आ. अ. 25.—यतः, मिजोरम विधान सभा के साधारण निर्वाचन, 2018 की घोषणा भारत निर्वाचन आयोग द्वारा प्रेस नोट संख्या ईसीआई/पीएन/66/2018 दिनांक 6.10.2018 के तहत की गई थी। अनुसूची के अनुसार, मतगणना की तारीख 11.12.2018 थीः
और यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले अभ्यर्थी को, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर अपने निर्वाचन व्ययों के लेखों की सही प्रति जिला निर्वाचन अधिकारी को प्रस्तुत करनी होती है;

(75)76 THE GAZETTE OF INDIA : JUNE 13, 2020/JYAISTHA 23, 1942 [PART II—SEC. 3(iii)] और यतः, 2-डम्पा (अ.ज.जा) और 3-मामित (अ.ज.जा.) विधान सभा निर्वाचन क्षेत्रों के संबिद्धत रिटनिग ऑफिसर द्वारा उक्त निर्वाचन के परिणाम 11.12.2018 को घोषित किए गए थे। इस प्रकार निर्वाचन व्ययों के लेखे दाखिल करने की अन्तिम तारीख 10.01.2019 थी;
और यतः, जिला निर्वाचन अधिकारी, मामित जिला, मिजोरम द्वारा प्रस्तुत और मुख्य निर्वाचन अधिकारी द्वारा अपने दिनांक 26.04.2019 के पत्र संख्या एच.11016/2/2019-सीईओ के तहत अग्रेषित दिनांक 11.01.2019 की रिपोर्ट के अनुसार श्री लालाव्मपुइया छांगते, जो मिजोरम के 2-डम्पा (अ.ज.जा) और 3-मामित (अ.ज.जा.) विधान सभा निर्वाचन क्षेत्रों से निर्वाचन लड़ने वाले नेशनलिस्ट कांग्रेस पार्टी के अभ्यर्थी हैं, विधि द्वारा यथा अपेक्षित अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे हैं;
और यतः, जिला निर्वाचन अधिकारी, मामित जिला, मिजोरम और मुख्य निर्वाचन अधिकारी, मिजोरम की रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचन का संचालन नियम, 1961 के नियम 89 के उप नियम (5) के अंतर्गत श्री लालाव्मपुइया छांगते को निर्वाचन संबंधी व्यय प्रस्तुत नहीं करने के लिए दिनांक 18.07.2019 को कारण बताओ नोटिस जारी किया गया था;
और यत:, दिनांक 18.07.2019 के उपयु र्क्त कारण बताओ नोटिस के जरिए निर्वाचन के संचालन नियम, 1961 के नियम 89 के उप-नियम (6) के अनुसार, श्री लालाव्मपुइया छांगते को अपना अभ्यावेदन, जिसमें लेखों को प्रस्तुत न किए जाने संबंधी कारणों को स्पष्ट किया गया हो, आयोग को प्रस्तुत करने और निर्वाचन व्यय संबंधी अपने लेखों को दाखिल करने/अपने लेखों में कमियों को संशोधित करने और इन्हें इस नोटिस के प्राप्त होने के 20 दिनों के अंदर जिला निर्वाचन अधिकारी को प्रस्तुत करने के लिए लिखित में निदेश दिया गया था;
और यत:, उक्त नोटिस श्री लालाव्मपुइया छांगते ने दिनांक 10.08.2019 को प्राप्त किया था। अभ्यर्थी से प्राप्त पावती रसीद जिला निर्वाचन अधिकारी, मामित द्वारा अपने दिनांक 23.12.2019 के पत्र संख्या एच.15014/86/2018- डीसी/(एम)/ईएलएन के तहत आयोग को प्रस्तुत की गई है और मुख्य निर्वाचन अधिकारी, मिजोरम द्वारा अपने दिनांक 13.02.2020 के पत्र संख्या एच.11016/2/2019-सीईओ के तहत अग्रेषित की गई है;
और यत:, जिला निर्वाचन अधिकारी, मामित जिला द्वारा अपने दिनांक 23.12.2019 के पत्र संख्या एच.15014/86/2018-डीसी/(एम)/ईएलएन के तहत प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री लालाव्मपुइया छांगते ने आज की तारीख तक अपना कोई भी अभ्यावेदन अथवा मूल वाउचरों आदि के साथ विधिवत हस्ताक्षरित अपने निर्वाचन संबंधी व्ययों का सही लेखा विवरण प्रस्तुत नहीं किया है। इसके अतिरिक्त, उन्होंने भारत निर्वाचन आयोग का सम्यक नोटिस मिलने के उपरांत भी अपनी उक्त विफलता के संबंध में न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है;
और यत:, आयोग का यह समाधान हो गया है कि श्री लालाव्मपुइया छांगते अपने निर्वाचन व्ययों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है।
और यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह निर्धारित है कि:
''यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति-
(क) निश्चित समय के भीतर और इस अधिनियम के द्वारा अथवा अधीन अपेक्षित रीति में निर्वाचन व्यय लेखा दाखिल करने में विफल रहा है; और [भाग II—खण्ड 3(iii)] भारत का राजपत्र : जून 13, 2020/ज्येष्ठ 23, 1942 77 (ख) उसके पास इस विफलता का कोई उचित कारण अथवा औचित्य नहीं है तो, निर्वाचन आयोग सरकारी राजपत्र में
आदेश प्रकाशित करके उसे निरर्ह घोषित करेगा और ऐसा कोई भी व्यक्ति इस आदेश की तारीख से तीन वर्ष की
अवधि के लिए निरर्ह रहेगा;
अत:, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा
घोषणा करता है कि मिजोरम राज्य के 2-डम्पा (अ.ज.जा) और 3-मामित (अ.ज.जा.) विधान सभा निर्वाचन क्षेत्रों से विधान
सभा के साधारण निर्वाचन, 2018 के लिए नेशनलिस्ट कांग्रेस पार्टी के निर्वाचन लड़ने वाले अभ्यर्थी श्री लालाव्मपुइया छांगते
निवासी म.नं. जे-3, नर्सरी वेंग, एजवाल, मिजोरम इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी
सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए
निरर्ह होंगे।

New Delhi, the 11th June, 2020
O. N. 25 .—WHEREAS, the General Election to the Legislative Assembly of Mizoram, 2018 was announced by the Election Commission of India vide Press Note No. ECI/PN/66/2018 dated 06.10.2018. As per the schedule, the date of Counting was 11.12.2018:
AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate has to lodge a true copy of his account of election expenses within 30 days with the District Election Officer, from the date of election of the returned candidate ;
AND WHEREAS, the result of the said election was declared by the Returning Officers of 2-Dampa (ST) & 3- Mamit (ST) Assembly Constituencies on 11.12.2018. As such the last date for lodging of account of election expenses was 10.01.2019;
AND WHEREAS, as per the report dated 11.01.2019 submitted by the District Election Officer, Mamit District, Mizoram, and forwarded by Chief Electoral Officer vide his letter No. H.11016/2/2019-CEO dated 26-04-2019, Shri Lalawmpuia Chhangte, a contesting candidate of Nationalist Congress Party from 2-Dampa (ST) & 3-Mamit (ST) Assembly Constituencies of Mizoram has failed to lodge any account of his election expenses for both Assembly Constituencies as required by law;
AND WHEREAS, on the basis of the reports of the District Election Officer, Mamit District, Mizoram and the Chief Electoral Officer, Mizoram, a Show-Cause notice dated 18.07.2019 was issued by the Election Commission of India under Sub Rule (5) of rule 89 of the Conduct of Election Rules, 1961 to Shri Lalawmpuia Chhangte for non submission of Election expenses;
AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Election Rules,1961, through the above said Show Cause Notice dated 18.07.2019, Shri Lalawmpuia Chhangte was directed to submit his representation in writing to the Commission explaining the reason for non submission of accounts and also to lodge his accounts of election expenses/rectify the defects in his accounts and submit the same with the District Election Officer concerned within 20 days from the date of receipt of the notice;
AND WHEREAS, the said notice was received by Shri Lalawmpuia Chhangte on 10.08.2019. Acknowledgement receipt obtained have been submitted to the Commission by the District Election Officer, Mamit vide his letter No. H.15014/86/2018-DC(M)/ELN dated 23.12.2019 and forwarded by Chief Electoral Officer, Mizoram vide his letter No. H.11016/2/2019-CEO dated 13.02.2020;
AND WHEREAS, in the supplementary report submitted by the District Election Officer, Mamit District vide his letter No. H.15014/86/2018-DC(M)/ELN dated 23.12.2019 it has been stated that Shri Lalawmpuia Chhangte, has78 THE GAZETTE OF INDIA : JUNE 13, 2020/JYAISTHA 23, 1942 [PART II—SEC. 3(iii)] not submitted any representation or a statement of correct account of his election expenses, duly signed along with original vouchers etc. till date. Further he has neither furnished any reason nor explanation for the said failure even after receipt of the due notice to the Election Commission of India as well;
AND WHEREAS, the Commission is satisfied that Shri Lalawmpuia Chhangte has failed to lodge an account of election expenses and has no good reason or justification for the failure;
AND WHEREAS, Section 10 A of the Representation of the People Act, 1951 stipulates that :-
"If the Election Commission is satisfied that a person-
(a) Has failed to lodge an account of election expenses within the time and in the manner required by or under this Act; and
(b) Has no good reason or justification for the failure, the Election Commission shall, by order published in the official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from the date of the order;
NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Lalawmpuia Chhangte, resident of House No. J-3, Nursery Veng, Aizawl and a contesting candidate of Nationalist Congress Party for the General Election to the Legislative Assembly, 2018, from 2-Dampa (ST) & 3-Mamit (ST) Assembly Constituencies of the State of Mizoram to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order.
