आ. अ. 71.—यतः, भारत निर्वाचन आयोग द्वारा मध्य प्रदेश राज्य में लोक सभा के साधारण निर्वाचन, 2019 की घोषणा प्रेस नोट संख्या ईसीआई/प्रे.नो./23/2019 दिनांक 10.03.2019 के जरिए की गई थी। कार्यक्रम के अनुसार, मतगणना की तारीख 23.05.2019 थी।

और यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सही प्रति जिला निर्वाचन अधिकारी को दाखिल करनी होती है;

और यतः, मुख्य निर्वाचन अधिकारी, मध्य प्रदेश के दिनांक 26.06.2019 के पत्र सं.10-क/लो.स.2019/ चार/निर्वा.व्यय/गुना/13607 द्वारा अग्रेषित जिला निर्वाचन अधिकारी, शिवपुरी जिला, मध्य प्रदेश द्वारा दिनांक 22.06.2019 को प्रस्तुत रिपोर्ट के अनुसार श्री धाकड़ लोके न्द्र सिंह राजपूत, मध्य प्रदेश के 04-गुना संसदीय निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले बहुजन समाज पार्टी के अभ्यर्थी, अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे ।

और यतः, जिला निर्वाचन अधिकारी, शिवपुरी जिला, मध्य प्रदेश और मुख्य निर्वाचन अधिकारी, मध्य प्रदेश की रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए श्री धाकड़ लोके न्द्र सिंह राजपूत को कारण बताओ नोटिस दिनांक 18.07.2019 जारी किया गया था;

और यत:, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 18.07.2019 के उपयु र्क्त कारण बताओ नोटिस के जरिए श्री धाकड़ लोके न्द्र सिंह राजपूत को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर आयोग में लेखे न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, अपने पूर्ण निर्वाचन व्यय का लेखा संबंधित जिला निर्वाचन अधिकारी को प्रस्तुत करें;

और यत:, उक्त नोटिस श्री धाकड़ लोके न्द्र सिंह राजपूत द्वारा 08.08.2019 को प्राप्त किया था। अभ्यर्थी से प्राप्त पावती रसीद जिला निर्वाचन अधिकारी, शिवपुरी द्वारा दिनांक 29.11.2019 के पत्र संख्या सा. निर्वा/व्यय लेखा /2019/142 द्वारा आयोग को प्रस्तुत कर दी गई है;

और यत:, जिला निर्वाचन अधिकारी, शिवपुरी द्वारा अपने दिनांक 19.02.2020 के पत्र सं. सा. निर्वा/व्यय/ लेखा /2020/38 के जरिए प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री धाकड़ लोके न्द्र सिंह राजपूत ने आज की तारीख तक न तो कोई भी अभ्यावेदन और न ही मूल वाउचरों आदि के साथ विधिवत रूप से हस्ताक्षरित अपने निर्वाचन व्यय के सही लेखे का विवरण प्रस्तुत किया है। इसके अतिरिक्त, उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है;

और यत:, आयोग का यह समाधान हो गया है कि श्री धाकड़ लोके न्द्र सिंह राजपूत निर्वाचन खर्चों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है;

और यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है कि:-

''यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति-

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है; तथा

(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है, तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरर्हित घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरर्हित होगा;

राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद् का सदस्य चुने जाने अथवा होने के लिए निरर्हित है।

ORDER

New Delhi, the 5th August, 2020

O.N. 71.—WHEREAS, the General Election to the Lok Sabha in the state of Madhya Pradesh, 2019 was announced by Election Commission of India vide Press Note No ECI/PN/23/2019 dated 10.03.2019. As per the schedule, the Date of Counting was 23.05.2019.

AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate has to lodge a true copy of his account of election expenses within 30 days with the District Election Officer, from the date of election of returned candidate;

AND WHEREAS, the result of 04-Guna Parliamentary Constituency was declared by the Returning Officer concerned on 23.05.2019. As such the last date for lodging of account of election expenses was 22.06.2019.

AND WHEREAS, as per the report dated 22.06.2019 submitted by the District Election Officer, Shivpuri District, Madhya Pradesh and forwarded by Chief Electoral Officer, Madhya Pradesh vide letter No.10-A/Lok Sabha 2019/Four/Elec.Expenses/Guna/13607 dated 26.06.2019, Shri Dhakad Lokendra Singh Rajpoot, Bahujan Samaj Party contesting candidate from 04-Guna Parliamentary Constituency of Madhya Pradesh, failed to lodge any account of his election expenses as required by law.

AND WHEREAS, on the basis of the reports of the District Election Officer, Shivpuri District, Madhya Pradesh and the Chief Electoral Officer, Madhya Pradesh, a Show Cause notice dated 18.07.2019 was issued by the Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to Shri Dhakad Lokendra Singh Rajpoot for non submission of accounts of Election expenses;

AND WHEREAS, as per Sub Rule(6) of Rule 89 of the Conduct of Election Rules, 1961, through the above said Show Cause Notice dated 18.07.2019, Shri Dhakad Lokendra Singh Rajpoot was directed to submit his representation in writing to the Commission explaining the reason for non submission of accounts and also to lodge his complete accounts of election expenses to the District Election Officer concerned within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was received by Shri Dhakad Lokendra Singh Rajpoot on 08.08.2019. Acknowledgment receipt obtained from the candidate have been submitted to the Commission by District Election Officer, Shivpuri vide his letter No.Gen. Elec./2019/1942 dated 29.11.2019 .

AND WHEREAS, in the supplementary report submitted by District Election Officer, Shivpuri vide his letter No. Gen. Elec./Expenditure/Account/ 2020/38 dated 19.02.2020 it has been stated that Shri Dhakad Lokendra Singh Rajpoot has not submitted any representation or a statement of correct account of his election expenses, duly signed along with original vouchers etc. till date. Further, he has neither furnished any reason nor explanation for the said failure even after receipt of the due notice to the Election Commission of India as well;

AND WHEREAS, the Commission is satisfied that Shri Dhakad Lokendra Singh Rajpoot has failed to lodge an account of election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10 A of the Representation of the People Act, 1951 stipulates that :-

(b) has no good reason or justification for the failure, the Election Commission shall by order published in the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from the date of the order;

NOW THEREFORE, in pursuance of Section 10 A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Dhakad Lokendra Singh Rajpoot resident of A-9/14, Basant Vihar, Indore Marg, Ujjain(M.P.) 456010, the contesting candidate of Bahujan Samaj Party for the General Election to the Lok Sabha in the state of Madhya Pradesh from 04-Guna Parliamentary Constituency to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order.

आ. अ. 72.—यत:, भारत निर्वाचन आयोग द्वारा उत्तर प्रदेश राज्य में 7-गंगोह विधान सभा निर्वाचन क्षेत्र से उप- निर्वाचन, 2019 की घोषणा प्रेस नोट संख्या ईसीआई/प्रे.नो./84/2019 दिनांक 21 सितम्बर, 2019 के जरिए की गई थी;

और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सही प्रति संबन्धित जिला निर्वाचन अधिकारी को दाखिल करनी होती है; और

यत:, 7-गंगोह विधान सभा निर्वाचन क्षेत्र के रिटर्निंग अधिकारी द्वारा उक्त विधान सभा क्षेत्र से निर्वाचन के परिणाम दिनांक 24 अक्तू बर, 2019 को घोषित किए गए थे और इस प्रकार, निर्वाचन व्यय का लेखा दाखिल करने की अन्तिम तारीख 23 नवम्बर, 2019 थी; और

यत:, जिला निर्वाचन अधिकारी, सहारनपुर जिला, उत्तर प्रदेश द्वारा प्रस्तुत दिनांक 28 नवम्बर, 2019 की रिपोर्ट के अनुसार, उत्तर प्रदेश के 7-गंगोह विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी श्री प्रदीप अपने निर्वाचन व्यय का कोई भी लेखा दायर करने में विफल रहे हैं; और

यत:, जिला निर्वाचन अधिकारी, की उक्त रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत श्री प्रदीप को दिनांक 27 जनवरी, 2020 को निर्वाचन व्यय का कोई भी लेखा दाखिल नहीं करने हेतु कारण बताओ नोटिस नं. 76/उ.प्र.-वि.स./7/ भा.नि.आ./नोटिस/टेर./उ.अनु.-III- उ.प्र./2019(उप) जारी किया गया था; और

यत:, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (6) के अनुसार एवं उपयु र्क्त कारण बताओ नोटिस के द्वारा श्री प्रदीप को निर्देश दिया गया था की वे इस नोटिस के प्राप्त होने के 20 दिनों के भीतर लेखा दाखिल नहीं करने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन निर्वाचन आयोग के समक्ष प्रस्तुत करें और साथ ही अपना निर्वाचन व्ययों का लेखा जिला निर्वाचन अधिकारी, सहारनपुर के समक्ष प्रस्तुत करें; और [भाग II—खण्ड 3(iii)] भारत का राजपत्र : अगस्त ¹⁵, ²⁰²⁰/श्रावण ²⁴, ^{1942 207}

यत:, जिला निर्वाचन अधिकारी, सहारनपुर जिला, द्वारा भारत निर्वाचन आयोग को प्रस्तुत की गई पावती रसीद के अनुसार, उक्त नोटिस श्री प्रदीप को दिनांक 4 जुलाई, 2020 को उनके द्वारा नामांकन पत्र में दर्शाये गये पते पर तामील किया गया था; और

यत:, जिला निर्वाचन अधिकारी, सहारनपुर ने दिनांक 24 जुलाई, 2020 की अपनी अनुपूरक रिपोर्ट में यह बताया है कि श्री प्रदीप द्वारा अभी तक कोई जवाब नहीं दिया गया है और मूल वाउचर सहित हस्ताक्षरित निर्वाचन व्यय के सही लेखे का विवरण प्रस्तुत नहीं किया गया है । इसके अतिरिक्त, उक्त नोटिस मिलने के उपरांत भी अभ्यर्थी द्वारा उक्त विफलता के लिए भारत निर्वाचन आयोग के समक्ष कोई कारण अथवा स्पष्टीकरण प्रस्तुत नहीं किया गया है; और

यत:, तथ्यों और उपलब्ध दस्तावेजों के आधार पर, आयोग का यह समाधान हो गया है कि श्री प्रदीप अपने निर्वाचन खर्चों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है;

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है कि :-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति –

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में विफल रहा है; तथा

(ख) उस विफलता के लिए कोई अच्छा कारण या औचित्य नहीं है

तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरर्हित घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरर्हित होगा ।";

अत:, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि श्री प्रदीप, निवासी ग्राम तातारपुर कलां, डाक बीनपुर, तहसील नकु ड़, जिला सहारनपुर, उत्तर प्रदेश जो उत्तर प्रदेश विधान सभा उप-निर्वाचन, 2019 में 7-गंगोह विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी थे, इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद् का सदस्य चुने जाने अथवा होने के लिए निरर्हित होंगे ।

O.N. 72.—WHEREAS, the Bye Election for 7-Gangoh Assembly Constituency of Uttar Pradesh, 2019 was announced by the Election Commission of India vide Press Note No. ECI/PN/84/2019 dated 21st September, 2019; and WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate has to lodge a true copy of his accounts of election expenses within 30 days with the concerned District Election Officer, from the date of election of the returned candidate; and

WHEREAS, the result of the election for 7-Gangoh Assembly Constituency was declared by the Returning Officer on 24th October, 2019 and hence the last date for lodging the accounts of election expenses was 23rd November, 2019; and

WHEREAS, as per the report dated 28th November, 2019 submitted by the District Election Officer, Saharanpur District, Uttar Pradesh, Sh. Pradeep, a contesting candidate from 7-Gangoh Assembly Constituency of Uttar Pradesh has failed to lodge any account of his election expenses, as required under law; and²⁰⁸ THE GAZETTE OF INDIA : AUGUST ¹⁵, ²⁰²⁰/SRAVANA ²⁴, ¹⁹⁴² [PART II—SEC. ³(iii)] WHEREAS, on the basis of the said report of the District Election Officer, a Show-Cause notice No. 76/UP- LA/7/ECI/Notice/TERR/NS-III-UP/2019(Bye), dated 27th January, 2020 was issued under Sub-Rule (5) of rule 89 of the Conduct of Election Rules, 1961 by the Election Commission of India to Sh. Pradeep, for non submission of any accounts of his Election expenses; and

WHEREAS, through the above said Show-Cause Notice and under Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, Sh. Pradeep was directed to submit his representation in writing to the Commission explaining the reason for non-submission of accounts and also to lodge his accounts of election expenses with the District Election Officer, Saharanpur within 20 days from the date of receipt of the notice; and

WHEREAS, as per the acknowledgement receipt made available to the Election Commission by the District Election Officer, Saharanpur, the said notice was served to Sh. Pradeep on 4th July, 2020 at the address provided by the candidate in the nomination papers; and

WHEREAS, the District Election Officer, Saharanpur has submitted in his supplementary report, dated 24th July, 2020 that Sh. Pradeep, has not submitted any representation or a statement of correct account of his election expenses, duly signed along with original vouchers etc. till date. Further, after receipt of the said notice, he has neither furnished any reason nor explanation to the Election Commission of India, for his failure to lodge the accounts as prescribed under law; and

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Pradeep has failed to lodge his accounts of election expenses and has no good reason or justification for the failure to do so; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that :-

"If the Election Commission is satisfied that a person-

(a) Has failed to lodge an account of election expenses within the time and in the manner required by or under this Act; and

(b) Has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from the date of the order.";

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Sh. Pradeep, resident of Village-Tatarpur Kalan, Post-Binpur, Tehsil-Nakur, District-Saharanpur, Uttar Pradesh and a contesting candidate from 7-Gangoh Assembly Constituency of the State of Uttar Pradesh in the Bye Elections to the Legislative Assembly, 2019, to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order.

आ. अ. 73.—यतः, भारत निर्वाचन योग का यह समाधान हो गया है कि नीचे दी गई तालिका के स्तंभ 2में

विनिर्दिष्ट के रल राज्य से लोक सभा के साधारण निर्वाचन, 2019 में स्तंभ 3 में विनिर्दिष्ट संसदीय निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले स्तंभ 4 में विनिर्दिष्ट प्रत्येक अभ्यर्थी अपने निर्वाचन व्ययों का लेखा दाखिल करने में विफल रहा है, जैसा उक्त तालिका के स्तंभ 5 में दर्शाया गया है और जैसा लोक प्रतिनिधित्व अधिनियम, 1951 तथा इसके अंतर्गत बने नियमों के अधीन आवश्यक है।

और यतः, निर्वाचन आयोग द्वारा विधिवत नोटिस देने के बाद भी इन अभ्यर्थियों ने उक्त विफलता के लिए न तो कोई कारण बताया और न ही कोई स्पष्टीकरण दिया है अथवा उनके द्वारा दिए गए प्रतिवेदन, यदि कोई है, पर विचार करने के बाद निर्वाचन आयोग का यह समाधान हो गया है कि उनके पास इस विफलता लिए कोई भी उचित कारण अथवा औचित्य नहीं है।

अतः, अब उक्त अधिनियम की धारा 10 के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि नीचे दी गई तालिका के स्तंभ 4 में विहित व्यक्ति इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद् का सदस्य चुने जाने अथवा होने के लिए निरर्हित होंगे।

New Delhi, the 10th August, 2020

O.N. 73.—Whereas, the Election Commission of India is satisfied that each of the contesting candidate specified in column 4 of the Table below at the General Election to the Lok Sabha, 2019 from the State of Kerala specified in column 2 and held from the Parliamentary Constituency specified in column 3 against his/her name has failed to lodge the account of his/her election expenses as shown in column 5 of the said Table as required by the Representation of the People Act, 1951 and the Rules made thereunder.

And whereas, the said candidates have furnished neither any reason nor explanation for the said failure even after due notice by the Election Commission or after considering the representation made by them, if any, the Election Commission is satisfied that they have no good reason or justification for the said failure.

Now, therefore, in pursuance of section 10A of the said Act, the Election Commission of India hereby declares the persons specified in column 4 of the Table below to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order.
