2. उपरोक्त अधिकारी भारतीय पुलिस सेवा (परिवीक्षा) विनियम, 1954, के तहत एक वर्ष के लिये परिवीक्षा पर रहेंगे और भारतीय पुंलिस सेवा (परिवीक्षा) विनियम 1954 के नियम 5(4) में संशोधन दिनांक 10.5.2011 के तहत अधिकारियों को इंडक्शन प्रशिक्षण प्राप्त करना होगा।

सं. आई-14013/21/2017-आईपीएस—1(II)—माननीय सर्वोच्च न्यायालय के अनुपालन में श्री प्राणतोष कुमार दास द्वारा माननीय उच्च न्यायालय में दायर सीडब्ल्यूजेसी संख्या 12235/2016 के आदेश दिनांक 17.07.2017 एवं माननीय सर्वोच्च न्यायालय में दायर एस एल पी संख्या 29755/2017 के आदेश दिनांक 19.11.2018 के आलोक में श्री प्राणतोष कुमार दास के नाम को भारतीय पुलिस सेवा के बिहार संवर्ग में 2010 की चयन सूची से प्रोन्नति हेतु दिनांक 14.01.2019 को आयोजित रिव्यू चयन समिति की बैठक की अनुसंसा जिसे संघ लोक सेवा आयोग के पत्र संख्या 7/3(1)/2018-AIS दिनांक 19.03.2019 को अनुमोदित कर दिया है, जिसके परिणामस्वरूप श्री प्राणतोष कुमार दास का नाम चयन सूची 2010 के क्रम संख्या 5 ए पर जो श्री बिरेन्द्र नारायण झा क्रम संख्या 5 और श्री शंकर झा, क्रम संख्या 6 के बीच है, में सम्मिलित किए जाने के लिए संघ लोक सेवा आयोग के पत्र संख्या 7/3(1)/2018-ए आई एस दिनांक 19.03.2019 को राष्ट्रपति, भारतीय पुलिस सेवा (भर्ती) विनियम, 1955 के विनियम 9 के उप-विनियम (1) के साथ पठित भारतीय पुलिस सेवा (भर्ती) विनियम, 1954 के विनियम 9 के उप-विनियम (2) में प्रदत्त शक्तियों का प्रयोग करते हुए, बिहार पुलिस सेवा के श्री प्राणतोष कुमार दास (जन्म तिथिः 03.01.1962) एवं पूर्व में 2016 की चयन सूची से भारतीय पुलिस सेवा में नियुक्त को चयन सूची 2010 से समस्त परिणामी लाभांषों सहित बिहार संवर्ग प्रदान करते हैं।

2. उपर्युक्त नियुक्ति 30.06.2019 तक अथवा पद के नियमित पदोन्नति से भरे जाने तक अथवा अगले आदेशों तक, जो भी पहले हो, केवल तदर्थ आधार पर की जा रही है। तदर्थ पदोन्नति इन्हें अनिश्चित अवधि के लिए ग्रेड में बने रहने अथवा नियमित नियुक्ति के लिए चयन सूची में शामिल होने अथवा सीएसएसएस के वरिष्ठ पीपीएस ग्रेड में वरिष्ठता का दावा करने का कोई अधिकार प्रदान नहीं करेगी। सरकार किसी भी समय बिना कोई कारण देते हुए उपर्युक्त तदर्थ को समाप्त करने का अधिकार सुरक्षित रखती है।

3. तदर्थ पदोन्नति निम्नलिखित न्यायालय मामालों के परिणामों के अध्ययधीन हैः

(क) माननीय उच्च न्यायालय पंजाब एवं हरियाणा द्वारा सीडब्ल्यूपी सं. 13218/2009 में दिए गए 15.07.2001 के अंतिम निर्णय और आदेश के परिणामस्वरूप एसएलपी(सी) सं. 30621/2011 तथा माननीय उच्चतम न्यायालय के समक्ष अन्य संबद्ध मामला।

(ख) ऑल इंडिया इक्विटी फोरम एवं अन्य बनाम यूओआई तथा अन्य द्वारा दायर की गई रिट याचिका(सी) सं. 3490/2010 में माननीय दिल्ली उच्च न्यायालय के दिनांक 23.08.2017 के निर्णय के परिणामस्वरूप एसएलपी(सी) सं. 31288/2017 तथा किसी भी सक्षम न्यायालय में अन्य संबंधित न्यायालयी मामला।

(ग) संबंधित मामले में अन्य कोई न्यायालयी मामला।

2. उपर्युक्त नियुक्ति 30.06.2019 तक अथवा पद के नियमित पदोन्नति से भरे जाने तक अथवा अगले आदेशों तक, जो भी पहले हो, केवल तदर्थ आधार पर की जा रही है। तदर्थ पदोन्नति इन्हें अनिश्चित अवधि के लिए ग्रेड में बने रहने अथवा नियमित नियुक्ति के लिए चयन सूची में शामिल होने अथवा सीएसएसएस के पीपीएस ग्रेड में वरिष्ठता का दावा करने का कोई अधिकार प्रदान नहीं करेगी। सरकार किसी भी समय बिना कोई कारण देते हुए उपर्युक्त तदर्थ नियुक्ति को समाप्त करने का अधिकार सुरक्षित रखती है।

3. तदर्थ पदोन्नति निम्नलिखित न्यायालय मामालों के परिणामों के अध्ययधीन हैः
