सं.एफ.9/1/2018-यू.3 (ए).— जबकि, के न्1 सरकार को वि?विद्यालय अनुदान आयोग यूजीसी अिधिनयम,1956 की धारा 3 के तहत यूजीसी की सलाह पर किसी उ9तर शिक्षा संस्था को समवत वि?विद्यालय घोिषत करने की शक्ति प्राप्त है।

2. और जबकि, यूजीसी अिधिनयम, 1956 की धारा 3 के तहत, राष्ट्रीय रेल और परिवहन संस्थान (एनआरटीआई), एनएआईआर कै म्पस, लालबाग, वड़ोदरा, गुजरात को समवत् विश्वविद्यालय (डी-नोवो -ेणी के तहत स्थािपत किया जाना) का दर्जा प्रदान करने के िलए दिनांक 17.01.2018 को आवेदन प्राप्त Fआ था।

3. और जबकि, आवेदन यूजीसी (समविश्वविद्यालय संस्थाएं), िविनयम, 2016 के अनुसार परामर्श के िलए यूजीसी को अHेषित किया गया था।

4. और जबकि, यूजीसी ने यह सिफारिश करने के िलए विशेषJ सिमित गठित की थी कि क्या राष्ट्रीय रेल और परिवहन संस्थान (एनआरटीआई), वड़ोदरा, गुजरात के आवेदन पर डी-नोवो -ेणी के तहत िवचार किया जा सकता है। सिमित की, संस्थान के प्रतिनिधि के साथ विस्तृत बातचीत और िवचार विमर्श के बाद यह राय थी कि प्रारंभ किए जाने के िलए प्रस्तािवत पाO)म डी-नोवो की परिभाषा के तहत कवर होते हैं जैसाकि यूजीसी (समविश्वविद्यालय संस्थाएं), िविनयम, 2016 में परिकल्पना की गई है और यह सही मायने में Jान के उभरते Fए क्षेत्रों में है। सिमित ने निम्निलिखत सिफारिशें की हैं :

''मानव संसाधन िवकास मंत्रालय द्वारा सम-विश्वविद्यालय संस्था के रूप में राष्ट्रीय रेल और परिवहन संस्थान की स्थापना के िलए निम्निलिखत शतS के साथ डी नोवो -ेणी के तहत संस्थान को आशय पत्र जारी किया जाए:

i प्रस्तािवत समवत विश्वविद्यालय के नाम पर अलग और िवशेष सिमित/ट्रस्ट/कं पनी स्थािपत की जाएगी।

ii सभी परिसंपत्तियां कानूनी रूप से प्रस्तािवत समवत विश्वविद्यालय के नाम होंगी।

iii यूजीसी िविनयम, 2016 के अनुसरण में एमओए/िनयम तैयार किए जाएं।

iv यूजीसी िविनयम, 2016 के अनुसरण में भूिम, भवन, पुस्तकालय, प्रयोगशालाएं, छात्रावास, आवास और अन्य अवसंरचना बनाई जाएं।

v Jान के उभरते Fए क्षेत्रों में आयोिजत किए जाने वाले पाO)मों और अनुसंधान कार्य)मों की विस्तृत पाOचर्या सिहत उभरते Fए क्षेत्र में प्रस्तािवत अवरस्नातक और न्यूनतम पांच वर्षीय स्नात्कोत्तर पाO)म।

vi यूजीसी द्वारा निर्धारित अर्हताओं सिहत प्रस्तािवत पाO)मों के िलए संकाय भर्ती की जाएं।

vii अन्य प्राधिकारी जैसे कु लसिचव, रजिस्ट्रार, आदि नियुक्त किए जाएं।

इसके अतिरिक्त सिमित ने सिफारिश की है कि यूजीसी की विशेषJ सिमित भारतीय राष्ट्रीय रेल अकादमी (एनएआईआर),वड़ोदरा, (गुजरात) संस्थान में उपलब्ध अवसंरचना और अन्य सुविधाओं का स्थल दौरा करे और यह सिफारिश करे कि क्या प्रारंभ किए जाने वाले प्रस्तािवत पाO)म के िलए यूजीसी (सम विश्वविद्यालय) िविनयम, 2016 के अनुरूप सुिवधाएं उपलब्ध हैं, यह सिमित, वतर्मान सिमित से एक सदस्य को शािमल कर सकती है।''

5. और जबकि, यूजीसी (सम विश्वविद्यालय) िविनयम, 2016 के तहत यथाअपेक्षित, अिखल भारतीय तकनीकी शिक्षा परिषद के साथ साथ यूजीसी की अन्य विशेषJ सिमित ने संस्थान में उपलब्ध अवसंरचना और अन्य सुविधाओं के वास्तिवक सत्यापन के िलए 18-19 अप्रैल 2018 के दौरान संस्थान का दौरा किया। आयोग ने दिनांक 11.05.2018 को आयोिजत अपनी 531 व0 बैठक (मद सं. 2.01) में यूजीसी और एआईसीटीई दोनों की विशेषJ समितियों की रिपोर्ट पर िवचार किया जिसमें निम्नलिखित संकल्प पास किया गया:

''राष्ट्रीय रेल और परिवहन संस्थान (एनआरटीआई), एनएआईआर परिसर, लालबाग, वड़ोदरा, 390004 गुजरात को डी-नोवो वर्ग के तहत सम विश्वविद्यालय का दर्जा देने के िलए िवचार किया गया और इसे अनुमोदित किया गया। इसके अतिरिक्त, यह भी सुझाव दिया गया था कि एनआरटीआई विद्या[थयों की प्लेसमेंट के िलए उिचत कदम उठाए।''

6. और जबकि, यूजीसी और एआईसीटीई की विशेषJ सिमित की रिपोर्ट पर िवचार करने के बाद और यूजीसी की सलाह पर, मंत्रालय ने यूजीसी अिधिनयम 1956 की धारा 3 के तहत राष्ट्रीय रेल और परिवहन संस्थान (एनआरटीआई), वड़ोदरा, गुजरात को समविश्वविद्यालय के रूप में स्थािपत करने के िलए निम्निलिखत शतS के साथ 25.05.2018 को रेल मंत्रालय को आशय पत्र जारी किया:-

i प्रस्तािवत सम विश्वविद्यालय के नाम पर अलग और िवशेष सिमित/ट्रस्ट/कं पनी स्थािपत की जाएगी।

ii सभी परिसंपत्तियां कानूनी रूप से प्रस्तािवत सम विश्वविद्यालय के नाम पंजीकृ त होंगी।

iii यूजीसी िविनयम, 2016 के अनुसरण में एमओए/िनयम तैयार किए जाएं।

iv Jान के उभरते Fए क्षेत्रों में आयोिजत किए जाने वाले पाO)मों और अनुसंधान कार्य)मों की विस्तृत पाOचर्या सिहत उभरते Fए क्षेत्र में प्रस्तािवत अवरस्नातक और न्यूनतम पांच वर्षीय स्नात्कोत्तर पाO)म।

v यूजीसी द्वारा निर्धारित अर्हताओं सिहत प्रस्तािवत पाO)मों के िलए संकाय भर्ती किए जाएं।

vi अन्य प्राधिकारी जैसे कु लसिचव, रजिस्ट्रार, आदि नियुक्त किए जाएं।

7. और जबकि, रेल मंत्रालय, भारत सरकार ने आशय पत्र में उल्लिखित शतS के संबंध में दिनांक 14 जून 2018 को अपनी अनुपालन रिपोर्ट भेज दी थी। इस अनुपालन रिपोर्ट की समीक्षा करने एवं इस पर अपनी टिप्पिणयां इस मंत्रालय को भेजने के िलए यूजीसी को अHेषित किया गया था। इसके जवाब में, यूजीसी ने दिनांक 29 जून, 2018 को अपनी टिप्पिणयां इस मंत्रालय को भेज दी थ0।

8. अब, इसिलए, कें 1 सरकार यूजीसी के परामर्श और रेल मंत्रालय, भारत सरकार द्वारा अनुपालन रिपोर्ट पर दिए गए स्पष्टीकरण को ध्यान में रखते Fए, यूजीसी अिधिनयम, 1956 की धारा 3 के द्वारा प्रदत्त शक्तियों का प्रयोग करते Fए राष्ट्रीय रेल और परिवहन संस्थान (एनआरटीआई), एनएआईआर परिसर, लाल बाग, वडोदरा, गुजरात को इस शर्त के अध्यधीन कि एनआरटीयू प्रतिष्ठान (कं पनी अिधिनयम, 2013 की धारा 8 के अंतर्गत पंजीकृ त रेल मंत्रालय, भारत सरकार की एक गैर लाभकारी कं पनी) एनआरटीआई में शैक्षणिक गितिविधयां प्रारंभ करने से पूर्व अपेक्षित संख्या में संकाय और अन्य प्राधिकारी जैसे कु लपित, रजिस्ट्रार इत्यादि की यूजीसी के मानदंडों के अनुसार नियुक्ति करेगा, डी-नेवो -ेणी के अंतर्गत पांच वषS की अनंितम अविध के िलए एक मानद समविश्वविद्यालय घोिषत किया जाता है। पांच वषS के पश्चात् यूजीसी विशेषJ सिमित की रिपोर्ट तथा आयोग सिफारिशों के आधार पर लागू विनियमों के प्रावधानों के आधार पर समवत वि?विद्यालय के दज^ की पुष्टि की जाएगी।

9. उपरोक्त पैरा 8 में की गई उ'ोषणा इस अिधसूचना के पृष्ठांकन के )म सं. 4 में उल्लिखित शतS की पू[त के अध्यधीन है।

2. And whereas, an application was received on 17.01.2018 for grant of Deemed to be University status (under De-novo yet to be established category) to National Rail and Transportation Institute (NRTI), NAIR Campus, Lalbaug, Vadodara, Gujarat under Section 3 of the UGC Act, 1956.

3. And whereas, the application was forwarded to UGC for advice as per the UGC (Institutions Deemed to be Universities) Regulations, 2016.

4. And whereas, UGC constituted an Expert Committee to recommend whether the application of National Rail and Transportation Institute (NRTI), Vadodara, Gujarat may be considered under de-novo category. The Committee, after detailed deliberation and discussions with the representative of the Institution was of the opinion that the Courses proposed to be started are covered under the definition of 'De-novo' as envisaged in the UGC (Institutions Deemed to be Universities) Regulations, 2016 and are in the emerging areas of knowledge in true sense. The Committee has made the following recommendations:

"Letter of Intent (LoI) may be issued by the Ministry of HRD to the Institution for establishment of National Rail & Transportation Institute as an Institution Deemed to be University under de-novo category with the following conditions:

i. A separate and exclusive society/trust/company to be created in the name of the proposed deemed to be university.

ii. All the assets should legally vest in the name of the proposed deemed to be university.

iii. MoA/Rules to be prepared in accordance with the UGC Regulations, 2016.

iv. Land, Buildings, Library, Labs, Hostels, Residences and other Infrastructure to be created in accordance with the UGC Regulations, 2016.

v. UG and minimum of five PG courses proposed in emerging area alongwith the detailed syllabi of the courses and research programmes to be conducted in the emerging areas of knowledge.

vi. Faculty to be recruited for the proposed courses with the qualifications prescribed by the UGC.

vii. Other authorities such as Vice-Chancellor, Registrar, etc. to be appointed.

The Committee further recommended that an Expert Committee of UGC may visit the National Academy of Indian

Railways (NAIR), Vadodara (Gujarat) for on the spot visit of the infrastructure and other facilities available with the

Institute and to recommend whether the facilities available are in accordance with the UGC (Institutions Deemed to be

Universities) Regulations, 2016 for the courses proposed to be started. The Committee may also include one member from

the present Committee."

5. And whereas, as required under the UGC (Institutions Deemed to be Universities) Regulations, 2016, another Expert Committee of UGC as well as that of All India Council for Technical Education (AICTE) visited the Institution during 18- 19th April, 2018 for physical verification of infrastructure and other facilities available with the Institute. The Reports of both UGC & AICTE Expert Committees were considered by the Commission in its 531st meeting (Item No. 2.01) held on 11.05.2018 in which following resolution was passed:

"Considered and approved. National Rail and Transport Institute (NRTI), NAIR Campus, Lalbaug, Vadodara-

390004, Gujarat for Deemed to be University status under de-novo category. Further, it was suggested that NRTI be advised

to take appropriate steps for placement of the students."

And whereas, taking into consideration the report of UGC & AICTE Expert Committees and the advice of UGC, this Ministry had issued Letter of Intent (LoI) on 25.05.2018 to Ministry of Railways, Government of India for setting up National Rail and Transportation Institute (NRTI), Vadodara, Gujarat as an Institution Deemed to be University under Section 3 of the UGC Act, 1956 with the following conditions:

i. A separate and exclusive society/trust/company shall be created in the name of the proposed deemed to be university.

ii. All the assets shall be legally registered in the name of the proposed deemed to be university.

iii. MoA/Rules to be prepared in accordance with the UGC Regulations, 2016.

iv. UG and minimum of five PG courses proposed in emerging area along with the detailed syllabi of the courses and research programmes to be conducted in the emerging areas of knowledge.

v. Faculty to be recruited for the proposed courses with the qualifications prescribed by the UGC.

vi. Other authorities such as Vice-Chancellor, Registrar, etc. to be appointed.

7. And further whereas, Ministry of Railways, Government of India submitted its compliance report on 14th June, 2018 with regard to the conditions mentioned in LoI. The compliance report was forwarded to UGC for examination and sending its comments to this Ministry. In response, UGC sent its comments to this Ministry on 29th June, 2018.

8. Now, therefore, taking into consideration the advice of UGC and its further clarification on the compliance report of Ministry of Railways, the Central Government, in exercise of the powers conferred by Section 3 of the UGC Act, 1956, hereby declare National Rail and Transportation Institute (NRTI), NAIR Campus, Lalbaug, Vadodara, Gujarat, as an Institution deemed to be University under De-novo category for a provisional period of five years subject to conditions that the NRTU Foundation (a not-for-profit Company of Ministry of Railways, Government of India registered under Section 8 of Companies Act, 2013) will recruit the required number of faculty and appoint other authorities such as Vice-Chancellor, Registrar, etc. as per the norms of the UGC before starting academic activities in the NRTI. The status of Deemed to be University shall be confirmed after five years based on the review report of UGC Expert Committee and the recommendation of the Commission, as per the provisions of the prevailing Regulations.

9. The declaration as made in Para 8 above is further subject to fulfilment of the conditions mentioned at Sr. No.4 of the endorsement to this Notification;
