आदेश से,

अनुज जयपुरियार, वरिष्ठ प्रधान सचिव1876 GI/2020 (69) 70 THE GAZETTE OF INDIA : MAY 9, 2020/VAISAKHA 19, 1942 [PART II—SEC. 3(iii)] ELECTION COMMISSION OF INDIA New Delhi, the 5th May, 2020 O. N. 23.—In pursuance of section 106 of the Representation of the People Act, 1951 (43 of 1951), the Election Commission of India hereby publishes the Judgement dated 12th February, 2020 of the High Court of Judicature at Allahabad in Election Petition No. 4 of 2019.

IN THE HIGH COURT OF JUDICATURE AT ALLAHABAD

ELECTION PETITION NO. 4 OF 2019

(Under Section 80, 84, 98 & 99 of Representation of the People Act 1951)

DISTRICT: MAU

Hari Narayan son of Bhagirathi

Resident of Village-Tangunia Post Chainpur

District-Ballia. ...... Election Petitioner.

….

Court No. - 29

Case :- ELECTION PETITION No. - 4 of 2019

Petitioner :- Hari Narayan

Respondent :- Atul Kumar Singh

Counsel for Petitioner :- Hari Narayan ( In Person ), Sudist Kumar

Counsel for Respondent :- Ajay Srivastava, Shiv Bahadur Singh

Hon'ble Pankaj Mithal, J.

Heard Sri Sudist Kumar, learned counsel for the petitioner and Sri S.B. Singh and Sri Ajay Srivastava, learned counsel for the respondent.

The petitioner is an unsuccessful candidate in the Parliamentary Elections, 2019 from 70 Ghosi Parliamentary Constituency. He has challenged the election of the respondent.

After the written statement was filed by the respondent and an application was moved to reject the plaint under Order 7 Rule 11 C.P.C., petitioner was given time to file replica and reply to the application filed under Order 7 Rule 11 C.P.C., but till date there is no response from the side of the petitioner.

On the last occasion i.e. 08.01.2020, the matter was adjourned as Sri Sudist Kumar sought time of two weeks for filing replica and reply to the application filed under Order 7 Rule 11 C.P.C. Earlier also, time in this regard was allowed to him.

Today, he submits that the petitioner is not responding and he is not receiving any instructions whatsoever from him so as to press this petition.

The fact that the counsel is not receiving instructions amply demonstrates that the petitioner is no longer interested in pursuing this petition.

Accordingly, the Court is left with no option but to dismiss the petition for want of prosecution.

The Election Petition is, therefore, dismissed and is directed to be consigned to record.
