आ. अ. 62 .— यत:, भारत निर्वाचन आयोग द्वारा उत्तर प्रदेश राज्य में 4-सहारनपुर विधान सभा निर्वाचन क्षेत्र से साधारण निर्वाचन, 2017 की घोषणा प्रेस नोट संख्या ईसीआई/प्रे.नो./1/2017 दिनांक 4 जनवरी, 2017 के जरिए की गई थी; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सही प्रति संबन्धित जिला निर्वाचन अधिकारी को दाखिल करनी होती है;

(177)178 THE GAZETTE OF INDIA : AUGUST 1, 2020/SRAVANA 10, 1942 [PART II—SEC. 3(iii)] यत:, 4-सहारनपुर विधान सभा निर्वाचन क्षेत्र के रिटनिग अधिकारी द्वारा उक्त विधान सभा क्षेत्र से निर्वाचन के परिणाम दिनांक 11 मार्च, 2017 को घोषित किए गए थे और इस प्रकार, निर्वाचन व्यय का लेखा दाखिल करने की अन्तिम तारीख 10 अप्रैल, 2017 थी; और

यत:, जिला निर्वाचन अधिकारी, सहारनपुर जिला, उत्तर प्रदेश द्वारा प्रस्तुत दिनांक 15 अप्रैल, 2017 की रिपोर्ट के अनुसार, उत्तर प्रदेश के 4-सहारनपुर विधान सभा निर्वाचन क्षेत्र से जन अधिकार पार्टी से निर्वाचन लड़ने वाले अभ्यर्थी श्री नौशाद अपने निर्वाचन व्यय का सही लेखा विधि द्वारा यथापेक्षित रीति से दाखिल करने में विफल रहे हैं; और

यत:, जिला निर्वाचन अधिकारी, की उक्त रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (5) के अंतर्गत श्री नौशाद को दिनांक 11 सितम्बर, 2017 को निर्वाचन व्यय का लेखा निम्नलिखित त्रुटियों के साथ दाखिल करने हेतु कारण बताओं नोटिस नं. 76/उ.प्र.-वि.स./4/2017 जारी किया गया था:-

(1) दिन-प्रतिदिन के लेखा रजिस्टर, रोकड़ रजिस्टर, बैंक रजिस्टर, सार विवरण को शामिल करते हुए निर्वाचन व्यय रजिस्टर दाखिल नहीं किया गया है |

(2) शपथ पत्र में विधिवत रूप से शपथ दाखिल नहीं की गई |

(3) निर्वाचन व्यय की मदों के सन्दर्भ में अपेक्षित वाउचर प्रस्तुत नहीं किए गए हैं |

(4) निर्वाचन के लिए अलग से बैंक अकाउन्ट खोला नहीं गया है |

(5) सभी व्यय (छोटे-मोटे व्ययों को छोड़कर) बैंक खाते के माध्यम से नहीं किए गए हैं; और

यत:, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (6) के अनुसार एवं उपयु र्क्त कारण बताओ नोटिस के द्वारा श्री नौशाद को निर्देश दिया गया था की वे इस नोटिस के प्राप्त होने के 20 दिनों के भीतर लेखा दाखिल नहीं करने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन निर्वाचन आयोग के समक्ष प्रस्तुत करें और साथ ही उक्त त्रुटियों को दूर करते हुए अपना निर्वाचन व्ययों का लेखा जिला निर्वाचन अधिकारी, सहारनपुर के समक्ष प्रस्तुत करें; और

यत:, जिला निर्वाचन अधिकारी, सहारनपुर जिला, द्वारा भारत निर्वाचन आयोग को प्रस्तुत की गई पावती रसीद के अनुसार, उक्त नोटिस श्री नौशाद को दिनांक 29 जुलाई, 2019 को उनके द्वारा नामांकन पत्र में दर्शाये गये पते पर तामील किया गया था; और

यत:, जिला निर्वाचन अधिकारी, सहारनपुर ने दिनांक 4 नवम्बर, 2019 की अपनी अनुपूरक रिपोर्ट में यह बताया है कि श्री नौशाद द्वारा अभी तक कोई जवाब नहीं दिया गया है और मूल वाउचर सहित हस्ताक्षरित निर्वाचन व्यय के सही लेखे का विवरण प्रस्तुत नहीं किया गया है; और

यतः, भारत निर्वाचन आयोग द्वारा अभ्यर्थी श्री नौशाद को अंतिम अवसर प्रदान करते हुए पत्र सं० 76/उ0प्र.- वि.स./4/2017, दिनांक 22 नवम्बर, 2019 जारी किया गया, जो जिला निर्वाचन अधिकारी, सहारनपुर के माध्यम से उन्हें दिनांक 4 दिसम्बर, 2019 को प्राप्त हुआ; और

यत:, जिला निर्वाचन अधिकारी, से प्राप्त दिनांक 27 फरवरी, 2020 तथा दिनांक 02 जुलाई, 2020 की रिपोर्ट के अनुसार श्री नौशाद द्वारा उक्त कमियों को सुधारते हुए न तो कोई लेखा जमा किया गया है न ही कोई अभ्यावेदन प्रस्तुत किया गया है | इसके अतिरिक्त, उक्त नोटिस/पत्र मिलने के उपरांत भी अभ्यर्थी द्वारा उक्त विफलता के लिए भारत निर्वाचन आयोग के समक्ष कोई कारण अथवा स्पष्टीकरण प्रस्तुत नहीं किया गया है; और[भाग II—खण्ड 3(iii)] भारत का राजपत्र : अगस्त 1, 2020/श्रावण 10, 1942 179 यत:, तथ्यों और उपलब्ध दस्तावेजों के आधार पर, आयोग का यह समाधान हो गया है कि श्री नौशाद विहित प्रपत्र में अपने निर्वाचन व्यय का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है कि :-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति –

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में विफल रहा है; तथा

(ख) उस विफलता के लिए कोई अच्छा कारण या औचित्य नहीं है

तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरहित घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरहित होगा ।";

अत:, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतदद्वारा घोषणा करता है कि श्री नौशाद, निवासी ग्राम कु तुबपुर कु सानी, पोस्ट तिवाया, जिला सहारनपुर, उत्तर प्रदेश, जो उत्तर प्रदेश विधान सभा साधारण निर्वाचन, 2017 में 4-सहारनपुर विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी थे, इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निरहित होंगे ।

ELECTION COMMISSION OF INDIA

ORDER

New Delhi, the 27th July, 2020

O. N. 62 .— WHEREAS, the General Election for 4-Saharanpur Assembly Constituency of Uttar Pradesh, 2017 was announced by the Election Commission of India vide Press Note No. ECI/PN/1/2017 dated 4th January, 2017; and WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate has to lodge a true copy of his accounts of election expenses within 30 days with the concerned District Election Officer, from the date of election of the returned candidate; and

WHEREAS, the result of the election for 4-Saharanpur Assembly Constituency was declared by the Returning Officer on 11th March, 2017 and hence the last date for lodging the accounts of election expenses was 10th April, 2017; and

WHEREAS, as per the report dated 15th April, 2017 submitted by the District Election Officer, Saharanpur District, Uttar Pradesh, Sh. Naushad, a contesting candidate of Jan Adhikar Party from 4-Saharanpur Assembly Constituency of Uttar Pradesh has failed to lodge accounts of his election expenses, in the manner prescribed under the law; and

WHEREAS, on the basis of the said report of the District Election Officer, a Show-Cause notice No. 76/UP- LA/4/2017, dated 11th September, 2019 was issued under sub rule (5) of rule 89 of the Conduct of Election Rules, 1961 by the Election Commission of India to Sh. Naushad, for the following defects in accounts of his election expenses:-

(i) Election expenditure register comprising of day to day account register, cash register, bank register, abstract statement has not been lodged.

(ii) Duly sworn in Affidavit has not been submitted by candidate.

(iii) Requisite vouchers in respect of items of election expenditure not submitted.

(iv) Separate Bank Account not opened for election.

(v) All Expenditure (Except petty expenditure) not routed through bank account; and

WHEREAS, through the above said Show Cause Notice and as required under sub rule (6) of rule 89 of the Conduct of Election Rules, 1961, Sh. Naushad was directed to submit his representation in writing to the Commission explaining the reason for the above said shortcomings in his accounts of election expenses and also to lodge the accounts, after rectifying the above mentioned defects, with the District Election Officer, Saharanpur within 20 days from the date of receipt of the notice; and

WHEREAS, as per the acknowledgement receipt made available to the Election Commission by the District Election Officer, Saharanpur, the said notice was served to Sh. Naushad on 29th July, 2019 at the address provided by the candidate in the nomination papers; and

WHEREAS, the District Election Officer, Saharanpur has submitted in his supplementary report, dated 4th November, 2019 that Sh. Naushad, has not submitted any representation or a statement of correct account of his election expenses duly signed, along with original vouchers etc. till that date; and

WHEREAS, the candidate was given last opportunity to rectify the defects found in his accounts, vide Commission's letter No. 76/UP-LA/4/2017, dated 22nd November, 2019, which was served to him on 4th December, 2019 through the District Election Officer, Saharanpur; and

WHEREAS, as per the report, dated 27th February, 2020 and dated 02nd July, 2020 submitted by the District Election Officer to the Commission, Sh. Naushad has neither rectified the above mentioned defects nor any representation has been received from him. Further, no representation from the candidate has been received in the Secretariat of the Election Commission of India, after delivery of the above mentioned notice/letter; and

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Naushad has failed to lodge his accounts of election expenses in the manner prescribed under law and has no good reason or justification for the failure to do so; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that :-

"If the Election Commission is satisfied that a person-

(a) Has failed to lodge an account of election expenses within the time and in the manner required by or under this Act; and

(b) Has no good reason or justification for the failure,

the Election Commission shall, by order published in the official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from the date of the order.";

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Sh. Naushad, resident of Village Kutubpur Kusani, Post Tiwaya, District Saharanpur, Uttar Pradesh and a contesting candidate from 4-Saharanpur Assembly Constituency of the State of Uttar Pradesh in the General Elections to the State Legislative Assembly, 2017, to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order.

आ. अ. 63 .— यत:,भारत निर्वाचन आयोग द्वारा मिज़ोरम विधान सभा के साधारण निर्वाचन, 2018 की घोषणा

प्रेस नोट सं. भा.नि.आ./प्रे.नोट/66/2018 दिनांक 06.10.2018 के माध्यम से की गई थी। कार्यक्रम के अनुसार मतगणना की

तिथि 11.12.2018 थी;

और यत:,लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को निर्वाचन खर्च के अपने लेखे की सही प्रति निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के अन्दर जिला निर्वाचन अधिकारी को दर्ज करनी होती है;

और यत:, 30-लु ंगलेई उत्तर (अ.ज.जा.) विधान सभा निर्वाचन क्षेत्र के रिटनिग अधिकारी द्वारा उक्त निर्वाचन का परिणाम 11.12.2018 को घोषित कर किया गया था। इस तरह, निर्वाचन खर्च का लेखा दर्ज करने की अंतिम तिथि 10.01.2019 थी;

और यत:,जिला निर्वाचन अधिकारी, जिला लु ंगलेई, मिज़ोरम द्वारा प्रस्तुत एवं मुख्य निर्वाचन अधिकारी, मिज़ोरम द्वारा अपने पत्र सं. एच.11016/2/2019-मु.नि.अ. दिनांक 26.04.2019 के माध्यम से अग्रसारित रिपोर्ट दिनांक 10.01.2019 के अनुसार, मिज़ोरम की 30-लु ंगलेई उत्तर (अ.ज.जा.) विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले भारतीय जनता पार्टी के अभ्यर्थी, श्री रामदिनजौवा विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन खर्च का कोई लेखा दर्ज करने में विफल रहे हैं;

और यत:,निर्वाचन खर्च नहीं प्रस्तुत करने के लिए लु ंगलेई जिला, मिज़ोरम के जिला निर्वाचन अधिकारी और मुख्य निर्वाचन अधिकारी, मिज़ोरम की रिपोर्टों के आधार पर निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (5) के तहत श्री रामदिनजौवा को भारत निर्वाचन आयोग द्वारा दिनांक 18.07.2019 को कारण बताओ नोटिस जारी किया गया था;

और यत:, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (6) के तहत उपयु र्क्त कारण बताओ नोटिस दिनांक 18.07.2019 के अनुसार श्री रामदिनजौवा को निदेश दिया गया था कि वे निर्वाचन खर्च लेखा प्रस्तुत न करने का कारण स्पष्ट करते हुए अपना अभ्यावेदन लिखित रूप में प्रस्तुत करें और साथ ही निर्वाचन खर्च का अपना लेखा दर्ज करें /अपने लेखे की कमियों का निराकरण करें और उसे नोटिस प्राप्ति की तारीख से 20 दिनों के अन्दर संबंधित जिला निर्वाचन अधिकारी को प्रस्तुत करें;

और यत:, उक्त नोटिस श्री रामदिनजौवा द्वारा 06.08.2019 को प्राप्त किया गया। उनसे प्राप्त पावती रसीद मुख्य निर्वाचन अधिकारी, मिज़ोरम द्वारा अपने पत्र सं. एच.11016/2/2019-मु.नि.अ. दिनांक 09.03.2020 के माध्यम से आयोग को प्रस्तुत की गई है;

और यत:, नोटिस के प्रत्युत्तर में श्री रामदिनजौवा ने अपना अभ्यावेदन दिनांक 19.08.2019, प्रस्तुत किया, जिसमें उन्होंने कहा कि व्यय समापन के दिन उनके व्यय एजेंट/टीम को सूचित किया गया था कि प्रेक्षणों से पहले लेखा दर्शाने के लिए प्रस्तुत न किया जाए। इसके अलावा, उन्हें कहा गया कि बाद में यह उतना प्रभावी नहीं होगा और इसलिए उन्होंने मिशन पूरा कर लिया है, ऐसा समझ कर अपना लेखा कार्यालय में बन्द कर दिया था। उक्त के परिप्रेक्ष्य में श्री रामदिनजौवा ने अनुरोध किया कि उनके व्यय टीम की गलतियों और लापरवाहियों के लिए उन्हें क्षमा कर दिया जाए और उन्हें निरहित घोषित न किया जाए।

और यत:, अभ्यर्थी को एक अवसर प्रदान करने के लिए आयोग के पत्र दिनांक 25.09.2019 एवं 23.12.2019 के माध्यम से जिला निर्वाचन अधिकारी, लु ंगलेई से अनुरोध किया गया कि वे अभ्यर्थी श्री रामदिनजौवा द्वारा प्रस्तुत अभ्यावेदन पर अपना अभिमत दें। उनसे यह भी कहा गया था कि अभ्यर्थी द्वारा नोटिस प्राप्ति की प्रति और अभ्यर्थी के निर्वाचन खर्चे की नई संवीक्षा एवं पूरक रिपोर्ट प्रस्तुत करें ।

और यत:,मुख्य निर्वाचन अधिकारी, मिज़ोरम द्वारा पत्र सं. एच.11016/2/2019–मु.नि.अधि. दिनांक 14.07.2020 के माध्यम से अग्रसारित जिला निर्वाचन अधिकारी, लु ंगलेई के अभिमत के अनुसार लेखा दर्ज न करने के औचित्य के लिए श्री रामदिनजौवा द्वारा प्रस्तुत तर्क की पुष्टि नहीं की जा सकती है और इसलिए अस्वीकार्य है। तत्कालीन रिटनिग अधिकारी, 30-लु ंगलेई उत्तर (अ.ज.जा.) विधान सभा और सहायक व्यय प्रेक्षक ने भी स्पष्ट रूप में कहा है कि श्री रामदिनजौवा के अभ्यावेदन में जो दावा किया गया है, ऐसा कोई भी लिखित या मौखिक अनुदेश उनके प्रतिनिधि को नहीं दिया गया था। वस्तुत:, श्री रामदिनजौवा को 22.11.2018 को 48 घंटे के भीतर अद्यतन व्यय रजिस्टर जमा करने का नोटिस दिया गया था। एक और नोटिस 27.11.2018 को दिया गया था। निर्वाचन व्यय रजिस्टर जमा करने के अनुदेश के साथ पुन: तीसरा नोटिस 07.01.2019 को दिया गया था। यह सभी सुस्पष्ट रूप में दर्शाता है कि श्री रामदिनजौवा अभ्यर्थी के रूप में अपने दायित्वों का निर्वहन करने में विफल रहे हैं और इस तरह उन्होंने निर्वाचन व्यय संबंधी प्रावधानों का उल्लंघन किया है।

और यत:,मुख्य निर्वाचन अधिकारी, मिज़ोरम द्वारा पत्र सं. एच.11016/2/2019–मु.नि.अधि. दिनांक 14.07.2020 के माध्यम से अग्रसारित जिला निर्वाचन अधिकारी, लु ंगलेई की नई पूरक रिपोर्ट दिनांक 14.07.2020 से पता चलता है कि श्री रामदिनजौवा ने आयोग के दिनांक 18.07.2018 के कारण बताओ नोटिस के जवाब में निर्वाचन खर्चों का अपना लेखा अभी तक नहीं प्रस्तुत किया है।

और यत:, आयोग का समाधान हो गया है कि श्री रामदिनजौवा निर्वाचन खर्चों का लेखा प्रस्तुत करने में विफल रहे हैं और उनके अभ्यावेदन दिनांक 19.08.2019 के माध्यम से उनके द्वारा दिए गए कारण संतोषजनक और न्यायसंगत नहीं हैं।

और यत:,लोक प्रतिनिधित्व अधिनियम1951 की धारा 10क में विनिर्धारित किया गया है कि :--

यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति –

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है; तथा

(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है, तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरहित घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरहित होगा।

अत: अब,लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में, भारत निर्वाचन आयोग एतद्द्वारा विधान सभा साधारण निर्वाचन, 2018 में मिजोरम राज्य के 30-लु ंगलेई उत्तर (अ.ज.जा.) विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले भारतीय जनता पार्टी के अभ्यर्थी, श्री रामदिनजौवा, निवासी छिफे र, लु ंगलेई जिला, मिज़ोरम– 796181 को इस आदेश की तिथि से तीन वर्षों तक के लिए संसद के दोनों सदनों अथवा राज्य या संघ राज्य क्षेत्र की विधान सभा या विधान परिषद का सदस्य चुनने से और सदस्य बनने से निरहित घोषित करता है।

AND WHEREAS, as per section 78 of the Representation of the People Act, 1951, every contesting candidate has to lodge a true copy of his/her account of election expenses within 30 days with the District Election Officer, from the date of election of the returned candidate;

AND WHEREAS, the result of the said election was declared by the Returning Officer of 30-Lunglei North (ST) Assembly Constituency on 11.12.2018. As such the last date for lodging of account of election expenses was 10.01.2019;

AND WHEREAS, as per the report dated 10.01.2019 submitted by the District Election Officer, District Lunglei, Mizoram, and forwarded by the Chief Electoral Officer vide his letter No. H.11016/2/2019-CEO dated 26-04- 2019, Shri Ramdinzauva, a contesting candidate of Bharatiya Janata Party from 30-Lunglei North (ST) Assembly Constituency of Mizoram has failed to lodge any account of his election expenses as required by law;

AND WHEREAS, on the basis of the reports of the District Election Officer, Lunglei District, Mizoram and the Chief Electoral Officer, Mizoram, a Show-Cause notice dated 18.07.2019 was issued by the Election Commission of India under sub-rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 to Shri Ramdinzauva for non submission of Election expenses;

AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Elections Rules,1961, through the above said Show Cause Notice dated 18.07.2019, Shri Ramdinzauva was directed to submit his representation in writing to the Commission explaining the reason for non submission of accounts and also to lodge his accounts of election[भाग II—खण्ड 3(iii)] भारत का राजपत्र : अगस्त 1, 2020/श्रावण 10, 1942 183 expenses/rectify the defects in his accounts and submit the same with the District Election Officer concerned within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was received by Shri Ramdinzauva on 06.08.2019. Acknowledgement receipt obtained from him, has been submitted to the Commission by Chief Electoral Officer, Mizoram vide his letter No. H.11016/2/2019-CEO dated 09.03.2020;

AND WHEREAS, in response to the notice Shri Ramdinzauva submitted his representation dated 19.08.2019, wherein he stated that on the expenditure closing day, his expenditure agent/team was informed not to submit the accounts for showing before the observations. Further they were told that it would not be so effective later on and so they closed their account in the office, thinking that they had completed the mission. In view of the same Shri Ramdinzauva requested to forgive him for his expenditure team mistakes and negligence and not to declare him disqualified.

AND WHEREAS, to provide an opportunity to the candidate, DEO, Lunglei vide Commission's letter dated 25.09.2019 & 23.12.19 was requested to give his comments on the representation submitted by the candidate Shri Ramdinzauva. He was further asked to send copy of receipt of notice by the candidate and fresh scrutiny and supplementary report of election expenses by the candidate.

AND WHEREAS, as per the comments of the District Election Officer, Lunglei forwarded by the Chief Electoral Officer, Mizoram vide letter No. H.11016/2/2019-CEO dated 14.07.2020 the arguments submitted by Shri Ramdinzauva for justifying non lodging of accounts cannot be substantiated and therefore not acceptable. The then Returning Officer, 30-Lunglei North (ST) Assembly Constituency and Assistant Expenditure Observer also clearly stated that no such instructions as claimed by Shri Ramdinzauva in the representation were given, either in writing or verbally to his representative. In fact, notice was served to Shri Ramdinzauva to submit updated expenditure register within 48 hrs on 22.11.2018. Another notice was served on 27.11.2018. On 07.01.2019, third notice was again served with the instruction to submit accounts of election expenses. All these clearly show that Shri Ramdinzauva persistently failed to fulfil his obligations as a candidate and has thus violated provisions related to Election Expenditure.

AND WHEREAS, the fresh supplementary report dated 14.07.2020 of District Election Officer, Lunglei forwarded by the Chief Electoral Officer, Mizoram vide letter No. H.11016/2/2019-CEO dated 14.07.2020, reveals that Shri Ramdinzauva has not yet submitted his accounts of Election Expenses in response to Commission's Show-Cause Notice dated 18.07.2019.

AND WHEREAS, the Commission is satisfied that Shri Ramdinzauva has failed to lodge an account of election expenses and the reasons given by him in his representation dated 19.08.2019 for the failure are not satisfactory and justifiable.

AND WHEREAS, Section 10 A of the Representation of the People Act, 1951 stipulates that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses within the time and in the manner required by or under this Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from the date of the order;

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Ramdinzauva, resident of Chhipher, Lunglei Distt. Mizoram-796181, a contesting candidate of Bharatiya Janata Party for the General Election to the Legislative Assembly, 2018, from 30- Lunglei North (ST) Assembly Constituency of the State of Mizoram to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order.
