(ii) एनसीएल के सभी खण्डों की नियमावली के अध्याय XII के उपनियम 8 की व्याख्या 2 को निम्ननुसार संशोधित किया जाना प्रस्तावित है (काटे गए शब्दों को हटाना और मोटे अक्षरों को शामिल करना है)ः—
क्लीयरिंग कॉर्पोरेशन चूक न करने वाले क्लीयरिंग सदस्यों की सीएसजीएफ में उनके द्वारा आवश्यक प्राथमिक योगदान के गुणज में अतिरिक्त योगदान के दायित्व को सीमित करेगा और उसके संबंध में रूपरेखा की घोषणा की जाएगी। चूक न करने वाले सदस्यों सेPART IV] THE GAZETTE OF INDIA, FEBRUARY 22, 2020 (PHALGUNA 3, 1941) 369 ली जाने वाली राशि में कमी के मामले में आगे हानि को सेबी की मंजूरी से 'एफ' लेयर में आबंटित किया जा सकता है।
(i) क्लीयरिंग कॉर्पोरेशन 30 दिन की अवधि के दौरान केवल एक बार टोपित अतिरिक्त योगदान के लिए मांग करेगा चाहे अवधि के दौरान कितनी भी बार चूक की गई हो। 30 दिन की अवधि मार्केट भागीदार को क्लीयरिंग कॉर्पोरेशन द्वारा जारी नोटिस की तिथि से शुरू होगी।
(ii) क्लीयरिंग कॉर्पोरेशन के पास चूक न करने वाले सदस्यों के लिए बिना शर्त 30 दिन की उक्त अवधि के अंदर त्यागपत्र देने के लिए उचित विनियम/प्रावधान होंगे, जो कोई भी बकाया पॉजिशन्स को क्लोजिंग आउट/निपटान करने वाले सदस्य, अतिरिक्त टोपित योगदान के भुगतान और सेबी को देय किसी भी बकाया पर निर्भर होगा।
(iii) इक्विटी/ऋण खण्ड के मामले में चूक न करने वाले सदस्यों द्वारा टोपित अतिरिक्त अधिकतम योगदान कोर एसजीएफ में उनके प्राथमिक योगदान से दो गुणा कम या चूक की तिथि को खण्ड के कोर एसजीएफ का 10 प्रतिशत होगा।
(iv) डेरिवेटिव्स खण्ड के मामले में चूक न करने वाले सदस्यों द्वारा टोपित अतिरिक्त अधिकतम योगदान कोर एसजीएफ में उनके प्राथमिक योगदान से दो गुणा कम या चूक की तिथि को खण्ड के कोर एसजीएफ का 20 प्रतिशत होगा।
(v) चूक न करने वाले सदस्यों से मूल्यांकित धनराशि की रिकवरी में कमी के मामले में आगे हानि को सेबी की मंजूरी से 'एफ' लेयर में आबंटित किया जा सकता है।

(iii) कोमोडिटी डेरिवेटिव्स के लिए उननियमावली के अध्याय VI के उपनियम 14 (5) को निम्नानुसार संशोधित किया जाना प्रस्तावित है (काटे गए शब्दों को हटाना और मोटे अक्षरों को शामिल करना है)ः

The draft amendments to NCL Rules and Byelaws (Capital Market, Futures & Options, Currency Derivatives and Commodity segment) as given hereunder are published for criticism in accordance with the provisions of Section 23 of the General Clauses Act, 1897 in the Official Gazette of India.
370 THE GAZETTE OF INDIA, FEBRUARY 22, 2020 (PHALGUNA 3, 1941) [PART IVAny person having any observations on the proposed amendments to the said Regulations can send the same in writing to the undersigned at the Exchange Plaza, C-1, Block G, Bandra-Kurla Complex, Bandra (East), Mumbai - 400 051 within 15 days from the date of this publication in the Gazette. The observations received after the aforementioned date will not be considered when the draft amendment will be taken for consideration:—
(a) The definition of term Relevant Authority in Chapter 1 of the Byelaws and Rules of all segments of NCL is proposed to be amended (by deletion of the words in strikethrough mode) as under:—
"Relevant Authority" means the Board, Securities and Exchange Board of India or such other authority as specified by the Board from time to time as relevant for a specified purpose.
(b) (i) The existing Byelaw 7 (3) of Chapter XII of the Byelaws of all segments of NCL is proposed to be amended (by insertion of the words in bold) as under:—
In the event of usage of Core SGF during a calendar month, contributors shall, as per usage of their individual contribution, immediately replenish the Core SGF to MRC. However, such contribution towards replenishment of Core SGF by the members would be restricted to only once during a period of 30 calendar days regardless of the number of defaults during the period. The period of 30 calendar days shall commence from the date of notice of default by Clearing Corporation to market participants.
(ii) the Explanation 2 to Byelaw 8 of Chapter XII of the Byelaws of all segments of NCL is proposed to be amended (by deletion of the words in strikethrough mode and insertion of the words in bold) as under:—

Clearing Corporation shall limit the liability of non-defaulting Clearing Members towards additional contribution to a multiple of their required primary contribution to CSGF and the framework regarding the same shall be disclosed. In case of shortfall in recovery of assessed amounts from non- defaulting Clearing Members, further loss can be allocated to layer 'f' with approval of SEBI.
(i) Clearing Corporation shall call for the capped additional contribution only once during a period of 30 calendar days regardless of the number of defaults during the period. The period of 30 calendar days shall commence from the date of notice of default by CC to market participants.
(ii) Clearing Corporation shall have relevant regulations/provisions for non - defaulting members to resign unconditionally within the abovementioned period of 30 calendar days, subject to member closing out/settling any outstanding positions, paying the capped additional contribution and any outstanding dues to SEBI. No further contribution shall be called from such resigned members.
(iii) The maximum capped additional contribution by non - defaulting members shall be lower of 2 times of their primary contribution to Core SGF or 10% of the Core SGF of the segment on the date of default in case of equity/debt segments.
(iv) The maximum capped additional contribution by non - defaulting members shall be lower of 2 times of their primary contribution to Core SGF or 20% of the Core SGF of the segment on the date of default in case of derivatives segment.
(v) In case of shortfall in recovery of assessed amounts from non -defaulting members, further loss can be allocated to layer 'f' with approval of SEBI.

(iii) Byelaw 14(5) of Chapter VI of Byelaws for Commodity Derivatives segment is proposed to be amended (by deletion of the words in strikethrough mode and insertion of the words in bold) as under:—

Notwithstanding anything contained in the Bye-laws, the Clearing Corporation shall ensure guarantee for settlement of trades including good delivery.
Explanation: For the purpose of this clause, Good delivery for the purpose of this clause shall mean the delivery of goods that is in proper form to transfer title and is of the that goods of the same quality and quantity as transacted for are delivered by the delivering member as per the contract specifications of the Specified Exchange.

(iv) The collection of stamp duty is proposed to be included in the Regulations of all segments of NCL by addition of a new clause in Chapter 2 of the Regulations of all the segments of NCL after the existing Clause on collection of Securities Transaction Tax/Commodity Transaction tax:—

As per authorisation received from Stock Exchange(s), the Clearing Corporation shall collect the Stamp Duty.
