2. The Appointment is subject to final outcome of the following :—

No. A.12031/01/2019-Admn.—The President is pleased to appoint Shri Amber Dubey as Joint Secretary in the Ministry of Civil Aviation on contract basis under lateral recruitment policy in the Level-14 of Pay Matrix for a period of three years w.e.f. the forenoon of 19.09.2019 or until further orders, whichever is earlier, in pursuance of DoP&T's O.M. No. 14017/05/2019-Estt.RR dated 31.08.2019.
2. The appointment of Shri Amber Dubey as Joint Secretary in this Ministry is subject to the following terms and conditions:—
(i) The appointment is provisional and subject to verification of the veracity of the certificates of educational qualification.
(ii) The provisions of CCS (Conduct) Rules, 1964 and CCS (CCA) Rules, 1965, or any other rules made or deemed to be made under Article 309 or contained under Article 313 of the Constitution shall apply to the officer and the decision of the Government as to their applicability shall be final.
(iii) The officer shall receive in Indian currency through a bank account in India, pay, as admissible to the Joint Secretary to the Government of India (Rs. 144200 – 218200 per month in Level 14 of Pay Matrix) and allowances thereon paid or payable by the Central Government. The aforesaid pay and allowances shall be paid to the officer for such time as he shall serve under the Contract Agreement and actually perform his duties. If at any time, the officer proceeds on tour abroad, his pay during the period of such tour, shall be regulated by the Central Government rules and orders.
(iv) The headquarters of the officer shall be New Delhi. The officer will not be entitled for any compensation for taking over the assignment at the headquarters at the time of initial appointment.
(v) The officer shall be entitled to Government residential accommodation on the same terms as applicable for officers serving in equivalent posts. In the alternative, if he opts to reside in his own accommodation, he will be entitled to House Rent Allowance as per extant rules.
(vi) The officer will be entitled to travelling allowance and other allowances as admissible to equivalent level of officers in the Government of India on transfer for the journey of the officer and his family members for taking over his assignment at the headquarters.
(vii) If the officer is required to travel in the interest of the public service, he shall be entitled to travelling allowance on the scale provided for in the rules supplementary to the Fundamental Rules framed by the Government from time to time in force and applicable to the officers of his level.
(viii) The officer will not be eligible to join any retirement scheme of Government of India.
(ix) The officer will be entitled to Earned Leave, Half Pay Leave/Commuted Leave, Extraordinary Leave and leave encashment in terms of DoPT's OM No. 12016/3/1984-Estt. (L) dated 12.04.1985 as amended by OM No. 12016/1/90-Estt.(L) dated 05.07.1990, No. 12016/2/99-Esstt (L) dated 12.07.1999 and No. 12016/5/2009- Estt.(L) dated 31.01.2011 and any subsequent amendments made in the matter.
(x) The officer shall, during the contract period, be eligible for all concessions in relation to medical attendance and treatment that may be prescribed by the Government for the class of officers serving in the equivalent post to which the Government may declare the officer to correspond in status or in conditions of service, subject to the payment by him of contribution as applicable, under the prescribed rules.
PART I—SEC. 2] THE GAZETTE OF INDIA, OCTOBER 26, 2019 (KARTIKA 4, 1941) 1271(xi) Upon successful completion of contract, it will be open to the Government to offer a similar assignment to the officer for a further period of one year at a time. However, in no case shall the aggregate period of contract exceed five years including the initial three years period mentioned in the contract.
3. In addition to the above, all other terms & conditions as mentioned in Contract Agreement signed between Shri Amber Dubey and Government of India would be applicable for said appointment.
