सं. ए-32011/04/2017 प्रशा.-एमसीए (i)-कार्मिक एवं प्रशिक्षण विभाग के दिनांक 30.04.2019 के कार्यालय आदेश संख्या 5/4/2019-सीएस-I(यू) (i) के संदर्भ में, राष्ट्रपति, के केन्द्रीय सचिवालय सेवा (सीएसएस) के नियमित अनुभाग अधिकारी (एसएलवाई 2009) श्री सुरजीत साहा (सीएसएल संख्या 9869) को कारपोरेट कार्य मंत्रालय में सीएसएस के ग्रेड-I (अवर सचिव), वेतन मैट्रिक्स स्तर-11 (रू. 67,700-208,700) [पूर्व-संशोधित पीबी-3 (` 15600-39100) ` 6600/- ग्रेड वेतन सहित] में तदर्थ आधार पर दिनांक 1 मई, 2019 पूर्वाहन से दिनांक 30.06.2019 की अवधि तक या नियमित रूप से पद भरे जाने तक या अगले आदेशों, जो भी पहले हो, तक के लिए नियुक्त करते हैं।

2. तदर्थ पदोन्नति निम्नलिखित शर्तों के अध्यधीन हैः-

(i) यह तदर्थ पदोन्नति अधिकारी को इस ग्रेड में अनिश्चित समय के लिए लगातार रहने या नियमित नियुक्ति के लिए चयन सूची में शामिल होने के लिए या सीएसएस के ग्रेड-1 (अवर सचिव) में वरिष्ठता का दावा करने का कोई अधिकार नहीं देगी।

(ii) तदर्थ नियुक्ति को किसी भी समय बिना कोई कारण बताए निरस्त किया जा सकता है। (iii) ग्रेड-1 (अवर सचिव) में तदर्थ आधार पर की गई सेवाओं की गणना उस ग्रेड में वरिष्ठता या अगली उच्चतर ग्रेड में पदोन्नति के लिए नहीं की जाएगी।

(iv) तदर्थ आधार पर पदोन्नति एसएलपी (सी) 30621/2011 (जनरैल सिंह और अन्य बनाम लछमी नारायण गुप्ता और अन्य) एसएलपी (सी) सं. 31288/2017, एसएलपी (सी) सं. 5724-5725/2019 मामले में और अन्य किसी न्यायालय के इस से जुड़े मामलों के फैसले के अध्यधीन होगी।

(v) यदि अधिकारी ने स्तर (घ) के अनिवार्य प्रािशक्षण में भाग नहीं लिया है, तो कार्मिक एवं प्रशिक्षण विभाग द्वारा नामित किये जाने पर इस प्रशिक्षण को सफलतापूर्वक पूरा करना अपेक्षित होगा।

2. तदर्थ पदोन्नति निम्नलिखित शर्तों के अध्यधीन हैः-

(i) यह तदर्थ पदोन्नति अधिकारी को इस ग्रेड में अनिश्चित समय के लिए लगातार बने रहने या नियमित नियुक्ति के लिए चयन सूची में शामिल होने के लिए या सीएसएस के ग्रेड-1 (अवर सचिव) में वरिष्ठता का दावा करने का कोई अधिकार नहीं देगी।

(ii) तदर्थ नियुक्ति को किसी भी समय बिना कोई कारण बताए निरस्त किया जा सकता है।

(iii) ग्रेड-I (अवर सचिव) में तदर्थ आधार पर की गई सेवाओं की गणना उस ग्रेड में वरिष्ठता या अगली उच्चतर ग्रेड में पदोन्नति के लिए नहीं की जाएगी।

(iv) तदर्थ आधार पर पदोन्नति एसएलपी (सी) 30621/2011 (जनरैल सिंह और अन्य बनाम लछमी नारायण गुप्ता और अन्य) एसएलपी (सी) सं. 31288/2017, एसएलपी (सी) सं. 5724-5725/2019 मामले में और अन्य किसी न्यायालय के इस से जुड़े मामलों के फैसले के अध्यधीन होगी।

II (ए) दिनांक 27.11.2018 द्वारा केद्रीय सचिवालय आशुलिपिक सेवा के निजी सचिव के ग्रेड में तदर्थ आधार पर नियुक्ति किए जाने के परिणामस्वरूप, श्री प्रिय रंजन मिश्रा को दिनांक 15 फरवरी, 2019 (पूर्वाहन) से दिनांक 30.06.2019 तक अथवा केन्द्रीय सचिवालय आषुपिलिक सेवा (सीएसएसएस) के निममित निजी सचिव (पीएस) के उपलब्ध होने तक, जो भी पहले हो, निजी सचिव (पीएस) ग्रेड में पूर्णतः तदर्थ आधार पर एतद्‌द्वारा पर्यावरण, वन और जलवायु परिवर्तन मंत्रालय की नफरी पर लिया जाता है।

2. यह तदर्थ प्रोन्नति निम्नलिखित शर्तों के अध्यधीन हेः-- (i) इस तदर्थ पदोन्नति से इस ग्रेड में अनिश्चित काल तक बने रहने या नियमित नियुक्ति के लिए चयन सूची में शामिल किए जाने या केन्द्रीय सचिवालय आशुलिपिक सेवा के निजी सचिव ग्रेड में वरिष्ठता का दावा करने का कोई अधिकार प्राप्त नहीं होगा;

(ii) इस तदर्थ नियुक्ति को किसी भी समय बिना कोई कारण बताए निरस्त किया जा सकता है; (iii) निजी सचिव ग्रेड में तदर्थ आधार पर की गई सेवा की उक्त ग्रेड में वरिष्ठता के प्रयोजन से अथवा अगले उच्चतर ग्रेड में प्रोन्नति के लिए गणना नहीं की जाएगी;

(iv) यह नियुक्ति कार्मिक एवं प्रशिक्षण विभाग के का.ज्ञा. सं. 2203141412012-स्थापना (डी), दिनांक 02.11.2012 के संदर्भ में सतर्कता निकासी और उक्त विषय संबंधी अन्य संगत अनुदेशों के अध्यधीन है। जिस मंत्रालय/विभाग में अधिकारी कार्यरत है, वह उनकी प्रोन्नति यह सत्यापित करने के बाद ही करेगा कि उस अधिकारी के विरूद्ध कोई भी अनुशासनिक कार्यवाही लम्बित या प्रारंभ किए जाने का विचार नहीं है;

(v) जो अधिकारी तदर्थ प्रोन्नति को स्वीकार करने में विफल रहेंगे, उन पर इस प्रोन्नति आदेश को जारी किए जाने की तारीख से एक वर्ष की अवधि के लिए तदर्थ प्रोन्नति पर विचार नहीं किया जाएगा;

(vi) पंजाब और हरियाण के माननीय उच्च न्यायालय द्वारा सीडब्ल्यूपी सं. 13218/2009 में दिनांक 15.07.2011 को पारित अंतिम निर्णय और आदेश से उत्पन्न एसएलपी (सि.) सं. 30621/2011 तथा माननीय उच्चतम न्यायालय के समक्ष अन्य संबंधित मामले;

(vii) अखिल भारतीय समानता मंच और अन्य बनाम भारत संघ और अन्य द्वारा दायर डब्ल्यूपी (सि.) सं. 3490/2010 में तथा किसी सक्षम न्यायालय में अन्य संबंधित न्यायिक मामलों में माननीय न्यायालय के दिनांक 23.08.2017 के निर्णय से उत्पन्न एसएलपी (सि.) सं. 31288/2017;

(viii) ओए सं. 2891/2015 के साथ ओए सं. 2883/2015 और कैट, पीबी में पुनरीक्षण याचिका आरए सं. 266/2016 से उत्पन्न माननीय उच्च न्यायालय के पास लम्बित भारत संघ और एएनआर बनाम हिमांशु प्रभाकर और अन्य में डब्ल्यूपी (सि.) सं. 1738/2017;

(ix) संबंधित मामले से जुड़ा कोई अन्य न्यायिक मामला।

2. यह तदर्थ प्रोन्नति निम्नलिखित शर्तों के अध्यधीन हैः--

(i) इस तदर्थ पदोन्नति से इस ग्रेड में अनिश्चित काल तक बने रहने या नियमित नियुक्ति के लिए चयन सूची में शामिल किए जाने या केन्द्रीय सचिवालय आशुलिपिक सेवा के निजी सचिव ग्रेड में वरिष्ठता का दावा करने का कोई अधिकार प्राप्त नहीं होगा;
