2. उपर्युक्त निुयक्ति 30.06.2019 तक की अवधि अथवा पद के नियमित पदोन्नति से भरे जाने तक अथवा अगले आदेशों तक, जो भी पहले हो, के लिए पूर्णतः तदर्थ आधार पर की जा रही है। तदर्थ पदोन्नति इन्हें अनिश्चित अवधि के लिए ग्रेड में बने रहने अथवा नियमित नियुक्ति के लिए चयन सूची में शामिल होने अथवा सीएसएस के अवर सचिव के चयन गे्रड-1 में वरिष्ठता का दावा करने का कोई अधिकार प्रदान नहीं करेगी। सरकार किसी भी समय बिना कोई कारण देते हुए उपर्युक्त तदर्थ नियुक्ति को समाप्त करने का अधिकार सुरक्षित रखती है।

3. तद्‌र्थ पदोन्नति एसएलपी (सी) सं. 30621/2011 (जरनैल सिंह एवं अन्य बनाम लक्ष्मी नारायण गुप्ता तथा अन्य) तथा एसएलपी (सी) सं. 31288/2017, एसएलपी (सी) सं. 5724-5725/2019 तथा संबद्ध मामले में किसी अन्य न्यायालय मामले के परिणाम के अध्यधीन रहेगी।

(iv.) तदर्थ प्रोन्नति पंजाब और हरियाणा के माननीय उच्च न्यायालय द्वारा पारित सीडब्ल्यूपी सं. 13218/2009 में अंतिम निर्णय एवं आदेश दिनांक 15.07.2011 और माननीय उच्चतम न्यायालय के समक्ष प्रस्तुत अन्य संबंध मामलों के आधार पर तैयार एसएलपी © सं. 30621/2011 के अध्यधीन होगी।
