New Delhi, the 26th November, 2018
S.O. 1679.—Whereas, it appears to the Central Government, that it is necessary in the public interest that for the transportation of Petroleum from the State of Maharashtra a pipeline should be laid for implementing Koyali - Ahmednagar – Solapur Pipeline Project under Koyali – Ahmednagar Pipeline by the Indian Oil Corporation Limited;
And, whereas, it appears to the Central Government that for the purpose of laying the said pipeline, it is necessary to acquire the right of user in the land under which the said pipeline is proposed to be laid, and which is described in the Schedule annexed to this notification;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), the Central Government hereby declares its intention to acquire the right of user therein;
Any person who is interested in the land described in the said Schedule may submit objection in writing to Shri A.B. Mohekar, Deputy Collector (Retd.) Competent Authority Indian Oil Corporation Limited, Second floor, 4/1, Varad Sankul, Nandgaon Road, Manmad – 423104, Maharashtra. Within twenty one days from the date on which the copies of this notification issued under sub-section (1) of Section 3 of the said Act, as published in the Gazette of India, are made available to the general public.

S.O. 1680.—Whereas by the notification of the Government of India in the Ministry of Petroleum and Natural Gas vide S.O.No. 500 (E) dated the 8th February, 2017, issued under sub-section (1) of Section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), (hereinafter referred to as the said Act), Published in the Gazette of India, No. 449 dated the 16th February, 2017, and Gazette of India, No.11 dated the 18th – 24th March, 2018, S.O.No 463 dated the 7th March 2018 the Central Government declared its intention to acquire the right of user in the land specified in the Schedule appended to that notification for the purpose of laying Koyali- Ahmednagar-Solapur Pipeline for the transportation of Petroleum Items in Bharuch District in the State of Gujarat by Indian Oil Corporation Limited;
And whereas copies of the said Gazette notification were made available to the public up to 18th May, 2018;

And Whereas the Central Government, after considering the said report and on being satisfied that the said land is required for laying the pipeline, has decided to acquire right of user therein;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act, the Central Government hereby declares that the right of user in the land specified in the Schedule appended to this notification is hereby acquired for laying the pipeline;
And further, in exercise of the powers conferred by sub-section (4) of Section 6 of the said Act, the Central Government hereby directs that right of user in the said land for laying the pipeline shall, instead of vesting in the Central Government, vest on the date of publication of the declaration, in Indian Oil Corporation Limited, free from all encumbrances.
Indian Oil Corporation Limited shall be exclusively liable for any compensation in terms of Section 10 of the P & MP Act, 1962 and no suit, claim or legal proceeding would lie against the Central Government on any matter relating to the pipeline.

S.O. 1681.—Whereas it appears to the Central Government that it is necessary in the public interest that a pipeline should be laid by the Indian Oil Corporation Limited in Tehsil: Salempur, District: Deoria in the State of Uttar Pradesh for 'Patna-Motihari-Baitalpur Branch Pipeline' for the transportation of Petroleum Product,
And, whereas, it appears to the Central Government that for the purpose of laying the said pipeline, it is necessary to acquire the right of user in the land under which the said pipeline is proposed to be laid, and which is described in the Schedule annexed to this notification;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), the Central Government hereby declares its intention to acquire the right of user therein;

S.O. 1682.—Whereas, it appears to the Central Government, that it is necessary in the public interest that for the transportation of Petroleum Pipeline from the State of Maharashtra a pipeline should be laid for implementing Koyali - Ahmednagar – Solapur Pipeline Project under Koyali – Ahmednagar Pipeline by the Indian Oil Corporation;
And, whereas, it appears to the Central Government that for the purpose of laying the said pipeline, it is necessary to acquire the right of user in the land under which the said pipeline is proposed to be laid, and which is described in the Schedule annexed to this notification;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), the Central Government hereby declares its intention to acquire the right of user therein;
Any person who is interested in the land described in the said Schedule may submit objection in writing to Shri A.B.Mohekar, Deputy Collector (Retd.) Competent Authority Indian Oil Corporation Limited, Second floor, 4/1, Varad Sankul, Nandgaon Road, Manmad – 423104, Maharashtra. Within twenty one days from the date on which the copies of this notification issued under sub-section (1) of Section 3 of the said Act, as published in the Gazette of India, are made available to the general public.

S.O. 1685.—Whereas by the notification of the Government of India in the Ministry of Petroleum and Natural Gas vide S.O. No. 1094 dated the 28th July, 2018, issued under sub-section (1) of Section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), (hereinafter referred as the said Act), Published in the Gazette of India, No. 29 dated the 22-28th July, 2018 the Central Government declared its intention to acquire the right of user in the land specified in the scheduled appended to that notification for the purpose of laying Koyali-Ahmednagar-Solapur Pipeline for the transportation of Petroleum Items in Bharuch District in the State of Gujarat by Indian Oil Corporation Limited;
And whereas copies of the said Gazette notification were made available to the public up to 2nd September, 2018;
And Where as the competent authority has under sub-section (1) of Section 6 of said act submitted report to the Central Government;
And Whereas the Central Government, after considering the said report and on being satisfied that the said land is required for laying the pipeline, has decided to acquire right of user therein;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act, the Central Government hereby declares that the right of user in the land specified in the Schedule appended to this notification is hereby acquired for laying the pipeline;
And further, in exercise of the powers conferred by sub-section (4) of Section 6 of the said Act, the Central Government hereby directs that right of user in the said land for laying the pipeline shall, instead of vesting in the Central Government, vest on the date of publication of the declaration, in Indian Oil Corporation Limited, free from all encumbrances.
Indian Oil Corporation Limited shall be exclusively liable for any compensation in terms of Section 10 of the P & MP Act, 1962 and no suit, claim or legal proceeding would lie against the Central Government on any matter relating to the pipeline.

S.O. 1688.—In exercise of the powers conferred by sub-section (1) of section 3 of the Petroleum and Minerals pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), the Central Government hereby makes the following amendment in the notification of the Government of India in the Ministry of Petroleum and Natural Gas, S. O. No. 500 (E) dated 8th February 2017 published at page 13 in part II, section 3, sub-section (ii) of the Gazette of India, No. 449 dated 16th February 2017 and S. O. No. 463 dated 7th March 2018, published at page 2210 and 2211 in part II, section 3, sub-section (ii) of the Gazette of India, No. 11 dated 18-24 March, 2018 It came to our notice that survey number 278 is falling under ROU instead of survey number 208. as per S.O.500(E) dated 8/2/2017 this village shown in Taluka Mangrol, and as per S.O.463 dated 7/3/2018 the village falls in Taluka Mandvi so we have mentioned both the S.O. S.O. 1689.—Whereas it appears to the Central Government that it is necessary in the public interest that a pipeline should be laid by the Indian Oil Corporation Limited in District Saran in the State of Bihar for "Patna - Motihari - Baitalpur Branch Pipeline'' for the transportation of Petroleum Product;
And, whereas, it appears to the Central Government that for the purpose of laying the said pipeline, it is necessary to acquire the right of user in the land under which the said pipeline is proposed to be laid, and which is described in the Schedule annexed to this notification;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), the Central Government hereby declares its intention to acquire the right of user therein;
Any person interested in the land described in the said Schedule may, within twenty one days from the date on which the copies of the notification issued under sub-section (1) of Section 3 of the said Act, as published in the Gazette of India are made available to the general public, object in writing to the acquisition of the right of user therein for laying of the pipeline under the land, to Shri Jagdish Prasad Singh, B.A.S. & Competent Authority, Indian Oil Corporation Limited. S.O. 1690.—Whereas, it appears to the Central Government that it is necessary in the public interest that for the transportation of petroleum products from Tundla Terminal to Kanpur Terminal should be laid by Indian Oil Corporation Limited. And whereas, it appears to the Central Government that for the purpose of laying the said pipeline, it is necessary to acquire the right of user in the land described in the schedule annexed to this notification;
Now, therefore, in exercise of the powers conferred by Sub section (1) of section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in land ) Act, 1962 (50 of 1962), the Central Government hereby declares its intention to acquire the right of user therein;
Any person interested in the land described in the said schedule may, within twenty–one days from the date on which the copies of this notification, as published in the Gazette of India, are made available to the General Public, object in writing to the acquisition of the right of user therein or laying of the pipeline under the land to Competent Authority, Indian Oil Corporation Limited ( Pipelines Division), Construction Office, Northern Region Pipelines, Tundla-Gawria Pipeline Project, E-160,1st & 2nd floor, Kamlanagar, Agra (U.P.) – 282 004.

और के न्(cid:15)ीय सरकार को ऐसी पाइपलाइन िबछाने के प्रयोजन के िलये यह आवश्यक प्रतीत होता है कि ऐसी भूिम में जो इस से उपाब. अनुसूची में व!र्णत है, और जिसमें उक्त पाइपलाइन िबछाई जाने का प्रस्ताव है, उपयोग के अिधकार का अर्जन किया जाए ।
अतः अब, के न्(cid:15)ीय सरकार, पेट्रोलियम और खिनज पाइपलाइन (भूिम में उपयोग के अिधकार का अर्जन) अिधिनयम, 1962 (1962 का 50) की धारा 3 की उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते >ए उस भूिम में उपयोग के अिधकार का अर्जन करने के अपने आशय की घोषणा करती है ।

S.O. 1691.—Whereas, it appears to the Central Government that it is necessary in the public interest that for the transportation of petroleum products from Tundla Terminal to Kanpur Terminal should be laid by Indian Oil Corporation Limited. And whereas, it appears to the Central Government that for the purpose of laying the said pipeline, it is necessary to acquire the right of user in the land described in the schedule annexed to this notification;
Now, therefore, in exercise of the powers conferred by Sub section (1) of section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in land ) Act, 1962 (50 of 1962), the Central Government hereby declares its intention to acquire the right of user therein;
Any person interested in the land described in the said schedule may, within twenty–one days from the date on which the copies of this notification, as published in the Gazette of India, are made available to the General Public, object in writing to the acquisition of the right of user therein or laying of the pipeline under the land to Competent Authority, Indian Oil Corporation Limited ( Pipelines Division), Construction Office, Northern Region Pipelines, Tundla-Gawria Pipeline Project, E-160,1st & 2nd floor, Kamlanagar, Agra (U.P.) – 282 004.

S.O. 1693.—Whereas, it appears to the Central Government that it is necessary in the public interest that for the transportation of petroleum products from Tundla Terminal to Kanpur Terminal should be laid by Indian Oil Corporation Limited. And whereas, it appears to the Central Government that for the purpose of laying the said pipeline, it is necessary to acquire the right of user in the land described in the schedule annexed to this notification;
Now, therefore, in exercise of the powers conferred by Sub section (1) of section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in land ) Act, 1962 (50 of 1962), the Central Government hereby declares its intention to acquire the right of user therein;

ORDER
Authorized representative of the Management is present, whereas none appears on behalf of the 2nd party-Union. Heard the authorized representative of the Management, who submitted that the Union is not taking any step in the proceeding for the last several adjournments and in that view of the matter order/award be passed rejecting the claim of the 2nd party-Union. Perusal of the record reveals that after filing of the claim statement the 2nd party-Union was in appearance till hearing on settlement of issues and it is not taking any steps further-more when the case is posted for evidence of the 2nd Party-Union. The reference case cannot be protracted for an indefinite period by mechanical adjournment awaiting the appearance of the 2nd party-Union at its sweet will. The 2nd party-Union did not adduce any evidence before defaulting in appearance. In absence of evidence and materials on behalf of the 2nd party-Union there is nothing before the Tribunal for adjudication of the dispute, which has been referred to.
2. It is pertinent to mention here that until adjudication of the dispute referred to by the authority concerned, an award cannot be made within the meaning of the award as defined under section 2(b) of the Act. There is also no provision in the Act to pass a no-dispute award or nil award in case the disputant fails to make appearance and prosecute its claim. In that view of the matter passing of a no-dispute award or nil award for absence of the disputant/parties would be a misconception and the above position has been settled by the Hon'ble High Court of Orissa in the case between M/s. IDL Chemicals Limited –versus- P.O. Labour Court, Sambalpur reported in 72(1991)CLT 73 and in the decision of the Calcutta High Court in the case of B.R. Bermen and Mohatta (India) Pvt. Ltd., -versus- Seventh Industrial Tribunal, West Bengal and others (short noted in 1977 Lab. I.C. (NOC) 13 (CAL). It has been also held by the Hon'ble Courts that so long as the dispute remains unsettled and the proceeding came to an end without adjudication of the dispute between the parties, there is no bar under the Act whereby the Government is precluded from referring the dispute over again so that there may be an industrial adjudication as contemplated by the Act.
3. Having regard to the above facts and circumstances as well as settled principles I am constrained to dismiss the case registered on the reference of the dispute without any award and accordingly the reference is disposed of. A copy of this order be sent to the Government of India, Ministry of Labour for necessary action at their end.

The Government of India/Ministry of Labour, New Delhi by reference adjudication Order No. L-30011/6/99–IR(M) dated 17.05.1999 referred the dispute for adjudication to the Industrial Tribunal, Ahmedabad (Gujarat) in respect of the matter specified in the Schedule:

"Whether Gujarat Mazdoor Panchayat is justified in demanding employment for the workmen listed in Annexure with ONGC Ltd., Mehsana, declaring contract with M/s Chansma Taluka Sarvodaya Mazdoor Sahakari Mandli Ltd. and Swastik Mazdoor Contractor Sahakari Mandli Ltd. as sham contract and wages for the period these workmen has not been provided work? If yes, what relief these workmen are entitled to?"
1. The reference dates back to 17.05.1999 and received on 07.06.1999 from Ministry of Labour and Employment, New Delhi for adjudication and passing the award.
2. After receiving notice by the parties, the second party union The General Secretary, Gujarat Mazdoor Panchayat, Dr. Lohia Sadan, Odhv Road, Ahmedabad, submitted the statement of claim Ex. 4 and alleged in the statement of claim that Government of India through a notification under Contract Labour (Regulation and Abolition) Act, hereinafter referred to as "Act" prohibited the employment of watchman with effect from 01.03.1977 in all the establishments wherein the Government of India is the holding authority. Here in the case of ONGC, Government of India is the holding authority, therefore, the aforesaid notification also applied to ONGC. Despite the said notification, the ONGC has been engaging the persons performing the work of Watchman in its establishment and 47 workmen listed in the annexure were doing the work of Watchmen in the ONGC Limited at Mehsana as contract labour flagrantly violating the provisions of aforesaid notification issued under the Act. It is further alleged that all these 47 workmen have been working in ONGC since last several years as a contract labour but were denied of the benefits admissible to the employees of ONGC. The ONGC has entered into a sham and bogus arrangement with bogus intermediaries as contractor. Those contractors have no individual existence and capacity to employ these labourers. It is also alleged that the economic control of all these skilled workers subsists with the ONGC; therefore, real employer is the ONGC. Thus the second party union has prayed for issuing directions to ONGC to treat these 47 workmen as permanent Watchman of ONGC Limited with effect from the date they have been working and to pay them the wages and other benefits extending all the service conditions of a permanent employee of ONGC Limited besides any other relief as the Tribunal deems fit.
3. The first party ONGC vide written statement Ex. 5 raised the preliminary issues regarding jurisdiction of the Tribunal as well as to decide the issue as to whether the reference falls within the purview of Section 2 (k) of the Industrial Disputes Act.
4. The application Ex. 5 regarding the preliminary issues was rejected by the then Industrial Tribunal, Ahmedabad on 16.03.2001 after hearing the parties.
5. Later, the first party ONGC submitted the detailed written statement stating that the reference is liable to be dismissed being non-maintainable and also the Tribunal has no jurisdiction to decide the reference. It is further submitted that there was no master servant relationship between the workmen and ONGC as well as the reference is suffering with mis-joinder and non-joinder of the parties as the contractor has not been impleaded as necessary parties. These workmen cannot be said to be workmen under Section 2 (s) of the Industrial Disputes Act and there appears to be non-existence of dispute under Section 2 (k) of the Industrial Disputes Act. It has been further submitted that these 47 workmen have not been working as Watchman with the ONGC. It is wrong to say that the ONGC has entered into a sham and bogus arrangement with the contractor in engaging the persons as Watchman. It is further submitted that the ONGC has awarded various casual/seasonal and intermittent jobs on contract basis to various contractors after completing all the requirements of law and rules after signing a valid contract. These contract employees have never been controlled, supervised or subjected to any administrative, financial or disciplinary action by the ONGC. ONGC is a state industry and governed by the Industrial Rules of Government of India issued from time to time and regularisation of these persons would amount the recruitment by way of back door entry. Thus the reference and the prayer made by the second party union in the statement of claim are liable to be rejected. It is further submitted that the contract between the ONGC and contractor are always genuine as the ONGC is registered under Section 7 of the Contract Labour (Regulation and Abolition) Act and these contractors[भाग II—खण्ड 3(ii)] भारत का राजपत्रा : दिसम्बर 1, 2018/अग्रहायण 10, 1940 6545 have obtained a valid licence under Section 12 of the said Act. Thus the ONGC fulfils all the statutory obligations while outsourcing the human power.
6. On the basis of the pleadings, the following issues arise:
I. Whether the Gujarat Mazdoor Panchayat is justified in demanding employment for the workmen listed in Annexure with ONGC Ltd., Mehsana, declaring contract with M/s Chansma Taluka Sarvodaya Mazdoor Sahakari Mandli Ltd. and Swastik Mazdoor Contractor Sahakari Mandli Ltd. as sham contract and wages for the period these workmen has not been provided work?
II. To what relief, if any, the concerned workman is entitled to? 7. Both these issues are interrelated, therefore, are decided together. 8. Issue No. I and II: The burden of proof of these issues was lying on the second party workmen. The second party submitted the affidavit Ex. 13 of one of the workmen Vinuji Govindji Darbar reiterating the averments made in the statement of claim Ex. 4 but in the cross-examination, he has stated on oath that his date of birth is 01.06.1964. He is graduate. He was not served any letter regarding termination or removal of service. He along with other 46 workmen raised this dispute and in the said list of 47 workmen, he stood at Serial No. 37. He has further stated that his services was terminated by one Parmar, an Officer of ONGC. He was not a contract employee. He does not know any contractor whosoever. He does not know the details of date of births, educational qualifications, period of service etc. of other 46 workmen involved in this reference. This reference was drafted by the union. He does not know as to whether his affidavit matches with the statement of claim or not. ONGC used to pay them the wages but he does not have proof of it. He does not know as to who used to deduct the Provident Fund contribution. He has further stated that they were used to pay the wages for the day they worked. He along with other workmen was removed on 19.02.1997.
9. I heard the arguments of learned counsel of the parties and considered the evidence oral as well as documentary available on the record.

The record reveals that all these 47 workmen were not given any appointment letter by ONGC nor were they removed from employment by the ONGC because the second party union has failed to submit documentary evidences to this effect. The argument of the learned counsel of the second party is that these workmen were serving the ONGC for a number of years on the post of Watchman which is an essential service in ONGC but he has not submitted any evidence as to how many years these workmen served as Watchman in the establishment of ONGC. The only witness examined Vinuji Govindji Darbar is unable to name and giving details of other so called Watchman regarding their period of service, age, qualification etc. The witness examined was born in 1964 who has now become 54 years old. It may be possible that some of other workmen might have passed the age of superannuation.
11. The second party union has also failed that the post of Watchman was in the prohibited category wherein the contract employee cannot be engaged. Further from the perusal of the evidence, the witness has indirectly admitted that he was a employee in a contract system but the concerned contractors have not been made party at the stage of reconciliation and as well as in the reference.
12. Thus on the basis of the aforesaid discussions, prayer of reinstatement with back wages will amount to back door recruitment violating the rules of recruitment in the ONGC under the directions or circulars issued by Government of India from time to time.
13. Thus the reference has no force and fit to be decided in negative against the second party union with the observation as under: "Gujarat Mazdoor Panchayat is not justified in demanding employment for the workmen listed in Annexure with ONGC Ltd., Mehsana. Further the contract cannot be declared as sham and bogus."
14. No relief can be granted. The reference is disposed of accordingly.

ORDER
None of the parties is in appearance inspite of repeated calls. It is seen from the record that the applicant- workman has raised a dispute challenging his dismissal from service resorting to the provisions of Section 2-A(2) of the Act under the Industrial Disputes Act, 1947 (herein after referred to as "The Act"). It is pertinent to mention here that sub-clause 3 of Section 2-A of the Act mandates that an application filed under sub-section 2-A(2) shall be made to the Tribunal/Labour Court before the expiry of three years from the date of discharge, dismissal, retrenchment or otherwise termination of service as specified in sub-section 2-A(1). On a close reading of the statement of claim filed by the applicant it is seen that the disputant is stated to have been removed from service on 8.2.2008. The application/statement of claim is not filed within the prescribed limitation period and the period having been specified in the Act itself the Tribunal has no jurisdiction to condone the delay in filing of the application/statement of claim. Hence, the statement claim raising the dispute is not also maintainable in the eye of law. Therefore, the case registered on the filing of the statement of claim/application by the disputant is dismissed for default of the workman as well as for non-maintainability of the application keeping in view the limitation prescribed under the provision of Section 2-A(3) of the Act.

Whereas , contrary to it, Mr. D.K.Verma, Ld. Advocate for the Management made appearances as & when it warranted so .Needless to mention here, formal Notices dtt. 30.01.2004, 23.06.2004, and 28.09.2018 apart from one Show Cause Notice were sent to the address of the Union concerned but in vain. The case appears to have looming over filing W.S. by the workman/Sponsoring Union. Finally on 29.09.2004 upon having miserably failed to turn up by the Representative of the Union / workman petitioner a 'No Dispute order' was passed, pending with final formal Award by the then Presiding Officer. The case is related to demand of the Union about providing SLU to the workmen under the Management of SAIl, IISCO, Jitpur Colliery at Dhanbad.

AWARD
The Government of India/Ministry of Labour, New Delhi by reference adjudication Order No. L-11012/05/2015–IR (CM-I) dated 26.02.2015 referred the dispute for adjudication to the Central Government Industrial Tribunal cum Labour Court, Ahmedabad (Gujarat) in respect of the matter specified in the Schedule:
SCHEDULE
"Whether the action of the management, Sr. Vice President & Head of Ground Services, Spice Jet Ltd., Gurgaon and other to terminate the service of Shri Mohammad Zahid Kaiyum Bhai Rajput, Customer Care Executive at Ahmedabad Airport is justified? To what relief the workman is entitled?"
1. The reference dates back to 26.02.2015 and received on 10.03.2015 from Ministry of Labour and Employment, New Delhi for adjudication and passing the award.
2. In response to the notice issued to the parties, the second party workman Mohammad Zahid Kaiyum Bhai Rajput submitted the statement of claim Ex. 7 alleging that he appointed and joined as Customer Service Executive on 12.01.2013/23.01.2013 by the first party Spice Jet Limited as a permanent appointee but he was illegally terminated on 13.10.2013 by the first party Spice Jet Limited after serving for more than 240 days in the said calendar year after 10 months of his honest and diligent service. He has further alleged that on 29.08.2013, the first party Spice Jet Limited launched a new direct air service from Ahmedabad to Muscat. On his counter, one passenger named Sunita Gajjar was charged for excessive luggage of 34 Kg and was asked to pay Rs.17000/- (Rupees Seventeen Thousand) for the said excessive luggage. She paid the said amount but due to pressure, he could not provide the luggage receipt to the said passenger. He has further alleged that after end of the duty, he reached the house and realised that he could not provide the receipt of excessive luggage to the passenger and also did not credit the money of Rs.17000/-(Rupees Seventeen Thousand) in the account of Spice Jet Limited. Next day, he informed the Station Manager and Security Officer regarding the said incident and volunteered to deposit the said amount. He handed over Rs.17000/-(Rupees Seventeen Thousand) to the Station Manager, Mr. Johnson George immediately. He has further alleged that after 11 days, the Station Manager, Mr. Johnson George called him and said that the passenger's relative is claiming the receipt of the amount of Rs.17000/-(Rupees Seventeen Thousand) of excessive luggage. The Station Manager asked his explanation as to why his amount was not deposited. He submitted his explanation but on the said ground, on 23.09.2013, he was put under suspension and terminated on 13.10.2013 without any notice or paying the notice pay and that to without following the provisions of law. Thus he has alleged that his termination is violation of provisions of Section 25 F, G and H of the Industrial Disputes Act and he has prayed for declaring the termination illegal and to reinstate him with back wages along with Rs.15000/- (Rupees Fifteen Thousand) as expenses of the reference.
3. The first party despite service of notice by registered post, failed to submit the written statement, therefore, on 03.01.2017, the case was ordered to proceed ex-parte against all the first parties.
4. The second party workman submitted the affidavit Ex. 9 reiterating the averments made in the statement of claim. The affidavit reveals that the workman after charging the excessive luggage failed to credit the money into the account of first party but he has also stated that on the next working day, he handed over the amount to the Station Manager but the Station Manager, Mr. Johnson George or any authorised person of the first party did not come forward to explain or rebut the averments of the workman that he handed over the amount of Rs.17000/-(Rupees Seventeen Thousand) by way of submission of written statement. Thus in the said case, it can be assumed that the second party workman is speaking truth and his termination was illegal.

Thus the reference is disposed of with the observation as under: "the action of the management, Sr. Vice President & Head of Ground Services, Spice Jet Ltd., Gurgaon and other to terminate the service of Shri Mohammad Zahid Kaiyum Bhai Rajput, Customer Care Executive at Ahmedabad Airport is illegal and unjustified."
6. The first parties The Sr. Vice President & Head of Ground Services, Spice Jet Ltd., 319, Udyog Vihar, Phase IV, Gurgaon (Haryana), The Dy. General Manager – HR, Spice Jet Ltd., 319, Udyog Vihar, Phase IV, Gurgaon (Haryana), The Vice President – HR & Head HR, Spice Jet Ltd., 319, Udyog Vihar, Phase IV, Gurgaon (Haryana) and The Station Master, Spice Jet Ltd., SVPI Airport, Ahmedabad are directed to reinstate the second party workman Mohammad Zahid Kaiyum Bhai Rajput on his original post within 30 days from the publication of this award along with a lump-sum amount of Rs.115000/- (Rupees One Lac Fifteen Thousand) as compensation including legal expenses.
7. The award is passed accordingly.

The Government of India, Ministry of Labour, in exercise of the powers conferred on them under Sec.10(1)(d) of the I.D. Act.,1947 has referred the following dispute to this Tribunal for adjudication vide their Order No. L-20012/82/07-IR (CM-I) dt. 09.08.2007.

''Whether the action of the Management of Sendra Bansjora Colliery of M/s. BCCL in denying
regularization as PR Trammer to Shri Radhe Ram Chamar, M/Loader, is justified and legal? If not, to
what relief is the concerned workman entitled and form which date?"
2. The instant case put up on date with none registered appearance from either sides. .While going through the Case record, it apparently shows that several notices dtt. 05.12.07, 10.01.2008, 31.03.2008, 23.11.2007, 28.08.2018 and lastly on 25.10.2018 have been sent to the address of the Sponsoring Union referred under reference but they failed to file even WS .More so, it prima facie reflects workman unwillingness to go in for final adjudication. These sumps up the stand, the Tribunal has been looking on such cases over years. The status of case was fixed for filing W.S/Rejoinder an onus resting on the part of the Union/workman petitioner. Ironically , there have been subsequently sufficient adjournments availed of by both of the parties specially by the Sponsoring Union on different pretexts with no signs of action seems visible. The case deals with denial of regularization of the workman Radhe Ram Chemar as P R Trammer by the Management of Sendra Bansjora Colliery of M/s. BCCL seeking relief there under by challenging the alleged action.
Upon a careful perusal of the case and different materials on record, it stands clear that the workman/petitioner concerned is no longer interested to get to finality of the case through adjudication as reflected in the order sheets as well.. However, proceedings have been abruptly come to a grinding halt over non -filing of WS by the Union on its part. `So the Tribunal has no ground to hold it up for uncertainty. Usually the Tribunal would not have been left with no choice but to close the case dropping the proceedings presuming non-existence of the Industrial Dispute in reference owning to sheer disinterestedness of the workman. So the case is wrapped up as no Industrial Dispute in the line of the natural justice. Accordingly an Award of 'No Dispute' is passed.
