आ. अ. 104 .—यत:, भारत निर्वाचन आयोग का समाधान हो गया है कि नीचे तालिका के स्तंभ 2 में यथा- निर्दिष्ट,के रल राज्य से लोक सभा के साधारण निर्वाचन,2019 में, तालिका के स्तंभ 4 में यथा-निर्दिष्ट निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी, जो स्तंभ 3 में अपने नाम के सामने निर्दिष्टसंसदीय निर्वाचन क्षेत्र से आयोजित निर्वाचन लड़े थे, अपने निर्वाचन-खर्चों का लेखा लोक प्रतिनिधित्व अधिनियम, 1951 और तदंतर्गत बनाए गए नियमों द्वारा यथापेक्षित रीति, जैसा कि स्तंभ 5 में दर्शाया गया है, से दर्ज करने में असफल रहे हैं।

और यतः,उक्त अभ्यर्थियों ने निर्वाचन आयोग के सम्यक नोटिस के उपरांत भी उक्त असफलताका न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है अथवा उनके द्वारा दिए गए अभ्यावेदन, यदि कोई हो, पर विचार करने के बाद निर्वाचन आयोग का यह समाधान हो गया है कि उनके पास उक्तअसफलता लिए कोई भी उचित कारण या औचित्य नहीं है।

अब, इसलिए, उक्त अधिनियम की धारा 10क के अनुसरण में निर्वाचन आयोग एतद्द्वारा अधोलिखित तालिका के स्तंभ 4 में निर्दिष्ट व्यक्ति को इस आदेश की तिथि से तीन वर्षों की अवधि के लिए संसद के किसी भी सदन या किसी राज्य या संघ राज्य-क्षेत्र की विधान सभा या विधान परिषद के सदस्य के रूप में चुने जाने या सदस्य होने के लिए निरर्हित घोषित करता है।

New Delhi, the, 14th September, 2020

O. N. 104 .— Whereas, the Election Commission of India is satisfied that each of the contesting candidate specified in column 4 of the Table below at the General Election to the Lok Sabha, 2019 from the State of Kerala specified in column 2 and held from the Parliamentary Constituency specified in column 3 against his/her name has failed to lodge the account of his/her election expenses as shown in column 5 of the said Table as required by the Representation of the People Act, 1951 and the Rules made thereunder.

And whereas, the said candidates have furnished neither any reason nor explanation for the said failure even after due notice by the Election Commission or after considering the representation made by them, if any, the Election Commission is satisfied that they have no good reason or justification for the said failure.

Now, therefore, in pursuance of section 10A of the said Act, the Election Commission of India hereby declares the persons specified in column 4 of the Table below to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order.

आ. अ. 105 .—यतः, भारत निर्वाचन आयोग द्वारा छत्तीसगढ़ राज्य मे विधान सभा के साधारण निर्वाचन 2018 की घोषणा प्रेस नोट संख्या ईसीआई/प्रे.नो./66/2018 दिनांक 6 अक्टूबर, 2018 के जरिए की गई थी । कार्यक्रम के अनुसार, मतगणना की तारीख 11 दिसम्बर, 2018 थी ।

और यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सही प्रति जिला निर्वाचन अधिकारी को दाखिल करनी होती है;

और यतः, 19–धरमजयगढ़ (अ.ज.जा.) विधान सभा निर्वाचन क्षेत्र सहित संबंधित रिटर्निंग अधिकारी द्वारा उक्त निर्वाचन के परिणाम 11 दिसम्बर, 2018 को घोषित किए गए थे । इस प्रकार, निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 10 जनवरी, 2019 थी;

और यतः, जिला निर्वाचन अधिकारी, रायगढ़ जिला, छत्तीसगढ़ द्वारा प्रस्तुत और मुख्य निर्वाचन अधिकारी, छत्तीसगढ़ द्वारा अपने दिनांक 29 जनवरी, 2019 के पत्र सं. 21/चार/वि.स.चु./ई.ई.एम/2019/85 के जरिए अग्रेषित दिनांक 11 जनवरी, 2019 की रिपोर्ट के अनुसार श्री संत राम राठिया, जो छत्तीसगढ़ के 19–धरमजयगढ़ (अ.ज.जा.) विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले जनता कांग्रेस छत्तीसगढ़ (जे.) के अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे हैं ।

और यतः, जिला निर्वाचन अधिकारी, रायगढ़ जिला, छत्तीसगढ़ और मुख्य निर्वाचन अधिकारी, छत्तीसगढ़ की रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए श्री संत राम राठिया को कारण बताओ नोटिस दिनांक 28 अगस्त, 2019 जारी किया गया था;

और यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 28 अगस्त, 2019 के उपयु र्क्त कारण बताओ नोटिस के जरिए श्री संत राम राठिया को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखे न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें;

और यतः, उक्त नोटिस श्री संत राम राठिया द्वारा 7 सितम्बर, 2019 को प्राप्त किया गया था । अभ्यर्थी से प्राप्त पावती रसीद जिला निर्वाचन अधिकारी, रायगढ़ द्वारा अपने दिनांक 12 सितम्बर, 2019 के पत्र संख्या 5791/निर्वा.पर्य./ 2019 के जरिए आयोग को प्रस्तुत कर दी गई है;

और यतः, जिला निर्वाचन अधिकारी, रायगढ़ द्वारा अपने दिनांक 14 जुलाई, 2020 के पत्र संख्या 189/निर्वा.पर्य./2020 के जरिए प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री संत राम राठिया ने आज की तारीख तक न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है । इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है;

और यतः, आयोग का यह समाधान हो गया है कि श्री संत राम राठिया निर्वाचन खर्चों का लेखा दाखिल करन में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है,

और यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है कि :-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति -[भाग II—खण्ड 3(iii)] भारत का राजपत्र : सितम्बर ¹⁹, ²⁰²⁰/भाद्र ²⁸, ¹⁹⁴² 289 i. निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है; तथा

ii. उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है,

तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरर्हित घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरर्हित होगा;"

अतः, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा

घोषणा करता है कि छत्तीसगढ़ राज्य के 19–धरमजयगढ़ (अ.ज.जा.) विधान सभा निर्वाचन क्षेत्र से छत्तीसगढ़ राज्य में

विधान सभा के साधारण निर्वाचन, 2018 में निर्वाचन लड़ने वाले जनता कांग्रेस छत्तीसगढ़ (जे.) के अभ्यर्थी श्री संत राम

राठिया, निवासी ग्राम – कमरई, पो० – सुपकालो, तहसील – धरमजयगढ़, जिला – रायगढ़, छत्तीसगढ़ – 496665, इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निरर्हित है ।

O. N. 105 .—WHEREAS, the General Election to Legislative Assembly of Chhattisgarh, 2018 was announced by Election Commission of India vide Press Note No. ECI/PN/66/2018 dated 6th October, 2018. As per the schedule, Date of Counting was 11th December, 2018.

AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate has to lodge a true copy of his account of election expenses within 30 days with the District Election Officer, from the date of election of returned candidate;

AND WHEREAS, the result of the said election was declared by the concerned Returning Officer including 19-Dharamjaigarh (ST) Assembly Constituency on 11th December, 2018. As such, the last date for lodging of account of election expenses was 10th January, 2019.

AND WHEREAS, as per the report dated 11th January, 2019 submitted by the District Election Officer, Raigarh District, Chhattisgarh and forwarded by Chief Electoral Officer, Chhattisgarh vide letter No. 21/चार/वि.स.चु./ई.ई.एम/2019/85 dated 29th January, 2019, Shri Sant Ram Rathiya, Janta Congress Chhattisgarh (J) contesting candidate from 19-Dharamjaigarh (ST) Assembly Constituency of Chhattisgarh, has failed to lodge any account of his election expenses as required by law.

AND WHEREAS, on the basis of the reports of the District Election Officer, Raigarh District, Chhattisgarh and the Chief Electoral Officer, Chhattisgarh, a Show Cause notice dated 28th August, 2019 was issued by Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to Shri Sant Ram Rathiya for non-submission of Election expenses;

AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, through the above said Show Cause Notice dated 28th August, 2019, Shri Sant Ram Rathiya was directed to submit his representation in writing in the Commission explaining the reason for non-submission of accounts and also to lodge his accounts of election expenses/rectify the defects in his accounts and submit the same the District Election Officer concerned within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was received by Shri Sant Ram Rathiya on 7th September, 2020.

Acknowledgment receipt obtained from the candidate have been submitted to the Commission by District Election Officer, Raigarh vide his letter No. 5791/निर्वा.पर्य./2019 dated 12th September, 2019.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Raigarh vide his letter No. 189/निर्वा.पर्ा./2020 dated 14th July, 2020 has stated that Shri Sant Ram Rathiya, has not submitted any representation or his account of election expenses, till date. Further, he has furnished neither any reason nor explanation for the said failure even after receipt of the due notice to the Election Commission of India as well;

AND WHEREAS, the Commission is satisfied that Shri Sant Ram Rathiya has failed to lodge an account of election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that :-

"If the Election Commission is satisfied that a person:

(a) Has failed to lodge an account of election expenses within the time and in the manner required by law or under this Act, and

(b) Has no good reason or justification for the failure,

The Election Commission shall by order published in the official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from date of the under;"

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Sant Ram Rathiya, resident of Village – Kamrai, PO – Supkalo, Tehsil – Dharamjaigarh, District – Raigarh, Chhattisgarh - 496665 and the contesting candidate of Janta Congress Chhattisgarh (J) for General Election to Legislative Assembly of Chhattisgarh, 2018 from 19-Dharamjaigarh (ST) Assembly Constituency of the state of Chhattisgarh to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or legislative Council of a State or Union Territory for a period of three years from the date of this order.

AND WHEREAS, as per the report dated 11th January, 2019 submitted by the District Election Officer, Raigarh District, Chhattisgarh and forwarded by Chief Electoral Officer, Chhattisgarh vide letter No. 21/चार/वि.स.चु./ई.ई.एम/2019/85 dated 29th January, 2019, Shri Suresh Kumar Kujur, Independent contesting candidate from 15-Lailunga (ST) Assembly Constituency of Chhattisgarh, has failed to lodge any account of his election expenses as required by law.

AND WHEREAS, on the basis of the reports of the District Election Officer, Raigarh District, Chhattisgarh and the Chief Electoral Officer, Chhattisgarh, a Show Cause notice dated 23rd August, 2019 was issued by Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to Shri Suresh Kumar Kujur for non-submission of Election expenses;

AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, through the above said Show Cause Notice dated 23rd August, 2019, Shri Suresh Kumar Kujur was directed to submit his representation in writing in the Commission explaining the reason for non-submission of accounts and also to lodge his accounts of election expenses/rectify the defects in his accounts and submit the same the District Election Officer concerned within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was received by brother of Shri Suresh Kumar Kujur on 4th September, 2020. Acknowledgment receipt obtained from the candidate have been submitted to the Commission by District Election Officer, Raigarh vide his letter No. 5777/निर्वा.पर्य./2019 dated 5th September, 2019.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Raigarh vide his letter

No. 189/निर्वा.पर्य./2020 dated 14th July, 2020 has stated that Shri Suresh Kumar Kujur, has not submitted any

representation or his account of election expenses, till date. Further, he has furnished neither any reason nor explanation for the said failure even after receipt of the due notice to the Election Commission of India as well;

AND WHEREAS, the Commission is satisfied that Shri Suresh Kumar Kujur has failed to lodge an account of election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that :-

"If the Election Commission is satisfied that a person:

(a) Has failed to lodge an account of election expenses within the time and in the manner required by law or under this Act, and

(b) Has no good reason or justification for the failure,

The Election Commission shall by order published in the official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from date of the under;"

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Suresh Kumar Kujur, resident of Village + Post – Ghatgaon, Tahshil – Lailunga, District – Raigarh, Chhattisgarh – 496113 and the contesting Independent candidate for General Election to Legislative Assembly of Chhattisgarh, 2018 from 15-Lailunga (ST) Assembly Constituency of the state of Chhattisgarh to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or legislative Council of a State or Union Territory for a period of three years from the date of this order.

और यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सही प्रति जिला निर्वाचन अधिकारी को दाखिल करनी होती है;

और यतः, 69-बेमेतरा विधान सभा निर्वाचन क्षेत्र सहित संबंधित रिटर्निंग अधिकारी द्वारा उक्त निर्वाचन के परिणाम 11 दिसम्बर, 2018 को घोषित किए गए थे । इस प्रकार, निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 10 जनवरी, 2019 थी;

और यतः, जिला निर्वाचन अधिकारी, बेमेतरा जिला, छत्तीसगढ़ द्वारा प्रस्तुत और मुख्य निर्वाचन अधिकारी, छत्तीसगढ़ द्वारा अपने दिनांक 29 जनवरी, 2019 के पत्र सं. 21/चार/वि.स.चु./ई.ई.एम/2019/85 के जरिए अग्रेषित दिनांक 11 जनवरी, 2019 की रिपोर्ट के अनुसार श्री सोहन लाल निषाद, जो छत्तीसगढ़ के 69-बेमेतरा विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले निर्बल इंडियन शोषित हमारा आम दल के अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का लेखा दाखिल करने में विफल रहे हैं ।

और यतः, जिला निर्वाचन अधिकारी, बेमेतरा जिला, छत्तीसगढ़ और मुख्य निर्वाचन अधिकारी, छत्तीसगढ़ की रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए श्री सोहन लाल निषाद को कारण बताओ नोटिस दिनांक 19 मार्च, 2020 जारी किया गया था;

और यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 19 मार्च, 2019 के उपयु र्क्त कारण बताओ नोटिस के जरिए श्री सोहन लाल निषाद को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा विधि द्वारा आपेक्षित रीति से दाखिल करें;

और यतः, उक्त नोटिस श्री सोहन लाल निषाद द्वारा 16 अप्रैल, 2020 को प्राप्त किया गया था । अभ्यर्थी से प्राप्त पावती रसीद जिला निर्वाचन अधिकारी, बेमेतरा द्वारा अपने दिनांक 19 मई, 2020 के पत्र संख्या 499/विस.नि./व्यय लेखा/2020 के जरिए आयोग को प्रस्तुत कर दी गई है;

और यतः, जिला निर्वाचन अधिकारी, बेमेतरा द्वारा अपने दिनांक 10 अगस्त, 2020 के पत्र संख्या 2738/वि.स.नि./व्यय लेखा/2020 के जरिए प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री सोहन लाल निषाद ने आज की तारीख तक कोई भी अभ्यावेदन प्रस्तुत नहीं किया है । इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक नोटिस मिलने के उपरांत भी उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है;

और यतः, आयोग का यह समाधान हो गया है कि श्री सोहन लाल निषाद निर्वाचन खर्चों का लेखा विधि द्वारा अपेक्षित रीति से दाखिल करन में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है,

और यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है कि :-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति -

i. निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है; तथा

ii. उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है,

तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरर्हित घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरर्हित होगा;"

अतः, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि छत्तीसगढ़ राज्य के 69-बेमेतरा विधान सभा निर्वाचन क्षेत्र से छत्तीसगढ़ राज्य में विधान सभा के साधारण निर्वाचन, 2018 में निर्वाचन लड़ने वाले निर्बल इंडियन शोषित हमारा आम दल के अभ्यर्थी श्री सोहन लाल निषाद, निवासी बी.टी.आई. कॉलोनी, रानी लक्ष्मी बाई, वार्ड 10, तहसील व जिला – बेमेतरा, छत्तीसगढ़, इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निरर्हित है ।

AND WHEREAS, the result of the said election was declared by the concerned Returning Officer including 69- Bemetara Assembly Constituency on 11th December, 2018. As such, the last date for lodging of account of election expenses was 10th January, 2019.

AND WHEREAS, on the basis of the reports of the District Election Officer, Bemetara District, Chhattisgarh and the Chief Electoral Officer, Chhattisgarh, a Show Cause notice dated 19th March, 2020 was issued by Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to Shri Sohan Lal Nishad for non-submission of Election expenses in the manner as required by law;

AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, through the above said Show Cause Notice dated 19th March, 2020, Shri Sohan Lal Nishad was directed to submit his representation in writing in the Commission and to rectify the defects in his accounts and submit the same to the District Election Officer concerned within 20 days from the date of receipt of the notice;

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Saiyad Faruque Ali, resident of House No. 43, Sadar & Mahamaya Road Bemetara, Thana, Tehsil & District – Bemetara, Chhattisgarh and the contesting candidate of Aam Aadmi Party for General Election to Legislative Assembly of Chhattisgarh, 2018 from 69-Bemetara Assembly Constituency of the state of Chhattisgarh to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or legislative Council of a State or Union Territory for a period of three years from the date of this order.
