आ. अ. 64.—यत:, भारत निर्वाचन आयोग द्वारा उत्तर प्रदेश राज्य में 107-मैनपुरी विधान सभा निर्वाचन क्षेत्र से साधारण निर्वाचन, 2017 की घोषणा प्रेस नोट संख्या ईसीआई/प्रे.नो./1/2017 दिनांक 4 जनवरी, 2017 के जरिए की गई थी; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सही प्रति संबन्धित जिला निर्वाचन अधिकारी को दाखिल करनी होती है;

(185)186 THE GAZETTE OF INDIA : AUGUST 8, 2020/SRAVANA 17, 1942 [PART II—SEC. 3(iii)] यत:, 107-मैनपुरी विधान सभा निर्वाचन क्षेत्र के रिटनिग अधिकारी द्वारा उक्त विधान सभा क्षेत्र से निर्वाचन के परिणाम दिनांक 11 मार्च, 2017 को घोषित किए गए थे और इस प्रकार, निर्वाचन व्यय का लेखा दाखिल करने की अन्तिम तारीख 10 अप्रैल, 2017 थी; और

यत:, जिला निर्वाचन अधिकारी, मैनपुरी जिला, उत्तर प्रदेश द्वारा प्रस्तुत दिनांक 13 अप्रैल, 2017 की रिपोर्ट के अनुसार, उत्तर प्रदेश के 107-मैनपुरी विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी श्री सुरजीत सिह अपने निर्वाचन व्यय का सही लेखा विधि द्वारा यथापेक्षित रीति से दाखिल करने में विफल रहे हैं; और

यत:, जिला निर्वाचन अधिकारी, की उक्त रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (5) के अंतर्गत श्री सुरजीत सिह को दिनांक 07 फरवरी, 2018 को निर्वाचन व्यय का लेखा निम्नलिखित त्रुटियों के साथ दाखिल करने हेतु कारण बताओं नोटिस नं. 76/उ.प्र.-वि.स./107/भा.नि.आ./ नोटिस/टेरी./उ.अनु.-III-उ.प्र./2017 जारी किया गया था:-

(1) दिन-प्रतिदिन के लेखा रजिस्टर, रोकड़ रजिस्टर, बैंक रजिस्टर, सार विवरण को शामिल करते हुए निर्वाचन व्यय रजिस्टर दाखिल नहीं किया गया है ।

(2) शपथ पत्र प्रस्तुत नहीं किया गया है ।

(3) निर्वाचन व्यय की मदों के सन्दर्भ में अपेक्षित वाउचर प्रस्तुत नहीं किये हैं ।

यत:, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (6) के अनुसार एवं उपयु र्क्त कारण बताओ नोटिस के द्वारा श्री सुरजीत सिह को निर्देश दिया गया था की वे इस नोटिस के प्राप्त होने के 20 दिनों के भीतर लेखा दाखिल नहीं करने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन निर्वाचन आयोग के समक्ष प्रस्तुत करें और साथ ही उक्त त्रुटियों को दूर करते हुए अपना निर्वाचन व्ययों का लेखा जिला निर्वाचन अधिकारी, मैनपुरी के समक्ष प्रस्तुत करें; और

यत:, जिला निर्वाचन अधिकारी, मैनपुरी जिला, द्वारा भारत निर्वाचन आयोग को प्रस्तुत की गई पावती रसीद के अनुसार, उक्त नोटिस श्री सुरजीत सिह को दिनांक 30 जून, 2020 को उनके द्वारा नामांकन पत्र में दर्शाये गये पते पर तामील किया गया था; और

यत:, जिला निर्वाचन अधिकारी, मैनपुरी ने दिनांक 21 जुलाई, 2020 की अपनी अनुपूरक रिपोर्ट में यह बताया है कि श्री सुरजीत सिह द्वारा अभी तक कोई जवाब नहीं दिया गया है और मूल वाउचर सहित हस्ताक्षरित निर्वाचन व्यय के सही लेखे का विवरण प्रस्तुत नहीं किया गया है । इसके अतिरिक्त, उक्त नोटिस मिलने के उपरांत भी अभ्यर्थी द्वारा उक्त विफलता के लिए भारत निर्वाचन आयोग के समक्ष कोई कारण अथवा स्पष्टीकरण प्रस्तुत नहीं किया गया है; और

यत:, तथ्यों और उपलब्ध दस्तावेजों के आधार पर, आयोग का यह समाधान हो गया है कि श्री सुरजीत सिह विहित प्रपत्र में अपने निर्वाचन व्यय का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है कि :-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति –

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में विफल रहा है; तथा

(ख) उस विफलता के लिए कोई अच्छा कारण या औचित्य नहीं है[भाग II—खण्ड 3(iii)] भारत का राजपत्र : अगस्त 8, 2020/श्रावण 17, 1942 187 तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरहित घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरहित होगा ।";

अत:, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतदद्वारा घोषणा करता है कि श्री सुरजीत सिह, निवासी 146 गुलाबपुर कू कामई, मैनपुरी, उत्तर प्रदेश, जो उत्तर प्रदेश विधान सभा साधारण निर्वाचन, 2017 में 107-मैनपुरी विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी थे, इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निरहित होंगे ।

ELECTION COMMISSION OF INDIA

ORDER

New Delhi, the 31st July, 2020

O. N. 64 .— WHEREAS, the General Election for 107-Mainpuri Assembly Constituency of Uttar Pradesh, 2017 was announced by the Election Commission of India vide Press Note No. ECI/PN/1/2017 dated 4th January, 2017; and

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate has to lodge a true copy of his accounts of election expenses within 30 days with the concerned District Election Officer, from the date of election of the returned candidate; and

WHEREAS, the result of the election for 107-Mainpuri Assembly Constituency was declared by the Returning Officer on 11th March, 2017 and hence the last date for lodging the accounts of election expenses was 10th April, 2017;

and

WHEREAS, as per the report dated 13th April, 2017 submitted by the District Election Officer, Mainpuri District, Uttar Pradesh, Sh. Surjeet Singh, a contesting candidate from 107-Mainpuri Assembly Constituency of Uttar Pradesh has failed to lodge accounts of his election expenses, in the manner prescribed under the law; and WHEREAS, on the basis of the said report of the District Election Officer, a Show-Cause notice No. 76/UP- LA/107/ECI/Notice/TERR/NS-III-UP/2017, dated 7th February, 2018 was issued under sub rule (5) of rule 89 of the Conduct of Election Rules, 1961 by the Election Commission of India to Sh. Surjeet Singh, for the following defects in accounts of his election expenses:-

(i) Election expenditure register was not filed including day to day accounts register, cash register, bank register, abstract statement.

(ii) Affidavit has not been duly submitted.

(iii) Requisite vouchers in respect of items of election expenditure not submitted.

WHEREAS, through the above said Show Cause Notice and as required under sub rule (6) of rule 89 of the Conduct of Election Rules, 1961, Sh. Surjeet Singh was directed to submit his representation in writing to the Commission explaining the reason for the above said shortcomings in his accounts of election expenses and also to lodge the accounts, after rectifying the above mentioned defects, with the District Election Officer, Mainpuri within 20 days from the date of receipt of the notice; and188 THE GAZETTE OF INDIA : AUGUST 8, 2020/SRAVANA 17, 1942 [PART II—SEC. 3(iii)] WHEREAS, as per the acknowledgement receipt made available to the Election Commission by the District Election Officer, Mainpuri, the said notice was served to Sh. Surjeet Singh on 30th June, 2020 at the address provided by the candidate in the nomination papers; and

WHEREAS, the District Election Officer, Mainpuri has submitted in his supplementary report, dated 21st July, 2020 that Sh. Surjeet Singh, has not submitted any representation or a statement of correct account of his election expenses duly signed, along with original vouchers etc. till that date. Further, no representation from the candidate has been received in the Secretariat of the Election Commission of India, after delivery of the above mentioned notice; and WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Surjeet Singh has failed to lodge his accounts of election expenses in the manner prescribed under law and has no good reason or justification for the failure to do so; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that :-

"If the Election Commission is satisfied that a person-

(a) Has failed to lodge an account of election expenses within the time and in the manner required by or under this Act; and

(b) Has no good reason or justification for the failure,

the Election Commission shall, by order published in the official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from the date of the order.";

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Sh. Surjeet Singh, resident of 146 Gulabpur Kukaamai, Mainpuri, Uttar Pradesh and a contesting candidate from 107-Mainpuri Assembly Constituency of the State of Uttar Pradesh in the General Elections to the State Legislative Assembly, 2017, to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order.

यत:, जिला निर्वाचन अधिकारी, मैनपुरी ने दिनांक 22 नवम्बर, 2019 की अपनी अनुपूरक रिपोर्ट में यह बताया है कि श्री सत्येन्द्र सिह द्वारा अभी तक कोई जवाब नहीं दिया गया है और मूल वाउचर सहित हस्ताक्षरित निर्वाचन व्यय के सही लेखे का विवरण प्रस्तुत नहीं किया गया है; और

यतः, भारत निर्वाचन आयोग द्वारा अभ्यर्थी श्री सत्येन्द्र सिह को अंतिम अवसर प्रदान करते हुए पत्र सं० 76/उ.प्र.- वि.स./107/भा.नि.आ./पत्र/टेरी./उ.अनु.-III-उ.प्र./2017, दिनांक 10 जनवरी, 2020 जारी किया गया, जो जिला निर्वाचन अधिकारी, मैनपुरी के माध्यम से उन्हें दिनांक 30 जून, 2020 को प्राप्त हुआ; और

यत:, जिला निर्वाचन अधिकारी, से प्राप्त दिनांक 21 जुलाई, 2020 की रिपोर्ट के अनुसार श्री सत्येन्द्र सिह द्वारा उक्त कमियों को सुधारते हुए न तो कोई लेखा जमा किया गया है न ही कोई अभ्यावेदन प्रस्तुत किया गया है । इसके अतिरिक्त, उक्त नोटिस/पत्र मिलने के उपरांत भी अभ्यर्थी द्वारा उक्त विफलता के लिए भारत निर्वाचन आयोग के समक्ष कोई कारण अथवा स्पष्टीकरण प्रस्तुत नहीं किया गया है; और

यत:, तथ्यों और उपलब्ध दस्तावेजों के आधार पर, आयोग का यह समाधान हो गया है कि श्री सत्येन्द्र सिह विहित प्रपत्र में अपने निर्वाचन व्यय का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है कि :-

तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरहित घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरहित होगा ।";

अत:, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतदद्वारा घोषणा करता है कि श्री सत्येन्द्र सिह, निवासी अंजनी, पोस्ट अंजनी, मैनपुरी, उत्तर प्रदेश, जो उत्तर प्रदेश विधान सभा साधारण निर्वाचन, 2017 में 107-मैनपुरी विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी थे, इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निरहित होंगे ।

WHEREAS, on the basis of the said report of the District Election Officer, a Show-Cause notice No. 76/UP- LA/107/ECI/Notice/TERR/NS-III-UP/2017, dated 7th February, 2018 was issued under sub rule (5) of rule 89 of the Conduct of Election Rules, 1961 by the Election Commission of India to Sh. WHEREAS, the candidate was given last opportunity to rectify the defects found in his accounts, vide Commission's letter No. 76/UP-LA/107/ECI/LET/TERR/NS-III-UP/2017, dated 10th January, 2020, which was served to him on 30th June, 2020 through the District Election Officer, Mainpuri; and

WHEREAS, as per the report, dated 21st July, 2020 submitted by the District Election Officer to the Commission, Sh. Satyendra Singh has neither rectified the above mentioned defects nor any representation has been received from him. Further, no representation from the candidate has been received in the Secretariat of the Election Commission of India, after delivery of the above mentioned notice/letter; and

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Satyendra Singh has failed to lodge his accounts of election expenses in the manner prescribed under law and has no good reason or justification for the failure to do so; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that :-

"If the Election Commission is satisfied that a person-

यत:, 108-भोगाँव विधान सभा निर्वाचन क्षेत्र के रिटनिग अधिकारी द्वारा उक्त विधान सभा क्षेत्र से निर्वाचन के परिणाम दिनांक 11 मार्च, 2017 को घोषित किए गए थे और इस प्रकार, निर्वाचन व्यय का लेखा दाखिल करने की अन्तिम तारीख 10 अप्रैल, 2017 थी; और192 THE GAZETTE OF INDIA : AUGUST 8, 2020/SRAVANA 17, 1942 [PART II—SEC. 3(iii)] यत:, जिला निर्वाचन अधिकारी, मैनपुरी जिला, उत्तर प्रदेश द्वारा प्रस्तुत दिनांक 13 अप्रैल, 2017 की रिपोर्ट के अनुसार, उत्तर प्रदेश के 108-भोगाँव विधान सभा निर्वाचन क्षेत्र से भारतीय सुभाष सेना से निर्वाचन लड़ने वाले अभ्यर्थी श्री पुष्पेन्द्र कु मार अपने निर्वाचन व्यय का सही लेखा विधि द्वारा यथापेक्षित रीति से दाखिल करने में विफल रहे हैं; और

यत:, जिला निर्वाचन अधिकारी, की उक्त रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (5) के अंतर्गत श्री पुष्पेन्द्र कु मार को दिनांक 07 फरवरी, 2018 को निर्वाचन व्यय का लेखा निम्नलिखित त्रुटियों के साथ दाखिल करने हेतु कारण बताओं नोटिस नं. 76/उ.प्र.वि.स./108/भा.नि.आ./ नोटिस/टेरी./उ.अनु.-III-उ.प्र./2017 जारी किया गया था:-

(2) शपथ पत्र विधिवत रूप में प्रस्तुत नहीं किया गया है ।

(4) सभी व्यय (छोटे-मोटे व्ययों को छोड़कर) बैंक खाते के माध्यम से नहीं किए गए हैं; और

यत:, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (6) के अनुसार एवं उपयु र्क्त कारण बताओं नोटिस के द्वारा श्री पुष्पेन्द्र कु मार को निर्देश दिया गया था की वे इस नोटिस के प्राप्त होने के 20 दिनों के भीतर लेखा दाखिल नहीं करने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन निर्वाचन आयोग के समक्ष प्रस्तुत करें और साथ ही उक्त त्रुटियों को दूर करते हुए अपना निर्वाचन व्ययों का लेखा जिला निर्वाचन अधिकारी, मैनपुरी के समक्ष प्रस्तुत करें; और

यत:, जिला निर्वाचन अधिकारी, मैनपुरी जिला, द्वारा भारत निर्वाचन आयोग को प्रस्तुत की गई पावती रसीद के अनुसार, उक्त नोटिस श्री पुष्पेन्द्र कु मार को दिनांक 17 मार्च, 2020 को उनके द्वारा नामांकन पत्र में दर्शाये गये पते पर तामील किया गया था; और

यत:, जिला निर्वाचन अधिकारी, मैनपुरी ने दिनांक 13 मई, 2020 की अपनी अनुपूरक रिपोर्ट में यह बताया है कि श्री पुष्पेन्द्र कु मार द्वारा अभी तक कोई जवाब नहीं दिया गया है और मूल वाउचर सहित हस्ताक्षरित निर्वाचन व्यय के सही लेखे का विवरण प्रस्तुत नहीं किया गया है; और

यतः, भारत निर्वाचन आयोग द्वारा अभ्यर्थी श्री पुष्पेन्द्र कु मार को अंतिम अवसर प्रदान करते हुए पत्र सं.76/उ.प्र.- वि.स./108/भा.नि.आ./पत्र/टेरी./उ.अनु.-III-उ.प्र./2017, दिनांक 25 जून, 2020 जारी किया गया, जो जिला निर्वाचन अधिकारी, मैनपुरी के माध्यम से उन्हें दिनांक 30 जून, 2020 को प्राप्त हुआ; और

यत:, जिला निर्वाचन अधिकारी, से प्राप्त दिनांक 21 जुलाई, 2020 की रिपोर्ट के अनुसार श्री पुष्पेन्द्र कु मार द्वारा उक्त कमियों को सुधारते हुए न तो कोई लेखा जमा किया गया है न ही कोई अभ्यावेदन प्रस्तुत किया गया है । इसके अतिरिक्त, उक्त नोटिस/पत्र मिलने के उपरांत भी अभ्यर्थी द्वारा उक्त विफलता के लिए भारत निर्वाचन आयोग के समक्ष कोई कारण अथवा स्पष्टीकरण प्रस्तुत नहीं किया गया है; और

यत:, तथ्यों और उपलब्ध दस्तावेजों के आधार पर, आयोग का यह समाधान हो गया है कि श्री पुष्पेन्द्र कु मार विहित प्रपत्र में अपने निर्वाचन व्यय का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है कि :-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति –[भाग II—खण्ड 3(iii)] भारत का राजपत्र : अगस्त 8, 2020/श्रावण 17, 1942 193 (क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में विफल रहा है; तथा

(ख) उस विफलता के लिए कोई अच्छा कारण या औचित्य नहीं है

O. N. 66.— WHEREAS, the General Election for 108-Bhongaon Assembly Constituency of Uttar Pradesh, 2017 was announced by the Election Commission of India vide Press Note No. ECI/PN/1/2017 dated 4th January, 2017; and WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate has to lodge a true copy of his accounts of election expenses within 30 days with the concerned District Election Officer, from the date of election of the returned candidate; and

WHEREAS, the result of the election for 108-Bhongaon Assembly Constituency was declared by the Returning Officer on 11th March, 2017 and hence the last date for lodging the accounts of election expenses was 10th April, 2017;

and

WHEREAS, as per the report dated 13th April, 2017 submitted by the District Election Officer, Mainpuri District, Uttar Pradesh, Sh. Pushpendra Kumar, a contesting candidate of Bhartiya Subhash Sena from 108-Bhongaon Assembly Constituency of Uttar Pradesh has failed to lodge accounts of his election expenses, in the manner prescribed under the law; and

WHEREAS, on the basis of the said report of the District Election Officer, a Show-Cause notice No. 76/UP- LA/108/ECI/Notice/TERR/NS-III-UP/2017, dated 7th February, 2018 was issued under sub rule (5) of rule 89 of the Conduct of Election Rules, 1961 by the Election Commission of India to Sh. Pushpendra Kumar, for the following defects in accounts of his election expenses:-

(i) Election expenditure register was not filed including day to day accounts register, cash register, bank register, abstract statement.

(ii) Affidavit has not been duly submitted.

(iii) Requisite vouchers in respect of items of election expenditure not submitted.

(iv) All Expenditure (except petty expenditure) not routed through bank account; and

WHEREAS, through the above said Show Cause Notice and as required under sub rule (6) of rule 89 of the Conduct of Election Rules, 1961, Sh. Pushpendra Kumar was directed to submit his representation in writing to the Commission explaining the reason for the above said shortcomings in his accounts of election expenses and also to194 THE GAZETTE OF INDIA : AUGUST 8, 2020/SRAVANA 17, 1942 [PART II—SEC. 3(iii)] lodge the accounts, after rectifying the above mentioned defects, with the District Election Officer, Mainpuri within 20 days from the date of receipt of the notice; and

WHEREAS, as per the acknowledgement receipt made available to the Election Commission by the District Election Officer, Mainpuri, the said notice was served to Sh. Pushpendra Kumar on 17th March, 2020 at the address provided by the candidate in the nomination papers; and

WHEREAS, the District Election Officer, Mainpuri has submitted in his supplementary report, dated dated 13th May, 2020 that Sh. Pushpendra Kumar, has not submitted any representation or a statement of correct account of his election expenses duly signed, along with original vouchers etc. till that date; and

WHEREAS, the candidate was given last opportunity to rectify the defects found in his accounts, vide Commission's letter No. 76/UP-LA/108/ECI/LET/TERR/NS-III-UP/2017, dated 25th June, 2020, which was served to him on 30th June, 2020 through the District Election Officer, Mainpuri; and

WHEREAS, as per the report, dated 21st July, 2020 submitted by the District Election Officer to the Commission, Sh. Pushpendra Kumar has neither rectified the above mentioned defects nor any representation has been received from him. Further, no representation from the candidate has been received in the Secretariat of the Election Commission of India, after delivery of the above mentioned notice/letter; and

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Pushpendra Kumar has failed to lodge his accounts of election expenses in the manner prescribed under law and has no good reason or justification for the failure to do so; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that :-

"If the Election Commission is satisfied that a person-

(a) Has failed to lodge an account of election expenses within the time and in the manner required by or under this Act; and

(b) Has no good reason or justification for the failure,

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Sh. Pushpendra Kumar, resident of Village Malpur, Post-Sultanganj Bhongaon, Mainpuri, Uttar Pradesh and a contesting candidate from 108-Bhongaon Assembly Constituency of the State of Uttar Pradesh in the General Elections to the State Legislative Assembly, 2017, to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order.

WHEREAS, as per the acknowledgement receipt made available to the Election Commission by the District Election Officer, Mainpuri, the said notice was served to Sh. Sandeep Kumar on 30th June, 2020 at the address provided by the candidate in the nomination papers; and

यत:, जिला निर्वाचन अधिकारी, से प्राप्त दिनांक 21 जुलाई, 2020 की रिपोर्ट के अनुसार श्री अजय यादव द्वारा उक्त कमियों को सुधारते हुए न तो कोई लेखा जमा किया गया है न ही कोई अभ्यावेदन प्रस्तुत किया गया है । इसके अतिरिक्त, उक्त नोटिस/पत्र मिलने के उपरांत भी अभ्यर्थी द्वारा उक्त विफलता के लिए भारत निर्वाचन आयोग के समक्ष कोई कारण अथवा स्पष्टीकरण प्रस्तुत नहीं किया गया है; और

यत:, तथ्यों और उपलब्ध दस्तावेजों के आधार पर, आयोग का यह समाधान हो गया है कि श्री अजय यादव विहित प्रपत्र में अपने निर्वाचन व्यय का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है कि :-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति –

(ख) उस विफलता के लिए कोई अच्छा कारण या औचित्य नहीं है

अत:, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतदद्वारा घोषणा करता है कि श्री अजय यादव, निवासी ग्राम मनीरामपुर, पोस्ट मधपुरी, तहसील भोगांव, मैनपुरी, उत्तर प्रदेश, जो उत्तर प्रदेश विधान सभा साधारण निर्वाचन, 2017 में 108-भोगाँव विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी थे, इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निरहित होंगे ।

ORDER

New Delhi, the 31st July, 2020

O. N. 68.— WHEREAS, the General Election for 108-Bhongaon Assembly Constituency of Uttar Pradesh, 2017 was announced by the Election Commission of India vide Press Note No. ECI/PN/1/2017 dated 4th January, 2017; and

WHEREAS, as per the report dated 13th April, 2017 submitted by the District Election Officer, Mainpuri District, Uttar Pradesh, Sh. Ajay Yadav, a contesting candidate of Voters Party International from 108-Bhongaon Assembly Constituency of Uttar Pradesh has failed to lodge accounts of his election expenses, in the manner prescribed under the law; and

WHEREAS, on the basis of the said report of the District Election Officer, a Show-Cause notice No. 76/UP- LA/108/ECI/Notice/TERR/NS-III-UP/2017, dated 7th February, 2018 was issued under sub rule (5) of rule 89 of the Conduct of Election Rules, 1961 by the Election Commission of India to Sh. Ajay Yadav, for the following defects in accounts of his election expenses:-

(i) Election expenditure register was not filed including day to day accounts register, cash register, bank register, abstract statement.

(ii) Affidavit has not been duly submitted.

(iii) Requisite vouchers in respect of items of election expenditure not submitted.

(iv) All Expenditure (Except petty expenditure) not routed through bank account; and

WHEREAS, through the above said Show Cause Notice and as required under sub rule (6) of rule 89 of the Conduct of Election Rules, 1961, Sh. Ajay Yadav was directed to submit his representation in writing to the Commission explaining the reason for the above said shortcomings in his accounts of election expenses and also to lodge the accounts, after rectifying the above mentioned defects, with the District Election Officer, Mainpuri within 20 days from the date of receipt of the notice; and

WHEREAS, as per the acknowledgement receipt made available to the Election Commission by the District Election Officer, Mainpuri, the said notice was served to Sh. Anil b/o Sh. Ajay Yadav on 17th March, 2020 at the address provided by the candidate in the nomination papers; and

WHEREAS, the District Election Officer, Mainpuri has submitted in his supplementary report, dated 13th May, 2020 that Sh. Ajay Yadav, has not submitted any representation or a statement of correct account of his election expenses duly signed, along with original vouchers etc. till that date; and

WHEREAS, as per the report, dated 21st July, 2020 submitted by the District Election Officer to the Commission, Sh. Ajay Yadav has neither rectified the above mentioned defects nor any representation has been received from him. Further, no representation from the candidate has been received in the Secretariat of the Election Commission of India, after delivery of the above mentioned notice/letter; and

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Ajay Yadav has failed to lodge his accounts of election expenses in the manner prescribed under law and has no good reason or justification for the failure to do so; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that :-

"If the Election Commission is satisfied that a person-

(a) Has failed to lodge an account of election expenses within the time and in the manner required by or under this Act; and

(b) Has no good reason or justification for the failure,

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Sh. Ajay Yadav, resident of Village Manirampur, Post-Madhupuri, Tehsil- Bhongaon, Mainpuri, Uttar Pradesh and a contesting candidate from 108-Bhongaon Assembly Constituency of the State of Uttar Pradesh in the General Elections to the State Legislative Assembly, 2017, to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order.

(ए.जी.एम.यू.टी:1989), को उनके कार्यभार ग्रहण करने की तारीख से आगामी आदेशों तक के लिए राष्ट्रीय राजधानी क्षेत्र दिल्ली के मुख्य निर्वाचन अधिकारी के रूप में नामित करता है।

2. डा. जी. नरेंद्र कु मार, राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार के अधीन सभी पदभार या किसी कार्य के पदभारों को तत्काल सौंप देंगे या धारण करना समाप्त कर देंगे, जो कि वे ऐसा पदभार ग्रहण करने से पहले धारण कर रहे थे।

3. डा. जी. नरेंद्र कु मार, मुख्य निर्वाचन अधिकारी, राष्ट्रीय राजधानी क्षेत्र दिल्ली के रूप में कार्य करते हुए राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार के अधीन किसी भी प्रकार का कोई अतिरिक्त कार्यभार ग्रहण नहीं करेंगें सिवाय इसके कि उनको राज्य सचिवालय में निर्वाचन विभाग के प्रभारी, सरकार के प्रधान सचिव पदाभिहित किया जाएगा।

O.N. 69.—In exercise of the powers conferred by sub-section (1) of section 13A of the Representation of the People Act, 1950 (43 of 1950), the Election Commission of India in consultation with the Govt. of N.C.T. of Delhi hereby designates Dr. G.Narendra Kumar, IAS (AGMUT: 1989) as the Chief Electoral Officer for the N.C.T. of Delhi with effect from the date he takes over charge and until further orders in place of Dr. Ranbir Singh, IAS.

2. Dr. G. Narendra Kumar shall cease to hold and hand over forthwith the charge of all or any charges of work under the Govt. of N.C.T. of Delhi, which he may be holding before such assumption of office.

3. Dr. G. Narendra Kumar while functioning as the Chief Electoral Officer, N.C.T. of Delhi shall not hold any additional charge whatsoever under the Government of N.C.T. of Delhi except that he should be designated Principal Secretary to the Government in charge of Election Department in the State Secretariat.
