भारतीय प्रतिभूति और विनिमय बोर्ड (''सेबी'') के अध्यधीन, मल्टी कमाडिटी एक्सचेंज क्लीयरिंग कारपोरेशन लिमिटेड (''एमसीएक्ससीसीएल'') के उप-नियमों में निम्नलिखित संशोधन करने का प्रस्ताव है। प्रस्तावित संशोधनों को सूचना/सार्वजनिक टिप्पणी/ आलोचना के लिए प्रतिभूति संविदा (विनियमन) नियम, 1957 के नियम 18 के तहत प्रकाशित किया जाता है। उप-नियमों के प्रस्तावित संशोधनों पर कोई टिप्पणी/प्रेक्षण रखने वाला कोई व्यक्ति इसे इस प्रकाशन की तारीख से पन्द्रह दिन के भीतर अधोहस्ताक्षरी के मल्टी कमाडिटी एक्सचेंज क्लीयरिंग कारपोरेशन लिमिटेड, एक्सचेंज स्केयर, सीटीएस सं. 255, सुरेन रोड, चकाला, अंधेरी (पूर्व), मुंबई-400093 या ई-मेल के माध्यम से [email protected]उ को भेज सकता है। पन्द्रहवें दिन के पश्चात प्राप्त टिप्पणी/प्रेक्षणों पर विचार नहीं किया जाएगा और मसौदे को पन्द्रह दिन की समाप्ति के पश्चात तत्काल विचार के लिए लिया जाएगा।
एमसीएक्ससीसीएल के उप-नियमों में प्रस्तावित संशोधन
1. एमसीएक्ससीसीएल के उप-नियमों के उप-नियम 13.4.2 में ''एमआरसी के लिए कोर एसजीएफ'' शब्दों के पश्चात निम्नलिखित पैरा को अंतःस्थापित किया जाएगा,
''तथापि, सदस्यों द्वारा कोर एसजीएफ की पुनःपूर्ति के प्रति ऐसे अंशदान को अवधि के दौरान चूक की संख्या पर ध्यान दिए बिना 30 कैलेंडर दिनों की अवधि के दौरान एक बार तक सीमित किया जाएगा। 30 कैलेंडर दिनों की अवधि बाजार भागीदारों को क्लीयरिंग कारपोरेशन द्वारा चूक के नोटिस की तारीख से शुरू होगी।''
2. एमसीएक्ससीसीएल उप-नियमों के उप-नियम 13.5.1 में परंतुक के खंड (छ) में मौजूदा नोट को निम्न से प्रतिस्थापित किया जाएगा :-
(i) क्लीयरिंग कारपोरेशन अवधि के दौरान चूक की संख्या पर ध्यान दिए बने 30 कैलेंडर दिनों की अवधि के दौरान केवल एक बार टोपित (कैप्ट) अतिरिक्त अंशदान के लिए मांग करेगा। 30 कैलेंडर दिनों की अवधि बाजार भागीदारों को क्लीयरिंग कारपोरेशन द्वारा चूक के नोटिस की तारीख से शुरू होगी।
(ii) क्लीयरिंग कारपोरेशन के पास 30 कैलेंडर दिनों की उपरोक्त अवधि के भीतर बेशर्त त्याग देने के लिए गैर-चूककर्ता सदस्यों के लिए संगत विनियम/प्रावधान होंगे, जो सदस्य की किसी बकाया स्थिति की क्लोजिंग आउट/निपटान करने, टोपित अतिरिक्त अंशदान अदा करना और सेबी को किसी बकाया देय के अध्यधीन होगा। ऐसे किए गए सदस्यों से और कोई अंशदान ही नहीं मांगा जाएगा।
(iii) गैर-चूककर्ता सदस्यों द्वारा अधिकतम-टोपित अतिरिक्त अंशदान कोर एसजीएफ के लिए उनके प्राइमरी अंशदान के दुगने से कम होगा या इक्विटी/ऋण खंड के मामले में चूक की तारीख को खंड के कोर एसजीएफ का 10 प्रतिशत होगा।
(iv) गैर-चूककर्ता सदस्यों द्वारा अधिकतम-टोपित अतिरिक्त अंशदान कोर एसजीएफ के लिए उनके प्राइमरी अंशदान के दुगने से कम होगा या डेरीवेटिव खंड के मामले में चूक की तारीख को खंड के कोर एसजीएफ का 20 प्रतिशत होगा।
(v) गैर-चूककर्ता सदस्यों से निर्धारित राशियों की वसूली में कमी के मामले में और हानि को सेबी के अनुमोदन से लेयर ''च'' को आवंटित किया जा सकता है।

MULTI COMMODITY EXCHANGE CLEARING CORPORATION LIMITED Subject Securities and Exchange Board of India's ("SEBI") approval, it is proposed to make the following amendments in the Bye-laws of Multi Commodity Exchange Clearing Corporation Limited ("MCXCCL"). The proposed amendments are published under Rule 18 of Securities Contracts (Regulation) Rules, 1957 for information/public comments/criticism. PROPOSED AMENDMENTS IN THE BYE-LAWS OF MCXCCL
1. In Bye law 13.4.2 of MCXCCL Bye-laws, the following para shall be inserted after the words " Core SGF to the MRC".
"However, such contribution towards replenishment of Core SGF by the members would be restricted to only once during a period of 30 calendar days regardless of the number of defaults during the period. The period of 30 calendar days shall commence from the date of notice of default by Clearing Corporation to market participants. Note:
i. Clearing Corporation shall call for the capped additional contribution only once during a period of 30 calendar days regardless of the number of defaults during the period. The period of 30 calendar days shall commence from the date of notice of default by the Clearing Corporation to market participants.
ii. Clearing Corporation shall have relevant regulations/provisions for non-defaulting members to resign un- conditionally within the abovementioned period of 30 calendar days, subject to member closing out/settling any outstanding positions, paying the capped additional contribution and any outstanding dues to SEBI. No further contribution shall be called from such resigned members.
iii. The maximum-capped additional contribution by non-defaulting members shall be lower of 2 times of their primary contribution to Core SGF or 10% of the Core SGF of the segment on the date of default in case of equity/ debt segments.
iv. The maximum-capped additional contribution by non-defaulting members shall be lower of 2 times of their primary contribution to Core SGF or 20% of the Core SGF of the segment on the date of default in case of derivatives segment.
v. In case of shortfall in recovery of assessed amounts from non-defaulting members, further loss can be allocated to layer "f" with approval of SEBI.
