2. श्री एच एम बैजल की नियुक्ति श्री एम आर गुरिये, चयन सूची 2010 जो की उक्त अधिकारी के तत्काल कनिष्ठ अधिकारी की नियुक्ति तिथि 13.05.2013 से प्रभावी होगी। इसके अलावा, श्री एच एम बैजल की नियुक्ति भारत सरकार के अंतिम निर्णय या कोर्ट के आदेशों का पालन करती है, के अध्यधीन होंगी।

2. तदर्थ नियुक्ति निम्नलिखित शर्तों के अधीन होगीः—

(i) तदर्थ पदोन्नति केंद्रीय सचिवालय आशुलिपिक सेवा (सीएसएसएस) में अनिश्चित रूप से बने रहने या नियमिति नियुक्ति के लिए चयन सूची में शमिल होने अथवा वरिष्ठ प्रधान निजी सचिव के ग्र्रेड में वरीयता दावे का कोई अधिकार प्रदान नहीं करेगी।

(ii) तदर्थ नियुक्ति बिना कोई कारण बताएं किसी भी समय समाप्त की जा सकती है।

(iii) वरिष्ठ प्रधान निजी सचिव के ग्रेड में तदर्थ आधार पर प्रतिपादित सेवाएं उस ग्रेड में वरीयता अथवा अगले उच्च ग्रेड में पद्दोन्नति के उद्देश्य के लिए नहीं गिनी जाएंगी।

(iv) अधिकारी की नियुक्ति अगले आदेशों के अधीन होगी जो कार्मिक और प्रशिक्षण विभाग के दिनांक 28 दिसम्बर, 2018 के का.ज्ञा. सं. 2/5/2017-सीएस. II (ए) के पैरा 3 (vi), (vii) और (viii) में उल्लिखित मामलों में माननीय न्यायालयों द्वारा पारित किए जाए।

(i) तदर्थ पदोन्नति केंद्रीय सचिवालय आशुलिपिक सेवा (सीएसएसएस) में निजी सचिव के ग्रेड में वरीयता के दावे या नियमित नियुक्ति के लिए चयन सूची में शामिल होने अथवा ग्रेड में अनिश्चित काल तक बने रहने का कोई अधिकार प्रदान नहीं करेगी।

(ii) तदर्थ नियुक्ति बिना कोई कारण बताए किसी भी समय समाप्त की जा सकती है।

(iii) निजी सचिव के ग्रेड में तदर्थ आधार पर प्रतिपादित सेवाएं अगले उच्च ग्रेड में पद्दोन्नति के लिए अथवा उस ग्रेड में वरीयता के उद्देश्य के लिए नहीं गिनी जाएंगी।

(iv) अधिकारी की नियुक्ति अगले आदेशों के अधीन होगी जो कार्मिक और प्रशिक्षण विभाग के दिनांक 31 दिसम्बर, 2018 के का.ज्ञा. सं.4/2/2018-सीएस.II(ए) के पैरा 3 (vi), (vii), और (viii) में उल्लिखित मामलों में माननीय न्यायालयों द्वारा पारित किए जाए।

(i) तदर्थ पदोन्नति केंद्रीय सचिवालय आशुलिपिक सेवा (सीएसएसएस) में निजी सचिव के ग्रेड में वरीयता के दावे या नियमित नियुक्ति के लिए चयन सूची में शामिल होने अथवा ग्रेड में अनिश्चित काल तक बने रहने का कोई अधिकार प्रदान नहीं करेगी।

(ii) तदर्थ नियुक्ति बिना कोई कारण बताए किसी भी समय समाप्त की जा सकती है।

(iii) निजी सचिव के ग्रेड में तदर्थ आधार पर प्रतिपादित सेवाएं अगले उच्च ग्रेड में पद्दोन्नति के लिए अथवा उस ग्रेड में वरीयता के उद्देश्य के लिए नहीं गिनी जाएंगी।

(iv) अधिकारी जो तदर्थ प्रोन्नति का लाभ नहीं उठाते हैं तो उनके नाम पर इस प्रोन्नति आदेश के जारी होने की तारीख से एक वर्ष की अवधि के लिए तदर्थ प्रोन्नति के लिए विचार नहीं किया जाएगा।

(v) माननीय पंजाब और हरियाणा उच्च न्यायालय द्‌वारा सीडब्ल्यूपी सं. 13218/2009 में दिनांक 15.07.2011 को जारी अंतिम निर्णय और आदेश तथा माननीय उच्चतम न्यायालय में अन्य संबंधित न्यायालयी मामलों से उत्पन्न एसएलपी (सी) सं. 30621/2011।
