आ. अ. 86 .—यत:,भारत निर्वाचन आयोग का समाधान हो गया है कि नीचे तालिका के स्तंभ 2 में यथा- निर्दिष्ट,कर्नाटक राज्य सेलोक सभा के साधारण निर्वाचन,2019 में,तालिका के स्तंभ 4 में यथा-निर्दिष्ट निर्वाचन लड़ने वाले अभ्यर्थी,जो स्तंभ 3 में अपने नाम के सामने निर्दिष्टसंसदीय निर्वाचन क्षेत्र से आयोजित निर्वाचन लड़े थे, अपने निर्वाचन-खर्चों का लेखा लोक प्रतिनिधित्व अधिनियम, 1951 और तदंतर्गत बनाए गए नियमों द्वारा यथापेक्षित रीति, जैसा कि स्तंभ 5 में दर्शाया गया है, से दर्ज करने में असफल रहे हैं।

और यतः, उक्त असफलता के लिए उनके द्वारा दिए गए अभ्यावेदन पर विचार करने के उपरांत निर्वाचन आयोग का समाधान हो गया है कि उनके पास उक्त असफलता के लिए कोई उचित कारण या औचित्य नहीं है।

New Delhi, the 27th August, 2020

O. N. 86.— Whereas, the Election Commission of India is satisfied that the contesting candidate specified in column 4 of the Table below at the General Election to the Lok Sabha, 2019 from the State of Karnataka, specified in column 2 and held from the Parliamentary Constituency specified in column 3 against his name has failed to lodge the account of his election expenses as shown in column 5 of the said Table as required by the Representation of the People Act, 1951 and the Rules made thereunder.

And whereas, after considering the representation made by him for the said failure, the Election Commission is satisfied that he has no good reason or justification for the said failure.

Now, therefore, in pursuance of section 10A of the said Act, the Election Commission of India hereby declares the person specified in column 4 of the Table below to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order.

आ. अ. 87 .—यतः, भारत निर्वाचन आयोग द्वारा छत्तीसगढ़ राज्य मे लोक सभा के साधारण निर्वाचन 2019 की घोषणा प्रेस नोट संख्या ईसीआई/प्रे.नो./23/2019 दिनांक 10 मार्च, 2019 के जरिए की गई थी । कार्यक्रम के अनुसार, मतगणना की तारीख 23 मई, 2019 थी ।

और यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सही प्रति जिला निर्वाचन अधिकारी को दाखिल करनी होती है;

और यतः, 11-कांके र (अ.ज.जा.) लोक सभा निर्वाचन क्षेत्र सहित संबंधित रिटर्निंग अधिकारी द्वारा उक्त निर्वाचन के परिणाम 23 मई, 2019 को घोषित किए गए थे । इस प्रकार, निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 22 जून, 2019 थी;

और यतः, जिला निर्वाचन अधिकारी, उत्तर बस्तर कांके र जिला, छत्तीसगढ़ द्वारा प्रस्तुत और मुख्य निर्वाचन अधिकारी, छत्तीसगढ़ द्वारा अपने दिनांक 26 जून, 2019 के पत्र सं. 21/चार/लो.स.चु./EEM/2019/6169 के जरिए अग्रेषित दिनांक 25 जून, 2019 की रिपोर्ट के अनुसार श्री उमाशंकर भण्डारी, जो छत्तीसगढ़ के 11-कांके र (अ.ज.जा.) लोक सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले शिवसेना के अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे हैं ।

और यतः, जिला निर्वाचन अधिकारी, उत्तर बस्तर कांके र जिला, छत्तीसगढ़ और मुख्य निर्वाचन अधिकारी, छत्तीसगढ़ की रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए श्री उमाशंकर भण्डारी को कारण बताओ नोटिस दिनांक 14 अगस्त, 2019 जारी किया गया था;

और यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 14 अगस्त, 2019 के उपयु र्क्त कारण बताओ नोटिस के जरिए श्री उमाशंकर भण्डारी को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखे न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें;

और यतः, उक्त नोटिस श्री उमाशंकर भण्डारी द्वारा 31 अगस्त, 2019 को प्राप्त किया था । अभ्यर्थी से प्राप्त पावती रसीद जिला निर्वाचन अधिकारी, उत्तर बस्तर कांके र द्वारा अपने दिनांक 31 जनवरी, 2020 के पत्र संख्या सा.निर्वा./लो.स.नि.व्यय/2019/73 के जरिए आयोग को प्रस्तुत कर दी गई है;

और यतः, जिला निर्वाचन अधिकारी, उत्तर बस्तर कांके र द्वारा अपने दिनांक 13 मार्च, 2020 के पत्र संख्या सा.निर्वा./लोसनि-2019/2020/150 के जरिए प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री उमाशंकर भण्डारी ने आज की तारीख तक न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है । इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है;

और यतः, आयोग का यह समाधान हो गया है कि श्री उमाशंकर भण्डारी निर्वाचन खर्चों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है,

और यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है कि :-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति -

i. निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है; तथा

ii. उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है, तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरर्हित घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरर्हित होगा;

अतः, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि छत्तीसगढ़ राज्य के 11-कांके र (अ.ज.जा.) लोक सभा निर्वाचन क्षेत्र से छत्तीसगढ़ राज्य में लोक सभा के साधारण निर्वाचन, 2019 में निर्वाचन लड़ने वाले शिवसेना के अभ्यर्थी श्री उमाशंकर भण्डारी, निवासी ग्राम – गढ़पिछवाडी, तहसील – कांके र, जिला – उत्तर बस्तर कांके र, छत्तीसगढ़, इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निरर्हित है ।

O. N. 87 .—WHEREAS, the General Election to Lok Sabha of Chhattisgarh, 2019 was announced by Election Commission of India vide Press Note No. ECI/PN/23/2019 dated 10th March, 2019. As per the schedule, Date of Counting was 23rd May, 2019.

AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate has to lodge a true copy of his account of election expenses within 30 days with the District Election Officer, from the date of election returned candidate;

AND WHEREAS, the result of the said election was declared by the concerned Returning Officer including 11- Kanker (ST) Parliamentary Constituency on 23rd May, 2019. As such the last date for lodging of account of election expenses was 22nd June, 2019.

AND WHEREAS, as per the report dated 25th June, 2019 submitted by the District Election Officer, North Bastar Kanker District, Chhattisgarh and forwarded by Chief Electoral Officer, Chhattisgarh vide letter No. 21/चार/लो.स.चु./EEM/2019/6169 dated 26th June, 2019, Shri Umashankar Bhandari, Shiv Sena contesting candidate from 11-Kanker (ST) Parliamentary Constituency of Chhattisgarh, has failed to lodge any account of his election expenses as required by law.

AND WHEREAS, on the basis of the reports of the District Election Officer, North Bastar Kanker District, Chhattisgarh and the Chief Electoral Officer, Chhattisgarh, a Show Cause notice dated 14th August, 2019 was issued by Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to Shri Umashankar Bhandari for non-submission of Election expenses;

AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, through the above said Show Cause Notice dated 14th August, 2019, Shri Umashankar Bhandari was directed to submit his representation in writing in the Commission explaining the reason for non-submission of accounts and also to lodge his accounts of election expenses/rectify the defects in his accounts and submit the same the District Election Officer concerned within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was received by Shri Umashankar Bhandari on 31st August, 2019. Acknowledgment receipt obtained from the candidate have been submitted to the Commission by District Election Officer, North Bastar Kanker vide his letter No. सा.निर्वा./लो.स.नि.व्यय/2019/73 dated 31st January, 2020.

AND WHEREAS, in the supplementary report submitted by District Election Officer, North Bastar Kanker vide his letter No. सा.निर्वा./लोसनि-2019/2020/150 dated 13th March, 2020 has stated that Shri Umashankar Bhandari, has not submitted any representation or his account of election expenses, duly signed along with original vouchers etc. till date. Further, he has furnished neither any reason nor explanation for the said failure even after receipt of the due notice to the Election Commission of India as well;

AND WHEREAS, the Commission is satisfied that Shri Umashankar Bhandari has failed to lodge an account of election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that :-

"If the Election Commission is satisfied that a person:

(a) Has failed to lodge an account of election expenses within the time and in the manner required by law or under this Act, and

(b) Has no good reason or justification for the failure the Election Commission shall by order published in the official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from date of the under;

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Umashankar Bhandari, resident of Village – Gadhpichhvadi, Tehsil – Kanker, District – Uttar Bastar Kanker, Chhattisgarh and the contesting candidate of Shiv Sena for General Election to Lok Sabha of Chhattisgarh, 2019 from 11-Kanker (ST) Parliamentary Constituency of the state of Chhattisgarh to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Parliamentary or legislative Council of a State or Union Territory for a period of three years from the date of this order.

और यतः, जिला निर्वाचन अधिकारी, दुर्ग जिला, छत्तीसगढ़ और मुख्य निर्वाचन अधिकारी, छत्तीसगढ़ की रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए श्री अनूप कु मार पाण्डेय को कारण बताओ नोटिस दिनांक 19 अगस्त, 2019 जारी किया गया था;

और यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 19 अगस्त, 2019 के उपयु र्क्त कारण बताओ नोटिस के जरिए श्री अनूप कु मार पाण्डेय को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखे न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें;

और यतः, उक्त नोटिस श्री अनूप कु मार पाण्डेय द्वारा 30 अगस्त, 2019 को प्राप्त किया था । अभ्यर्थी से प्राप्त पावती रसीद जिला निर्वाचन अधिकारी, दुर्ग द्वारा अपने दिनांक 27 सितम्बर, 2019 के पत्र संख्या 3443/नि.प./2019 के जरिए आयोग को प्रस्तुत कर दी गई है;

और यतः, जिला निर्वाचन अधिकारी, दुर्ग द्वारा अपने दिनांक 6 मार्च, 2019 के पत्र संख्या 280/नि.प./2020 के जरिए प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री अनूप कु मार पाण्डेय ने आज की तारीख तक न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है । इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है;

AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, through the above said Show Cause Notice dated 19th August, 2019, Shri Anoop Kumar Pandey was directed to submit his representation in writing in the Commission explaining the reason for non-submission of accounts and also to lodge his accounts of election expenses/rectify the defects in his accounts and submit the same the District Election Officer concerned within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was received by Shri Anoop Kumar Pandey on 30th August, 2019. Acknowledgment receipt obtained from the candidate have been submitted to the Commission by District Election Officer, Durg vide his letter No. 3443/नि.प./2019 dated 27th September, 2019.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Durg vide his letter No. 280/नि.प./2020 dated 6th March, 2020 has stated that Shri Anoop Kumar Pandey, has not submitted any representation or his account of election expenses, duly signed along with original vouchers etc. till date. Further, he has furnished neither any reason nor explanation for the said failure even after receipt of the due notice to the Election Commission of India as well;

AND WHEREAS, the Commission is satisfied that Shri Anoop Kumar Pandey has failed to lodge an account of election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that :-

"If the Election Commission is satisfied that a person:

(a) Has failed to lodge an account of election expenses within the time and in the manner required by law or under this Act, and

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Anoop Kumar Pandey, resident of 41, Arya Nagar, Durg Chhattisgarh and the contesting Independent candidate for General Election to Lok Sabha of Chhattisgarh, 2019 from 07-Durg Parliamentary Constituency of the state of Chhattisgarh to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Parliamentary or legislative Council of a State or Union Territory for a period of three years from the date of this order.

घोषणा प्रेस नोट संख्या ईसीआई/प्रे.नो./23/2019 दिनांक 10 मार्च, 2019 के जरिए की गई थी । कार्यक्रम के अनुसार,

मतगणना की तारीख 23 मई, 2019 थी ।

और यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को,

निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सही प्रति जिला निर्वाचन

और यतः, 08-रायपुर लोक सभा निर्वाचन क्षेत्र सहित संबंधित रिटर्निंग अधिकारी द्वारा उक्त निर्वाचन के परिणाम 23 मई, 2019 को घोषित किए गए थे । इस प्रकार, निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 22 जून, 2019 थी;

और यतः, जिला निर्वाचन अधिकारी, रायपुर जिला, छत्तीसगढ़ द्वारा प्रस्तुत और मुख्य निर्वाचन अधिकारी, छत्तीसगढ़ द्वारा अपने दिनांक 26 जून, 2019 के पत्र सं. 21/चार/लो.स.चु./EEM/2019/6169 के जरिए अग्रेषित दिनांक 22 जून, 2019 की रिपोर्ट के अनुसार श्री इकराम सैफी, जो छत्तीसगढ़ के 08-रायपुर लोक सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले आम्बेडकराईट पार्टी ऑफ़ इन्डिया अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे हैं ।

और यतः, जिला निर्वाचन अधिकारी, रायपुर जिला, छत्तीसगढ़ और मुख्य निर्वाचन अधिकारी, छत्तीसगढ़ की रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए श्री इकराम सैफी को कारण बताओ नोटिस दिनांक 14 अगस्त, 2019 जारी किया गया था;

और यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 14 अगस्त, 2019 के उपयु र्क्त कारण बताओ नोटिस के जरिए श्री इकराम सैफी को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखे न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें;

और यतः, उक्त नोटिस श्री इकराम सैफी द्वारा 27 अगस्त, 2019 को प्राप्त किया था । अभ्यर्थी से प्राप्त पावती रसीद जिला निर्वाचन अधिकारी, रायपुर द्वारा अपने दिनांक 31 अगस्त, 2019 के पत्र संख्या 2806/निर्वा./नि.प./2019 के जरिए आयोग को प्रस्तुत कर दी गई है;

और यतः, जिला निर्वाचन अधिकारी, रायपुर द्वारा अपने दिनांक 9 मार्च, 2019 के पत्र संख्या 7396/निर्वा./ नि. प./2020 के जरिए प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री इकराम सैफी ने आज की तारीख तक न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है । इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है;

और यतः, आयोग का यह समाधान हो गया है कि श्री इकराम सैफी निर्वाचन खर्चों का लेखा दाखिल करन में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है,

और यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है कि :-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति -

O. N. 89 .—WHEREAS, the General Election to Lok Sabha of Chhattisgarh, 2019 was announced by Election Commission of India vide Press Note No. ECI/PN/23/2019 dated 10th March, 2019. As per the schedule, Date of Counting was 23rd May, 2019.

AND WHEREAS, the result of the said election was declared by the concerned Returning Officer including 08-Raipur Parliamentary Constituency on 23rd May, 2019. As such the last date for lodging of account of election expenses was 22nd June, 2019.

AND WHEREAS, as per the report dated 22th June, 2019 submitted by the District Election Officer, Raipur District, Chhattisgarh and forwarded by Chief Electoral Officer, Chhattisgarh vide letter No. 21/चार/लो.स.चु./EEM/2019/6169 dated 26th June, 2019, Shri Ikram Saifi, Ambedkarite Party of India contesting candidate from 08-Raipur Parliamentary Constituency of Chhattisgarh, has failed to lodge any account of his election expenses as required by law.

AND WHEREAS, on the basis of the reports of the District Election Officer, Raipur District, Chhattisgarh and the Chief Electoral Officer, Chhattisgarh, a Show Cause notice dated 14th August, 2019 was issued by Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to Shri Ikram Saifi for non- submission of Election expenses;

AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, through the above said Show Cause Notice dated 14th August, 2019, Shri Ikram Saifi was directed to submit his representation in writing in the Commission explaining the reason for non-submission of accounts and also to lodge his accounts of election expenses/rectify the defects in his accounts and submit the same the District Election Officer concerned within 20 days from the date of receipt of the notice;

आ. अ. 90 .—यत:, भारत निर्वाचन आयोग द्वारा उत्तर प्रदेश राज्य में 354-घोसी विधान सभा निर्वाचन क्षेत्र से उप निर्वाचन, 2019 की घोषणा प्रेस नोट संख्या ईसीआई/प्रे.नो./84/2019 दिनांक 21 सितम्बर, 2019 के जरिए की गई थी; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सही प्रति संबन्धित जिला निर्वाचन अधिकारी को दाखिल करनी होती है;

यत:, 354-घोसी विधान सभा निर्वाचन क्षेत्र के रिटर्निंग अधिकारी द्वारा उक्त विधान सभा क्षेत्र से निर्वाचन के परिणाम दिनांक 24 अक्तू बर, 2019 को घोषित किए गए थे और इस प्रकार, निर्वाचन व्यय का लेखा दाखिल करने की अन्तिम तारीख 23 नवम्बर, 2019 थी; और

यत:, जिला निर्वाचन अधिकारी, मऊ जिला, उत्तर प्रदेश द्वारा प्रस्तुत दिनांक 25 नवम्बर, 2019 की रिपोर्ट के अनुसार, उत्तर प्रदेश के 354-घोसी विधान सभा निर्वाचन क्षेत्र से बहुजन समाज पार्टी से निर्वाचन लड़ने वाले अभ्यर्थी श्री अब्दुल कयूम अपने निर्वाचन व्यय का सही लेखा विधि द्वारा यथापेक्षित रीति से दाखिल करने में विफल रहे हैं; और

यत:, जिला निर्वाचन अधिकारी, की उक्त रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (5) के अंतर्गत श्री अब्दुल कयूम को दिनांक 31 जनवरी, 2020 को निर्वाचन व्यय का लेखा निम्नलिखित त्रुटियों के साथ दाखिल करने हेतु कारण बताओं नोटिस नं.76/उ.प्र.-वि.स./354/भा.नि.आ./ पत्र/टेर./उ.अनु.-III-उ.प्र./2019(उप) जारी किया गया था:-

(1) निर्वाचन व्यय की मदों के संदर्भ में अपेक्षित वाउचर प्रस्तुत नहीं किए गए हैं |

(2) सभी व्यय (छोटे-मोटे व्ययों को छोड़कर) बैंक खाते के माध्यम से नहीं किए गए हैं |

यत:, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (6) के अनुसार एवं उपयु र्क्त कारण बताओं नोटिस के द्वारा श्री अब्दुल कयूम को निर्देश दिया गया था की वे इस नोटिस के प्राप्त होने के 20 दिनों के भीतर लेखा दाखिल नहीं करने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन निर्वाचन आयोग के समक्ष प्रस्तुत करें और साथ ही उक्त त्रुटियों को दूर करते हुए अपना निर्वाचन व्ययों का लेखा जिला निर्वाचन अधिकारी, मऊ के समक्ष प्रस्तुत करें; और[भाग II—खण्ड 3(iii)] भारत का राजपत्र : सितम्बर ¹², ²⁰²⁰/भाद्र ²¹, ¹⁹⁴² 255 यत:, जिला निर्वाचन अधिकारी, मऊ जिला, द्वारा भारत निर्वाचन आयोग को प्रस्तुत की गई पावती रसीद के अनुसार, उक्त नोटिस श्री अब्दुल कयूम को दिनांक 19 मार्च, 2020 को उनके द्वारा नामांकन पत्र में दर्शाये गये पते पर तामील किया गया था; और

यत:, जिला निर्वाचन अधिकारी, मऊ ने दिनांक 11 अगस्त, 2020 की अपनी अनुपूरक रिपोर्ट में यह बताया है कि श्री अब्दुल कयूम द्वारा अभी तक कोई जवाब नहीं दिया गया है और मूल वाउचर सहित हस्ताक्षरित निर्वाचन व्यय के सही लेखे का विवरण प्रस्तुत नहीं किया गया है । इसके अतिरिक्त, उक्त नोटिस मिलने के उपरांत भी अभ्यर्थी द्वारा उक्त विफलता के लिए भारत निर्वाचन आयोग के समक्ष कोई कारण अथवा स्पष्टीकरण प्रस्तुत नहीं किया गया है; और

यत:, तथ्यों और उपलब्ध दस्तावेजों के आधार पर, आयोग का यह समाधान हो गया है कि श्री अब्दुल कयूम विहित प्रपत्र में अपने निर्वाचन व्यय का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है कि :-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति –

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में विफल रहा है; तथा

(ख) उस विफलता के लिए कोई अच्छा कारण या औचित्य नहीं है

तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरर्हित घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरर्हित होगा ।";

अत:, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतदद्वारा घोषणा करता है कि श्री अब्दुल कयूम, निवासी मोहल्ला-करीमुद्दीनपुर, थाना व तहसील-घोसी, जनपद-मऊ, उत्तर प्रदेश, जो उत्तर प्रदेश विधान सभा उप निर्वाचन, 2019 में 354-घोसी विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी थे, इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निरर्हित होंगे ।

O.N. 90 .—WHEREAS, the Bye Election for 354-Ghosi Assembly Constituency of Uttar Pradesh, 2019 was announced by the Election Commission of India vide Press Note No. ECI/PN/84/2019 dated 21st September, 2019; and WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate has to lodge a true copy of his accounts of election expenses within 30 days with the concerned District Election Officer, from the date of election of the returned candidate; and

WHEREAS, the result of the election for 354-Ghosi Assembly Constituency was declared by the Returning Officer on 24th October, 2019 and hence the last date for lodging the accounts of election expenses was 23rd November, 2019; and

WHEREAS, as per the report dated 25th November, 2019 submitted by the District Election Officer, Mau District, Uttar Pradesh, Sh. Abdul Qayum, a contesting candidate of Bahujan Samaj Party from 354-Ghosi Assembly²⁵⁶ THE GAZETTE OF INDIA : SEPTEMBER ¹², ²⁰²⁰/BHADRA ²¹, ¹⁹⁴² [PART II—SEC. ³(iii)] Constituency of Uttar Pradesh has failed to lodge accounts of his election expenses, in the manner prescribed under the law; and

WHEREAS, on the basis of the said report of the District Election Officer, a Show-Cause notice No. 76/UP- LA/354/ECI/LET/TERR/NS-III-UP/2019(Bye), dated 31st January, 2020 was issued under sub rule (5) of rule 89 of the Conduct of Election Rules, 1961 by the Election Commission of India to Sh. Abdul Qayum, for the following defects in accounts of his election expenses:-

(i) Requisite vouchers in respect of items of election expenditure not submitted.

(ii) All Expenditure (Except petty expenditure) not routed through bank account; and

WHEREAS, through the above said Show Cause Notice and as required under sub rule (6) of rule 89 of the Conduct of Election Rules, 1961, Sh. Abdul Qayum was directed to submit his representation in writing to the Commission explaining the reason for the above said shortcomings in his accounts of election expenses and also to lodge the accounts, after rectifying the above mentioned defects, with the District Election Officer, Mau within 20 days from the date of receipt of the notice; and

WHEREAS, as per the acknowledgement receipt made available to the Election Commission by the District Election Officer, Mau, the said notice was served to Sh. Abdul Qayum on 19th March, 2020 at the address provided by the candidate in the nomination papers; and

WHEREAS, the District Election Officer, Mau has submitted in his supplementary report, dated 11th August, 2020 that Sh. Abdul Qayum, has not submitted any representation or a statement of correct account of his election expenses duly signed, along with original vouchers etc. till that date. Further, no representation from the candidate has been received in the Secretariat of the Election Commission of India, after delivery of the above mentioned notice; and

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Abdul Qayum has failed to lodge his accounts of election expenses in the manner prescribed under law and has no good reason or justification for the failure to do so; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that :-

"If the Election Commission is satisfied that a person-

(a) Has failed to lodge an account of election expenses within the time and in the manner required by or under this Act; and

(b) Has no good reason or justification for the failure,

the Election Commission shall, by order published in the official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from the date of the order.";

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Sh. Abdul Qayum, resident of Mohalla-Karimuddinpur, P.S. & Tehsil Ghosi, District-Mau, Uttar Pradesh and a contesting candidate from 354-Ghosi Assembly Constituency of the State of Uttar Pradesh in the Bye Elections to the State Legislative Assembly, 2019, to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order.

यत:, 1-बारामुला लोक सभा निर्वाचन क्षेत्र के रिटर्निंग अधिकारी द्वारा उक्त लोक सभा क्षेत्र से निर्वाचन के परिणाम दिनांक 23 मई 2019 को घोषित किए गए थे और इस प्रकार, निर्वाचन व्यय का लेखा दाखिल करने की अन्तिम तारीख 22 जून, 2019 थी; और

यत:, जिला निर्वाचन अधिकारी, जम्मू और कश्मीर की प्रस्तुत दिनांक 22 अगस्त, 2019 की रिपोर्ट जिसके साथ जिला निर्वाचन अधिकारी, बारामुला की दिनांक 27.06.2019 की रिपोर्ट अग्रेषित की गई थी के अनुसार,1-बारामुला निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी श्री जाविद अहमद कू रैशी विधि के अंतर्गत यथापेक्षित अपने निर्वाचन व्यय का कोई भी लेखा दायर करने में विफल रहे हैं; और

यत:, उक्त रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (5) के अंतर्गत श्री जाविद अहमद कू रैशी को दिनांक 13 सितम्बर, 2019 को निर्वाचन व्यय का कोई भी लेखा दाखिल करने हेतु कारण बताओं नोटिस नं. 76/जम्मू और कश्मीर-लो.स./1/2019/उ.अनु-1 जारी किया गया था; और

यत:, जिला निर्चावन अधिकारी, बारामुला, जम्मू एवं कश्मीर द्वारा प्रस्तुत दिनांक 12 फरवरी, 2020 की अनुपूरक रिपोर्ट के अनुसार, जम्मू और कश्मीर के 1-बारामुला संसदीय निर्वाचन क्षेत्र से निर्वाचन लडने वाले अभ्यर्थी श्री जाविद अहमद कु रैशी विधि द्वारा यथापेक्षित अपने निर्वाचन व्यय का सही लेखा दायर करने में विफल रहे है ; और

यत:, जिला निर्चावन अधिकारी, बारामुला की उक्त रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (5) के अंतर्गत श्री जाविद अहमद कु रैशी को दिनांक 3 मार्च, 2020 को निर्वाचन व्यय का लेखा निम्नलिखित त्रुटियों के साथ दाखिल करने हेतु कारण बताओ नोटिस न. 76/जम्मू और कश्मीर- लो.स./1/2019/उ.अनु-1 जारी किया गया था; और

(1) सार कथन (भाग I से भाग IV) तक विधिवत हस्ताक्षरित नहीं भरा हुआ हैं।

(2) विधिवत उम्मीदवार के शपथ पत्र में शपथ नहीं ली गई है।

(3) बैंक रजिस्टर और नकदी रजिस्टर के साथ दिन-प्रतिदिन के रजिस्टर पर हस्ताक्षर नहीं किए गए हैं।

(4) बैंक खाते का विवरण प्रस्तुत नहीं किया गया है।

(5) खाता विवरण के समर्थन में कोई वाउचर का उत्पादन नहीं किया गया हैं।

(6) बैंक खाते में जमा किए गए चुनाव खर्चों के लिए सभी रसीदों का विवरण और चेक द्वारा किए गए छोटे खर्चों को छोड़कर सभी भुगतान प्रदान नहीं किए गए हैं।

(7) निर्वाचन व्यय की मदों के संदर्भ में अपेक्षित वाउचर प्रस्तुत नहीं किए गए है।

यत:, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (6) के अनुसार, दिनांक 3 मार्च, 2020 के उपयु र्क्त कारण बताओं नोटिस के द्वारा श्री जाविद अहमद कू रैशी को निदेश दिया गया था की वे इस नोटिस के प्राप्त होने के 20 दिनों के भीतर लेखा दाखिल नहीं करने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन निर्वाचन आयोग के समक्ष प्रस्तुत करें और साथ ही उक्त त्रुटियों को दूर करते हुए अपना निर्वाचन व्ययों का लेखा जिला निर्वाचन अधिकारी, बारामुला के समक्ष प्रस्तुत करें; और

यत:, जिला निर्वाचन अधिकारी, बारामुला जिला, द्वारा भारत निर्वाचन आयोग को उपलब्ध करवाई गई पावती रसीद के अनुसार, उक्त नोटिस श्री जाविद अहमद कू रैशी को दिनांक 06 मार्च, 2020 को तामील किया गया था; और

यत:, जिला निर्वाचन अधिकारी, बारामुला ने दिनांक 30 जुलाई, 2020 की अपनी अनुपूरक रिपोर्ट में यह बताया है कि श्री जाविद अहमद कू रैशी न तो कोई अभ्यावेदन दिया है और न ही उक्त रिपोर्ट में इंगित की गई कमियों को सुधारा गया है। इसके अतिरिक्त भारत निर्वाचन आयोग सचिवालय में भी कोई अभ्यावेदन प्राप्त नही हुआ है; और²⁵⁸ THE GAZETTE OF INDIA : SEPTEMBER ¹², ²⁰²⁰/BHADRA ²¹, ¹⁹⁴² [PART II—SEC. ³(iii)] यत:, जिला निर्वाचन अधिकारी, बारामुला से प्राप्त दिनांक 30 जुलाई, 2020 की रिपोर्ट के अनुसार श्री जाविद अहमद कू रैशी द्वारा उक्त कमियों को सुधारते हुए न तो कोई लेखा जमा किया गया है न ही कोई अभ्यावेदन प्रस्तुत किया गया है । इसके अतिरिक्त, उक्त नोटिस मिलने के उपरांत भी अभ्यर्थी द्वारा उक्त विफलता के लिए भारत निर्वाचन आयोग के समक्ष कोई कारण अथवा स्पष्टीकरण प्रस्तुत नहीं किया गया है; और

यत:, तथ्यों और उपलब्ध दस्तावेजों के आधार पर, आयोग का यह समाधान हो गया है कि श्री जाविद अहमद कू रैशी विहित प्रपत्र में अपने निर्वाचन व्यय का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है;

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है कि :-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति –

(ख) उस विफलता के लिए कोई अच्छा कारण या औचित्य नहीं है

अत:, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतदद्वारा घोषणा करता है कि श्री जाविद अहमद कू रैशी, नर बाबा हँगा, बटगु ंड हंदवाडा, कु पवाडा, जम्मू और कश्मीर जो जम्मू और कश्मीर लोक सभा साधारण निर्वाचन, 2019 में 1-बारामुला लोक सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी थे, इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निरर्हित होंगे ।

O. N. 91.—WHEREAS, the General Election to the Lok Sabha, 2019 was announced by the Election Commission of India vide Press Note No. ECI/PN/24/2019 dated 10th March, 2019; and

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate has to lodge a true copy of his accounts of election expenses within 30 days with the concerned District Election Officer, from the date of election of the returned candidate; and

WHEREAS, the result of the election for 1-Baramulla Parliamentary Constituency was declared by the Returning Officer on 23rd May, 2019 and hence the last date for lodging the accounts of election expenses was 22nd June, 2019; and

WHEREAS, as per the report dated 22nd August, 2019 of the Chief Electoral Officer, Jammu & Kashmir, forwarding therewith DEO, Baramulla report dated 27.06.2019, Sh. Javid Ahmad Qureshi, a contesting candidate from 1-Baramulla Parliamentary Constituency has failed to lodge any account of his election expenses, as required under law; and

WHEREAS, on the basis of the said report, a Show-Cause Notice No. 76/J&K-HP/1/2019/NS-I, dated 13th September, 2019 was issued under Sub Rule (5) of rule 89 of the Conduct of Election Rules, 1961 by the Election Commission of India to Sh. Sh. Javid Ahmad Qureshi, for non submission of any accounts of his Election expenses; and[भाग II—खण्ड 3(iii)] भारत का राजपत्र : सितम्बर ¹², ²⁰²⁰/भाद्र ²¹, ¹⁹⁴² 259 WHEREAS, as per the supplementary report dated 12th February, 2020 submitted by the District Election Officer, Baramulla, Jammu & Kashmir, Sh. Javid Ahmad Qureshi, a contesting candidate from 1-Baramulla Parliamentary Constituency of J&K has failed to lodge true accounts of his election expenses, as required under law; and WHEREAS, on the basis of the said report of the District Election Officer, Baramulla, Jammu & Kashmir, a Show-Cause Notice No. 76/J&K-HP/1/2019/NS-I, dated 3rd March, 2020 was issued under Sub Rule (5) of rule 89 of the Conduct of Election Rules, 1961 by the Election Commission of India to Sh. Javid Ahmad Qureshi, for submission of accounts of his election expenses with the following defects: -

1. Abstract statement (Part I to part IV) not filled up/ not duly signed.

2. Duly sworn in Affidavit of candidate not filed.

3. Register of day to day account along with bank register and cash register not signed.

4. Voucher in respect of items of election expenditure not submitted at all.

5. The statement of bank account has not been submitted.

6. Details of all receipts for election expenses deposited in the bank a/c and all payment except petty expenses made by cheque have not been provided.

7. Not produced any voucher in support of account details.

WHEREAS, through the above said Show Cause Notice and under Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, Sh. Javid Ahmad Qureshi was directed to submit his representation in writing to the Commission explaining the reason for the above said shortcomings in his accounts of election expenses and also to lodge the accounts, after rectifying the above mentioned defects, with the District Election Officer, Baramulla within 20 days from the date of receipt of the notice; and

WHEREAS, as per the acknowledgement receipt made available to the Election Commission by the District Election Officer, Baramulla, the said notice was served to Sh. Javid Ahmad Qureshi on 6th March, 2020 and WHEREAS, the District Election Officer, Baramulla has submitted in his supplementary report, dated 30th July, 2020 that Sh. Javid Ahmad Qureshi, has neither submitted any representation and nor rectified the defects pointed out in the said notice. Further, no representation has been received in the Secretariat of the Election Commission of India, too and

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Javid Ahmad Qureshi has failed to lodge his accounts of election expenses in the manner prescribed under law and has no good reason or justification for the failure to do so; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that :-

"If the Election Commission is satisfied that a person-

(a) Has failed to lodge an account of election expenses within the time and in the manner required by or under this Act; and

(b) Has no good reason or justification for the failure,?

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Sh. Javid Ahmad Qureshi, Nar Baba Hangah, Batagund Handwara, Kupwara, J&K and a contesting candidate from 1-Baramulla Parliamentary Constituency of the State of J&K in the General Elections to the Lok Sabha, 2019, to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order.

यत:, जिला निर्वाचन अधिकारी, कठुआ ने दिनांक 26 मई, 2020 की अपनी अनुपूरक रिपोर्ट में यह बताया है कि श्री फिरदौस अहमद बवानी द्वारा अभी तक कोई जवाब नहीं दिया गया है और मूल वाउचर सहित हस्ताक्षरित निर्वाचन व्यय के सही लेखे का विवरण प्रस्तुत नहीं किया गया है । इसके अतिरिक्त, उक्त नोटिस मिलने के उपरांत भी अभ्यर्थी द्वारा उक्त विफलता के लिए भारत निर्वाचन आयोग के समक्ष कोई कारण अथवा स्पष्टीकरण प्रस्तुत नहीं किया गया है; और यत:, तथ्यों और उपलब्ध दस्तावेजों के आधार पर, आयोग का यह समाधान हो गया है कि श्री फिरदौस अहमद बवानी अपने निर्वाचन खर्चों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है;

WHEREAS, on the basis of the said report, a Show-Cause Notice No. 76/J&K-HP/5/2019/NS-I, dated 13th September, 2019 was issued under Sub Rule (5) of rule 89 of the Conduct of Election Rules, 1961 by the Election Commission of India to Sh. Firdous Ahmad Bawani, for non submission of any accounts of his Election expenses; and

WHEREAS, through the above said Show Cause Notice and under Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, Sh. Firdous Ahmad Bawani was directed to submit his representation in writing to the Commission explaining the reason for non submission of accounts and also to lodge his accounts of election expenses with the District Election Officer, Kathua 20 days from the date of receipt of the notice; and

WHEREAS, as per the acknowledgement receipt made available to the Election Commission by the District Election Officer, Kathua, the said notice was served to Sh. Firdous Ahmad Bawani on 26th September, 2019 at the address provided by the candidate in the nomination papers; and

WHEREAS, the District Election Officer, Kathua has submitted in his supplementary report, dated 26th May, 2020 that Sh. Firdous Ahmad Bawani, has not submitted any representation or a statement of correct account of his election expenses, duly signed along with original vouchers etc. till date. Further, after receipt of the said notice, he has neither furnished any reason nor explanation to the Election Commission of India, for his failure to lodge the accounts as prescribed under law; and

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Firdous Ahmad Bawani has failed to lodge his accounts of election expenses and has no good reason or justification for the failure to do so; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that: -

"If the Election Commission is satisfied that a person-

(a) Has failed to lodge an account of election expenses within the time and in the manner required by or under this Act; and

यत:, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (6) के अनुसार, दिनांक 13 सितम्बर 2019 के उपयु र्क्त कारण बताओ नोटिस के द्वारा श्री मिर्ज़ा सजाद हुसैन बेग को निदेश दिया गया था की वे इस नोटिस के प्राप्त होने के 20 दिनों के भीतर लेखा दाखिल नहीं करने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन निर्वाचन आयोग के समक्ष प्रस्तुत करें और साथ ही अपना निर्वाचन व्ययों का लेखा जिला निर्वाचन अधिकारी, अनंतनाग के समक्ष प्रस्तुत करें; और

यत:, जिला निर्वाचन अधिकारी, अनंतनाग जिला, द्वारा भारत निर्वाचन आयोग को प्रस्तुत की गई पावती रसीद के अनुसार, उक्त नोटिस श्री मिर्ज़ा सजाद हुसैन बेग को दिनांक 17 जनवरी, 2020(स्पीड पोस्ट/रजिस्टर्ड पोस्ट द्वारा) को उनके द्वारा नामांकन पत्र में दर्शाये गये पते पर तामील किया गया था; और

यत:, जिला निर्वाचन अधिकारी, अनंतनाग ने दिनांक 12 फरवरी, 2020 की अपनी अनुपूरक रिपोर्ट में यह बताया है कि श्री मिर्ज़ा सजाद हुसैन बेग द्वारा अभी तक कोई जवाब नहीं दिया गया है और मूल वाउचर सहित हस्ताक्षरित निर्वाचन व्यय के सही लेखे का विवरण प्रस्तुत नहीं किया गया है । इसके अतिरिक्त, उक्त नोटिस मिलने के उपरांत भी अभ्यर्थी द्वारा उक्त विफलता के लिए भारत निर्वाचन आयोग के समक्ष कोई कारण अथवा स्पष्टीकरण प्रस्तुत नहीं किया गया है; और यत:, तथ्यों और उपलब्ध दस्तावेजों के आधार पर, आयोग का यह समाधान हो गया है कि श्री मिर्ज़ा सजाद हुसैन बेग अपने निर्वाचन खर्चों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है;

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है कि :-

O.N. 93.—WHEREAS, the General Election to the Lok Sabha, 2019 was announced by the Election Commission of India vide Press Note No. ECI/PN/24/2019 dated 10th March, 2019; and;

WHEREAS, as per the report dated 22nd August, 2019 of the Chief Electoral Officer, Jammu & Kashmir, forwarding therewith DEO, Anantnag report dated 10.07.2019, Sh. Mirza Sajad Hussain Beigh, a contesting candidate from 3-Anantnag Parliamentary Constituency has failed to lodge any account of his election expenses, as required under law; and

WHEREAS, through the above said Show Cause Notice and under Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, Sh. Mirza Sajad Hussain Beighwas directed to submit his representation in writing to the Commission explaining the reason for non submission of accounts and also to lodge his accounts of election expenses with the District Election Officer, Anantnag within 20 days from the date of receipt of the notice; and

WHEREAS, as per the acknowledgement receipt made available to the Election Commission by the District Election Officer, Anantnag, the said notice was served to Sh. Mirza Sajad Hussain Beigh on 17th January, 2020 (Through Speed/Regd. Post) at the address provided by the candidate in the nomination papers; and

WHEREAS, the District Election Officer, Anantnag has submitted in his supplementary report, dated 12th February, 2020 that Sh. Mirza Sajad Hussain Beigh, has not submitted any representation or a statement of correct account of his election expenses, duly signed along with original vouchers etc. till date. Further, after receipt of the said notice, he has neither furnished any reason nor explanation to the Election Commission of India, for his failure to lodge the accounts as prescribed under law; and

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Mirza Sajad Hussain Beighhas failed to lodge his accounts of election expenses and has no good reason or justification for the failure to do so; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that :-

यत:, मुख्य निर्वाचन अधिकारी, की उक्त रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (5) के अंतर्गत श्री अली मोहम्मद वानी को दिनांक 13 सितम्बर, 2019 को निर्वाचन व्यय का कोई भी लेखा दाखिल नहीं करने हेतु कारण बताओं नोटिस नं. 76/ जम्मू और कश्मीर- लो.स./03/2019/उ.अनु-1 जारी किया गया था; और

यत:, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (6) के अनुसार, दिनांक 13 सितम्बर 2019 के उपयु र्क्त कारण बताओ नोटिस के द्वारा श्री अली मोहम्मद वानी को निदेश दिया गया था की वे इस नोटिस के प्राप्त होने के 20 दिनों के भीतर लेखा दाखिल नहीं करने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन निर्वाचन आयोग के समक्ष प्रस्तुत करें और साथ ही अपना निर्वाचन व्ययों का लेखा जिला निर्वाचन अधिकारी, अनंतनाग के समक्ष प्रस्तुत करें;

और

यत:, जिला निर्वाचन अधिकारी, अनंतनाग जिला, द्वारा भारत निर्वाचन आयोग को प्रस्तुत की गई पावती रसीद के अनुसार, उक्त नोटिस श्री अली मोहम्मद वानी को दिनांक 17 जनवरी, 2020(स्पीड पोस्ट/रजिस्टर्ड पोस्ट द्वारा) को उनके द्वारा नामांकन पत्र में दर्शाये गये पते पर तामील किया गया था; और

यत:, जिला निर्वाचन अधिकारी, अनंतनाग ने दिनांक 12 फरवरी, 2020 की अपनी अनुपूरक रिपोर्ट में यह बताया है कि श्री अली मोहम्मद वानी द्वारा अभी तक कोई जवाब नहीं दिया गया है और मूल वाउचर सहित हस्ताक्षरित निर्वाचन व्यय के सही लेखे का विवरण प्रस्तुत नहीं किया गया है । इसके अतिरिक्त, उक्त नोटिस मिलने के उपरांत भी अभ्यर्थी द्वारा उक्त विफलता के लिए भारत निर्वाचन आयोग के समक्ष कोई कारण अथवा स्पष्टीकरण प्रस्तुत नहीं किया गया है; और यत:, तथ्यों और उपलब्ध दस्तावेजों के आधार पर, आयोग का यह समाधान हो गया है कि श्री अली मोहम्मद वानी अपने निर्वाचन खर्चों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है;

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है कि :-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति –

(ख) उस विफलता के लिए कोई अच्छा कारण या औचित्य नहीं है

अत:, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतदद्वारा घोषणा करता है कि श्री अली मोहम्मद वानी, तैलंगम् पुलवामा, जम्मू और कश्मीर जो लोक सभा साधारण निर्वाचन, 2019 में 03-अनंतनाग लोक सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी थे, इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निरर्हित होंगे ।

O.N. 96.—WHEREAS, the General Election to the Lok Sabha, 2019 was announced by the Election Commission of India vide Press Note No. ECI/PN/24/2019 dated 10th March, 2019; and;

WHEREAS, as per the report dated 22nd August, 2019 of the Chief Electoral Officer, Jammu & Kashmir, forwarding therewith DEO, Anantnag report dated 10.07.2019, Sh. Ali Mohd. Wani, a contesting candidate from 3-Anantnag Parliamentary Constituency has failed to lodge any account of his election expenses, as required under law; and

WHEREAS, through the above said Show Cause Notice and under Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, Sh. Ali Mohd. Wani was directed to submit his representation in writing to the Commission explaining the reason for non submission of accounts and also to lodge his accounts of election expenses with the District Election Officer, Anantnag within 20 days from the date of receipt of the notice; and

WHEREAS, as per the acknowledgement receipt made available to the Election Commission by the District Election Officer, Anantnag, the said notice was served to Sh. Ali Mohd. Wani on 17th January, 2020 (Through Speed/Regd. Post) at the address provided by the candidate in the nomination papers; and

WHEREAS, the District Election Officer, Anantnag has submitted in his supplementary report, dated 12th February, 2020 that Sh. Ali Mohd. Wani, has not submitted any representation or a statement of correct account of his election expenses, duly signed along with original vouchers etc. till date. Further, after receipt of the said notice, he has neither furnished any reason nor explanation to the Election Commission of India, for his failure to lodge the accounts as prescribed under law; and

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Ali Mohd. Wani has failed to lodge his accounts of election expenses and has no good reason or justification for the failure to do so; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that :-

"If the Election Commission is satisfied that a person-

(a) Has failed to lodge an account of election expenses within the time and in the manner required by or under this Act; and

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Sh. Ali Mohd. Wani, r/o Telangam, Pulwama, J&K and a contesting candidate from 3-Anantnag Parliamentary Constituency in the UT of J&K in the General Election to the Lok Sabha, 2019, to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order.

तालिका के स्तंभ (3) में अपने नाम के सामने निर्वाचन-क्षेत्र से निर्वाचन लड़े थे, लोक प्रतिनिधित्व अधिनियम, 1951 तथा उसके अधीन बनाए गए नियमों और आदेश के अन्तर्गत यथापेक्षित रीति जैसा कि उक्त सारणी के स्तम्भ (5) में दर्शाया गया है, से अपने निर्वाचन व्यय का लेखा दाखिल करने में विफल रहे हैं; और

यतः, उक्त अभ्यर्थियों ने निर्वाचन आयोग द्वारा सम्यक् नोटिस दिए जाने के बावजूद, उक्त विफलता के लिए कोई कारण व स्पष्टीकरण नहीं दिया है और निर्वाचन आयोग का यह समाधान हो गया है कि उक्त विफलता के लिए उनके पास

कोई उपयुक्त या न्यायोचित कारण नहीं है;

अतः, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10-क के अनुसरण में, भारत निर्वाचन आयोग, अधोलिखित सारणी के स्तंभ (4) में विनिर्दिष्ट व्यक्तियों को इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के²⁷⁶ THE GAZETTE OF INDIA : SEPTEMBER ¹², ²⁰²⁰/BHADRA ²¹, ¹⁹⁴² [PART II—SEC. ³(iii)] किसी भी सदन या राज्य की विधानसभा अथवा विधान परिषद के लिए सदस्य के रूप में चुने जाने या सदस्य होने के लिए निरर्हित घोषित करता हैः-

N. 99 .—Whereas, the Election Commission is satisfied that each of the contesting candidates specified in column (4) of the Table below at the General Election to the Lok Sabha, 2019 as specified in Column (2) held from the constituency specified in column (3) against his/her name, has failed to lodge an account of election expenses as required by the Representation of the People Act, 1951 and Rules and Order made there under; as shown in column (5) of the said Table; and

आ. अ. 100 .—यत:, भारत निर्वाचन आयोग द्वारा लोक सभा के साधारण निर्वाचन, 2019 की घोषणा प्रेस नोट संख्या ईसीआई/प्रे.नो./24/2019 दिनांक 10 मार्च, 2019 के जरिए की गई थी; और

यत:, 06-जम्मू लोक सभा निर्वाचन क्षेत्र के रिटर्निंग अधिकारी द्वारा उक्त लोक सभा क्षेत्र से निर्वाचन के परिणाम दिनांक 23 मई, 2019 को घोषित किए गए थे और इस प्रकार, निर्वाचन व्यय का लेखा दाखिल करने की अन्तिम तारीख 22 जून, 2019 थी; और

यत:, मुख्य निर्वाचन अधिकारी, की उक्त रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (5) के अंतर्गत श्री अनिल सिंह को दिनांक 13 सितम्बर, 2019 को निर्वाचन व्यय का कोई भी लेखा दाखिल नहीं करने हेतु कारण बताओं नोटिस नं. 76/ जम्मू और कश्मीर-लो.स./06/2019/उ.अनु-1 जारी किया गया था; और

यत:, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (6) के अनुसार, दिनांक 13 सितम्बर 2019 के उपयु र्क्त कारण बताओ नोटिस के द्वारा श्री अनिल सिंह को निदेश दिया गया था की वे इस नोटिस के प्राप्त होने के 20 दिनों के भीतर लेखा दाखिल नहीं करने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन निर्वाचन आयोग के समक्ष प्रस्तुत करें और साथ ही अपना निर्वाचन व्ययों का लेखा जिला निर्वाचन अधिकारी, जम्मू के समक्ष प्रस्तुत करें; और

यत:, जिला निर्वाचन अधिकारी, जम्मू जिला, द्वारा भारत निर्वाचन आयोग को प्रस्तुत की गई पावती रसीद के अनुसार, उक्त नोटिस श्री अनिल सिंह को दिनांक 12 अक्टूबर, 2019 को उनके द्वारा नामांकन पत्र में दर्शाये गये पते पर तामील किया गया था; और

यत:, जिला निर्वाचन अधिकारी, जम्मू ने दिनांक 16 जनवरी, 2020 की अपनी अनुपूरक रिपोर्ट में यह बताया है कि श्री अनिल सिंह द्वारा अभी तक कोई जवाब नहीं दिया गया है और मूल वाउचर सहित हस्ताक्षरित निर्वाचन व्यय के सही लेखे का विवरण प्रस्तुत नहीं किया गया है । इसके अतिरिक्त, उक्त नोटिस मिलने के उपरांत भी अभ्यर्थी द्वारा उक्त विफलता के लिए भारत निर्वाचन आयोग के समक्ष कोई कारण अथवा स्पष्टीकरण प्रस्तुत नहीं किया गया है; और

यत:, तथ्यों और उपलब्ध दस्तावेजों के आधार पर, आयोग का यह समाधान हो गया है कि श्री अनिल सिंह अपने निर्वाचन खर्चों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है;

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है कि :-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति –[भाग II—खण्ड 3(iii)] भारत का राजपत्र : सितम्बर ¹², ²⁰²⁰/भाद्र ²¹, ¹⁹⁴² 279 (क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में विफल रहा है; तथा

(ख) उस विफलता के लिए कोई अच्छा कारण या औचित्य नहीं है

अत:, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतदद्वारा घोषणा करता है कि श्री अनिल सिंह, कोटे, तहसील भलवल, जिला जम्मू, जम्मू और कश्मीर जो लोक सभा साधारण निर्वाचन, 2019 में 06-जम्मू लोक सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी थे, इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निरर्हित होंगे ।

O. N. 100.—WHEREAS, the General Election to the Lok Sabha, 2019 was announced by the Election Commission of India vide Press Note No. ECI/PN/24/2019 dated 10th March, 2019; and;

WHEREAS, the result of the election for 6-Jammu Parliamentary Constituency was declared by the Returning Officer on 23rd May, 2019 and hence the last date for lodging the accounts of election expenses was 22nd June, 2019 ; and

WHEREAS, as per the report dated 22nd August, 2019 of the Chief Electoral Officer, Jammu & Kashmir forwarding therewith the DEO, Jammu report dated 21.06.2019, Sh. Anil Singh, a contesting candidate from 6-Jammu Parliamentary Constituency has failed to lodge any account of his election expenses, as required under law; and WHEREAS, on the basis of the said report, a Show-Cause Notice No. 76/J&K-HP/6/2019/NS-I, dated 13th September, 2019 was issued under Sub Rule (5) of rule 89 of the Conduct of Election Rules, 1961 by the Election Commission of India to Sh. Anil Singh, for non submission of any accounts of his Election expenses; and WHEREAS, through the above said Show Cause Notice and under Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, Sh. Anil Singh was directed to submit his representation in writing to the Commission explaining the reason for non submission of accounts and also to lodge his accounts of election expenses with the District Election Officer, Jammuwithin 20 days from the date of receipt of the notice; and

WHEREAS, as per the acknowledgement receipt made available to the Election Commission by the District Election Officer, Jammu, the said notice was served to Sh. Anil Singh on 12th October, 2019 at the address provided by the candidate in the nomination papers; and

WHEREAS, the District Election Officer, Jammu has submitted in his supplementary report, dated 16th January, 2020 that Sh. Anil Singh, has not submitted any representation or a statement of correct account of his election expenses, duly signed along with original vouchers etc. till date. Further, after receipt of the said notice, he has neither furnished any reason nor explanation to the Election Commission of India, for his failure to lodge the accounts as prescribed under law; and

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Anil Singh has failed to lodge his accounts of election expenses and has no good reason or justification for the failure to do so; and WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that :-

यत:, मुख्य निर्वाचन अधिकारी, जम्मू और कश्मीर की दिनांक 22 अगस्त, 2019 की रिपोर्ट जिसके साथ जिला निर्वाचन अधिकारी, जम्मू की दिनांक 21.06.2019 की अग्रेषित की गई थी के अनुसार, जम्मू और कश्मीर के 06-जम्मू निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी श्री सकं दर अहमद नूरानी विधि के अंतर्गत यथापेक्षित अपने निर्वाचन व्यय का कोई भी लेखा दायर करने में विफल रहे हैं; और[भाग II—खण्ड 3(iii)] भारत का राजपत्र : सितम्बर ¹², ²⁰²⁰/भाद्र ²¹, ¹⁹⁴² 283 यत:, मुख्य निर्वाचन अधिकारी, की उक्त रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (5) के अंतर्गत श्री सकं दर अहमद नूरानी को दिनांक 13 सितम्बर, 2019 को निर्वाचन व्यय का कोई भी लेखा दाखिल नहीं करने हेतु कारण बताओं नोटिस नं. 76/ जम्मू और कश्मीर- लो.स./06/2019/उ.अनु-1 जारी किया गया था; और

यत:, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (6) के अनुसार, दिनांक 13 सितम्बर 2019 के उपयु र्क्त कारण बताओ नोटिस के द्वारा श्री सकं दर अहमद नूरानी को निदेश दिया गया था की वे इस नोटिस के प्राप्त होने के 20 दिनों के भीतर लेखा दाखिल नहीं करने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन निर्वाचन आयोग के समक्ष प्रस्तुत करें और साथ ही अपना निर्वाचन व्ययों का लेखा जिला निर्वाचन अधिकारी, जम्मू के समक्ष प्रस्तुत करें; और

यत:, जिला निर्वाचन अधिकारी, जम्मू जिला, द्वारा भारत निर्वाचन आयोग को प्रस्तुत की गई पावती रसीद के अनुसार, उक्त नोटिस श्री सकं दर अहमद नूरानी को दिनांक 29 सितम्बर, 2019 को उनके द्वारा नामांकन पत्र में दर्शाये गये पते पर तामील किया गया था; और

यत:, जिला निर्वाचन अधिकारी, जम्मू ने दिनांक 16 जनवरी, 2020 की अपनी अनुपूरक रिपोर्ट में यह बताया है कि श्री सकं दर अहमद नूरानी द्वारा अभी तक कोई जवाब नहीं दिया गया है और मूल वाउचर सहित हस्ताक्षरित निर्वाचन व्यय के सही लेखे का विवरण प्रस्तुत नहीं किया गया है । इसके अतिरिक्त, उक्त नोटिस मिलने के उपरांत भी अभ्यर्थी द्वारा उक्त विफलता के लिए भारत निर्वाचन आयोग के समक्ष कोई कारण अथवा स्पष्टीकरण प्रस्तुत नहीं किया गया है; और

यत:, तथ्यों और उपलब्ध दस्तावेजों के आधार पर, आयोग का यह समाधान हो गया है कि श्री सकं दर अहमद नूरानी अपने निर्वाचन खर्चों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है;

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है कि :-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति –

(ख) उस विफलता के लिए कोई अच्छा कारण या औचित्य नहीं है

अत:, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतदद्वारा घोषणा करता है कि श्री सकं दर अहमद नूरानी, गाँव पोस्ट ऑपिस हारी , तहसील सुरनकोत, जिला पु ंछ, जम्मू और कश्मीर जो लोक सभा साधारण निर्वाचन, 2019 में 06-जम्मू लोक सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी थे, इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निरर्हित होंगे ।

ORDER

New Delhi, the 7th September, 2020

O. N. 102.—WHEREAS, the General Election to the Lok Sabha, 2019 was announced by the Election Commission of India vide Press Note No. ECI/PN/24/2019 dated 10th March, 2019; and;

WHEREAS, as per the report dated 22nd August, 2019 of the Chief Electoral Officer, Jammu & Kashmir forwarding therewith the DEO, Jammu report dated 21.06.2019, Sh. Sakander Ahmad Nourani, a contesting candidate from 6-Jammu Parliamentary Constituency has failed to lodge any account of his election expenses, as required under law; and

WHEREAS, on the basis of the said report, a Show-Cause notice No. 76/J&K-HP/6/2019/NS-I, dated 13th September, 2019 was issued under Sub Rule (5) of rule 89 of the Conduct of Election Rules, 1961 by the Election Commission of India to Sh. Sakander Ahmad Nourani, for non submission of any accounts of his Election expenses; and

WHEREAS, through the above said Show Cause Notice and under Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, Sh. Sakander Ahmad Nourani was directed to submit his representation in writing to the Commission explaining the reason for non submission of accounts and also to lodge his accounts of election expenses with the District Election Officer, Jammu within 20 days from the date of receipt of the notice; and

WHEREAS, as per the acknowledgement receipt made available to the Election Commission by the District Election Officer, Jammu, the said notice was served to Sh. SakanderAhmad Nourani on 29th September, 2019 at the address provided by the candidate in the nomination papers; and

WHEREAS, the District Election Officer, Jammu has submitted in his supplementary report, dated 16th January, 2020 that Sh. Sakander Ahmad Nourani, has not submitted any representation or a statement of correct account of his election expenses, duly signed along with original vouchers etc. till date. Further, after receipt of the said notice, he has neither furnished any reason nor explanation to the Election Commission of India, for his failure to lodge the accounts as prescribed under law; and

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Sakander Ahmad Nouranihas failed to lodge his accounts of election expenses and has no good reason or justification for the failure to do so; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that :-

"If the Election Commission is satisfied that a person-

(a) Has failed to lodge an account of election expenses within the time and in the manner required by or under this Act; and

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Sh. Sakander Ahmad Nourani, r/o VPO Hari, Tehsil Surankote, District Poonch, J&K and a contesting candidate from 6-Jammu Parliamentary Constituency in the UT of J&K in the General Election to the Lok Sabha, 2019, to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order.
