आ. अ. 51 .— यतः, भारत निर्वाचन आयोग द्वारा असम राज्य में लोक सभा के साधारण निर्वाचन, 2019 की घोषणा प्रेस नोट संख्या ईसीआई/प्रे.नो./23/2019 दिनांक 10.03.2019 के जरिए की गई थी। कार्यक्रम के अनुसार, मतगणना की तारीख 23.05.2019 थी।

और यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सही प्रति जिला निर्वाचन अधिकारी को दाखिल करनी होती है;

(147)¹⁴⁸ THE GAZETTE OF INDIA : JULY ¹⁸, ²⁰²⁰/ASADHA ²⁷, ¹⁹⁴² [PART II—SEC. ³(iii)] और यतः,07-गौहाटी संसदीय निर्वाचन क्षेत्र सहित संबंधित रिटर्निंग अधिकारी द्वारा उक्त निर्वाचन के परिणाम 23.05.2019 को घोषित किए गए थे। इस प्रकार, निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 22.06.2019 थी।

और यतः, जिला निर्वाचन अधिकारी,कामरूप जिला,असम द्वारा प्रस्तुत और मुख्य निर्वाचन अधिकारी, असम द्वारा अपने दिनांक 08.07.2019 के पत्र सं.ईएलई 94/2018/227 के जरिए अग्रेषित दिनांक 24.06.2019 की रिपोर्ट के अनुसार,श्री अलीमुद्दीन अहमद, जो असम के 07-गौहाटी, संसदीय निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले निर्दलीय अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे हैं।

और यतः, जिला निर्वाचन अधिकारी,कामरूप जिला,असम और मुख्य निर्वाचन अधिकारी,असम की रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए श्री अलीमुद्दीन अहमद को दिनांक 20.09.2019 को कारण बताओ नोटिस जारी किया गया था;

और यत:, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (6) के अनुसार,दिनांक 20.09.2019 के उपयु र्क्त कारण बताओ नोटिस के जरिएश्री अलीमुद्दीन अहमद को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखे न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें/अपने लेखे की त्रुटियों को ठीक करें और उसे संबंधित जिला निर्वाचन अधिकारी को प्रस्तुत करें;

और यत:,उक्त नोटिस श्री अलीमुद्दीन अहमद द्वारा 12.03.2020 को प्राप्त किया गया था। अभ्यर्थी से प्राप्त पावती रसीद, जिला निर्वाचन अधिकारी,कामरूप जिला, असम द्वारा उनके दिनांक 11.05.2020 के पत्र सं.ईएलई(के )/व्यय/1/2/74 के जरिए आयोग को प्रस्तुत कर दी गई है;

और यत:, जिला निर्वाचन अधिकारी, कामरूप द्वारा उनके दिनांक 11.05.2020 के पत्र सं.ईएलई(के )/व्यय/1/2/74 के द्वारा प्रस्तुत अनुपूरक रिपोर्ट में यह बताया गया है कि श्री अलीमुद्दीन अहमद द्वारा अभी तक कोई जवाब नहीं दिया गया है और मूल वाउचर सहित हस्ताक्षरित निर्वाचन व्यय के सही लेखे का विवरण प्रस्तुत नहीं किया गया है। इसके अतिरिक्त, उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है;

और यत:,आयोग का यह समाधान हो गया है कि श्री अलीमुद्दीन अहमद निर्वाचन खर्चों का लेखा दाखिल करन में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है;

और यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है कि:-

''यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति-

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में विफल रहा है; तथा

(ख) उस विफलता के लिए कोई समुचित कारण या औचित्य नहीं है, तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरर्हित घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरर्हित होगा;

अत:,अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि श्री अलीमुद्दीन अहमद, निवासी गांव- एनसी पब काजिया, डाकखाना कालारचर, पी.एस. भंगनामाड़ी, जिला नलबाड़ी, असम और असम राज्य के 07-गौहाटी संसदीय निर्वाचन क्षेत्र से असम राज्य में लोक सभा के साधारण[भाग II—खण्ड 3(iii)] भारत का राजपत्र : जुलाई ¹⁸, ²⁰²⁰/आषाढ़ ²⁷, ¹⁹⁴² ¹⁴⁹ निर्वाचन, 2019 में निर्वाचन लड़ने वाले निर्दलयी अभ्यर्थी इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के

किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने

के लिए निरर्हित होंगे।

New Delhi, the 8th July, 2020

O. N. 51 .— WHEREAS, the General Election to the Lok Sabha in the state of Assam, 2019 was announced by Election Commission of India vide Press Note No ECI/PN/23/2019 dated 10.03.2019. As per the schedule Date of Counting was 23.05.2019.

AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate has to lodge a true copy of his account of election expenses within 30 days with the District Election Officer, from the date of election returned candidate;

AND WHEREAS, the result of the said election was declared by the concerned Returning Officer including 07-Gauhati Parliamentary Constituency on 23.05.2019. As such the last date for lodging of account of election expenses was 22.06.2019.

AND WHEREAS, as per the report dated 24.06.2019 submitted by the District Election Officer, Kamrup District, Assam and forwarded by Chief Electoral Officer, Assam vide letter No.ELE 94/2018/227 dated 08.07.2019, Shri Alimuddin Ahmed, Independent contesting candidate from 07-Gauhati Parliamentary Constituency of Assam, has failed to lodge any account of his election expenses as required by law.

AND WHEREAS, on the basis of the reports of the District Election Officer, Kamrup District, Assam and the Chief Electoral Officer, Assam, a Show Cause notice dated 20.09.2019 was issued by the Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to Shri Alimuddin Ahmed for non submission of Election expenses;

AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, through the above said Show Cause Notice dated 20.09.2019, Shri Alimuddin Ahmed, was directed to submit his representation in writing in the Commission explaining the reason for non submission of accounts and also to lodge his accounts of election expenses/rectify the defects in his accounts and submit the same the District Election Officer concerned within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice were received by Shri Alimuddin Ahmed, on 12.03.2020. Acknowledgment receipt obtained from the candidate have been submitted to the Commission by District Election Officer, Kamrup vide his letter No.ELE(K)/EXP/1/2/74 dated 11.05.2020 .

AND WHEREAS, in the supplementary report submitted by District Election Officer, Kamrup vide his letter No.ELE(K)/EXP/1/2/74 dated 11.05.2020 has stated that Shri Alimuddin Ahmed, has not submitted any representation or a statement of correct account of his election expenses, duly signed along with original vouchers etc. till date. Further, he has neither furnished any reason nor explanation for the said failure even after receipt of the due notice to the Election Commission of India as well;

AND WHEREAS, the Commission satisfied that Shri Alimuddin Ahmed, has failed to lodge an account of election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10 A of the Representation of the People Act, 1951 stipulates that :-

"If the Election Commission is satisfied that a person-

(a) Has failed to lodge an account of election expenses within the time and in the manner required by law or under this Act; and

(b) Has no good reason or justification for the failure the Election Commission shall by order published in the official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from date of the under;

NOW THEREFORE, in pursuance of Section 10 A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Alimuddin Ahmed resident of Vill-NC Pub Kajiya, P.O.Kalarchar, P.S.Bhangnamari,Distt.-Nalbari (Assam) and the contesting Independent candidate for the General Election to the Lok Sabha in the state of Assam, 2019 from 07-Gauahti Parliamentary Constituency of the state of Assam to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order.

आ. अ. 53.—यत:, भारत निर्वाचन आयोग द्वारा उत्तर प्रदेश राज्य में 1-सहारनपुर लोक सभा निर्वाचन क्षेत्र से साधारण निर्वाचन, 2019 की घोषणा प्रेस नोट संख्या ईसीआई/प्रे.नो./23/2019 दिनांक 10 मार्च, 2019 के जरिए की गई थी; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सही प्रति संबन्धित जिला निर्वाचन अधिकारी को दाखिल करनी होती है; और

यत:, 1-सहारनपुर लोक सभा निर्वाचन क्षेत्र के रिटर्निंग अधिकारी द्वारा उक्त लोक सभा क्षेत्र से निर्वाचन के परिणाम दिनांक 23 मई, 2019 को घोषित किए गए थे और इस प्रकार, निर्वाचन व्यय का लेखा दाखिल करने की अन्तिम तारीख 22 जून, 2019 थी; और

यत:, जिला निर्वाचन अधिकारी, सहारनपुर जिला, उत्तर प्रदेश द्वारा प्रस्तुत दिनांक 25 जून, 2019 की रिपोर्ट के अनुसार, उत्तर प्रदेश के 1-सहारनपुर लोक सभा निर्वाचन क्षेत्र से प्रगतिशील समाजवादी पार्टी (लोहिया) से निर्वाचन लड़ने[भाग II—खण्ड 3(iii)] भारत का राजपत्र : जुलाई ¹⁸, ²⁰²⁰/आषाढ़ ²⁷, ¹⁹⁴² ¹⁵³ वाले अभ्यर्थी श्री मौ. उवैस अपने निर्वाचन व्यय का सही लेखा विधि द्वारा यथापेक्षित रीति से दाखिल करने में विफल रहे हैं;

और

यत:, जिला निर्वाचन अधिकारी, की उक्त रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (5) के अंतर्गत श्री मौ. उवैस को दिनांक 1 अक्तू बर, 2019 को निर्वाचन व्यय का लेखा निम्नलिखित त्रुटियों के साथ दाखिल करने हेतु कारण बताओं नोटिस नं. 76/उ.प्र. लो.स./1/भा.नि.आ./टेर./ पत्र/उ.अनु.- III-उ.प्र./2019 जारी किया गया था:-

(1) दिन-प्रतिदिन का लेखा का रजिस्टर, रोकड़ रजिस्टर, बैंक रजिस्टर, एवं सार विवरण को शामिल करते हुए निर्वाचन व्यय रजिस्टर दाखिल नहीं किया गया है ।

(2) निर्वाचन के लिए अलग से बैंक अकाउं ट नहीं खोला गया है ।

(3) सभी व्यय (छोटे-मोटे व्ययों को छोड़कर) बैंक खाते के माध्यम से नहीं किये गए हैं ।

यत:, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (6) के अनुसार, उपयु र्क्त कारण बताओं नोटिस के द्वारा श्री मौ. उवैस को निर्देश दिया गया था की वे इस नोटिस के प्राप्त होने के 20 दिनों के भीतर लेखा दाखिल नहीं करने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन निर्वाचन आयोग के समक्ष प्रस्तुत करें और साथ ही उक्त त्रुटियों को दूर करते हुए अपना निर्वाचन व्ययों का लेखा जिला निर्वाचन अधिकारी, सहारनपुर के समक्ष प्रस्तुत करें; और

यत:, जिला निर्वाचन अधिकारी, सहारनपुर द्वारा भारत निर्वाचन आयोग को प्रस्तुत की गई पावती रसीद के अनुसार, उक्त नोटिस श्री मौ. उवैस को दिनांक 11 अक्तू बर, 2019 को उनके द्वारा नामांकन पत्र में दर्शाये गये पते पर तामील किया गया था; और

यत:, जिला निर्वाचन अधिकारी, सहारनपुर ने दिनांक 26 नवम्बर, 2019 की अपनी अनुपूरक रिपोर्ट में यह बताया है कि श्री मौ. उवैस द्वारा अभी तक कोई जवाब नहीं दिया गया है और मूल वाउचर सहित हस्ताक्षरित निर्वाचन व्यय के सही लेखे का विवरण प्रस्तुत नहीं किया गया है; और

यतः, भारत निर्वाचन आयोग द्वारा अभ्यर्थी श्री मौ. उवैस को अंतिम अवसर प्रदान करते हुए पत्र सं. 76/उ.प्र.- लो.स./1/भा.नि.आ./टेरी./पत्र/उ.अनु.-III-उ.प्र./2019, दिनांक 4 दिसम्बर, 2019 जारी किया गया, जो जिला निर्वाचन अधिकारी, सहारनपुर के माध्यम से उन्हें दिनांक 17 दिसम्बर, 2019 को प्राप्त हुआ; और

यत:, जिला निर्वाचन अधिकारी, से प्राप्त दिनांक 10 फरवरी, 2020 की रिपोर्ट के अनुसार श्री मौ. उवैस द्वारा उक्त कमियों को सुधारते हुए न तो कोई लेखा जमा किया गया है न ही कोई अभ्यावेदन प्रस्तुत किया गया है । इसके अतिरिक्त, उक्त नोटिस मिलने के उपरांत भी अभ्यर्थी द्वारा उक्त विफलता के लिए भारत निर्वाचन आयोग के समक्ष कोई कारण अथवा स्पष्टीकरण प्रस्तुत नहीं किया गया है; और

यत:, तथ्यों और उपलब्ध दस्तावेजों के आधार पर, आयोग का यह समाधान हो गया है कि श्री मौ. उवैस विहित प्रपत्र में अपने निर्वाचन व्यय का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है कि :-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति –

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में विफल रहा है; तथा¹⁵⁴ THE GAZETTE OF INDIA : JULY ¹⁸, ²⁰²⁰/ASADHA ²⁷, ¹⁹⁴² [PART II—SEC. ³(iii)] (ख) उस विफलता के लिए कोई अच्छा कारण या औचित्य नहीं है

O.N. 53.—WHEREAS, the General Election for 1-Saharanpur Parliamentary Constituency of Uttar Pradesh, 2019 was announced by the Election Commission of India vide Press Note No. ECI/PN/23/2019 dated 10th March, 2019; and

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate has to lodge a true copy of his accounts of election expenses within 30 days with the concerned District Election Officer, from the date of election of the returned candidate; and

WHEREAS, the result of the election for 1-Saharanpur Parliamentary Constituency was declared by the Returning Officer on 23rd May, 2019 and hence the last date for lodging the accounts of election expenses was 22nd June, 2019; and

WHEREAS, as per the report dated 25th June, 2019 submitted by the District Election Officer, Saharanpur District, Uttar Pradesh, Shri Mohd. Uvais, a contesting candidate of Pragatishil Samajwadi Party (Lohia) from 1-Saharanpur Parliamentary Constituency of Uttar Pradesh has failed to lodge true accounts of his election expenses, as required under law; and

WHEREAS, on the basis of the said report of the District Election Officer, a Show-Cause notice No. 76/UP- HP/1/ECI/LET/TERR/NS-III-UP/2019, dated 1st October, 2019 was issued under Sub Rule (5) of rule 89 of the Conduct of Election Rules, 1961 by the Election Commission of India to Shri Mohd. Uvais, for submission of accounts of his election expenses with the following defects:-

(i) Election expenditure register including day to day accounts register, cash register, bank register and abstract statement were not filed

(ii) No separate bank account has been opened for election.

(iii) All Expenditure (Except petty expenditure) not routed through bank account; and

WHEREAS, through the above said Show Cause Notice and under Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, Shri Mohd. Uvais was directed to submit his representation in writing to the Commission explaining the reason for the above said shortcomings in his accounts of election expenses and also to lodge the accounts, after rectifying the above mentioned defects, with the District Election Officer, Saharanpur within 20 days from the date of receipt of the notice; and

WHEREAS, as per the acknowledgement receipt made available to the Election Commission by the District Election Officer, Saharanpur, the said notice was served to Shri Mohd. Uvais on 11th October, 2019 at the address provided by the candidate in the nomination papers; and

WHEREAS, the District Election Officer, Saharanpur has submitted in his supplementary report, dated 26th November, 2019 that Shri Mohd. Uvais has not submitted any representation or a statement of correct account of his election expenses, duly signed along with original vouchers etc. till that date; and[भाग II—खण्ड 3(iii)] भारत का राजपत्र : जुलाई ¹⁸, ²⁰²⁰/आषाढ़ ²⁷, ¹⁹⁴² ¹⁵⁵ WHEREAS, the candidate was given last opportunity to rectify the defects found in his accounts, vide Commission's letter No. 76/UP-HP/1/ECI/LET/TERR/NS-III-UP/2019, dated 4th December, 2019, which was served to him on 17th December, 2019 through the District Election Officer, Saharanpur; and

WHEREAS, as per the report, dated 10th February, 2020 submitted by the District Election Officer to the Commission, Shri Mohd. Uvais has neither rectified the above mentioned defects nor any representation has been received from him. Further, no representation from the candidate has been received in the Secretariat of the Election Commission of India, after receipt of the Commission's said notice; and

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Shri Mohd. Uvais has failed to lodge his accounts of election expenses in the manner prescribed under law and has no good reason or justification for the failure to do so; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that :-

"If the Election Commission is satisfied that a person-

(a) Has failed to lodge an account of election expenses within the time and in the manner required by or under this Act; and

(b) Has no good reason or justification for the failure,

the Election Commission shall, by order published in the official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from the date of the order.";

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Mohd. Uvais, resident of H.No. 6/2246, Mohalla, Husainabad, Saharanpur, Uttar Pradesh and a contesting candidate from 1-Saharanpur Parliamentary Constituency of the State of Uttar Pradesh in the General Elections to the House of the People, 2019, to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order.

WHEREAS, on the basis of the said report of the District Election Officer, a Show-Cause notice No. 76/UP- HP/68/ECI/Notice/TERR/NS-III-UP/2019, dated 23rd August, 2019 was issued under Sub Rule (5) of rule 89 of the Conduct of Election Rules, 1961 by the Election Commission of India to Shri Lcchiman Kannooizya, for non- submission of any accounts of his Election expenses; and

WHEREAS, through the above said Show Cause Notice and under Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, Shri Lcchiman Kannooizya was directed to submit his representation in writing to the Commission explaining the reason for non submission of accounts and also to lodge his accounts of election expenses with the District Election Officer, Azamgarh within 20 days from the date of receipt of the notice; and

WHEREAS, as per the acknowledgement receipt made available to the Election Commission by the District Election Officer, Azamgarh, the said notice was served to Sh. Lcchiman Kannooizya on 27th December, 2019 at the address provided by the candidate in the nomination papers; and

WHEREAS, the District Election Officer, Azamgarh has submitted in his supplementary report, dated 10th February, 2020 that Sh. Shri Lcchiman Kannooizya, has not submitted any representation or a statement of correct account of his election expenses, duly signed along with original vouchers etc. till date. Further, after receipt of the said notice, he has neither furnished any reason nor explanation to the Election Commission of India, for his failure to lodge the accounts as prescribed under law; and

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Shri Lcchiman Kannooizya has failed to lodge his accounts of election expenses and has no good reason or justification for the failure to do so; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that :-

O.N. 55.—WHEREAS, the General Election for 69-Azamgarh Parliamentary Constituency of Uttar Pradesh, 2019 was announced by the Election Commission of India vide Press Note No. ECI/PN/23/2019 dated 10th March, 2019; and

WHEREAS, the result of the election for 69-Azamgarh Parliamentary Constituency was declared by the Returning Officer on 23rd May, 2019 and hence the last date for lodging the accounts of election expenses was 22nd June, 2019; and

WHEREAS, as per the report submitted by the District Election Officer, Azamgarh District, Uttar Pradesh, Shri Anil Singh, a contesting candidate of Rashtriya Ulama Council from 69-Azamgarh Parliamentary Constituency of Uttar Pradesh has failed to lodge any accounts of his election expenses, as required under law; and

WHEREAS, on the basis of the said report of the District Election Officer, a Show-Cause notice No. 76/UP- HP/69/ECI/Notice/TERR/NS-III-UP/2019, dated 23rd August, 2019 was issued under Sub Rule (5) of rule 89 of the Conduct of Election Rules, 1961 by the Election Commission of India to Shri Anil Singh, for non-submission of any accounts of his Election expenses; and

WHEREAS, through the above said Show Cause Notice and under Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, Shri Anil Singh was directed to submit his representation in writing to the Commission explaining the reason for non submission of accounts and also to lodge his accounts of election expenses with the District Election Officer, Azamgarh within 20 days from the date of receipt of the notice; and

WHEREAS, as per the acknowledgement receipt made available to the Election Commission by the District Election Officer, Azamgarh, the said notice was served to Sh. Anil Singh on 17th September, 2019 at the address provided by the candidate in the nomination papers; and

WHEREAS, the District Election Officer, Azamgarh has submitted in his supplementary report, dated 10th February, 2020 that Sh. Shri Anil Singh, has not submitted any representation or a statement of correct account of his election expenses, duly signed along with original vouchers etc. till date. Further, after receipt of the said notice, he has neither furnished any reason nor explanation to the Election Commission of India, for his failure to lodge the accounts as prescribed under law; and¹⁶⁰ THE GAZETTE OF INDIA : JULY ¹⁸, ²⁰²⁰/ASADHA ²⁷, ¹⁹⁴² [PART II—SEC. ³(iii)] WHEREAS, on the basis of facts and available records, the Commission is satisfied that Shri Anil Singh has failed to lodge his accounts of election expenses and has no good reason or justification for the failure to do so; and WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that :-

यत:, 17-मथुरा लोक सभा निर्वाचन क्षेत्र के रिटर्निंग अधिकारी द्वारा उक्त लोक सभा क्षेत्र से निर्वाचन के परिणाम दिनांक 23 मई, 2019 को घोषित किए गए थे और इस प्रकार, निर्वाचन व्यय का लेखा दाखिल करने की अन्तिम तारीख 22 जून, 2019 थी; और

यत:, जिला निर्वाचन अधिकारी, की उक्त रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (5) के अंतर्गत श्री जगवीर सिंह को दिनांक 23 अगस्त, 2019 को निर्वाचन व्यय का कोई भी लेखा दाखिल नहीं करने हेतु कारण बताओं नोटिस नं. 76/उ.प्र.-लो.स./17/भा.नि.आ./ नोटिस/टेरी.//उ.अनु.-III- उ.प्र./2019 जारी किया गया था; और

यत:, जिला निर्वाचन अधिकारी, मथुरा ने दिनांक 14 फरवरी, 2020 की अपनी अनुपूरक रिपोर्ट में यह बताया है कि श्री जगवीर सिंह द्वारा अभी तक कोई जवाब नहीं दिया गया है और मूल वाउचर सहित हस्ताक्षरित निर्वाचन व्यय के सही लेखे का विवरण प्रस्तुत नहीं किया गया है । इसके अतिरिक्त, उक्त नोटिस मिलने के उपरांत भी अभ्यर्थी द्वारा उक्त विफलता के लिए भारत निर्वाचन आयोग के समक्ष कोई कारण अथवा स्पष्टीकरण प्रस्तुत नहीं किया गया है; और

यत:, तथ्यों और उपलब्ध दस्तावेजों के आधार पर, आयोग का यह समाधान हो गया है कि श्री जगवीर सिंह अपने निर्वाचन व्ययों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है कि :-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति –

(ख) उस विफलता के लिए कोई अच्छा कारण या औचित्य नहीं है

WHEREAS, on the basis of the said report of the District Election Officer, a Show-Cause notice No. 76/UP- HP/17/ECI/Notice/TERR/NS-III-UP/2019, dated 23rd August, 2019 was issued under Sub Rule (5) of rule 89 of the Conduct of Election Rules, 1961 by the Election Commission of India to Shri Jagvir Singh, for non- submission of any accounts of his Election expenses; and

यत:, जिला निर्वाचन अधिकारी, आगरा जिला, उत्तर प्रदेश द्वारा प्रस्तुत दिनांक 27 जून, 2019 की रिपोर्ट के अनुसार, उत्तर प्रदेश के 18-आगरा (अ.जा.) लोक सभा निर्वाचन क्षेत्र से पीस पार्टी से निर्वाचन लड़ने वाले अभ्यर्थी श्री रामजी लाल विद्यार्थी अपने निर्वाचन व्यय का सही लेखा विधि द्वारा यथापेक्षित रीति से दाखिल करने में विफल रहे हैं;

और

यत:, जिला निर्वाचन अधिकारी, की उक्त रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (5) के अंतर्गत श्री रामजी लाल विद्यार्थी को दिनांक 17 अक्तू बर, 2019 को निर्वाचन व्यय का लेखा निम्नलिखित त्रुटियों के साथ दाखिल करने हेतु कारण बताओं नोटिस नं.76/उ.प्र.-लो.स./ 18/भा.नि.आ./पत्र/टेर./उ.अनु.-III-उ.प्र./2019 जारी किया गया था:-

(2) अभ्यर्थी द्वारा रू. 1,92,367/- व्यय किया गया, परन्तु नियमानुसार नकद धनराशि बैंक में जमा किये बिना खर्च की गयी है ।

(3) अभ्यर्थी द्वारा चन्दे/दान में ली गई धनराशि से सम्बन्धित रसीदें प्रस्तुत नहीं की गई है ।

यत:, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (6) के अनुसार, उपयु र्क्त कारण बताओं नोटिस के द्वारा श्री रामजी लाल विद्यार्थी को निर्देश दिया गया था की वे इस नोटिस के प्राप्त होने के 20 दिनों के भीतर लेखा दाखिल नहीं करने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन निर्वाचन आयोग के समक्ष प्रस्तुत करें और साथ ही उक्त त्रुटियों को दूर करते हुए अपना निर्वाचन व्ययों का लेखा जिला निर्वाचन अधिकारी, आगरा के समक्ष प्रस्तुत करें; और

यत:, जिला निर्वाचन अधिकारी, आगरा द्वारा भारत निर्वाचन आयोग को प्रस्तुत की गई पावती रसीद के अनुसार, उक्त नोटिस श्री रामजी लाल विद्यार्थी को उनके द्वारा नामांकन पत्र में दर्शाये गये पते पर तामील किया गया था; और

यत:, आयोग के उक्त नोटिस के जवाब में श्री रामजी लाल विद्यार्थी से दिनांक 7 नवम्बर, 2019 का एक अभ्यावेदन, आयोग में दिनांक 9 नवम्बर, 2019 को प्राप्त हुआ; और

यत:, आयोग के पत्र, दिनांक 21 नवम्बर, 2019 द्वारा जिला निर्वाचन अधिकारी से अभ्यर्थी के उक्त संदर्भित अभ्यावेदन पर अपना मंतव्य आयोग में भेजने को कहा गया; और

यत:, जिला निर्वाचन अधिकारी, आगरा से प्राप्त पत्र, दिनांक 20 दिसम्बर, 2019 एवं 14 जनवरी, 2020 के अनुसार अभ्यर्थी श्री रामजी लाल विद्यार्थी द्वारा उनके लेखे में कोई सुधार नहीं किया गया, के वल अभ्यावेदन प्रस्तुत किया गया; और

यतः, भारत निर्वाचन आयोग द्वारा अभ्यर्थी श्री रामजी लाल विद्यार्थी को अंतिम अवसर प्रदान करते हुए पत्र सं. 76/उ.प्र.-लो.स./18/भा.नि.आ./टेरी./पत्र/उ.अनु.-III-उ.प्र./2019,दिनांक 15 जनवरी, 2020 जारी किया गया, जो जिला निर्वाचन अधिकारी, आगरा के माध्यम से उन्हें प्राप्त हुआ; और

यत:, आयोग के उक्त पत्र के जवाब में श्री रामजी लाल विद्यार्थी से दिनांक 13 मार्च, 2020 का एक अभ्यावेदन, आयोग में दिनांक 16 मार्च, 2020 को प्राप्त हुआ; और

यत:, आयोग के पत्र, दिनांक 19 मार्च, 2020 द्वारा जिला निर्वाचन अधिकारी से अभ्यर्थी के उक्त संदर्भित अभ्यावेदन पर भी अपना मंतव्य आयोग में भेजने को कहा गया; और

यत:, जिला निर्वाचन अधिकारी, आगरा द्वारा उनके पत्र, दिनांक 23 अप्रैल, 2020 में यह पुन: कहा गया कि अभ्यर्थी श्री रामजी लाल विद्यार्थी द्वारा उनके लेखे में कोई सुधार नहीं किया गया है के वल अभ्यावेदन प्रस्तुत किया गया है; और

यत:, तथ्यों और उपलब्ध दस्तावेजों के आधार पर, आयोग का यह समाधान हो गया है कि श्री रामजी लाल विद्यार्थी विहित प्रपत्र में अपने निर्वाचन व्यय का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है कि :-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति –

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में विफल रहा है; तथा[भाग II—खण्ड 3(iii)] भारत का राजपत्र : जुलाई ¹⁸, ²⁰²⁰/आषाढ़ ²⁷, ¹⁹⁴² ¹⁶⁷ (ख) उस विफलता के लिए कोई अच्छा कारण या औचित्य नहीं है

अत:, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतदद्वारा घोषणा करता है कि श्री रामजी लाल विद्यार्थी, निवासी 38/58 अ, ईदगाह कटघर, थाना रकाबगंज, आगरा, उत्तर प्रदेश, जो लोक सभा साधारण निर्वाचन, 2019 में 18-आगरा (अ.जा.) लोक सभा निर्वाचन क्षेत्र, उत्तर प्रदेश से निर्वाचन लड़ने वाले अभ्यर्थी थे, इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निरर्हित होंगे ।

New Delhi, the 13th July, 2020

O.N. 58.—WHEREAS, the General Election for 18-Agra (SC) Parliamentary Constituency of Uttar Pradesh, 2019 was announced by the Election Commission of India vide Press Note No. ECI/PN/23/2019 dated 10th March, 2019; and

WHEREAS, the result of the election for 18-Agra (SC) Parliamentary Constituency was declared by the Returning Officer on 23rd May, 2019 and hence the last date for lodging the accounts of election expenses was 22nd June, 2019; and

WHEREAS, as per the report dated 27th June, 2019 submitted by the District Election Officer, Agra District, Uttar Pradesh, Shri Ramji Lal Vidhyarthi, a contesting candidate of Peace Party from 18-Agra (SC) Parliamentary Constituency of Uttar Pradesh has failed to lodge true accounts of his election expenses, as required under law; and WHEREAS, on the basis of the said report of the District Election Officer, a Show-Cause notice No. 76/UP- HP/18/ECI/LET/TERR/NS-III-UP/2019, dated 17th October, 2019 was issued under Sub Rule (5) of rule 89 of the Conduct of Election Rules, 1961 by the Election Commission of India to Shri Ramji Lal Vidhyarthi, for submission of accounts of his election expenses with the following defects:-

(1) Expenditure bills /vouchers have not been presented by the candidate.

(2) Rs. 1,92,367/ - was spent by the candidate, but as per the rules, the cash amount has been spent without depositing it in the bank.

(3) The receipts related to the funds taken by the candidate / donation have not been submitted.

WHEREAS, through the above said Show Cause Notice and under Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, Shri Ramji Lal Vidhyarthi was directed to submit his representation in writing to the Commission explaining the reason for the above said shortcomings in his accounts of election expenses and also to lodge the accounts, after rectifying the above mentioned defects, with the District Election Officer, Agra within 20 days from the date of receipt of the notice; and

WHEREAS, as per the acknowledgement receipt made available to the Election Commission by the District Election Officer, Agra, the said notice was served to Shri Ramji Lal Vidhyarthi at the address provided by the candidate in the nomination papers; and

WHEREAS, in response to the said notice, a representation, dated 7th November, 2019 was received from Sh.

Ramji Lal Vidhyarthi in the Commission on 9th November, 2019; and

WHEREAS, The Commission vide letter, dated 21st November, 2019 sought comments of District Election Officer on the above mentioned representation of the candidate; and¹⁶⁸ THE GAZETTE OF INDIA : JULY ¹⁸, ²⁰²⁰/ASADHA ²⁷, ¹⁹⁴² [PART II—SEC. ³(iii)] WHEREAS, as per the District Election Officer's letter, dated 20th December, 2019 and 14th January, 2020, Sh. Ramji Lal Vidhyarthi did not rectify the defects in his accounts and only above mentioned representation was submitted by him; and

WHEREAS, the candidate was given last opportunity to rectify the defects found in his accounts, vide Commission's letter No. 76/UP-HP/18/ECI/LET/TERR/NS-III-UP/2019, dated 15th January, 2020, which was served to him through the District Election Officer, Agra; and

WHEREAS, in response to the aforesaid letter of the Commission, a representation, dated 13th March, 2020 was received from Sh. Ramji Lal Vidhyarthi in the Commission on 16th March, 2020; and

WHEREAS, The Commission vide letter, dated 19th March, 2020 sought comments of District Election Officer on the above mentioned representation of the candidate; and

WHEREAS, as per the District Election Officer vide his letter, dated 23rd April, 2020, reiterated that Sh. Ramji Lal Vidhyarthi has not rectified the defects in his accounts and only representation has been submitted by him; and WHEREAS, on the basis of facts and available records, the Commission is satisfied that Shri Ramji Lal Vidhyarthi has failed to lodge his accounts of election expenses in the manner prescribed under law and has no good reason or justification for the failure to do so; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that :-

"If the Election Commission is satisfied that a person-

(a) Has failed to lodge an account of election expenses within the time and in the manner required by or under this Act; and

(b) Has no good reason or justification for the failure,

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Ramji Lal Vidhyarthi, resident of 38/58 A, Idgah Katghar, Thana Rakabgang, Agra, Uttar Pradesh and a contesting candidate from 18-Agra (SC) Parliamentary Constituency of the State of Uttar Pradesh in the General Elections to the House of the People, 2019, to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order.

यत:, 21-मैनपुरी लोक सभा निर्वाचन क्षेत्र के रिटर्निंग अधिकारी द्वारा उक्त लोक सभा क्षेत्र से निर्वाचन के परिणाम दिनांक 23 मई, 2019 को घोषित किए गए थे और इस प्रकार, निर्वाचन व्यय का लेखा दाखिल करने की अन्तिम तारीख 22 जून, 2019 थी; और

यत:, जिला निर्वाचन अधिकारी, मैनपुरी ने दिनांक 25 जून, 2020 की अपनी अनुपूरक रिपोर्ट में यह बताया है कि श्री रजत कु मार द्वारा अभी तक कोई जवाब नहीं दिया गया है और मूल वाउचर सहित हस्ताक्षरित निर्वाचन व्यय के सही लेखे का विवरण प्रस्तुत नहीं किया गया है । इसके अतिरिक्त, उक्त नोटिस मिलने के उपरांत भी अभ्यर्थी द्वारा उक्त विफलता के लिए भारत निर्वाचन आयोग के समक्ष कोई कारण अथवा स्पष्टीकरण प्रस्तुत नहीं किया गया है; और

यत:, तथ्यों और उपलब्ध दस्तावेजों के आधार पर, आयोग का यह समाधान हो गया है कि श्री रजत कु मार अपने निर्वाचन व्ययों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है कि :-

WHEREAS, the result of the election for 21-Mainpuri Parliamentary Constituency was declared by the Returning Officer on 23rd May, 2019 and hence the last date for lodging the accounts of election expenses was 22nd June, 2019; and

WHEREAS, as per the report dated 29th June, 2019 submitted by the District Election Officer, Mainpuri District, Uttar Pradesh, Shri Rajat Kumar, a contesting candidate of Bhartiya Jan Nayak Party from 21-Mainpuri Parliamentary Constituency of Uttar Pradesh has failed to lodge any accounts of his election expenses, as required under law; and

WHEREAS, on the basis of the said report of the District Election Officer, a Show-Cause notice No. 76/UP- HP/21/ECI/Notice/TERR/NS-III-UP/2019, dated 23rd August, 2019 was issued under Sub Rule (5) of rule 89 of the Conduct of Election Rules, 1961 by the Election Commission of India to Shri Rajat Kumar, for non- submission of any accounts of his Election expenses; and

WHEREAS, through the above said Show Cause Notice and under Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, Shri Rajat Kumar was directed to submit his representation in writing to the Commission explaining the reason for non submission of accounts and also to lodge his accounts of election expenses with the District Election Officer, Mainpuri within 20 days from the date of receipt of the notice; and

WHEREAS, as per the acknowledgement receipt made available to the Election Commission by the District Election Officer, Mainpuri, the said notice was served to Shri Rajat Kumar on 29th February, 2020 at the address provided by the candidate in the nomination papers; and

WHEREAS, the District Election Officer, Mainpuri has submitted in his supplementary report, dated 25th June, 2020 that Shri Rajat Kumar, has not submitted any representation or a statement of correct account of his election expenses, duly signed along with original vouchers etc. till date. Further, after receipt of the said notice, he has neither furnished any reason nor explanation to the Election Commission of India, for his failure to lodge the accounts as prescribed under law; and

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Shri Rajat Kumar has failed to lodge his accounts of election expenses and has no good reason or justification for the failure to do so; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that :-

"If the Election Commission is satisfied that a person-

(a) Has failed to lodge an account of election expenses within the time and in the manner required by or under this Act; and

(b) Has no good reason or justification for the failure,

2. श्री प्रवीण गुप्ता राजस्थान सरकार के अधीन सभी पदभार या किसी कार्य के पदभारों कोे तत्काल सौंप देंगे या धारण करना समाप्त कर देंगे जो कि वह ऐसा पदभार ग्रहण करनें से पहले धारण कर रहे थे।

N. 60 .—In exercise of the powers conferred by sub-section (1) of section 13A of the Representation of the People Act, 1950 (43 of 1950), the Election Commission of India in consultation with the Government of Rajasthan hereby designates Shri Praveen Gupta, IAS (RJ : 1995) as the Chief Electoral Officer for the State of Rajasthan with effect from the date he takes over charge and until further orders vice Shri Anand Kumar, IAS.

2. Shri Praveen Gupta shall cease to hold and hand over forthwith the charge of all or any charges of work under the Government of Rajasthan, which he may be holding before such assumption of office.

3. Shri Praveen Gupta while functioning as the Chief Electoral Officer, Rajasthan shall not hold any additional charge whatsoever under the Government of Rajasthan except that he should be designated Principal Secretary to the Government in charge of Election Department in the State Secretariat.
