द का प्रयोग नहX करेगा लेकिन, प्रत्यय के रूप में 'समविश्वविद्यालय' शब्द का कोष्ठक में उल्लेख कर सकता है।

5. और जबकि, यूजीसी द्वारा विशेषJ सिमित की सहायता से 29-31 अक्टूबर, 2017 के दौरान मानव रचना अंतर्राष्ट्रीय अनुसंधान एवं अध्ययन संस्थान, फरीदाबाद, हरियाणा के कार्यकरण की समीक्षा की गई थी। विशेषJ सिमित की रिपोर्ट दिनांक 22.12.2017 को आयोिजत इसकी 527वX बैठक (मद सं. 2.14) में आयोग के समक्ष रखी गयी थी। आयोग ने रिपोर्ट पर िवचार किया था और इस मंत्रालय को निम्निलिखत संकल्प भेजा गया था:

6. अत: अब, कें < सरकार, एतदद्वारा यूजीसी अिधिनयम, 1956 की धारा 3 के तहत प्रदत्त शक्तियों का प्रयोग करते Uए, यूजीसी की सलाह पर, इस शर्त के अध्यधीन कि संस्थान निम्निलिखत के संबंध में एक माह के भीतर यूजीसी को अनुपालन रिपोर्ट प्रस्तुत करेगा; मानव रचना अंतर्राष्ट्रीय अनुसंधान तथा अध्ययन संस्थान, फरीदाबाद, हरियाणा के समविश्वविद्यालय के दजV को 21.10.2013 से आगे बढ़ाती/िविनयिमत करती है:-

i. समविश्वविद्यालय संस्था अपनी सोसायटी, भू-शीर्षक, लेखाओं, काियक िनिध आदि का नाम बदलकर नए नाम अर्थात् मानव रचना अंतर्राष्ट्रीय अनुसंधान और अध्ययन संस्थान में करेगी।

ii. समविश्वविद्यालय संस्था सभी लेटर हैvस, वेबसाइट और अपने सभी भावी पत्राचारों में नए नाम को शािमल करेगी।

iii. समविश्वविद्यालय संस्था अपने संगम Jापन/िनयमावली में नए नाम को शािमल करेगी।

iv. संस्था, यूजीसी विशेषJ सिमित द्वारा दिए गए सुझावों के संबंध में अनुपालन रिपोर्ट प्रस्तुत करेगी।

7. 'मानव रचना अंतर्राष्ट्रीय अनुसंधान और अध्ययन संस्थान, फरीदाबाद, हरियाणा द्वारा इस मंत्रालय की पूर्व अिधसूचना(ओं) में उल्लििखत सभी अन्य शतG के साथ-साथ यूजीसी एवं अन्य सांिविधक परिषदों द्वारा समय-समय पर जारी किए गए नियमों/विनियमों का अनुपालन किया जाएगा।

3. और इसके अतिरिक्त जबकि, यूजीसी द्वारा अपनी विशेषJ सिमित की मदद से 9-11 जनवरी, 2018 के दौरान 'चेKीनाड अनुसंधान और शिक्षा अकादमी (के यर), पाडुर, के लाबक्कम, कांचीपुरम िजला, तिमलनाडु की समीक्षा की गई थी। विशेषJ सिमित की रिपोर्ट दिनांक 20.03.2018 को आयोिजत इसकी 530वX बैठक (मद सं. 2.02) में आयोग के समक्ष प्रस्तुत की गई थी। आयोग ने रिपोर्ट पर िवचार किया था और इस मंत्रालय को निम्निलिखत संकल्प अgेषित किया गया था:

3. और इसके अतिरिक्त जबकि, के न्< सरकार ने, यूजीसी अिधिनयम, 1956 की धारा 3 के तहत प्रदत्त शक्तियों का प्रयोग करते Uए, अपनी दिनांक 20.02.2009 की अिधसूचना सं. 10-22/2008-यू3(ए) के तहत, यूजीसी के परामर्श पर, bी सत्य साई मेिडकल कॉलेज ए_ड रिसर्च इंस्टिQूट, कांचीपुरम, तिमलनाडु को ऑफ-कै म्पस सेंन्टर के रूप में bी बालाजी विद्यापीठ, पांिडचेरी, के अिधकार क्षेत्र में शािमल किया था।

इसके अलावा, दिनांक 20.07.2009 की अिधसूचना सं. 9-53/2005-यू3 के तहत निम्निलिखत दो संस्थाओं को घटक संस्था के रूप में bी बालाजी विद्यापीठ के अिधकार क्षेत्र में शािमल किए जाने की अनुमित प्रदान की गई थी:

(i) कस्तूरबा गांधी नSसग कॉलेज, पुदुचेरी

(ii) इंदिरा गांधी इंस्टिQूट ऑफ डेंन्टल सांइस, पुदुचेरी

4. और जबकि, यूजीसी द्वारा इसकी विशेषJ सिमित की सहायता से 14-16 दिसम्बर, 1017 के दौरान bी बालाजी विद्यापीठ, पुदुचेरी की समीक्षा की गई थी। विशेषJ सिमित की रिपोर्ट को दिनांक 08.02.2018 को आयोिजत इसकी 529 वX बैठक (मद संख्या 2.06) में आयोग के समक्ष रखा गया था। आयोग ने रिपोर्ट पर िवचार किया था और निम्निलिखत संकल्प सम्प्रेिषत किया था:

2.07) में आयोग के समक्ष रखी गई थी। आयोग ने रिपोर्ट पर िवचार किया था और इस मंत्रालय को निम्नलिखित संकल्प अgेषित किया गया था:

3. और जबकि, यूजीसी द्वारा इसकी विशेषJ सिमित की सहायता से 11-13 अगस्त, 2017 के दौरान प{bी डॉ. डी.वाई. पाटिल विद्यापीठ, नेरूल, नवी मु ंबई की समीक्षा की गई थी। विशेषJ सिमित की रिपोर्ट 04.09.2017 को आयोिजत इसकी 525वX बैठक (मद सं.2.03) में आयोग के समक्ष रखी गई थी। आयोग ने अपनी विशेषJ सिमित की रिपोर्ट पर िवचार किया और इसे अनुमोदित किया था।

4. अत: अब, के न्< सरकार एतदद्वारा यूजीसी अिधिनयम, 1956 की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते Uए, यूजीसी की सलाह पर, इस शर्त पर कि प्रायोजक सोसायटी सभी चल-अचल परिसंपत्तियों को कानूनी रूप से समविBविद्यालय के नाम में अंतरित करेगी, प{bी डॉ.

डी.वाई. पाटिल विद्यापीठ, नेरूल, नवी मु ंबई के समविBविद्यालय दजV को दिनांक 20.06.2007 से 30.06.2019 तक आगे बढ़ाती है। यह घोषणा इसके अतिरिक्त इस शर्त के अध्यधीन है कि समविश्वविद्यालय संस्था राष्ट्रीय संस्थागत रैंfकग uे मवर्क (एनआईआरएफ) में अपनी रैंfकग के माध्यम से अपने कार्य-निष्पादन में सुधार लाएगी और यह यूजीसी विशेषJ सिमित द्वारा दिये गए सुझावों के संबंध में अनुपालन रिपोर्ट प्रस्तुत करेगी।

3. और इसके अतिरिक्त जबकि, के न्< सरकार ने यूजीसी अिधिनयम, 1956 की धारा 3 द्वारा प्रदत शक्तियों का प्रयोग करते Uए, अपनी दिनांक 24 सितम्बर, 2014 की अिधसूचना सं. 10-9/2007-यू-3 (ए) के तहत एसीएस मेिडकल कॉलेज एंड हास्पिटल, चेन्नई को एक घटक संस्था के रूप में डॉ. एम.जी.आर. एज्युके शनल एंड रिसर्च इंस्टिQूट, चेन्नई में समावेिशत करने की अनुमित माननीय सवo]च न्यायालय में लम्बित 2006 की डब्ल्यू.पी (सी) सं. 142 में विप्लव शर्मा मामले के निष्कर्ष और यथालागू एमसीआई विनियमों और शतG की अनुपालना के अध्यधीन दी थी।

4. और जबकि, यूजीसी द्वारा अपनी विशेषJ सिमित की मदद से 2-4 नवम्बर, 2017 के दौरान डॉ. एम.जी.आर एजुके शनल एंड रिसर्च इंस्टिQूट, चेन्नई और इसकी सभी घटक इकाइयों/संस्थाओं के कार्यकरण की समीक्षा की गई थी। विशेषJ सिमित की रिपोर्ट को दिनांक 09.01.2018 को आयोिजत अपनी 528वX बैठक (मद सं. 2.01) मे आयोग के समक्ष प्रस्तुत की थी। आयोग ने रिपोर्ट पर िवचार किया और निम्नलिखित संकल्प पारित कियाः

''िवचार किया गया और इस शर्त के अधीन अनुमोदन किया गया कि विजिdटग विशेषJ सिमित द्वारा दिए गए सुझावों पर, यदि कोई हो, छह माह की समयाविध के भीतर कार्रवाई की जाएगी और यूजीसी को दस्तावेजी प्रमाण सिहत अनुपालन रिपोर्ट प्रस्तुत की जाएगी।''

5. और आगे जबकि, यूजीसी विशेषJ सिमित की रिपोर्ट के अवलोकन के बाद यह पाया गया कि कु छ भूिम सम-विBविद्यालय न्यास को पKे पर दी गई। कु छ भूिम की अविध यूजीसी (समवत विBविद्यालय संस्थाएं) िविनयम, 2016 के अनुसार अपेक्षित कम से कम 30 वषG की आवश्यकता के बदले के वल 25 वर्ष और 20 वर्ष थी।

6. अतः अब, के न्< सरकार यूजीसी अिधिनयम, 1956 की धारा 3 के तहत प्रदत्त शक्तियों का प्रयोग करते Uए यूजीसी की सलाह पर एतद्दवारा डॉ. एम.जी.आर. एजुके शनल एंड रिसर्च इंस्टिQूट, चेन्नई के सम-विBविद्यालय दजV को निम्नलिखित शतG के साथ 30.06.2019 तक बढ़ाती हैः-

i. सम-विBविद्यालय की संपूर्ण भूिम का विनियमों के अनुसार पKे के माध्यम से न्यूनतम 30 वषG की अविध के िलए अधिgहण किया जाएगा।

ii. संस्था यूजीसी विशेषJ सिमित द्वारा दिए गए सुझाव/बताई गई कमियों के संबंध में अनुपालन रिपोर्ट प्रस्तुत करेगी।

7. डॉ. एम.जी.आर एजुके शनल एंड रिसर्च इंस्टिQूट, चेन्नई, तिमलनाडु द्वारा इस मंत्रालय की पूर्व अिधसूचना(ओं) में उल्लिखित अन्य सभी शतG के साथ-साथ, यूजीसी एवं अन्य सांिविधक परिषदों द्वारा समय-समय पर जारी नियमों/विनियमों का अनुपालन किया जाएगा।

3. और जबकि, के न्< सरकार द्वारा यूजीसी अिधिनयम, 1956 की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते Uए अपनी दिनांक 20.02.2009 की अिधसूचना सं. 9-19/2000-यू.3 के तहत निम्नलिखित संस्थाओं को के एलई एके डमी ऑफ हायर एजुके शन एंड रिसर्च, बेलगाम के अिधकार487 Hkkx Iµ[k.M 1] Hkkjr dk jkti=] tqykbZ 21] 2018 ¼vk"kk<+ 30] 1940½ क्षेत्र में इस शर्त पर लाया गया था कि के एलई एके डमी ऑफ हायर एजुके शन एंड रिसर्च, बेलगाम को प्रदत्त सम-विBविद्यालय दर्जा प्रदान किए जाने संबंधी िनबंधन एवं शतG में कोई परिवर्तन नहX किया जाएगाः

i. के एलई इंस्टिQूट ऑफ नSसग साइंसेज, बेलगाम;

ii. के एलई इंस्टिQूट ऑफ फिजियोथेरेपी, बेलगाम;

iii. के एलई bी बी.एम.के . आयुवVद महाविद्यालय, बेलगाम;

4. और आगे जबकि, के न्< सरकार ने यूजीसी अिधिनयम 1956 की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते Uए अपनी दिनांक 17.01.2017 की अिधसूचना सं. 9-19/2000-यू.3 के तहत यूजीसी की सलाह पर के एलई एके डमी ऑफ हायर एजुके शन एंड रिसर्च, बेलगाम के सम-विBविद्यालय दजV को पूर्व अिधसूचना में उल्लिखित शतG के अध्यधीन आगे 05 वषG अर्थात् 13.04.2011 से 12.04.2016 तक की अविध के िलए बढ़ा दिया था।

5. और जबकि, यूजीसी द्वारा इसकी विशेषJ सिमित की सहायता से 14-17 फरवरी, 2017 के दौरान के एलई एके डमी ऑफ हायर एजुके शन एंड रिसर्च, बेलगाम और इसकी घटक संस्थाओं के कार्यकरण की समीक्षा की गई थी। विशेषJ सिमित की रिपोर्ट को 28.03.2017 को आयोिजत इसकी 522वX बैठक (मद संख्या 2.08) में आयोग के समक्ष प्रस्तुत किया गया था। आयोग ने रिपोर्ट पर िवचार किया और निम्नलिखित संकल्प पारित कियाः

''िवचार किया गया और इस शर्त के अधीन अनुमोदन किया कि विजिdटग विशेषJ सिमित द्वारा दिए गए सुझावों पर, यदि कोई हो, छह माह की समयाविध के भीतर कार्रवाई की जाएगी और यूजीसी को दस्तावेजी प्रमाण सिहत अनुपालन रिपोर्ट प्रस्तुत की जाएगी।''

6. और इसके अतिरिक्त जबकि, यूजीसी विशेषJ सिमित की रिपोर्ट और यूजीसी द्वारा रिपोर्ट के संबंध में उपलब्ध करवाए गए कितपय स्पष्टीकरणों के अवलोकन के बाद यह पाया गया कि यूजीसी के मौजूदा विनियमों के अलावा सम-विBविद्यालय प्रबंधन के िलए कोई अलग एवं िवशेष सोसायटी/न्यास/कं पनी नहX है।

7. अतः अब, के न्< सरकार यूजीसी अिधिनयम, 1956 की धारा 3 के तहत प्रदत्त शक्तियों का प्रयोग करते Uए यूजीसी की सलाह पर एतद्दवारा के एलई एके डमी ऑफ हायर एजुके शन एंड रिसर्च, बेलगाम के सम-विBविद्यालय दजV का 13.04.2016 से 12.04.2019 तक की अविध के िलए निम्नलिखित शतG के अध्यधीन विस्तार करती हैः

i. संस्था समविश्वविद्यालय के प्रबंधन के िलए एक अलग एवं िवशेष अलाभ अर्जक सोसायटी/न्यास/कं पनी का गठन करेगी।

ii. संस्था यूजीसी विशेषJ सिमित द्वारा दिए गए सुझावों/बताई गई कमियों के संबंध में अनुपालना रिपोर्ट प्रस्तुत करेगी।

8. यह स्पष्ट किया जाता है कि सम-विBविद्यालय को आगे विस्तार उपयु र्क्त शतG की अनुपालना के बाद ही दिया जाएगा। के एलई एके डमी ऑफ हायर एजुके शन एंड रिसर्च, बेलगाम, कर्नाटक द्वारा इस मंत्रालय की पूर्व अिधसूचना(ओं) में उल्लिखित सभी अन्य शतG के साथ-साथ यूजीसी एवं अन्य सांिविधक परिषदों द्वारा समय-समय पर जारी नियमों/विनियमों का अनुपालन किया जाएगा।

No. F.9-25/2000-U3(A)Pt.3.—Whereas, 'Amrita Vishwa Vidyapeetham' Coimbatore, Tamil Nadu consisting of following five Institutions was declared as deemed to be university under Section 3 of the University Grants Commission (UGC) Act, 1956 vide this Ministry's Notification No. F.9-25/2000-U.3 dated the 13th January, 2003 subject to a review after five years:

i. Amrita Institute of Technology and Science, Ettimadai Campus, Coimbatore;

ii. Amrita Institute of Management, Ettimadai Campus, Coimbatore;

iii. Amrita Institute of Medical Sciences and Research Centre, Kochi;

iv. Amrita Institute of Pharmaceutical Sciences, Kochi; and

v. Amrita Institute of Nursing Sciences, Kochi.

2. And whereas, as per the provisions of the Ministry's Notification dated 13.01.2003, an Expert Committee was constituted by the UGC to review the functioning of the Amrita Vishwa Vidyapeetham, Coimbatore.

3. And whereas, the Central Government vide its Notification No.9-25/2000-U.3A dated 30th September, 2016, in exercise of the powers conferred by Section 3 and on the advice of the UGC, extended the status of Deemed to be University of 'Amrita Vishwa Vidyapeetham' Coimbatore, Tamil Nadu for another period of five years i.e. from 13.01.2008 to 12.01.2013.

4. And further whereas, 'Amrita Vishwa Vidyapeetham' Coimbatore, Tamil Nadu and its Constituent Units have been reviewed by UGC through an Expert Committee. Further, in exercise of the powers conferred by Section 3, the Central Government vide its Notification No.9-25/2000-U3(A)Pt.3 dated 27th March, 2017, on the advice of the UGC, further extended the status of Deemed to be University of 'Amrita Vishwa Vidyapeetham' Coimbatore, Tamil Nadu for another period of five years i.e. from 13.01.2013 to 12.01.2018 subject to condition that further extension shall only be given if a separate Society in the name of Deemed to be University is created and all the moveable and immovable assets are legally transferred in the newly created Society. Till the deficiencies are rectified, no further expansion shall be permitted to Amrita Vishwa Vidyapeetham, Coimbatore, Tamil Nadu.

5. And whereas, as per the request of Amrita Vishwa Vidyapeetham, Coimbatore, Tamil Nadu and also as per the advice of UGC, the Ministry, in exercise of the powers conferred by Section 3 of the UGC Act, 1956, extended / regularized the Deemed to be University status to Amrita Vishwa Vidyapeetham, Coimbatore, Tamil Nadu for a period of six months w.e.f. 13.01.2018 to 12.07.2018.

6. And whereas, the Amrita Vishwa Vidyapeetham, Coimbatore, Tamil Nadu once again requested the UGC to extend the Deemed to be University status by one academic year so that its academic activities are not affected. The request of the Institution has been considered by the Commission in its 530th meeting (Item No.2.19) held on 20.03.2018 and recommended for the extension of Deemed to be University status to Amrita Vishwa Vidyapeetham, Coimbatore, Tamil Nadu for another period of one year w.e.f. 13.07.2018 to 12.07.2019.

7. Now, therefore, in exercise of the powers conferred by Section 3 of the UGC Act, 1956, the Central Government, on the advice of UGC, hereby extend / regularize the Deemed to be University status to Amrita Vishwa Vidyapeetham, Coimbatore, Tamil Nadu for another period of one year w.e.f. 13.07.2018 to 12.07.2019 within which the Institute will comply with the conditions of this Ministry's order dated 27th March, 2017 otherwise no further extension shall be given for this reason.

8. The other conditions mentioned in the earlier Notifications of this Ministry shall continue to be adhered by Amrita Vishwa Vidyapeetham, Coimbatore, Tamil Nadu.

And whereas, in exercise of the powers conferred by Section 3 of the UGC Act, 1956, the Central Government vide its Notification No.9-19/2005-U.3 dated 21.08.2007, on the advice of UGC, had declared Academy of Maritime Education & Training, Kanathur, Tamil Nadu as an Institution deemed to be University under de-novo category, for the provisional period of five years, with effect from the date of disaffiliation of the Institute from its affiliating University.

And further whereas, the functioning of Academy of Maritime Education & Training, Kanathur, Tamil Nadu was reviewed by the UGC with the help of its Expert Committee during 31st January to 2nd February, 2018. The report of the Expert Committee was placed before the Commission in its 530th meeting (Item No.2.06) held on 20.03.2018. The Commission considered the report and the following resolution was forwarded to this Ministry:

Now, therefore, in exercise of the powers conferred under Section 3 of the UGC Act, 1956, the Central Government, on the advice of the UGC, do hereby extend the deemed to be University status to Academy of Maritime Education & Training, Kanathur, Tamil Nadu from 21.08.2012 to 30.06.2019 with the condition that the Institution shall submit compliance report w.r.t. suggestions / deficiencies pointed out by the UGC Expert Committee. This is further subject to condition that the Institution deemed to be University shall improve its performance through its ranking / grading in NIRF / NAAC.

5. The all other conditions mentioned in the earlier Notification(s) of this Ministry as well as the Rules / Regulations of UGC and other Statutory Councils, issued from time to time, shall continue to be adhered by Academy of Maritime Education & Training, Kanathur, Tamil Nadu.

And whereas, in exercise of the powers conferred by Section 3 of the UGC Act, 1956, the Central Government vide its Notification No.9-38/2006-U3(A) dated 16.12.2008, on the advice of UGC, had declared B.S. Abdur Rahman Crescent Engineering College, Vandalur, Chennai, Tamil Nadu, as an Institution deemed to be University in the name of B.S. Abdur Rahman Institute of Science & Technology, for a provisional period of five years, with effect from the date of disaffiliation of the College from its affiliating University.

3. And further whereas, the functioning of Academy of Maritime Education & Training, Kanathur, Tamil Nadu was reviewed by the UGC with the help of its Expert Committee during 29-31st January, 2018. The report of the Expert Committee was placed before the Commission in its 530th meeting (Item No.2.13) held on 20.03.2018. The Commission considered the report and the following resolution was forwarded to this Ministry:

"Considered and approved with the condition that the suggestions by the visiting Expert Committee, if any, will be addressed within a period of six months and the compliance report would be submitted alongwith documentary proof to UGC."PART I—SEC. 1] THE GAZETTE OF INDIA, JUNE 23, 2018 (ASHADHA 30, 1940) 491 4. i. The deemed to be University shall revise its MoA / Rules and align its composition of various bodies as per the UGC (Institutions Deemed to be Universities) Regulations, 2016, as amended from time to time.

ii. The deemed to be University shall start new Courses / Departments / Centres in accordance with the provisions of the UGC (Institutions Deemed to be Universities) Regulations, 2016, as amended from time to time.

iii. The deemed to be University shall always use the approved nomenclature of its name.

iv. The deemed to be University shall submit compliance report w.r.t. suggestions / deficiencies pointed out by the UGC Expert Committee.

The all other conditions mentioned in the earlier Notification(s) of this Ministry as well as the Rules / Regulations of UGC and other Statutory Councils, issued from time to time, shall continue to be adhered by B.S. No. F.9-37/2007-U3(A)Vol.2.—Whereas, the Central Government is empowered under Section 3 of the University Grants Commission (UGC) Act, 1956 to declare, on the advice of the UGC, an Institution of higher learning as deemed to be University.

2. And whereas, in exercise of the powers conferred by Section 3 of the UGC Act, 1956, the Central Government vide its Notification No.9-37/2007-U3(A) dated 29.02.2008, on the advice of UGC, had declared Shri B. M. Patil Medical College, Hospital & Research Centre, Bijapur, Karnataka as an Institution deemed to be University in the name & style of 'BLDE University' for the provisional period of five years, with effect from the date on which the aforesaid Medical College disaffiliates itself from its affiliating University viz. Rajiv Gandhi University of Health Sciences, Karnataka, Bangalore. This declaration was subject to condition that the status of deemed to be University shall be confirmed after the period of 5 years based on the inspection and assessment report of UGC's Expert Review Committee and the recommendations of the UGC thereon.

3. And further whereas, the Hon'ble Supreme Court of India vide its judgment Order dated 03.11.2017 in Civil Appeal Nos. 17869-17870/2017 (arising out of SLP(C) Nos.19807-19808/2012) filed by Orissa Lift Irrigation Corp. Ltd Versus Rabi Sankar Patro & Ors. and Civil Appeal Nos.17902-17905/2017 (arising out of SLP C Nos.35793-96/2012) titled as Vijay Kumar & Ors Vs. Kartar Singh & Ors held that UGC shall take appropriate steps for implementing Section 23 of the UGC Act and restraining Deemed to be Universities from using the word 'University' within one month from today.

4. And whereas, as per direction of Hon'ble Supreme Court and on the advice of the UGC, the Central Government, in exercise of the powers conferred under Section 3 of the UGC Act, 1956, change the name of "BLDE University" to "BLDE" by deleting the word 'University' from its name vide its Notification No.9-37/2007-U3(A) dated 11.01.2018 with the condition that BLDE shall not use the word 'University' suffixed to its name but may mention the word "deemed to be university" within parenthesis suffixed thereto.

5. And whereas, the functioning of BLDE, Bijapur, Karnataka was reviewed by the UGC with the help of its Expert Committee during 22-24th September, 2017. The report of the Expert Committee was placed before the Commission in its 527th meeting (Item No.2.01) held on 22.12.2017. The Commission considered the report and the following resolution was forwarded to this Ministry:

6. And further whereas, the report of the UGC Expert Committee as well as recommendations of UGC was examined in the Ministry and observed the following:

i. The Institution deemed to be University has to change the name of its Society, Land title, Accounts, Corpus Fund, etc. in the new name i.e. BLDE.

ii. The Institution deemed to be University has to incorporate the new name in all Letter Heads, website and all its further correspondences.

iii. The Institution deemed to be University has to incorporate new name in its MoA / Rules.

iv. The Institution has to submit compliance report in respect of the suggestions given by the UGC Expert Committee.

v. The Institution deemed to be University failed to find place in top 200 of the latest Indian Rankings i.e. NIRF Rankings.

vi. The Institution deemed to be University has been accredited by National Assessment and Accreditation Council (NAAC) with 'B' Grade (CGPA-2.90) for the period from 16.11.2015 to 15.11.2020

7. Now, therefore, in exercise of the powers conferred under Section 3 of the UGC Act, 1956, the Central Government, on the advice of the UGC, do hereby extend the deemed to be University status to 'BLDE', Bijapur, Karnataka from 29.02.2013 to 30.06.2019 with the following condition:

i. The Institution deemed to be University shall change the name of its Society, Land title, Accounts, Corpus Fund, etc. in the new name i.e. BLDE.

ii. The Institution deemed to be University shall incorporate the new name in all Letter Heads, website and all its further correspondences.

iii. The Institution deemed to be University shall incorporate new name in its MoA / Rules.

Bangalore University. This declaration was subject to condition that the status of deemed to be University shall be confirmed after the period of 5 years based on the inspection and assessment report of UGC's Expert Review Committee and the recommendations of the UGC thereon.

i. The Institution deemed to be University has to change the name of its Society, Land title, Accounts, Corpus Fund, etc. in the new name i.e. Christ.

ii. The Institution deemed to be University has to incorporate new name in its MoA / Rules. iii. The Institution has to submit compliance report in respect of the suggestions given by the UGC Expert Committee.

iv. The Institution deemed to be University failed to find place in top 200 of the latest Indian Rankings i.e. NIRF Rankings.

7. Now, therefore, in exercise of the powers conferred under Section 3 of the UGC Act, 1956, the Central Government, on the advice of the UGC, do hereby extend / regularize the deemed to be University status to 'Christ', Bangalore, Karnataka from 22.07.2013 to 30.06.2019 with the following condition:

The report of the Expert Committee was placed before the Commission in its 527th meeting (Item No.2.13) held on 22.12.2017. The Commission considered the report and the following resolution was forwarded to this Ministry:

This declaration was subject to the condition that the status conferred upon the IISST will be confirmed after five years on the basis of performance reports of the Expert Review Committee of the UGC and the recommendation of the Commission thereon and the Department of Space shall finalize the Memorandum of Association (MoA) and Rules of the IISST in accordance with the model MoA/Rules prescribed by the UGC and in concurrence with the Commission.

And whereas, the functioning of Indian Institute of Space Science and Technology (IISST), Thiruvananthapuram, Kerala was reviewed by the UGC with the help of its Expert Committee during 29-31st January, 2018. The report of the Expert Committee was placed before the Commission in its 530th meeting (Item No.2.12) held on 20.03.2018. And whereas, in exercise of the powers conferred by Section 3 of the UGC Act, 1956, the Central Government vide its Notification No.9-57/2007-U3(A) dated 19.12.2008, on the advice of UGC, had declared Sri Bhagawan Mahaveer Jain College, Bangalore, Karnataka as an Institution deemed to be University in the name & style of 'Jain University' for the provisional period of five years, with effect from the date on which the aforesaid College disaffiliates itself from its affiliating University viz. Bangalore University, Bangalore. This declaration was subject to condition that the status of deemed to be University shall be confirmed after the period of 5 years based on the inspection and assessment report of UGC's Expert Review Committee and the recommendations of the UGC thereon.

3. And further whereas, the following Institutions were brought under the ambit of Jain (formerly known as Jain University), Karnataka vide this Ministry's Notification No. 9-57/2007-U3(A) dated 24.07.2009:

a. Sri Bhagwan Mahavir Jain College (School of Graduate Studies), 34 First Cross KC Road, Bangalore

b. Sri Bhagwan Mahavir Jain College (Centre for Management Studies), 1/1 Atria Tower, Palace Road, Bangalore

c. Sri Bhagwan Mahavir Jain College (Centre for PG Studies), 18/3, 9th Main, 3 rd Block, Jayanagar, Bangalore

d. Sri Bhagwan Mahavir Jain College of Engineering, Jakkasandra Post, Kanakpura Talur, Bangalore Rural

4. And further whereas, the Hon'ble Supreme Court of India vide its judgment Order dated 03.11.2017 in Civil Appeal Nos. 17869-17870/2017 (arising out of SLP(C) Nos.19807-19808/2012) filed by Orissa Lift Irrigation Corp. Ltd Versus Rabi Sankar Patro & Ors. and Civil Appeal Nos.17902-17905/2017 (arising out of SLP C Nos.35793-96/2012) titled as Vijay Kumar & Ors Vs. Kartar Singh & Ors held that UGC shall take appropriate steps for implementing Section 23 of the UGC Act and restraining deemed to be Universities from using the word 'University' within one month from today.

5. And whereas, as per direction of Hon'ble Supreme Court and on the advice of the UGC, the Central Government, in exercise of the powers conferred under Section 3 of the UGC Act, 1956, changed the name of "Jain University" to "Jain" by deleting the word 'University' from its name vide Notification No.9-57/2007-U3(A) dated 11.01.2018 with the condition that the Institution shall not use the word 'University' suffixed to its name but may mention the words "deemed to be university" within parenthesis suffixed thereto.

6. And further whereas, the functioning of Jain, Bangalore, Karnataka was reviewed by the UGC with the help of its Expert Committee during 21-23rd December, 2017. The report of the Expert Committee was placed before the Commission in its 530th meeting (Item No.2.09) held on 20.03.2018. The Commission considered the report and sent the following resolution to this Ministry:

7. And whereas, the report of the UGC Expert Committee as well as recommendations of UGC was examined in the Ministry and observed the following:

The deemed to be University is still using the word 'University' with its name despite the Order dated 03.11.2017 of Hon'ble Supreme Court prohibiting deemed to be Universities from using the word 'University' with their name.

iii. The Institution deemed to be University has to change the name of its Society, Land title, Accounts, Corpus Fund, etc. in the new name i.e. Jain.

iv. The deemed to be University has not participated in the latest National Institutional Ranking Framework (NIRF).

v. The Institution has to submit compliance report in respect of the suggestions given by the UGC Expert Committee.

8. Now, therefore, in exercise of the powers conferred under Section 3 of the UGC Act, 1956, the Central Government, on the advice of the UGC, do hereby extend / regularize the deemed to be University status to 'Jain', Bangalore, Karnataka from 19.12.2013 to 30.06.2019 with the following condition:

i. The deemed to be University shall amend its MoA/Rules as per the UGC (Institutions Deemed to be Universities) Regulations, 2016, as amended from time to time.

ii. The deemed to be University shall not use the word 'University' with its name but it may mention the words "deemed to be university" within parenthesis suffixed thereto.

iii. The deemed to be University will change the name of its Society, Land title, Accounts, Corpus Fund, etc. in the new name i.e. Jain.

iv. The deemed to be University shall participate in the National Institutional Ranking Framework (NIRF) and shall display its rankings on its website.

The Commission considered the report and the following resolution was forwarded to this Ministry:

i. There is no separate & exclusive Society / Trust / Company in the name of the deemed to be University.

ii. The moveable & immoveable assets are not in the name of the deemed to be University.

iii. The deemed to be University has been accredited by National Assessment and Accreditation Council (NAAC) with B Grade (CGPA- 2.91) for a period of five years from 25.05.2016 to 24.05.2021.

iv. The deemed to be University has not aligned its MoA / Rules as per the prevailing Regulations of UGC.

v. The Institution has to submit compliance report in respect of the suggestions given by the UGC Expert Committee.

Now, therefore, in exercise of the powers conferred under Section 3 of the UGC Act, 1956, the Central Government, on the advice of the UGC, do hereby extend the deemed to be University status to Karunya Institute of Technology & Sciences, Coimbatore, Tamil Nadu from 23.06.2007 to 30.06.2019 with the following conditions:

i. A separate & exclusive Society / Trust / Company in the name of the deemed to be University will be formed.

iii. The Institution deemed to be University shall incorporate new name in its MoA / Rules.

iv. The Institution shall submit compliance report in respect of the suggestions given by the UGC Expert Committee.

No. F.9-48/2006-U3(A)Pt.1.—Whereas, the Central Government is empowered under Section 3 of the University Grants Commission (UGC) Act, 1956 to declare, on the advice of the UGC, an Institution of higher learning as deemed to be University.

2. And whereas, in exercise of the powers conferred by Section 3 of the UGC Act, 1956, the Central Government vide its Notification No.9-48/2006-U3(A) dated 04.08.2008, on the advice of UGC, had declared Chettinad Academy of Research and Education (CARE), Padur, Kelambakkam, Kancheepuram District, Tamil Nadu, comprising (i) Chettinad Hospital and Research lnstitute, Padur, Kelambakkam and (ii) Chettinad College of Nursing, Padur, Kelambakkam, as an Institution deemed to be University under de-novo category, for the provisional period of five years, with effect from the date of disaffiliation of the Institute from its affiliating University, with certain conditions.

3. And further whereas, the functioning of Chettinad Academy of Research and Education (CARE), Padur, Kancheepuram District, Tamil Nadu was reviewed by the UGC with the help of its Expert Committee during 9-11th January, 2018. The report of the Expert Committee was placed before the Commission in its 530th meeting (Item No.2.02) held on 20.03.2018. The Commission considered the report and the following resolution was forwarded to this Ministry:

Now, therefore, in exercise of the powers conferred under Section 3 of the UGC Act, 1956, the Central Government, on the advice of the UGC, do hereby extend the deemed to be University status to Chettinad Academy of Research and Education (CARE), Padur, Kancheepuram District, Tamil Nadu from 04.08.2013 to 30.06.2019 with the condition that the Institution shall submit compliance report w.r.t. suggestions / deficiencies pointed out by the UGC Expert Committee as well as MHRD Review Committee.

5. The all other conditions mentioned in the earlier Notification(s) of this Ministry as well as the Rules / Regulations of UGC and other Statutory Councils, issued from time to time, shall continue to be adhered by Chettinad Academy of Research and Education (CARE), Padur, Kancheepuram District, Tamil Nadu.

And whereas, in exercise of the powers conferred by Section 3 of the UGC Act, 1956, the Central Government vide its Notification No.9-53/2005-U.3 dated 04.08.2008, on the advice of UGC, had declared Sri Balaji Vidyapeeth, Pondicherry consisting of Mahatma Gandhi Medical College & Research Institute, Pondicherry as an Institution deemed to be University under de-novo category, for a provisional period of five years.

3. And further whereas, in exercise of the powers conferred under Section 3 of the UGC Act, 1956 and also on the advice of UGC, the Central Government vide its Notification No.10-22/2008-U3(A) dated 20.02.2009 included Sri Sathya Sai Medical College & Research Institute, Kancheepuram, Tamil Nadu under the ambit of Sri Balaji Vidyapeeth, Pondicherry as an Off-Campus Centre. In addition, the following two Institutions were permitted to include under the ambit of Sri Balaji Vidyapeeth, Pondicherry as constituent Institutions vide Notification No.9-53/2005-U.3 dated 20.07.2009:

i. Kasturba Gandhi Nursing College, Puducherry

ii. Indira Gandhi Institute of Dental Sciences, Puducherry

4. And whereas, the functioning of Sri Balaji Vidyapeeth, Puducherry was reviewed by the UGC with the help of its Expert Committee during 14-16th December, 2017. The report of the Expert Committee was placed before the Commission in its 529th meeting (Item No.2.06) held on 08.02.2018. The Commission considered and send the following resolutions:

Now, therefore, in exercise of the powers conferred under Section 3 of the UGC Act, 1956, the Central Government, on the advice of the UGC, do hereby extend the deemed to be University status to Sri Balaji Vidyapeeth, Puducherry from 04.08.2013 onwards subject to condition that the Institution shall submit the compliance report w.r.t. the suggestions / deficiencies pointed out by the UGC Expert Committee.

No. F.9-52/2001-U.3Pt.1.—Whereas, the Central Government is empowered under Section 3 of the University Grants Commission (UGC) Act, 1956 to declare, on the advice of the UGC, an Institution of higher learning as deemed to be University.

2. And whereas, in exercise of the powers conferred by Section 3 of the UGC Act, 1956, the Central Government vide its Notification No.9-52/2001-U.3 dated 20.05.2002, on the advice of UGC, had declared National Brain Research Centre, Gurgaon, Haryana as an Institution deemed to be University for the purpose of the aforesaid act, with immediate effect subject to review after five years.

3. And whereas, the functioning of National Brain Research Centre, Gurgaon, Haryana was reviewed by the UGC with the help of its Expert Committee during 27-28th November, 2017. The report of the Expert Committee was placed before the Commission in its 528th meeting (Item No.2.07) held on 09.01.2018. The Commission considered the report and the following resolution was forwarded to this Ministry:

No. F.9-21/2000-U.3(Pt.1).—Whereas, the Central Government is empowered under Section 3 of the University Grants Commission (UGC) Act, 1956 to declare, on the advice of the UGC, an Institution of higher learning as deemed to be University.

2. And whereas, in exercise of the powers conferred by Section 3 of the UGC Act, 1956, the Central Government vide its Notification No.9-21/2000-U.3 dated 20.06.2002, on the advice of UGC, had declared Padmashree Dr. D. Y. Patil Vidyapeeth, Nerul, Navi Mumbai consisting of (a) Padmashree Dr. D. Y. Patil Medical College; and (b) Padmashree Dr. D. Y. Patil Dental College & Hospital as an Institution deemed to be University subject to review after five years.

3. And whereas, the functioning of Padmashree Dr. D. Y. Patil Vidyapeeth, Nerul, Navi Mumbai was reviewed by the UGC with the help of its Expert Committee during 11-13th August, 2017. The report of the Expert Committee was placed before the Commission in its 525th meeting (Item No.2.03) held on 04.09.2017. The Commission considered and approved the report of its Expert Committee.

4. Now, therefore, in exercise of the powers conferred under Section 3 of the UGC Act, 1956, the Central Government, on the advice of the UGC, do hereby extend the deemed to be University status to Padmashree Dr. D. Y. Patil Vidyapeeth, Nerul, Navi Mumbai from 20.06.2007 to 30.06.2019 subject to the condition that the Sponsoring Society shall legally transfer the entire moveable and immoveable assets in the name of the deemed to be University. This declaration is further subject to the condition that the Institution deemed to be University shall improve its performance through its ranking in National Institutional Ranking Framework (NIRF) and it will submit compliance report in respect of the suggestions given by the UGC Expert Committee.

5. The all other conditions mentioned in the earlier Notification(s) of this Ministry as well as the Rules / Regulations of UGC and other Statutory Councils, issued from time to time, shall continue to be adhered by Padmashree Dr. D. Y. Patil Vidyapeeth, Nerul, Navi Mumbai.

No. F.9-1/2002-U.3(Pt.1).—Whereas, the Central Government is empowered under Section 3 of the University Grants Commission (UGC) Act, 1956 to declare, on the advice of the UGC, an Institution of higher learning as deemed to be University.

2. And whereas, in exercise of the powers conferred by Section 3 of the UGC Act, 1956, the Central Government vide its Notification No.9-1/2002-U.3 dated 21.01.2003, on the advice of UGC, had declared Dr. M.G.R. Educational & Research Institute, Chennai, comprising (i) Thai Moogambigai Dental College and Hospital, Chennai and (ii) Dr. M.G.R. Engineering College, Maduravoyal, Chennai, as an Institution deemed to be University, subject to review of three years, and also with the condition that it will adhere to the guidelines / instructions issued by UGC & AICTE, from time to time as applicable to the deemed to be university.

3. And further whereas, in exercise of the powers conferred by Section 3 of the UGC Act, 1956, the Central Government vide its Notification No.10-9/2007-U3(A) dated 25th September, 2014 permitted inclusion of ACS Medical College & Hospital, Chennai under ambit of Dr. M.G.R. Educational & Research Institute, Chennai as a Constituent Institution subject to the outcome of the Viplav Sharma's case in W.P. (C) No. 142 of 2006 pending in the Supreme Court and compliance of MCI Regulations and conditions as applicable.

4. And whereas, the functioning of Dr. M.G.R. Educational & Research Institute, Chennai and all its Constituent Unit/Institutions was reviewed by the UGC with the help of Expert Committee during 2-4th November, 2017. The report of the Expert Committee was placed before the Commission in its 528th meeting (Item No.2.01) held on 09.01.2018. The Commission considered the report and passed the following resolutions:

And further whereas, after perusal of the report of UGC Expert Committee, it was observed that some of the land is leased to the deemed to be university Trust is only for a period of 25 years and 20 years against the requirement of at least 30 years as per the UGC (Institutions Deemed to be Universities) Regulations, 2016.

6. Now, therefore, in exercise of the powers conferred under Section 3 of the UGC Act, 1956, the Central Government, on the advice of the UGC, do hereby extend the deemed to be University status to Dr. M.G.R. Educational & Research Institute, Chennai upto 30.06.2019 with the following conditions:

i. The entire land of the deemed to be university shall be acquired through leasehold up to the minimum period of 30 years as per the Regulations.

ii. The Institution shall submit compliance report w.r.t. suggestions / deficiencies pointed out by the UGC Expert Committee.

And whereas, in exercise of the powers conferred by Section 3 of the UGC Act, 1956, the Central Government vide its Notification No.9-19/2000-U.3 dated 13.04.2006, on the advice of UGC, had declared KLE Academy of Higher Education &PART I—SEC. 1] THE GAZETTE OF INDIA, JUNE 23, 2018 (ASHADHA 30, 1940) 505 Research, Belgaum, Karnataka, comprising (i) Jawaharlal Nehru Medical College, Belgaum and (ii) KLE BK Institute of Dental Sciences, Belgaum, as an institution deemed to be University, for a period of five years.

And whereas, in exercise of the powers conferred by Section 3 of the UGC Act, 1956, following institutions were brought under ambit of KLE Academy of Higher Education and Research, Belgaum, by the Central Government vide Notification No.9-19/2000-U.3 dated 20.02.2009 subject to the conditions that all the terms & conditions of conferment of deemed to be university status to KLE Academy of Higher Education & Research, Belgaum shall remain unchanged:

i. KLE Institute of Nursing Sciences, Belgaum;

ii. KLE Institute of Physiotherapy, Belgaum;

iii. KLE Shri B.M.K. Ayurveda Mahavidyalaya, Belgaum;

iv. KLE College of Pharmacy, Belgaum;

v. KLE College of Pharmacy, Hubli;

vi. KLE College of Pharmacy, Bangalore.

4. And further whereas, , in exercise of the powers conferred by Section 3 of the UGC Act, 1956, the Central Government vide its Notification No.9-19/2000-U.3 dated 17.01.2017, on the advice of UGC, extended the status of deemed to be university to KLE Academy of Higher Education & Research, Belgaum for another period of five years i.e. from 13.04.2011 to 12.04.2016 subject to terms & conditions mentioned in earlier Notifications.

5. And whereas, the functioning of KLE Academy of Higher Education & Research, Belgaum and all its Constituent Institutions was reviewed by the UGC with the help of Expert Committee during 14-17th February, 2017. The report of the Expert Committee was placed before the Commission in its 522nd meeting (Item No.2.08) held on 28.03.2017. The Commission considered the report and passed the following resolutions:

And further whereas, after perusal of the report of UGC Expert Committee and certain clarifications provided by the UGC on the report, it was observed that there is no separate & exclusive Society / Trust / Company for managing the deemed to be university contrary to the prevailing Regulations of UGC.

7. Now, therefore, in exercise of the powers conferred under Section 3 of the UGC Act, 1956, the Central Government, on the advice of the UGC, do hereby extend the deemed to be University status to KLE Academy of Higher Education & Research, Belgaum from 13.04.2016 to 12.04.2019 with the following conditions:

i. The Institution shall create a separate & exclusive not-for-profit Society / Trust / Company for managing the deemed to be university.

ii. The Institution shall submit compliance report w.r.t. suggestions / deficiencies pointed out by the UGC Expert Committee.

8. It is clarified that the further extension of deemed to be university shall be given only after compliance of the above conditions. The all other conditions mentioned in the earlier Notification(s) of this Ministry as well as the Rules / Regulations of UGC and other Statutory Councils, issued from time to time, shall continue to be adhered by KLE Academy of Higher Education & Research, Belgaum, Karnataka.
