2. डा. हिरेन जोशी की विशेष कार्याधिकारी (संचार एवं सूचना प्रौद्योगिकी) के रूप में नियुक्ति उन्हीं अनुमोदित निबंधन एवं शर्तों के अध्ययधीन होगी, जो विशेष कार्याधिकारी (सूचना प्रौद्योगिकी) के लिए हैं और यह नियुक्ति प्रधानमंत्री के कार्यकाल के सह-समाप्य एवं उनके विवेकाधीन होगी।

2. वरिष्ठ प्रधान निजी सचिव के ग्रेड में यह तदर्थ पदोन्नति निम्न शर्तों के अध्यधीन होगीः

i. यह तदर्थ पदोन्नति इस ग्रेड में अनिश्चित समय तक बने रहने या नियमित आधार पर नियुक्ति हेतु चयन सूची में शामिल होने या केन्द्रीय सचिवालय आशुलिपिक सेवा संवर्ग के वरिष्ठ प्रधान निजी सचिव के ग्रेड में वरिष्ठता का दावा करने का अधिकार प्रदान नहीं करेगी;

ii. तदर्थ नियुक्तियों को बिना कोई कारण बताए किसी भी समय समाप्त किया जा सकता है;

iii. वरिष्ठ प्रधान निजी सचिव के ग्रेड में तदर्थ आधार पर दी गई सेवा को उस ग्रेड में वरिष्ठता या अगले उच्चतर ग्रेड में पदोन्नति के लिए नहीं गिना जाएगा;

iv. पंजाब और हरियाणा के माननीय उच्च न्यायालय द्वारा पारित सीडब्ल्यूपी सं. 13218/2009 में दिए गए अंतिम निर्णय और दिनांक 15.07.2011 के आदेश के परिणामस्वरूप एसएलपी(सी) सं. 30621/2011 और माननीय उच्चतम न्यायालय के समक्ष अन्य संबंधित वाद;

v. ऑल इंडिया इक्वेलिटी फोरम और अन्य बनाम यूओआई और अन्य द्वारा दायर डब्ल्यूपी(सी) सं. 3490/2010 में माननीय दिल्ली उच्च न्यायालय के दिनांक 23.08.2017 के निर्णय के परिणामस्वरूप एसएलपी(सी) सं. 31288/2017 और किसी भी सक्षम न्यायालय में संबंधित अन्य अदालती वाद;

vi. संबंधित मामले में कोई भी अन्य अदालती वाद।
