सं. आई-14011/11/2017-आईपीएस-1(III)—माननीय उच्च न्यायालय, दिल्ली द्वारा रिट याचिका संख्या (सी) 3626/2014 में पारित आदेश दिनांक 24.12.2014 के आलोक में, भारतीय पुलिस सेवा (पदोन्नति द्वारा नियुक्ति) विनियम, 1955 के विनियम 7 के उप-विनियम (3) में निहित उपबंधों का प्रयोग करते हुए संघ लोक सेवा आयोग ने दिनांक 21.08.2019 को चयन समिति की दिनांक 21.06.2019 की रिव्यू बैठक को अनुमोदित कर दिया है, जिसके परिणामस्वरुप श्री राजन भगत को चयन सूची 2013 के क्रम संख्या 1ए पर जो श्री जगजीत सिंह देसवाल क्रम संख्या 01 और श्री शरत कुमार सिन्हा क्रम संख्या 2 के बीच में सम्मलित किए जाने के पश्चात, राष्ट्रपति, भारतीय पुलिस सेवा (पदोन्नति द्वारा नियुक्ति) विनियम, 1955 के विनियम 9 के उप-विनियम (1) के साथ पठित भारतीय पुलिस सेवा (भर्ती) विनियम, 1954 के विनियम 9 के उप-विनियम (1) में प्रदत्त शक्तियों का प्रयोग करते हुए, श्री राजन भगत (जन्मतिथिः 02.04.1960) को भारतीय पुलिस सेवा में परिवीक्षा पर नियुक्त करते हैं तथा उन्हें भारतीय पुलिस सेवा (संवर्ग) विनियम, 1954 के विनियम 5 के उप-विनियम (1) के अन्तर्गत युटी खण्ड के संयुक्त एजीएमयूटी संवर्ग प्रदान करते हैं।

2. यह नियुक्ति दिनांक 15.07.2014 को अधिसूचित की गई अधिसूचना संख्या आई-14011/4/2014-आईपीएस.1(II) दिनांक 15.07.2014 के जारी होने की तिथि से प्रभावी होगी। इसके अलावा, श्री राजन भगत की नियुक्ति भारत सरकार के अंतिम निर्णय या कोर्ट के आदेशों का पालन करती है, के अध्यधीन होंगी ।

3. उपरोक्त अधिकारी भारतीय पुलिस सेवा (परिवीक्षा) विनियम, 1954, के तहत एक वर्ष के लिये परिवीक्षा पर रहेंगे और भारतीय पुलिस सेवा (परिवीक्षा) विनियम, 1954 के नियम 5 (4) में संशोधन दिनांक 10.05.2011 के तहत अधिकारी को इंडक्शन प्रशिक्षण प्राप्त करना होगा।

2. माननीय केन्द्रीय प्रशासनिक अधिकरण, मुम्बई पीठ द्वारा श्री डी. के. सकोरे द्वारा दायर ओ. ए. संख्या 722/2014 एवं श्री डी. टी. शिन्दे द्वारा दायर ओ. ए. संख्या 745/2014 में पारित आदेश दिनांक 02.05.2018 के आलोक में श्री डी. के. सकोरे और श्री डी. टी. शिन्दे के नामों को भारतीय पुलिस सेवा के महाराष्ट्र संवर्ग में 2012 की चयन सूची से प्रोन्नति हेतु दिनांक 02.07.2019 को आयोजित रिव्यू चयन समिति की बैठक की अनुसशंसा जिसे संघ लोक सेवा आयोग ने दिनांक 28.08.2019 को अनुमोदित कर दिया है, जिसके परिणामस्वरूप श्री डी. के. सकोरे और श्री डी. टी. शिन्दे के नामों को चयन सूची 2012 की क्रम संख्या जो पैरा 1 में वर्णित है, को किये जाने के लिए संघ लोक सेवा आयोग के पत्र संख्या 7/11(1)/2019-ए आई एस दिनांक 28.08.2019 को राष्ट्रपति, भारतीय पुलिस सेवा (पदोन्नति द्वारा नियुक्ति) विनियम, 1955 के विनियम 9 के उप-विनियनम (1) के साथ पठित भारतीय पुलिस सेवा (भर्ती) विनियम, 1954 के विनियम 9 के उप-विनियम (2) में प्रदत्त शक्तियों का प्रयोग करते हुए, महाराष्ट्र पुलिस सेवा के श्री डी. के. सकोरे (जन्म तिथिः 31.07.1971) एवं श्री डी. टी. शिन्दे (जन्म तिथिः 01.10.1970) (पूर्व में 2014 की चयन सूची में भारतीय पुलिस सेवा में सम्मिलित थे) को चयन सूची 2012 से समस्त परिणामी लाभांषों सहित महाराष्ट्र संवर्ग प्रदान करते हैं।

3. श्री डी. के. सकोरे की नियुक्ति श्री पी. वी. उगले, चयन सूची 2012 जो कि उक्त अधिकारी के तत्काल कनिष्ठ अधिकारी की नियुक्ति तिथि 08.01.2014 से एवं श्री डी. टी. शिन्दे की नियुक्ति श्री वी. जी. पाटिल उनके वरिष्ठ अधिकारी की नियुक्ति तिथि 08.01.2014 से प्रभावी होगी। इसके अलावा, श्री डी. के. सकोरे एवं श्री डी. टी. शिन्दे की नियुक्तियां भारत सरकार के अंतिम निर्णय या कोर्ट के आदेशों का पालन करती है, के अध्यधीन होंगी।

No. A-32014/02/2018-Admn.IV(LA):—The President is pleased to extend the tenure of appointment of following regular Personal Assistants of CSSS Cadre of Ministry of Law and Justice (Department of Legal Affairs and Legislative Department) as Private Secretary on ad-hoc basis in the Pay Matrix Level 8 in the CSSS Cadre of the said Ministry for the period upto 31st December, 2019 or date of superannuation or date of their regular appointment or till further order in the grade, whichever is the earliest:—

2. In terms of Department of Personnel and Training O.M. No.4/2/2018-CS.II(A) dated 03.07.2019, the above said ad-hoc extension is subject to the following conditions:—

(i) The ad-hoc appointment shall not confer on the appointees any right to continue in the grade indefinitely or for inclusion in the Select List of Private Secretaries for regular appointment or to claim seniority in the Private Secretaries grade of CSSS.

(ii) Ad-hoc appointment would continue till regular candidates in Private Secretaries grade are available either through Seniority Quota or Limited Departmental Competitive Examination (LDCE). In the event of ad-hoc appointees not qualifying for regular appointment in either of these two categories, they shall be reverted to the Personal Assistants' grade on availability of such regular officers from the date the regular Private Secretaries join duty in their respective cadre units allotted to them by DoP&T.

(iii) The officer(s) who fail to avail ad-hoc promotion would not be considered for ad-hoc promotion for a period of one year from the date of issue of promotion order.

(iv) The SLP (C) No.30621/2011 arising out of the final judgement and order dated 15.07.2011 in CWP No.13218/2009 passed by the Hon'ble Court of Punjab & Haryana and other connected cases before the Hon'ble Supreme Court.

(v) The SLP (C) No. 31288/2017 arising out of the Hon'ble Delhi High Court judgement dated 23.08.2017 in WP (C) No. 3490/2010 filed by the All India Equality Forum & Ors. Vs. UOI & Ors. and other related court cases in any competent court.

(vi) The WP (C) No.1738/2017 in UOI & ANR Vs. Himanshu Prabhakar & Ors. Pending before Hon'ble Delhi High Court arising out of O.A. No.2883/2015 with O.A. No.2891/2015 and Review Petitition RA No.266/2016 in CAT, PB, New Delhi.

(vii) Any other court cases in a connected matter.

2. The appointment will take effect from 15.07.2014 in continuation to this Ministry's Notification No. I.14011/4/2014-IPS.I (I) & (II) dated 15.07.2014. Further, the appointment of Shri Rajan Bhagat is subject to the final decision of the Govt. of India and Court orders if any, on the matter of interpolation.

3. The aforesaid officer will remain on probation for one year as per rule of Indian Police Service (Probation) Rules, 1954 and the officers will obtain induction training as per sub rule 5(4) of Indian Police Service (Probation) Rules, 1954 as amended dated 10.05.2011.
